A. The minutes for the regular meeting of August 17,
1971 were approved as submitted.

CITY OF TIGARD, Applicant
X-FgiUFFTnra change of zone classification from
0-3, General Commercial to C-P, Commercial Professional
and a variance of Section 156-7 of the zoning ordinance
to allow a free-standing sign in conformance with the
sign ordinance. The subject property is located on
the west side of S.W. Pacific Highway approximately
20 feet southwest of S.W. Walnut Street (Map 2S1
2BD, tax lot 2101) .
B. Variance (carried over from August 17, 1971)

request for a to lot width variance of 7 feet on a
0-3, General Commercial parcel located on the west
side of S.W. Pacific Highway approximately 120 feet
southwest of S.W. Walnut Street (Map 251 2RD, tax
lot 2101) .
The Planning Commission held the public hearings for
the City of Tigard and Stan Wiley, Inc. , Realtor
concurrently.

1. Staff Recommendation
a. The staff recommended approval of the
change of zone classification and the
sign variance
b. The staff recommended approval of the
lot width variance with two conditions.
2. Public Hearing •
a. Walt Zwingli, owner of the property,
stated that he agreed with the staff
recommendations, but he questioned the
landscaping requirement in the C-P district.
b. Mr. Zwingli asked if the first condition
of the staff recommendation for the lot
width variance request could be applied
under the zone change.
c Ray Rangila explained that the variance
requests did not apply td landscaping
requirements in the C-P disti^iot.
d. Ray Rangila explained to Mr. Zwingli that
he could apply for variance on the
landscaping requirements if the Commission
approved the zone change.
e. Fred Anderson stated that the Commission
should leave the property zoned 0-3 and
table the zone change request until
Comprehensive Plan Supplements are com-
pleted by the City.
f. Commissioner Goslin asked if the easement
information that the Commission required
last month had been supplied.
g. Chairman Paterson stated the information
had been supplied.
h. Public hearing was closed.
3. Commission Discussion and Action
a. Fred Anderson stated that the Commission
could approve the variance provided that
the building plans, layout and landscaping
are satisfactorily reviewed.
b. Commissioner Whittaker stated the first
condition should be amended by adding
a minimum frontage width of 33 feet.
C. It was moved (Nicoll) , seconded (Lewis)
and passed by unanimous vote of the Commission
present that the lot width variance be approved
provided:
1. That the front 10 feet by a minimum
frontage width of 33 feet of the, subject
property shall be landscaped and main-
tained.

2. That any change of use on the subject a
site shall be reviewed and approved by
the Planning Commission.
3. That the variance will be effective
after the building plans and site plan
are reviewed and approved by the Planning
Dept.

and passed by unanimous vote of the Commission
present to table the zone change application.
C. Conditional Use

1. Staff Recommendation
a. The staff recommended approval with 2
provisions.
2. Public Hearing
a, Fred Fields, Coe Manufacturing, asked if
there would be . outside processing.
b. . No one represented the application.
3. Commission Discussion and Action
a. Commissioner Goslin asked if the storage
would be between the buildings and not
extend above the buildings.
b. It was moved (Goslin) , seconded (Lewis)
and passed by unanimous vote of the Commission
present to approve the request with the follow-
ing provisions:
1. The conditional use permit shall be
in effect for a period ' of one year.
2. The outside storage yard shall begin
5 feet within lines drawn parallel
to the outside faces of the two buildings.
3. That the storage shall be between the
buildings and not extend above the buildings.
4. That the permit shall be limited to the
storage of completed module units, and
that no processing shall be allowed out-
side the buildings.

3, Commission Discussion and Action
.a. It was moved (Gosh) , seconded (Lewis)
and passed by unanimous vote of the Commission
present to deny the application based on the
staff findings:
1, The existing zoning does not conform to

the adopted Community Plan.
2. The requested use does not conform to
the Tigard Community Plan.
3. Approval of the conditional use permit
would encourage the development of the
southeast quadrant into freeway oriented
businesses.
4. The Community Plan designates the northwest
quadrant for a regional shopping center and
does not designate any other freeway oriented
business interdhanges along Hwy. 217.
5. The proposed drive-in retail commercial
use would be ixipompatible with adjoining_
residential parcels to the south and would
create traffic conflicts in the vicinity
of Greenburg Road and the Cascade industrial
Park frontage road.
6. Non-residential uses on the southeast
quadrant should be controlled and have access
from S.W. Shady Lane in order to minimize
vehicular, pedestrian and land use conflicts.

7. The Community Plan recommends planned
unit development controls over all
interchange development,
8. A survey of service stations within a
2 mile radius of the subject site reveals
that 8 stations have been vacated, ^losed
or converted out of a total of 39.
9. Standards in the Community Plan provide
for other high intensity uses on quadrants
which are zoned in nonconformance with the
Plan, such as apartments, offices, medical
clinics, churches and community centers.
Retail commercial uses, and especially
drive-in retail commercial uses, should
be discouraged along Greenburg Road.
V. OTHER ITEMS
A. Walnut Street Dedication
1. The staff recommends approval.
2. It was moved (Lewis), seconded (Goslin) and passed
by unanimous vote of the Commission present to
approve the street dedication.
B. Villa La Paz Directional Signs
1. Pete Wilson Realty requested approval of three
directional signs; one to be located at 91st
and Greenberg; two to be located at Greenburg
and Pacific Highway.
2. Staff Recommendation
a. The staff recommended approval of only
one double faced directional sign at the
nearest arterial (91st and. Greenburg) .
b. It was moved (Woodard) , seconded (Lewis) and
passed by unanimous vote of the Commission
present to deny the request.

The adopted Tigard Community Plan designates the
southeast. quadrant of State Hwy. 217 and S.W. Greenburg

Plan.
The Plan further states in its Intersection or Quadrant
`, policy that retail commercial development shall be
located on one quadrant where arterials intersect. The
f' northwest quadrant of Hwy. 217 and Greenburg Road is the

1. Commercial development at the intersection of an
arterial street with an expressway or another arterial
will be limited to one quadrant. Where more than one
quadrant is already developed with commercial uses,
• commercial development on the remaining undeveloped
' quadrants will be discouraged. The types of uses that
will be encouraged on adjacent corners include medical
clinics, other professional offices, churches, community
iz centers, and apartments.
,,. 2. Development of corner sites at major intersections
will be encouraged as "planned units." Planned unit
development will permit the flexibility in site
design that is needed to achieve the objectives
described for these locations.
u` Staff Findings and Recommendation
' The staff finds that a previous service station conditional
use permit for the subject lot lapsed, and that a second
service station approved and constructed with access from
S.W. Shady Lane (northeast corner of Shady Lane and Greenburg
Road) . Both conditional use permits were approved prior to
:P(` the adoption of the Tigard Community Plan.
' The existing Shell Service Station was approved because of
- its preferred location over the subject site--due to its
access from Shady Lane, minimized land use and vehicular _
' conflicts and the opinion that one station in the quadrant
i `,: was needed to serve the employment district to the west
and neighborhood to the south.
It is recommended that the request be denied with the
following additional findings:
