1. Vice President Owens calSed the meeting to order at 7:40 p.m. The
meeting was held at the Tigard Civic Center - TOWN HALL ROOM - 13125 SW
Hall Bl�vd., Tigard, Oregon.

3. PUBLIC HEARING 5'
3.1 ZUNE ORDINA��TCE AMENDMENT ZOA 87-07, Section 18.114. Signs.
Review proposed amendments to Section 18.114 (Signs) of the Community
Developn�ent Code.
Vice President Owens explained to the audience that this hearing has been �
set over from March 8 and the public h.earing portion had been closed. �'
She asked for staff's presentation. �'

Senior Keith Liden reviewed the time lines required to forward Planning ;;
Commission's recommendations to City Council for a March 28 hearing. Iie �
continued that even though the Plannin� Commission had closed �he public E'
hearin� portion that there are psople in the audience who would like to y
give testimony and that the Planning Commission could reopen the public
hearing portion if they so choose. He requested that Deborah Stuart come ;
forward and review changes that had been made to the proposal. '
Deborah Stuart reviewed her memo dated March 11, 1988. She summarized
changes that had been made to draft #5 which are now reflected in draft
��6. She continued by reviewing Exhibit II which had been submitted by
Commissioner Barber. Discussion followed regarding size of temporary
signs, the number of ai�ns that could be used as temporary signs, whether
to remove or leave in the obscenity aection of the Code, and what size
sign should be allowed on a mansard roof.
PUBLIC TESTIMONY
o Mike Carulli, Columbia Neon (OESA), 1820 East Burnside Street, 97214,
explair�ed that he represented the Oregon Electrical Sign Association
and that the changes being proposed by staff were basically
acceptable. They had several concerns: 1) The maximum height for
free-standing signs� They favored 25 feet which would allow for a
right-of--way clearance of 13 feet 6 inches which is required by the
state. 2) The requirement for engineering draw3n�a ahould be changed
to require engineering drawings only when a slgn code exemption is
required. 3) Regarding pre-applications, they felt they ehould be
required through the sign code exemption procesa only and not with

each sign permit issued. 4a Since we are working towards a neutral
code, they requested that the code be r�viewed in one year to resolve
any problems that have developed.
o Robert E. Farrell, Newport Bay Restaurant, 9780 5W Shady Lane,
explained that they had taken over the Newport Bay Restaurant three
years ago and had put in considerable amount of landscaping to make
the site visually attractive. He received a letter stating that their
boat with the painted word "Where fresh seafood comes ashore" is not a
permitted use. He stated that they would cooperate, but they want it
to look good also. ThPy would like a provision in the Code which
w�uld a11ow them to leave the boat with the patnted words as part of
their landscaping.
o Larry Bissett, 2004 NW Irving, Portland. Asked if the proposal had
been modified to allow two free-standing signs and if any provisian
had been allowecl for more than one tenant on a premise. Discussion
followed. It was determined that Mr. Bi�sett's concerns could be
covered under the aclministrative variance section of the Code.
PUBLIC HEARING CLOSED
Discussion .followed among the Commissioners regarding leaving the
requirement restricting obscenities in the Code, the height and aize of
signs that should be allowed on mansard roofs, the difference between a
mansard roof versus a pitched roof, a definition for an interior lot, how
to encourage the use of monuments signs, what the maximum distance a sign
should be fram the freeway to be considered a freeway-oriented sign, what
standard.s other iurisdiction use for freeway-oriented sign (staff to
research), and how variances to the Sign Code provisions will be reviewed
by the Planning Comffiission.
Discussion followed regarding the public testimony. Consensus of the
Commission was that the height should remain at 20 feet, that the Sign
Code should be reviewed after one year, and the Code does have a
provision that would allow Mr. Farrell to retain his boat sign.
* Commiasion Fqre moved and Commissioner Peterson seconded to forward draft
����3Ar seven to Ci�y Council which will incorporate all Planning
Co�sission's recommendation including the follovi.ng: 1) That the section
prohibiting obscenities be reviewed by the Citgv Attorney to see if it
could be left in the eode. 2) Tha� the freeway oriented signs have a
limit of 1,000 feet from the freeway, and that a recommendation be made
to the City Council to have the Code reviewed within one year. Motion
carried unanimously by Commisaioners pzeaent.

