The President announced that items 5.1 (M 6-79, Columbia Hardwood and
Moulding Co.), and 5.2 (ZC 1�-79, Way W. Lee) would not be heard at this meeting.
The MTNUTES of the June 17 meeting were considered. Wood asked the follow-
ing be added for clarification to the last paragraph on page 3: "7."he discussion �
was carried on in the presence of the members of the public attending the hear-
ing. " And on page 6, first paragraph, last sentence corrected to show that
Commissioners Wood, Kolleas, and Herron vc�ted no. Thereupon it was moved,
secorrded and carried that the minutes as submit•ted and amended be approved. ;
COMMUNICATIONS: Selby rep�rted no communications, but tt�at several matters
would be cansidered after the public hearing. The president reported several
contacts by Mrs. Ima Scott, who is raising issues on violation of City codes and
violation of the approval by the Pla�zning Commission for the Cant�rbury Woods
�` development. She will be on the agenda for thP August '7th meet.ing. The President ;
'` also reported meeting the previous evening with the City Council in a study �r
session on floodplain ordinances and problems arising therefrom. The enforcement 4`'
of the ordinance is difficult. The City Manager suggested the City Attor.ney draft k
language whe:mby written notiae woulcl be given violators to remove fill or other `,
violation of thE ordinance , and if this is not done the City would remove the �°
violation and place a lien on the property for the cost thereof. ''

consideration should be given to hearing items for which the applicant does not
appear. Wood felt little woulcl be gained by not considering matters such as
this, which are administrative in nature, notwithstan ding the absenee of an
applicant's presentation. Wood thereupon MOVED for approval of Zone Change ZC 11-79
based on staff findings and staff recommen'dations. The motion was seconded by
Helmer and carried unanimouslv.

Selby described the neighborhood and land use characteristics and reported
on plans �or subdivisions currently in process. He then read the STAFF REPORT
and STAFF R^COMMENDATIONS. He also read into the record a letter from Mr. and �
' Mrs. J.W. Evans opposing permitting duplexes in the area.
The APPLICANTiS PRESENTATION was made by Mary Burnham, one of the owners.
She fe]_t the duplexes preposed would be compatible with th:e rest of the develop-
ment and with the neighborhood. She recognized the problem to school children �
� posed by 97th Avenue in its pres�:nt condition, but felt this development was so '?
designed as to reduce this hazard to some extent, �

PUBLIC TESTIMONY--all in o�.position--was pr�°sented by Everett Greer, L7on �
F�rrest, Ed MUOre and Fred Bean, nearby residents, some of very long standing, °�
Mr. Greer read into the .record letters in opposi�ion frorn Wall�ce Powell. and Mr.
an d Mrs. Clinton, who with others known to be in oppositian �rere unable to be
present at this meeting. All e�ressed a stror�g desire to maintain the single-
family-residence character of the neighborhood, and all were very much opposed
to this conditional use, fe aring it would be merely an "openin g we dge" to further
duplex anel even apartment development on a number of parcels in the area,
COMMISSION DISCUSSION AND ACTION: Some Commissioners favored maintaining
the single-family character of the area. Funk saw no problems with duplexes,
indicating a conviction in the future we would see many more of them. Speaker �
expressed concern over the energy problem which has been highlighted within the !
last month and the now more apparent need for housing which is efficient in '
terms of use of energy and land and municipal facilities. He asked the President ':�
whether the Commission should be guided solely by the expressed wishes af the >;
people in an area, or whether consider�tions of good and/or efficient use o� '
land 3nd energy and services should enter into the decisions of the Cornmission. ,
The President acknowledged there are no easy answers to the question. i

Wood summarized factors which would justify conditional use for dupTexes in
general, and felt these justifications are absent in this case and in this area.
Tepedino felt the character of. the neighborhood and the facts presented in the
application were not persuasive in favor of the duplexes as requested.
Wo�d MOVED for denial of Conditional Use CU 13-79 based on Staff's General
Fin dings of Fact and the following Conclusionary Findings : (1) Same as Staff.
(2) The area presently is primarily a large-lot, single-family are a. (3) The
change an the charac•ter of tlle neighborhood is opposed by several surrounding
landowners. (4) The remainder of the pa.rcel does not require duplex buffering
from S.W. 97th Avenue in order to be developed as a single-family subdivision.
The motion was seconded by Kolleas. L'unk' asked if these units could be
sold as common-wall single-family units. Discussion among the Commissioners and
Staff brought out that duplexes on 10,000 square foot lots could not be sold
separately because of land registration :requirements. Also, in the present case ;
to p artition the 10,000-foot lots into two 5,000-f�ot lots would violate the zon-
ing, which calls for minimum 7500-foot lots. Another alternative would be to
request a planned unit cieveloprnent.
The President called for a vote on the motion for denial. The motion carried,
with Funk and Bonn voting no.

COMMISSION DTSCUSSION AND ACTION: Several Commissioners ob'ected to the

� r. Lipscomb stated the narrower street, because
of the configuration of the lot, would allow the developznent of one additional
lot--thereby permitting 15 lots as requested, instead of 14 if a 50-foot street
' were requir.ed, i3e pointed out the pavement width and the traffic-carrying capacity
of the narrower street would be the same as for the standard street--the pedestrian
sidewalk on ane side would be shorted. It was pointed out the Commission recom-
, mended 32 feet of paving to the City Council, but the Council did not agree. The
, addition al cost to the purchasers of each lot by reason of reduction from 15 to �
14 lots w�s estimated at $2,000, The difficulty with the long cul-�-de-sac and the ' �
- prospects for and timing of development on the property adjacent which would be
served by the proposed stub street, were discussed at some length. `'
Wood revi.ewed the requirements for granting a variance, stating his belief
the conditions for variance in the length of the cul-de-sae were met, esp�cially
in the light of prospective development of adjoining property with construction
of a loop street, but that the securing of one additional lr�t by reducing street
�ridth in the development was not a unique condition justifying a variance.
Wood MOVED the granting of Variance V 4-79 with respect.to cul-de-sac J
len gth, and denial of the variance to 40-foot street width, based on the follow- I
ing aonclusionary findings;

(1) The inability of •the applicant to develop the parcel without the , �
variance of cul-de-sac length has been demonstrated, which is an il
exceptional or extraordi,nary condition. Jf�

In support of the denial of the variance in right-of-way width, it is

(5) That the only harm that comes from refusing to vary the width

mit slightly mom intensive development of the parcel is not an

but applies generally to many subdivisions in Tigard, and has

The APPLICANT'S PRESENTATIOIQ was made by L�ynn L. Smith, architect, Port-
land. He described at some length the type of business far which the site had ;
been purchased and the building designed. He listed as difficulties in utiliza-
tion of the site the fact that thP property is anly 100 feet wida, the setback
requirements in the zone is 20 feet, and the "tear drop" shape of the buildable
area above the 100-year flood contour. He pointed out that the depth of water
under the building proPosed would be about eight inches at the 100-year flood �. '

level. He disputed Canclusionary Finding 3 asserting the displacement as of
significanc�. He stated they did not propose re moving the equivalent 15 cubic
fee� of displacement because of the desire to minimi.ze disturbing the floodplain.

He introduced the owner's attorney, Richard A. Uffelman, Boise Cascade Building, �
� Portland,� who is �also the secretary of the Astro Tool Corporation, the business k�
which would use the faci,litzes proposec?. He questioned the real significance of (
the zon.e change �rom M3 to M4, but asserted the Fasano standards are met in this `
case. He �ointed out that while, as paragr_aph 2 of the Staff Recommendatiori �;
states, "The structure is encroaching into the greenway, which violates the City's
Open Spaae Ordi,nance", Section 16.57.041 (1) provides for an exception process for
structures, and he submitted the proposed plan is an architecturally sound design
in an area zoned for the intended use.
There was no PUBLTC T.ESTTMONY.
CUMMISSI,ON DISCUSSION AND ACTION: Extensive discussion took place among
the Commissioners and Staff. Howard emphasized the precedent that allowing even
�hi,s small encroachznent on the greer�way would estahlish, and pointed out the
imprecise nature of tl�e data on flood levels. Fund, Wood, Speaker and Kolleas '
opposed the rer.ommendation for. denial. Wood outlined the reasons for the recent `'
chan ge in the floodplain ordinan.ce which permits certa.in encroachments. Tepedino
suggested con,sidexat�,on of alternatives such as two stories, rearrangement of
utilizatian of land above the .floodplain, oompen.sating e xcavation to preserve �';
flood storage capacity, etc.

