Note: City of Tigard match=$432,473 Page 2—2013 CPD GRANT IGA—Metro—City of Tigard River Terrace Community Plan Implementation 6/11/2014 i Metro Contract No. 932809 CONSTRUCTION EXCISE TAX GRANT INTERGOVERNMENTAL AGREEMENT Metro—City of Tigard River Terrace Community Plan This Construction Excise Tax Grant Intergovernmental Agreement ("CET Grant IGA'D is effective on the last date of signature below,and is entered into by and between Metro,a metropolitan service district organized under the laws of the state of Oregon and the Metro Charter,located at 600 Northeast Grand Avenue,Portland, OR,97232-2736 ("Metro'D,and the City of Tigard("City"),located at 13125 Southwest Hall Boulevard,Tigard,OR, 97223,collectively referred to as ("Parties' . WHEREAS,Metro has established a Construction Excise Tax ("CET'D,Metro Code Chapter 7.04,which imposes an excise tax throughout the Metro regional jurisdiction to fund regional and local planning that is required to make land ready for development after inclusion in the Urban Growth Boundary;and WHEREAS, the CET is collected by local jurisdictions when issuing building permits,which the local jurisdiction then remit to Metro pursuant to Construction Excise Tax Intergovernmental Agreements to Collect and Remit Tax ("CET Collection IGAs") entered into separately between Metro and the local collecting jurisdictions; and WHEREAS,the City has submitted a CET Grant Request("Grant Request") for the River Terrace Community Plan ("Project");and WHEREAS Metro has agreed to provide the City CET Grant funding for the Project in the amount of $245,000 subject to the terms and conditions set forth herein,and the parties wish to set forth the funding amounts, timing,procedures and conditions for receiving grant funding from the CET fund for the Project. NOW THEREFORE,the Parties hereto agree as follows: 1. Metro Grant Award. Metro shall provide CET grant funding to the City for the Project as described in the City's CET Grant Request,attached hereto as Exhibit B and incorporated herein ("Grant Request',in the amounts and at the milestone and deliverable dates as set forth in Exhibit A attached hereto and incorporated herein ("Deliverables Schedule"), subject to the terms and conditions in this Agreement. 2. City Responsibilities. The City shall perform the Project as described in the Grant Request and as specified in this Agreement and in Exhibit A, subject to the terms and conditions specified in this Agreement and subject to the "funding conditions"identified by the Screening Committee as stated in Metro Council Resolution No. 13-4450, Exhibit A. The city shall obtain all applicable permits and licenses from local,state or federal agencies or governing bodies related to the Project,and the City shall use the CET funds it receives under this Agreement only for the purposes specified in the Grant Request and to achieve the deliverables and/or milestones set forth in Exhibit A. 3. Payment Procedures. Within 30 days after the completion of each deliverable/milestone as set forth in Exhibit A, the City shall submit to Metro an invoice describing in detail its expenditures as may be needed to satisfy fiscal requirements. Within 30 days of receiving the City's invoice and supporting documents,and subject to the terms f and conditions in this Agreement,Metro shall reimburse the City for its eligible expenditures for the applicable deliverable as set forth in Exhibit A. Metro's funding commitment set forth in this Agreement shall be fulfilled solely through the programming of CET funds;no other funds or revenues of Metro shall be used to satisfy or pay any CET Grant funding commitments. The parties recognize and agree that if the CET is ever held to be unenforceable or invalid,or if a court orders that CET funds may no longer be collected or disbursed, that this Agreement shall terminate as of the effective date of that court order,and that Metro shall not be liable in any way for funding any further CET grant amounts beyond those already disbursed to the City as of the effective date of the court order. In such case the City shall not be liable to Metro for completing any further Project deliverables as of the date of the court order. (b) Waiver. The parties hereby waive and release one another for and from any and all claims,liabilities,or damages of any kind relating to this Agreement or the CET in excess of the liability limitations set forth herein. 5. Project Records. The City shall maintain all records and documentation relating to the expenditure of CET Grant funds disbursed by Metro under this Agreement. The City shall provide Metro with such information and documentation as Metro requires for implementation of the CET grant process. The City shall establish and maintain books,records,documents and other evidence in accordance with generally accepted accounting principles, in sufficient detail to permit Metro or its auditor to verify how the CET Grant funds were expended. Metro and its auditor shall have access to the books,documents,papers and records of the City that are directly related to this Agreement, the CET grant moneys provided hereunder,or the Project for the purpose of making audits and examinations. 