18.114.010 Purpose
(a) The purpose of this Chapter is: i

(1) To protect the health, safety, property and welfare of the ;

(2) To improve the neat, clean, orderly and attractive

users' needs while at the same time avoiding nuisances to
nearby properties.

(4) To provide for safe construction, location, erection, and
maintenance of signs;

(6) To minimize adverse visual safety factors to public highway
travelers.
(b) In addition, it is the purpose of this Chapter to regulate the
design, quality of materials, construction, location, ''
electrification, illumination and maintenance of a11 signs visible R
from public property or from public rights-of-way.
(c) It is not the purpose of this Chapter to permit the erection or
maintenance of any sign at any place or in any manner unlawful
' under any other ordinance or state or federal law. `
(d) This Chapter adopts by reference the provisions of the Oregon
Motorist Information Act, ORS 377.700-377.992. �

sign located along the street frontage or near an
access or egress point on a property. Such signs each
require a sign permit and payment of associated fees.
(B) On-site directional signs. Any directional sign
erected or Zocated internally on real property, No
sign permit or fee shall be required for such signs
(18.114.060(a)(9)).]
(15) Directional Sign. A permanent sign which is designed and
erected solely for the purpose of traffic or pedestrian
direction and placed on the proper�y to which the public is
directed.

structure for the purpose of displaying the advertising or

18.114.030 Administration and Approval Process
(a) The applicant for sign permit [struc�ure] proposals or si�n code
except3ons shall be the recorded owner of the property or an agent
authorized in writing by the owner.
(b) A Pre-Application Conference with City staff is required. See
Section 18.32.040.
(c) Due to possible changes in State statutea, or regional or local
policya information given by staff to the applicant during the
Pre-tiYplication Conference is valid for not more than 6 months.
(1) Another Pre-Application Conference is required if any
accessory use or structure applYcation is submitted 6
months after the Pre-Application Conference.
(2) Failure of the Director to provide any of the information
required by this Chapter shall not constitute a waiver of
the standard, criteria or requirements of the applications.
(d) The Director shall approve, approve with conditians or deny any
application for a sign permit. The Director shall apply the
standards set forth in [Sections 18.114.0$0, 18.114.090 and �
18.114.130 of] this [Code] Cha ter when reviewing an application (
for a sign. �

(e) The decision of the Director may be appealed in accordance with :
Section 18.32.310 (a). The following shall quaZify to have
standing as a party: €l

compliance of the structure with approved plana.

liable for expense, or other obligations, entailed in the
removal or replacement of any material required to allow
inspection.
(b) Inspection Requests. It shall be the duty of the person doing the
work authorized by a permit to notify the Building Official that

. (c) Required Inspectiuns. Reinforcing steel or structural framework
of any part of the proposed atructure ahall not be covered or
concealed withuut first obtaining approval of the Building

(d) Foundation inspections shall be made after all required
excavations, form work, bolt settings are completed and ready to
receive concrete.
(e) All anchorages shall be left exgosed for inspection.
(f) Electrical inspection shall be made by the agency issuing
electrical permits.
(�) Fina1 Inspections. Final inspection shall be called for by the
appl�cant when all work is eompleted. This inspection ahall cover
all items required by the Building Official under State law or
City ordinance such as the locationa, landscaping if required and
general compliance with the approved plans and requirements of
this title.
18.114.060 Sign Exemptions
(a) The following signs and operations shall not require a sign permit
but sha11 conform to all other applicable regulations of this
Chapter and the provisions of subsection (b) below:

to] Oregon State Expressway No. 217 and andlor

within 300 feet [or of another [outdoor ad.vertising]
billboard sign on the opposite side of the street or
highway or within 500 feet of another [outdoor advertising]
billboard sign on the same side of the [stree� or] highway.
(A) For purpases of applying this limitati�n, distances
shall be measured as a radius from a sign.
(B) Where 2 or more signs are in violation of these
spacing provisions, the first lawfully constructed,
erected and maintained shall be permitted to remain.
(6) [Outdoor advertising] Billboard signs shall have a11 metal
structures; provided, however, that the display surface or
display surfaces and the stringers used for the support of
the display surfaces together with cutouts may be made of
other materials.
(7) [Outdoor advertising] Billboard signs are not permitted as
roof signs.

(2) Placement of the bench sign shall not interfere with

(3) Application for a bench sign shall include the signature of
the affected property owner and proof of liability
insurance.
(4) The sign area is limited to a total of fourteen ('14) squar�

f(c) Incidental Si ns. Incident�l signs shall not egceed 12 inches in
height and�ches in width and shall be limited to 4 signs
attached to a permitted free standing sign.

only in the C-G, I-P, I-L and I-H zoning districts.

shall not exceed 35 feet from the ground level at its base.
(3) Total Area. A total magimum sign area of 120 square feet
per face (240 square feet total) sha11 be allowed. If the

(4) Locations Permitted. Freeway-oriented signs sha11 be

(e) Attachment. Temporary signs may not be permanently attached to
the ground, buildings or other structures.
18.114.110 Nonconforming Signs
(a) Except as provided in this Chapter, signs in existence on
March 20, 1978, in accordance with [according to] Ordinances
No. 77-89 and No. 78-16, which do not conform to the provisions of
this Chapter, but which were constructed, erected or maintained in
compliance with all previous regulationa, shall be regarded as
nonconforming signs which may be continued until March 20, 1988.
(b) Signs in existence on January 11, 1971, whieh do not conform to
the provisions nf this Chapzer, but which were constructed,
erected o.r maintained in compliance with all previous regulations,
were regarded as nonconforming signs and could be continued for a i
period of 10 years from January 11, 1971. All such signs which I
were not brought into compliance with the standards in Ordinance �
I�n. 77-$9 and No. 78-16 and th.e extensions granted are now 3n ;
violation of this Chapter. ;

;� (c) Signs located on premises annexed into the City after January 11, ;
1971, which do not comply with the provisions of this Chapter, I
ahall be brought into compliance with this Chapter within a period �
of 10 years after the ef£ective date of the annexation. �
(d) Any sign which is [structurally altered, ] maintained, relocated or f
replaced shall immediately be brought into compliance with all of �
the provisians of this Chapter, except the r�pairing and �
restoration of a s3gn on site or away from the site to a safe �

Dear Sirs:
Attached is a letter and sketch I submitted to Mr. Liden in regards
to the Frahler Electric sign.
Our roof sign was mounted on our originai building and then we added
a second story to our office, cons�quently, the visibility of aur sign is .
very minimal . In this respect I don't believe the location of this
particular sign would in any way spoil the aesthetic qualities of Tigard.
I am requesting a sign code amendment with provisions that v�ould
legalize roof signs in certain locations and a "Grandfather Clause"
installation similar to our Frahler Electric sign.

ments ;outlined in your letter of February 17 , 198$, to Eastgate Theater
Inc.

The purpose of this letter is to kiri�ng to the attention of staff and
the Plannin Commission the historical develnpment of our ro ert �

currently utilized for a private educational facility for dance and
' gynmastic instruction. rhis facility has been providing a wholesome !
and positive influence on the community since its erection in 1974 . "
Its function is similar to that of any small grade school with an
attendance of over 1000 students and a staff of between 25 and 40 persons.
Paramount in its past development was the safety of its patrons , which
included usually young students and their mothers . Identity on Pacific
Hwy. was a high priority which was assured by City of Tigard staff when
an off-street location was selected for purposes of safety .
Our small sign is currently erected according to the Sign Code Appeal
SCA 2-74 of May 29 , 1974 . This sign is situated at a site specified by
City of Tigard engineers on a 30 foot easement from our property to
Pacific Hwy . Its erection complied with the newly designed sign ordinances
which were being evaluated in 1974 , later being accepted in 1978.
Your recent letter indicating non-conformance of our sign is disturbing,
as our previous attempts to work closely with the Ci�y have been successful .
We hold that our sign is in conformance with the guidelines outlined to
us by the staff of the City of Tigard and its Plann�ng Commission, and i
that to remove our sign from its present locatic�n would provide undue �
hardship on our off-street location .