The Presic�ent asked Commissioner Wood if he could frame a rno-tion with
�' conditions sugges•ted by the pre ceding discussion. At this Foint Selby offered ''

5, That the applicant dedicate to the City that portion of lands with-
in and without the floodp�ain which are needed to continue the green-
way system as intended in the Comprehensive Plan, with the Staff to
recommend to the Commission the approprzate land :Eor dedication.
(Note: There was discussion on including a requirement for the con-
struction of an eight-foot bike path, but partly because. this would
be a very short, isolated segment in a plan of unknown timing, this
requirement was droppede)
6. That the applicant receive Site Design Review approval for the green-
way area, site plan and landscaping.
7, That applicant dedicate the greenway to the City with an 8' bike path
along the greenway frontin g the site boundaries.
8. Geohydrologist report on methods of assuring that in the light of the
upstream development the proposed construction will not impede flood
waters or reduce flood re•tention.
Funk seconded the motion, which carried unanimously.
The public hearin gs portion of the meeting was closed by the President at

date of August 14 was agreed upon.
QLD BUSTNESS: Howard presented the problem of Mr. Jack St. Clair, owner
of a 100 x 100 foot lot at Hampton an d 67th Avenue. According to Mr. St. Clair,
the pr4gerty was zoned C-P in 1975. As a member of NPO 4 he opposed the provision
for "discouraging" developments on parcels of less than one acre. His point is
that his property �,vas already zoned C-P when the neighborhood plan was adopted,
and he felt in view of the grandfather-type situation of his property, he would
be allowed to develop undex the ordinance establishing the zoning. The City
Attorney when asked said he had the right to develop under his prior zoning. The
Pla�aning Director, however, under date of July 2, wrote him that "the Comprehen-
sive Plan takes precedence over existing zones", and since the NPO plan "discouraged"
development of less-than-one-acre parcels, his request for development was denied.
There was considerable discussion af the pxoblem of getting numerous owners of
2500-foot lots to cooperate in developing parcels of an acre or more.
In order for Mr. St. Clair to obtain a decision by the City Council, whe re
he felt this matter would have to be settled, Speaker MOVED the Plannin g Commis-
sion sustain the Planning Director in the position he took in his July 2 letter
to Mr. St. Clair, and including a waiver of the appeal fee, The motion was second-
ed by Bann and carried unanimously.

NEW BUSINESSr Haward presented the request �f the developers of Pick's '
Landing to sell as a buildable lot an area in the interior of the deve].opme;nt
which was to be utilized as a neighborhood park, with the proceeds of the sale
to be given to the homeowners° associa�tion for the improvement of the common
areas. Speaker inqui.;red whether this would be to provide funds for additional
landscaping of the common areas, or would be used by the developers to provide
the landscaping normally expected for common areas insucri a developm�nt. It
was stated the funds would be for additions to the normal landscaping. It was
the consensus that the suggested change is satisfactory.
Howard stated that Mr. Patterson., who has been before the Commission in
connection with a small dPVelopment on Tigard Street, wishes now to amend his
devel.opment plan. It was agreed (with Funl, abstaining on the basis of conflict
of interest) that the revi.sed plan should come again before the Commission for
approval.
The President declared the meeting adjourned at 11:05 p.m.

I. FINDINGS OF FACT:
1. The site is designated "Urban Low Density" on the NPO #6 Plan which
If: allows four dwelling un.its per gross acre.

3. Applicable NPO #6 Policies for residential development are as follows: II�

�. Tax Lot 200 has a single family unit. Tax Lot 104 is vacant. The
terrain slopes from the north to the southeast at approximately seven
per cent (7�) grade difference. The southern portion is "wetlands".
Proper site surface drainage improvement wi11 be require d at tim� of
site de velopment. There is a heavy concentration of vegetation on the
South end of the property.
5. The surrounding land uses are designated "Urban Low Density" on the
Comprehensive Plan. Single family residences abut this property on
the north, south and west�with vaaant property to the east.
6. A local improvement district for sewer installati_on has been initiated
by residents in this area, however, at this time the applicant has not
agreed to participate in the district.

