CALL TO ORDER: 8:00 P.M. II. ROLL CALL Present: Commissioners Fletcher, Goslin, Nicola, Severson, Whittaker and Chairman Paterson: Keith Thompson, !' The minutes for the regular meeting of September 21, 1971 were approved as submitted. IV. SUBDIVIONS A. "Hollytree" (West side of S.W. 115th Ave. , north of Gaarde St. ) 1. Staff Recommendation a. The staff recommended that preliminary approval be granted with conditions. 2. Commission Discussion and Action a. Chairman Paterson suggested that a bond be secured ,for street improvements on 115th Ave. b. It was moved (Fletcher) , seconded (Nicola) and passed by a 5 to 1 vote (Commissioner Whittaker voting no) to grant preliminary approval with the following conditions: 1. That 5 feet be dedicated to the City along the frontage of S.W. 115th Ave. for street improvements. 2. That both cul-de-sacs be provided with street names. 3, That $11,000,00 (440 feet of frontage along 115th mulitplied by $25.00) be deposited, or a bond be secured, with the City for the applicant's share of the :imprsvement of S.W. 115th Ave, Any monies not spent for the street project shall be returned to the applicant, 4. That a 5 foot-wide combination bike and walkway be constructed to City standards into "Tract A" from Fairview Lane, 5, That $2.50 per square yard be deposited with the City for the future continuation of the greenway path system within the greenway. (to be determined by the Public Works Dept. ) 6. That engineering plans and specifications shall be approved prior to acceptance of the Final Plat, 7. That variance applications for the 26 foot- wide streets and any building setback �! variations be submitted prior to acceptance ,'. of the Final Plat. V. STREET DEDICATIONS A. S.W. Variance PAUL HIRANSOMBOON, Applicant A request for a rear yard variance of 17 feet on an ri; M--4, Industrial Park parcel located on the north side v ` of S.W. Hunziker Street, approximately 700 feet north- .east of S.W. 72nd Avenue (Map 2S1 lAC, tax lot 1800) 1, Staff Recommendation a. The staff recommended approval with conditions, `, 2. Public Hearing + a, No one spoke in opposition. ', b. Mr. Paul Hiransomboon and Ron Klemp, applicants, + testified in favor of the request, s, c. Commissioner Fletcher asked if they intended to landscape, d. Mr. Hiransomboon stated that they had started landscaping. G Pg, 2 PC` Minutes - 10/19/71 vel= e0 Commissioner Fletcher expressed concern over the trees being cut that were behind the building. f0 Mr0 Hiransomboon stated that the two trees in question were too close to the building and were a hazard. g0 Commissioner Whittaker asked if there were any alternatives in case the variance wasn't approved, h0 Mr0 Klemp stated that the slope of the land would prevent them from adding an addition to the east. io Public hearing was closed. 30 Commission Discussion and Action a0 Commissioner Whittaker asked if the first condition could be changed to read Planning Commission, instead of Planning Department. b0 Ray Rangila explained that the zoning ordinance has requirements for landscaping in the M-4 zone. c0 Commissioner Goslin asked if the zoning ordinance had a time period in which the landscaping had to be done. d0 Mr0 Hiransomboon explained that a company had been contracted to do the landscaping. e0 Commissioner Whittaker asked what the Highway Department' s intention is in the area. fa Ray Rangila explained that the City had received a letter from the State Highway Department which stated they were taking a closer look at the intersection of Hwy. 217 and 72nd Ave. g0 Mr0 Ron Klemp explained that the State highway Department has already reserved the land needed for an on and off ramp in that area h0 Commissioner Whittaker expressed concern about setting a precedent in allowing a building so close to the highway. i0 Commissioner Nicoll stated that he felt that screening along the highway would be impossible. j0 It was moved (Fletcher) , seconded (Severson) and passed by a 5 to 1 vote (Commissioner Goslin voting no) to approve the request with the following conditions: 10 That a detailed landscaping and tree planting plan be submitted to the Planning Commission prior to issuance of building permits. 20 That the State Highway Engineer review and approve the plans. Conditional Use • FOREMOST MOBILE HOMES INC o L Applicant A request for conditional use approval to allow a mobile home sales facility and a temporary sales office on a 0-3, General Commercial parcel located on the south side of S.W. Pacific Hwy. , approximately 350 feet southwest of S.W. Hall Blvd. (Map 251 2AA, tax lots 600 & 700) 1. Staff Recommendation a. The staff recommended approval with conditions. 2, Public Hearing a. Mrs. Laura Johnson testified in opposition to the request. She expressed concern over the image the proposed use might give Main Street. b. Mr. Dennis Meyer, Vice President of Mobile Homes Holding, testified in favor of the request c, Mr. Pat Mahony explained the way the site would be developed. d. Mr. Meyer explained that the mobile home sales facility would be an interim use. e. Public hearing was closed. 3. Commission Discussion and Action a. Commissioner Nicoli stated that he was opposed to approving the request because he had visited another of the applicant' s lots (Division St. ) and found it to have poor landscaping, too many units, and only 3 skirted units, b, Mr. Mahony stated that land use controls in the area of their Division Street lot were weak. c. Mro Meyer stated that they would comply with all the conditions the staff recommended, but they couldn' t regulate the week days the units might be delivered. d., Mr. Mahony said that 65 per cent of the units would go directly from the manufacturer to the purchaser. e, Commissioner Whittaker expressed concern over the number of units that would be taken into and off of the lot per month. f, Mr. Meyer stated that an average of 3 or 4 units would be taken in and off the lot per month. g. Commissioner Goslin stated that he felt the site plan should be submitted to the Planning Commission instead of the Planning Department. h. Commissioner Nicoli stated he felt this type of business should locate further out of Tigard. Pg. 4 - PC Minutes - 10/19/71 , i, Commissioner Severson expressed concern over a possible traffic conflict if the request were approved. j, Commissioner Whittaker asked if a penalty clause could be included in the conditions. ka Commissioner Goslin stated that condition number 1 could be changed to read as follows: The conditional use shall be in effect for a period of 2 years, subject to revocation by the Planning Commission if any violation of the conditions is not remedied after a period of 2 weeks. 1. It was moved (Goslin) and seconded (Fletcher) to approve the request. The request was denied by a 3 to 3 vote (Commissioners Fletcher, Goslin and Whittaker voting yes; Commissioners Nicoll, Severson and Chairman Paterson voting no) , 1 VII. OTHER ITEMS VIII. Applicant' s Re nest Preliminary approval of a subdivision plat which proposes to divide 7.5 acres into 24 single family residential lots, including .92 of an acre to be dedicated to the City as part of the community' s greenway system. Location and Zonin The subject property is located on the west side of S.W. 115th Avenue approximately 500 feet north of S.W. Gaarde Street, and is zoned R-7, Single Family Residential. Conforz�ance with the Community Plan The adopted Plan designates the subject property for Urban Low Density Residential development, having an average density of 4 dwelling units or 13 persons per gross residential acre. The density of the proposed subdivision would be 3.2 dwelling units or 10 persons I: per gross residential acre. Section 180-4 of the Zoning Ordinance requires a rear yard setback of 20 feet. Location and Land Use of Sub ect Property The subject site is located on the north side of • S.W. Hunziker Street approximately 700 feet north- �= west of S.W. 72nd Avenue, and supports the Hiranport 1 ; Company. The subject property abuts the Hwy. 217 C $ right-of-way to the north. 4 Surrounding Zoning and Land Use The M-3, Light Industrial District to the west along Hunziker Street supports various industrial uses. A-2, Multi-family Residential zoning across Hunziker from the subject property is developed with apartments. k An elementary school is located across Hwy. 217 to the ti north. 1 Applicant ' s Justification '' "Hiranport Company is currently operating a wholesale j • motorcycle accessory warehouse at 7585 S.W. Hunziker Rd. which is a conforming use in accordance with M4 zone. We now find it necessary to expand our facility. i We would like to extend our existing warehouse 3 r' additional 24 foot bays - 71 feet in an effort to efficiently utilize our property. We have a ( triangular piece ground that slopes in two directions. I Due to the northwestern slope and the west side of our property being the long side of the triangle, it is natural that truck ingress and egress continue to be on the west side of the property. 