Creek enc�uraging the Cit� to protect the Hart Wetland and c7a�sify it
� as a "significant natural area." She reques�ed clarification regarding
�' the next step in identifying the subject area as a signifi�ant natura�l
area. Senior P�anner Bewersdorff explained tt�e hearing process and
periodic review dealing with the City's inventory. Canmiss3oner Fessler
said she was very much in favor of includi.ng this ar°ea as a significant
natural �rea.
o President Moen asked Commissioners to sign the letter of appreciation
from the Planning Commission to former Senior Planner Keith Liden. He

that public improvements to the area have been completed and traffic $�
impacts on the subject parcel can be addressed. He distributed to ��{

up of 3 parcels. He handed out photographs of the site and adjacent f
areas (Exhibit A) f�r the consideration of the Connn��sioners. F!e used '�

stating reasons they were in favar of the Zone Change (letter a►lready ''
contained in the meeting packet)o He shared correspondence from Nelson ��
Management, Panoco, Ch�vron USA, Inc., Arco, Plaid Pantries, Tnc. , ��
5haris, and Taco Bell (Exhibit B). He said these letters demonstrated r�
the high interest in the site for retail use. He displayed letter�s the ��
City received fram the Washing�on County D�partment of Land Use and ;<��
Transpor�tation and discussed their concerns a�bout traffic issues and �
access to the site. '-�

o He described the issue of access to the site and presented a map of the 3�
area showing analysis of different traffic access scenarios. He showed �i
zoning maps of adj acent areas in Aloha and Bull Mountain and spoke about '��
the spacing of cor�nercial distwicts and the problems of strip �
development. He addressed the need to provide retail opportunities �1
within nearby access for the high-density neigh6arhoods in the subject �
area. �
o Mr. Gross displayed copies of the Aloha-Reedville-Cooper Mountain � �
Community P1an and the Bu11 Mountain Community Plan to compare other �
area canmunity planning intentions. He discussed the placement of �
neighborhood cortnn�rcial c�nters near majar arterials. tle observed that �
the subject site fits within the planners' design element criteria for {
the original Bull Mountain Community Pl�n. �

o Mr. Gross addressed the issue of noise levels along Scholls Ferry Road.
He discussed noise mitigation and presented a copy of a 1988 Naise Study
Report from the State Highway Division.
o Mr. Gross spoke abnut the traffic flow impact at the intersection of
Scholls Ferry Road and SW 1�5th. He referred to a supplemental traffic
analysis p�rformed by Carl �uttke, Inc. and explained Access Scenario E,
whieh pro=�ides a right-hand turn lane. He said this would improve the
�evel of service from what it is now. He advised that the traffiG
analysis was presented to the S�ate Highway Division for consideration.
He concluded that there would not be an adverse impact on the traffic at �
the subject site.
o Mr. Gross explained the a^easons the City of Beaverton was opposed to
this Zone Change, He said the major concern involved erosion of
a�tractiveness of other commercial properties.
o Mr. Gross discussed the following Orega�n Statewide Planning Goals: #2,
12, and 13. He discussed the City°s Comprehensive Plan Policies, and
suggested that the proposed Plan Amend�ent satisfies P1an policies 5,1 .1
and 5.1 .4. He t�lked about Comprehensive Plan Amendment 90-1 to
3nterpret the cancept of encroachment of commercial property into
neighborhood communities. He stated his belief th�t since the subject
site was surrounded by floodp�ains and right-of-ways fartewials and
callectors), this fulfills the lo�atiana� criteria pertaining to
� canmercial property not being bordered by residentia1 property on more
than two sides. He contended that right-of-way property and floodplain
property was not in any zone, but was separate from all zones.

a Mr. Gross reviewed the original applicar�t stat�ment. He stated that
�, since the orig�nal land use designation, the following changes had
occurred: (1 ) a Ghange in physical circu�nstances had occurred; (2)
anticipated transportation development had not occurred which the '
acknowledged plan assumed; (3) a change in assump�ions had occurred; (4) . �
a �ignificant loss of economic development opportunities for Genera1 i
Cammercial use had occurred. Ne concluded that a mistake was made in �
the original land use des�gnation. He elaborate�d on each of these items.
o Cmmmissioner Fessler requested clarificatiore concerning the siz� of the
subject site. Applicant adviSed that the Zone Change is being made only
for the 4.1 acres not including the portion of the property in the
floodplain,
� Commissianer Barber sought fur�her specifics concerning the cul-de-sac

o Commissioner Boone inquired about the postponement of this Zone Change
request previously, and the postponement of Item 5.3, a street vacation.
PUBLIC TE�TIMONY
o Cal Woolery, Chairman of NPO #7, 12356 SW 132nd Court in Tigard, advised
that NPO members were in agreement that it is not realistic to require
1/2 mile between commercial areas. He pointed out on the map the
nearest commercial outlets to his neighborhood. He discussed the noise
issues, advising that the increased noise levels expected after the
widening of the road, would make the subject property best suited as a
commercial site. He said the commercial use of this property would be a
convenience for the residents in the area.
o Commissianer Fessler asked about the Morris Brothers contract with the
CPO concerning the cessation of the industrial operation. Mr. Woolery
spoke about the noise, smoke, dust, and contamination of ground water
which brought about the agreement to close the operation in 1995.
o Me^. Woolery closed saying he favored the deve1opment of the subject site
based of economics and service ta the neighborhood.
PUBLIC HEARING CLOSED
o Commissioreer Moen requested clarification of f1oodplain issues
pertaining to c anmercial development. He discussed restrictions
cancerning Neighborhoad Commercial as compared to General Commercial and
site size restrictions. Assistant Planner Pomeroy explained.
o Cammissioner Fessler brought up the ODOT letter regarding access to the
sub;ject site and asked for clarification. City Engineer Randy Wnoley
exp�ained that the access to 135th would be decided through Site
Development Review. �

o Commissioner Boone suggested that the cul-de-sac on New Scholls Ferry ',`,
- Road would resu1t in traffic cutting through the neighborh�od. 6

Beader�on concerning strip developmerrt. She said the shape of the �
subject site did not appear to add to the strip cievelopment problem, and
she noted the convenience factor for local residents, She did not agree
with the applicant's in�erpretation concerning the zoning of surrounding �
property. She approved of the Zone Change. �

o Comrt�issioner Fessl�r discussed the Bu�l Mountain Comnunity Plan and the
role of CPU in the drawing up of the plan. She expressed concern about
the traffic access issues and was not convinced there had been a
sigrrificant change in circumstances. She favored deniai of the
application.
o Gommissioner Moore said he agreed that the site would be an attractive
canmercial location, but he was concerned about th� agre+ement with the
City of Beaverton to limit strip development. He agreea with
Commissioner Fessler that there did not seem to be a change in
circumstances to warrant a Zone Change.
o Conenissioner 8�oone stated he was concerned about the traffic issues, and
he did not see the the property as being a valuable a commercial site.
H� felt that saving energy was a minor consideration for this property.
He said he was inclined to vote for denial.
o Cominissioner Moen spoke about the convenience of the site, the traffic
access issues, and the rules governing zone changes, specifically
boundary zoning. He noted his main concern was for the City of
Beaverton's opposition to the proposal.
� Conanissioner Fessler moved and Comnissioner Moore seconded to deny CP�►
91-0001 and ZON 91-0005 per staff reca�rmenda�aon and findings. There
was brief discussion. Commissioner Barber advised that she would vote
to �eny the application, as the� arguments against outweighed the
'� arguments in favor of appr�va1 , Motion passed unanimously by
Canmissioner� present.

o Commissioner Moen told the Commission he would not be seeking
reappoi n�nent to the Conmi ss�on. H� said hi s y�ars served wer^e

T�ie Hart Wetiiand, adjacent to �he Fanno Creek Greenway is a natural
treasure d�serv�es t� be classified and protecfed as one af Tigard's
"sognificant natur.al area" under Goal 5. The wetlands contain a
� remarkable stand ,pf west�rn red cedars, 5-6' and more ir� diameter,
� vi►ildfiowers and oth:er wetland plants:, nestong Great Blue Herons and �
Wood Du�ks, and ather�wa�er�owl. The wetlands play an irr�portant
role of �iltering an� cleansing the waters of an unnamed tributary �

In ifs recent decision to protect the shoreline of Hart VVetland, a
decision that we applaud, the Tigard Planning Commission went on !,
record �s declaring the natu.ral vaiues of this area signifieant. The � ,