7. Southwest McDonald Street will serve as the major circulation
facility for thP site. It is designated as a "collector" street `
by the NPO #6 Plan. It is presently a county street and is in
substandard condition having inadequate paving, right-of-way
width and no curbs or sidewalks.
TI. CONCLUSIONARY FINDINGS:
l. There exists a need to zone parcels that are within the city limits
to the City of Tigard Comprehensive Plan designation.
2. Southwest McDonald Street is in need of_ ten (10) additional feet
of right-of-way with half street improvement to collector street
standard,
3. Sanitary sewer service remains a concern sinoe no formal agreement
has been receive d by the city for app roval. Therefore, any develop-
ment on this property must be subject to sewer installation agree-
rnent approval.
III. STAFF' RECOMMENDATIONS: s
i ��, Staff recommends approval subject to the following conditions:
l. That USA Tigard sewer service be available to the parcel prior l
to issuance of building permits. y

2. That ten feet of right-of-way be dedicated to the City along the s

Section 18.20.030 of the Tigard Municipal Code (see attached narrative)

REQUEST: For a variance for street right-of-way width from fifty feet to forty
feet and for a cul-de-sac length beyond the distance of fc,ur hundred
feet. The requests are in conjunction with the zone change on a 2.88
acre parcel.
PREVIOUS ACTION: On May 21, 1979, the City Council adopted the City of Tigard
Housing Implementation Plan. The plan designated methods to
be used which may cut costs on housing development. One of
the methods was to lessen street widths.
T. FINDINGS OF FACT;
� ' 1. The subject sites are presently zoned R-7 and are designated R-5 "Single
Family Residential" five thousand square foot lots on the NPO #2 Plan.
2. The applicant is requesting street width and cul-de-sac length variance �
in accordance with the Housing Implementation Plan and Section 17.28.110 i

3. The Housing Implementation Plan adopted by the City Council on May 21, �
1979, designated certain variances af standard conditions for subdivision
de velopment in order to reduce the cost of housing. One of the methods �
was to lesser�• the width of street width. The applicant proposes to
build the streets within the subdivision as foll.ows: 40 foot righ.t-of-
way, 34 feet of paving, sidewalk on one side with curbs on both sides ;
(see attached plan) . This would reduce the cost of public improvements '
�.and thus lessen the cost per unit.

5. Since the stub street (see plan) will not be completed until the develop-

structure for office use. The rear portion of the building wi.11 extend �
above the floodplain on thirteen pilings in the floodplain. The
applicant is requesting the planned development review anr3 special ;
permit in accordance with Sections 17.56.010(B) and 18.57.040 of the
Tigard Municipol Code. '•

6. Burrounding land uses consists of mu].tifamily units to the west acioss
the greenway, industrial uses to the north and east. To the south is ;
a single family house and vacant property. The surrounding properties
are designated "IndustriaJ_ Park" on the north, east and south. '.Phe f
western area across the greenway is designated residential and multi-
family.
7. The subject site is 220 feet south of the existing sewer line on S.W.
Bonita. It is physically possible to install the line and ample
capacity for the se�vice exists. Water se rviae is av�ilable to the
site.
8. Traffic circulation to the property will 1�e served by S.W. 74th W�11C�1 �
fronts the subject property. S.W. 74th is a czty stmet and it is
desiyazated as a local street on the NPO #S Plan. The street is in
substandard condition having inadequate paving width, no curbs or
sidewalks and five additional feet is n�cessary for street width.
9. The total amaunt of reduced storage capacity in the floodplain is
fifte�n (15) cubic feet. The area of floodplain that the pilings
will occupy is the storage area where n� water flow will be aEfected.

10. The project will extend into the greenway. The structures will
cause some displacement and interference of the water surfacQ�.
II. CONCLUSIONARY FINDIIVGS:
l. The proposed land use is in conformance with the "Industrial Park'"
zoning and designation.
2. The encroachment into the qreenway area is in violation of Palicy #7
(page 13) of the Environm�ntal Design and Open Space Plan
3. The structures in the floodplain will displace the flood level
capacity and may catise tur}�ulant water f1ow.
III. STAFF RECOMMENDATION:
Staff recomrnends denial of 1_he preliminary plan and special use permit �
