CALL TO ORDER A. The meeting was called to order at 8:00 P.M. 2. ROLL CALL A. PUBLIC HEARING - Zone Change 4.1 Zone Change ZO 4-73 (Farmers Insurance) An application by F. I. G. Holding Company to change a zone classification from R-7, Single Family Residential and C-3 to P-I), Planned Development to allow the future construction of a motel-office park. complex. The subject property is bounded by Highway 217, Interstate 5 and the Lamb-Weston property and comprises 27.76 acres (Tax Map 251 1D, Tax Lots 100, 200, 300, 400, 500, 501, 701 and 1100) 1, Staff Recommendation The staff informed the Planning Commission that the applicant has requested that consideration of their application be held over to the next public hearing. In that the Commission decided in their study session at 7:30 tonight to hold an additional public hearing each month this item will be heard on July 3rd. • • • 4.2 Zone Change ZC 1-72 (Lindquist A request by S, R. Lindquist to rehear and consider extension of P-D zoning on property located on the east side of Hall Boulevard, 300 feet south of Bonita Road and coaaprising 7,61 acres. (Tax Map 281 ]2B, Tax Lot 1700) 1. Staff Findings The staff stated that it has found no additional findings since the original approval of this P-D zone in J'anxAe 1972 and that although no substantial progress has been made 1' toward construction of the proposed Planned Development, the proposal remains in conformance with Tig rd's adopted. Community Plan and fulfills a community need for :.dditional housing. qq 2, Testimony and Cross examination A. Proponent: 10 Mr, Lindquist, S.E. Tacoma Street, Portland, stated that he was the developer and due to difficulties in financing the project, he is requesting some minor changes in original approval, plus an extension of to, one year G? time period0 1 • 2. Chairman Whittaker questioned the witness as to the new conditions the staff would present. The following is proponents testimony and he was in agreement with those possible conditions. 3. Mr. Lindquist replied that he had worked with the staff and was in agreement with the conditions 3 he had discussed with the staff. 4. No one present in the audience wished to cross examine the witness. B. Opposition: 1. There was no one present in opposition to the request. 3. Staff Recommendation A. The staff pointed out that the Planning Commission and City Council previously approved the request with 14 conditions, The staff has reviewed these conditions • and has revised them as follows: Page 2 - PC Minutes - June 19, 1973 C \. 1. The total number of dwelling units shall be no}.. more than 36 including no more than 5 d.npleaces to be located only on lots abutting Hail Blvd. 2. That the normal front, side and rear setb,.cks may be waived, except the rear setbacks along the ,perimeter lot lines of each plat shall be a minimum of 15 feet, and provided t.a, .t each dwelling unit shall have at least one yard of 20 feet or more and the plans to be approved by the Planning Department. 3. The construction and design of this facility shall, be approved by the Oregon State Highway Department. 7. That the developer provide curb side sidewalks on both sides of the easterly and southerly entry roads into the subdivision and on the outside of the circle road within the subdivision. No sidewalks shall be required in the Cul-de-sac areas of the subdivision. 8. That single family dwellings may have common walls, plans to be approved by the Planning Department. 9. Mt. `ticoli questioned condition number 8 which states • that duplexes :-.nd single f ..sii1y dwellings may have coffin walls. He said that this would in affect allow 4 plexes within the subdivision -:inl he found this type of building to be ix :ppropriate. Mt. Nicoll moved to $. approve the request with the staff's reoc ommennded 1<. conditions with the exception of deleting the word duplexes from condition number 8. B. Mr. Lewis seconded the motion and the Commission x approved it with a unanimous vote of the members present. 5. PUBLIC BEARING o Conditional. Use I? 5.1 Conditional Use CU 13-73 (Chamberlain) An application by.Arrow Beating, Company for consideration of a planned residential development located north of Walnut Street and 400 feet east of S.W. 121st, ,:djacent the BrookvaY Subdivision. 1. The proposed density conforms to the R zoning density. 3. That adeguc tce public access and utilities are adjacent or otherwise serve the site. 4+, That the applicant's property is not suitable for the c+ntinuation of the City's proposed greenway system as an existing dedicated right-of-may exists 800 feet to the west. I?. 5. That the applicant has demonstrated a means of Gi maintaining open space and common areas by means of a homeowner's association. ti 2. Public Hearin A. ChaMberlain was questioned by the residents present about the ownership of the duplex units.. W. Cbadberlain stated that the units mould be of owner-renter type with tom; owner renting the adjacent unit. B. Opponents: 1. Residents of the Brookway Subdivision were present in opposition to the applicant's proposal. Their testimony centered upon the f of that there would be rental units in the development. 2. Ron Andre of 121st Ave. testified concerning the fact that there would,be rental' units and stated that the existing apartments in Beliwod had created. problems p in their community which made h m . apposed to any further rental units. 3. Staff Recommendation Based upon the findings :;.nnd testimony offered, the staff recommended recommended.approval of the applicant's request with the foilovings: Page 5 - PC Minutes • June 19, 1973 1. A homeowners associ.tion (s) shall be formed to maintKin o the dam, lake, 10 feet of lake frontage and the duplex landscape and access are:s. Tract "Buv shall revert to the ownership of the Homeowners Association upon the sale of either lot 6 or 7 as indicated on the preliminary plat A. 2. The applicant shall cause deed restriction to be placed on Tract "B", so preventing any future residential development in the interest of the future public health and safety. This restriction not to preclude said tract's use for agriculture, grazing and necessary sturetures to carry out these uses. 3. The applicant shall dedicate to the City sufficient land to provide a 30 foot riR:it of-way width from the center line of Walnut Street. l+. The duplex property owner (s) shall, agree to support the formation of a local improvement district to bring S.W. Walnut Street up to City collector street standards and that the present property owner (s) shall execute a recordable covenant herewith. 5. All lots for single family dwellings shall cover 4 minimum 1:nd area ti.'f 15,E square feet. 6. The site and latdscapirng plans of the duplex area shall be approved by the Planning Commission. 7. Before a building permit shall be issued for construction of duplex units on the subject site, the ,applicant shall submit and the Planning Commission shall approve, a preliminaA,y subdivision plat of lot 1 and a program for common maintenance of access 'ways and landscaped areas. 8. All utilities shall be placed underground. 9. The cul-de-sac and street on the southeastern corner of the site shall be dedicated to the City and constructed to City standards. 3. Commission Discussion and Action A. Barkhurst proposed to table consideration of the request u itil. later in the evening, after all of the testimony on the public hearing items held 'been heard. After the public he:ring, when the Planning Commission did consider the request, discussion centered around three major points: 1. Whether the application, even thou:,* a conditional use, should be considered according to the rules of F..:san o. 2. Should the area outside of the .pplicati.n boundary but part of the ownership and desi:.c ted on the nap as parcel 0°BUo by the City Planner, be considered as part of the application? 3. Opponents testimony which was concerned with rental units. C. Ba.l stated that he was concerned due to previous reft.4:rks by the City- Attorney as to whether or not F san o s k..uld apply to this conditional use in that the impacts upon the area were essentially the same as would be produced if this were a 2enue change. He also stated that he felt testimony provided in opposition to the appliv,.tion did not provide a proper bsis for consideration by the Planning ( Commission. That the opponents were asking the Planning Commission to deny the application based upon the social belief that people who occupy multiple dwellings are a different class of people than t., se who occupy single family hoaxes. He stated that the Planning Commission should not rely upon this evidence as pertinent to the Planning issue at hand. D. After considerable discussion Lewis moved and Barkhurst seconded to table this item to the next public hearing to allow the applicant to confer with the staff and City Attorney in reference to the requirements resulting from Fasano. The motion was approved by a 4 to 1 vote with Hartman abstaining and Ball voting no. 5.2 Conditional Use CU 12-73 (Schulz) An application by S.N.S. Development Corporation to construct duplexes on four lots fronting S.W. Tiedeman 130 feet north of S.W. Walnut Street in the proposed Clydesdale Subdivision C Page 7 - PC Minutes - June 19, 1973 ee f, 1. Staff Findings The principal findings s related to the request's conformance with the Tigard Community Plan. It was found tiaet the request for four duplexes in Clydesdale would exceed the plan's density requirements by one unit. 2. Public Rearing A. Proponents: 1. Chudkk Schulz of S.N.S. Development Corporation spoke for the applicant stating that the existing Clydesdale subdivision is below the densities allowed in the Community Plan and the duplex es would allow the applicant to bring the density up those allowable while helping to offset certain development costs such 4:s improvement of Tiedem an Street and dedication of open space and bike path construction, B. Opponents: 1. There were some residents present from the subdivision to the south inc opposition to the application. They were concerned about additional traffic caused by the duplexes on 106 and the fact that these would be rental units. 3. Staff Recomm edation A. Staff recommended eeproval of the request stipulating the following conditions: ].. That approval be granted for the construction of two duplexes at the entrance of the s ibdivision on lots 1 and 24 in Clydesdale. 2. That said approvel be contingent u+.nn the recording of the final plat for the Clydesdale subdivision and that lot 1 and 24 meet the minimum lot size requirement of 130100 square feet when recorded. 3. That the submitted site plan be concerned with fencing the site in order to screen on site recreation areas from visible and physical access onto Tiedemar City c•,llector street. 