'r, 1 The infringement of our proposed addition on the 20 foot setback requirement would occur only on the northeast corner of the building. This corner would come to within 3 feet of our property line. The northwest corner would have more than 70 feet of setback. Enclosed-, • you will find a plot plan indicating proposed addition drawn by H. C. Mason and Associates, consulting engineers. Robert Sherzinger, one of their. engineers, has contacted Henry Brindley of the State Highway Right of Way Department concerning this matter. The Highway Department has no objections to the building coming to within 3 feet of the property line. Due to the unique position of our property and the elevation of Hwy. 217 at this point, we feel that the proposed addition would be compatible with the surround- ing area. We intend to retain whatever trees possible along the highway side of our property and landscape in an attractive manner. Thank you for your attention and consideration to this matter." Staff Findings and Recommendation The staff finds that the requested variance and building addition will not be detrimental to present or future surrounding land uses, nor to the purposes or standards of the Zoning Ordinance and Community Plan. The staff further finds that the subject property's (I shape and topography lends itself to the proposed addition. is In addition, the maximum height of the proposed r. addition would only be between 15 and 20 feet above the pavement surface of Hwy. 217, and approximately 50 feet from the pavement. The Zoning Ordinance allows a maximum height of 75 feet in the M-4 district with conditional use approval. It is recommended that the request be approved subject to the following condition: 1. That a detailed landscaping and tree planting plan be submitted to the Planning ! Dept. prior to issuance of building permits. Location and L and Use of Subject Property a d The vacant subject site is located on the south side of S.W. Pacific Hwy. approximately 350 feet • southwest of S.W. Hall Blvd. • Surrounding Zoning and Land Use The area surrounding the subject property is zoned C-3, General Commercial and developed with various • commercial uses and a junior high school. The abutting parcels to the west and east support a used car dealership and a service station. Another car dealership is located 400 feet to the east. Conformance •to the Community Plan The subject property is located between areas designated for general commercial and commercial- industrial uses on the adopted Plan. The commercial- industrial area is intended to accomodate commercial • uses which require outside storage or display. The subject property's specific land use designation on the Community Plan cannot be determined until the completion of a more detailed "plan supplement" for the. subject area, although commercial-industrial uses are intended to be located near the Main Street business. district. - • Staff FindtaEL1.21.3.19.911.22-111AUla The staff finds that the proposed use would be compatible with surrounding land uses, but would net be clearly in conformance with the adopted Community Plan. The staff further finds that there are presently no mobile home display lots within the City. ' It is recommended that the request be approved with the following conditions: 1. The conditional use shall be in effect for a period of 2 years, at the end of which time the .Planning Commission shall review Plan Supplements to determine the subject use's conformance with designated land uses in the Community Plan. 2. A detailed site plan shall be submitted to the Planning Dept. for review and approval prior to occupancy. Said site plan shall indicate mobile home display sites, driveway, off-street parking, landscaping and customer path system. 3. All mobile homes, including the temporary sale office; located within 100 feet of • Pacific Hwy. shall be provided with land- scaping, skirting and awnings. Existing • trees shall be preserved and maintained. 4. One driveway shall be provided into the subject property at the north end of the • lot. The entrance shall be of sufficient dimension that no backing movements' or stopping of traffic on 99-W will be necessary for access and egress. Access for said driveway shall be subject to • permit by the Oregon State Highway Dept. 5. The subject property will be limited to a maximum of 15 mobile homes or 20 frames, • including any used homes. 6. The display yard shall be confined to an area within 300 feet of the front property line. 7.
