They are opposed to decreasing the height of the eign ae they feel that there neede to be at least six to aeven feet separation from the sign that was permitted 43 inchea from their sign. They are willing to remove the "Color TV/Pool" portion of the sign to meet aquare footage requiremente. He felt th� City created a problem by allowing a aign to be con�tructed 43 inches from their nign. a Senior Planner L�den explained that the light bars are r�ot calculated as part of the aign size, h�w�•rer, they are considered when measuring the hei�ht af the sign. Discusaian followed regarding the "No Vacancy" portion of the eign and the abutting sign. The ather members felt tha Tigard Inn sign should be high enough for traffic to locate the sign coming from the east and off of I-5 aince the restaurant sign in front of it would obscure it �f the motel sign were 20 feet high. It (blanketing of the �ign) would add to traffic confi�sian ahould cars pass the motel and attempt to turn around to enter it. However, the liqhta on top are an eyesore and should be removed. Once mgain, there was concern about aetting a precedent where other businesees might ask fnr an exception when it wa�n't necess�ry because this one had been granted. The total sign area of 264 square feet ia 188 percent in excesa of what the Sign Code allocvs for a freestanding sign in the C-G zone (140 equare feet total). Staff agrees with the applicant that a lowered sign meaeuring 20 feet in height would be blanketsd L�y the adjacent Tang's restaurant eign which would result in a conflict with the purpose of th� Sign Code. The hardship attributed to this case is not self-imposed but rather is a reeult of the amortization alauses contained in the Sign Code. The height variance requested, however, is not the minimum variance which would alleviate the hardship. The staff recommends denial of the height variance as proposed. A lower sign would permit city standarde to be maintained to the greatedt extent possible while still pexmitting the economic viabi.l.ity of the sign. This option is discussed below with the Sign Code Exception ' criteria below. b) Sign Area The freestanding sign cabinet at the Tigard Znn measurea 8 feet 2 inches tall by 14 feet wide. These measurements produce a aign face of 112 • square feet for the upper portion. The lower portion meaaurea 2 feet by 10 feet for an additional 20 square feet per sign face. The total sign area of 264 square feet is 188 percent in excesa of what the 5ign Code allows for a freestanding sign i,n the C-G zone (140 square feet �otal) . As with sign height, the hardship ia not self-imposed. But the applicant has not met the other criteria for retaining the largsr sign area. The sign area of the existing sign is not the minimum aign variance which would alleviate the hardship. Because there is no evidence to suggest that a smaller sign would not be adequately visible, an examination of the Sign Code Exception approval criteria could result in a compromised sign area. In• �his case, the aigr� on the abutting property would block the vi.ew on the Tigard Inn sign if it is required to be leas than 29 feet in height. This would accomoclate the ug,per and larger aigra cabinet measuring 8 feet two inches high. The 29 foot ceiling would not permit the .i.ncluaion of the light fixture on the tap of the eign. Staff sees no reason why the applicant ahould be denied sufficient, but not excessive, height with which to diaglay his sign. Bas�ed on the above findinga and conclusions, staff recommends approval r�f this 5ign Code Exception with resp�ct tm sign height subject to certain candition�. Approval wae granted for the conetruction of the Dunkin Donute ahop and the Taco Bell restaurant subject to two conditions. The site plans in the file illustrate a nine foot wide sign which also was to project two feet into the public-right-of-way. In November, 1974, a minor land partition requeat was approved aubject to the fulfillment of two conditions. The propertiee were divided for reason� of separate taxation and the ability to have two freeetanding aigns. The Dunkin Donute freestanding sign measures 15 feet high and 72 square feet per eign face. The subject �ign was likely erect�d ix� Novemlaer, 1974. The Taco Bell fresstanding eign has been consid�red nonconforming as of March 20, 1988, and pro�erty and businees ownere were notified of thie prior to that time. I I The subject freeetandi.ng aign has been measured by staff to be 25 feet, eix inchea tall. Sign drawimgs from 1974 and this application ae well as ' I a field inepecti.on indicat�e a sign area of less than 70 sguaxe feet and , therefors, further analysis of the sign area is not warranted. However, ' the fr�eatanding eign gol� centerline is three inch�s from the Highway 99 rightpof-way according to a permit iasued in November, 1979. FINDINGS AND t90NCLIISION3 The appliaant ie requesting appraval of a Sign Variance; however in hie statement the applicant arguee that the sign ie justified based on the approval criteria for a Sign Code Exception. The review below includes an analysie of the applic�-�ble Sign Coda Exception criteria. Seo�ion 18.114.145(A) of Tigard's Community Development Code contains the criteria whereby the Planning Cammiasion can approve, approve with modifieations or deny an application for � Sign Code Exaeption. They are: (1) The proposed exception to the heic�ht limite in the Sign Cod� is necesaary to make the eign vi�ible from the atrRet because of the topography of the site, and/or a canforming buil.ding or sign on an I adjacent property would limit �he view of a aign erect�d on the site in conformance with Sign Code standasde; (2) A aecond freeetanding aign is neceaaary to ad�quately ieientify a busineee or premisee that ie ori�nted towards a prima.ry etreet but who�e main accesa ie �rom a se�ondary �treet; (3) Up to an addi�ional 25 perae�nt of eign area or height may be permitted when it ia determined that the increa�e will not deter f�om �he purpo�ee of this Chapter. Sign Code Excep�ion cri�eria (A) (1) abave allowe additional sign height in csrder �k� preven� oth�r conforming bui,�dinge or signs from obstructinq the view of a sign. The applicant maintains that the new proposed Oregan Dancra Academy eign (now 6 feet; eaon 9 feet tall) and Dunkin Donuta 'i; aign (15 feet tall) would bloak the view af the eubject sign by the westbound lanes of SW Pacific Highway and the Body Viaions sign weuld blac3c the view af the Taco Bell eign by the eastbound lanes if it is required to be 20 feet in height. Staff does not agree with the applicant that a lower�d sign measuring 20 feet in height would be blanketed by the adjacent 15 foot tall Body ` Viaiona sign to the south, Staff acknowledges, though, that the 15 foot tall Dunkin Donuta eign or the nine foot tall Oregon Dance Academy sign to ithe north could block the eign if it ie lowered to 20 feet in h�ight. StaFf does not agree that the sign, as it now stands, is fully blanketed by either the Body Visione, the Dunkin Donute aigns or will be by the Oregon Dance A�ademy sign. 1No buildings currently block the view of the aign in either dixection. The topography i� relatively fla� or elightly at an inclix�e at the subjec� sign location. Staff �eee na reason why the bueiness owner should be denied eufficient, but not exce�sive, height with which to display his sign. It appears to ataff that a s3.gn height of 25 feet six inches would be the minimum requireel to display the entire sign cabinet. Baeed upori the above findinge and conclusions, ataff recommends an approval af the Sign Code Exception based on exception criteria (A) (1).