4. Commission Discussion and Action A. Lewis moved that the decision on this item be delayed until after all of the public her.ring items had been heard. Barkhurst seconded. Ball asked if the City Page 8 - PC Minutes - June 190 1973 • • Attorney would be present later when thess items would be considered.. The City Attorney replied. that he would. The motion Was put to a vote and passed 5 to 1, Ball voting no. B. When this item was considered later in the evening the question of Fasano was again raised as with the preceeding Arrow Heating application. Ball asked Fred Anderson if the same problem would not exist in this ease and he replied that there is no difference in degree between the two cases. C. Barkhurst moved that the ites be continued to the next hearing to allow the applicant to familiarize himself with the requirements of Fasano. Ball seconded and the motion ;passed unanimously. 6.1 Variance V 2=73 (City of Tigard) An application by the City of Tigard to vary a side yard setback requirement of 20 feet to 16 feet for a proposed office-shop builds..: at the Tigard. City Shops located on Ash Str°ee& 250 feet southwest of S.W. Burnham. 1. Staff Findings A. The staff presented the following list of five findings: 1. That the proposed use conforms with the comprehensive plan. 2. Exceptional circumstances ,:, ise from the f...ct that this land is owned by the public and the City wishes to utilize the site to provide minimum efficiency per tax dollar invested. 3. The request preserves property rights of the public to use this site in accordance with the public need while not interfering with the rights of surrounding property owners. 4. The authorization of this variance will not be materially deetrimenntal to the purposes of the zoning ordinance or other property in this zone. 5. This request is for four feet, the minimum necessary to alleviate the hardship. Page 9 - PC Minutes - June 19, 1973 1 C 2. Public Hearing A. O,p.tnnennt 1. AO one appeared in opposition to the request. P. Proponents 1. Nick Hiebert of the City of Tigard Public Service and Facilities department appeared to speak in favor of the request. He stated the need for the facility be sed upon existing City spy ee needs and stressed the financial situation which the City is working under in attempting to alliew;te its space needs. C. Staff Recommendations 1. The staff recommended that the request be approved with the condition that the landso—pe plan which is sub;r fitted to the Planning Commission, recognize probe ms resulting from the reduced setback :rea. 3 Commission �gDiscussion ]�a and Action be allowed ®y� the . The motion was seconded by Nicola who stated that he mould like to see the 16 foot area landscaped and not used for storage. C. Chairman Whittaker said that this could be handled as part of the site development review procedure. P. The motion was put to a vote which resulted in a two to two tie and as result died, The roll call was Ball yes, Nicoll yes, Part hihurst no, Hartman no, Levis and Chairman Whittaker abstaining. E. Chairman Whittaker explained his absteinance explaining that "He s.w• no reason for denying t;,;w variance but felt the underlying purposes are not consistent with pro eJr planning.00 Mk. Lewis e pl ;fined his Abstainance saying that he personally could not see that a severage tre:tmernt plant was a proper place for a City office building. He did agree te,t it was ,. proper location for the shop building but not an office building. 7. SITE DEVEIOPMEN.t! PLAN REVIEW A. Tigard. Industrial Park = Phase II 1. Staff Recommendation a. The staff recommended approval of the site c;nd landscaping plan 'with two conditions pertaining primarily to the number and location of trees on the site. 2. Commission Discussion and Action a. The applicant Robert Gary's—vas present and discussed his plans with the Commission. ,'ee Commission questioned him about compliance with the previous requir'ei.ennts of his conditional use permit for the Tigard Industrial Park. Mr. Gray stated that he •Ks not yet complied with • all of the conditions but is in the process of doing so. b. Ball asked the City Planner if the applicant now has • a 'building permit. Mr. Brooks stated yes tA4't the applicant • has been issued a building permit. Chairman a ttaker t' n pointed out that one of the conditions of the original conditional use was that a buildi4 . permit not be issued until site plan be approved by the Planning Commission. c. Mtr. Brooks acknowledged this fact but stated that since this condition was imposed the City has adopted ane occupancy permit ordinance which he felt you'd, insure that all of necessary site an and conditions could be met in that the developer could be denied occupancy of the building once constructed. Chairman Whittaker said that another condition of the approval.was that a dedication of easement for greenway along Fenno Creek would be considered a phase II of this project. Harrtman moved to accept the plan as submitted and Lewis seconded. The vote was unanimous. P. Hyster - Outdoor Storage 1. Discussion a. T e Planning Director showed the Commission a plan submitted by Hyster Sales Corp. on Sandburg Street for a proposed expansion of their new facility there. Although no substantial progress has been made toward construction of the proposed Planned Development, the proposal remains in conformance with Tigard's adopted comprehensive plan and fulfills a community need for additional housing in a pleasant urban ?; • environment. The Planning Commission and City Council,in previous action approved a list of fourteen conditions with their prior approval to Mr. Lindquist's P-:D. Staff has reviewed these conditions and have revised them as follows: 1.