6. Audits,Inspections and Retention of Records. Metro and its representatives shall have full access to and the right to examine, during normal business hours and as often as they deem necessary,all City records with respect to all matters covered by this Agreement and Exhibit A. Such representatives shall be pernutted to audit,examine and make excerpts or transcripts from such records,and to make audits of all contracts,invoices,materials,payrolls and other matters covered by this Agreement. All documents,papers,time sheets,accounting records,and other materials pertaining to costs incurred in connection with the project shall be retained by the City and all of their contractors for three years from the date of completion of the project,or expiration of the Agreement,whichever is later,to facilitate audits or inspections. 7. Term. This agreement shall be effective on the date it is executed by both parties,and shall be in effect until all deliverables/milestones have been achieved, all required documentation has been delivered, and all payments have been made as set forth in Exhibit A,unless terminated earlier pursuant to this Agreement. 8. Amendment. This CET Grant IGA may be amended only by mutual written agreement of the Parties. 9. Other Agreements. This CET Grant IGA does not affect or alter any other agreements between Metro and the City. 10. Authority. The City and Metro each warrant and represent that each has the full power and authority to enter into and perform this Agreement in accordance with its terms; that all requisite action has been taken by the City and Metro to authorize the execution of this Agreement;and that the person signing this Agreement has full power and authority to sign for the City or Metro,respectively. Other aspects of the Community Plan will be funded by the city with existing resources. Annexation of the entire River Terrace area was recently completed, and finishing the River Terrace Community Plan in a timely manner is one of the highest priorities for the city so that we can begin to allow much-needed development to occur there. Without this grant, completion of the Community Plan will be significantly delayed. Developing an infrastructure financing strategy that delivers financial resources where and when they are needed and involving the city, major property owners and future residents in finding equitable funding solutions, is at the heart of this project. This is an enormous challenge, but I am confident that this work will serve as a regional community development model, applicable throughout the Metro area. River Terrace Community Plan Implementation s " CET Grant Application April 18, 2013 PROJECT NARRATIVE Project Description: The River Terrace Community Plan area consists of approximately 500 acres west of Bull Mountain. All of this area has been annexed to the City of Tigard. The Community Plan will provide for about 3,766 dwellings and a future population of approximately 11,600. A wide variety of housing types and densities are planned;the minimum net residential density is over 10 units per acre. The Community Plan calls for a connected, multi- modal street network,a system of public parks,open spaces and trails, a school site,and a mixed-use neighborhood commercial center. This grant application will fund two critical elements of the River Terrace Community Plan: a Public Facility Plan Update and an Infrastructure Financing Strategy. Other aspects of the Community Plan will be funded by the City with existing resources. The project work scope for the Community Plan identifies 11 tasks that will refine the work already completed as part of the West Bull Mountain Concept Plan into development entitlements.This includes updating city infrastructure master plans and identifying the funding strategy necessary to build needed infrastructure. The overall project work scope is summarized below. This application proposes to use a CET grant to fund consulting work related to tasks 5-11: these tasks make up the Infrastructure and Implementation Phase of the project. Without the CET grant, completion of the River Terrace Community Plan will be significantly delayed. A schedule for the full River Terrace Community Plan process is attached. Project Site Description: In 2002, Metro brought the West Bull Mountain Area, consisting of approximately 450 acres of land,within the UGB. In 2011, Metro brought the Roy Rogers West Area, approximately 50 acres,within the UGB. Both of these areas are now known as the River Terrace area. See Figure 1. Washington County adopted a Concept Plan for the areas(West Bull Mountain Concept Plan) in 2010 consistent with Metro Title 11.The Concept Plan has an estimated capacity of 3,766 dwellings and a future population of approximately 11,600. Project Background: The City and Washington County executed an intergovernmental agreement(IGA) in April 2012 coordinating planning in the River Terrace area and transferring county road ownership in the area to the City. One element of the IGA was an assignment of duties and resources from the County to the City for the remaining 3 funds from a CET grant awarded to the County in 2007 for the West Bull Mountain Project. The original grant amount was$670,500. The remaining funds assigned to the City to complete the River Terrace Community Plan are $134,100. The City of Tigard agreed to be the urban service provider for the River Terrace area and to prepare a more detailed land us, public infrastructure,governance, and financial planning framework for urban development of the concept planned area. This refinement is known as the River Terrace Community Plan. The City of Tigard has or is in the process of completing a number of Phase 1 work scope tasks related to the River Terrace Community Plan: • The City approved annexations in 2011 and 2013 for the entire River Terrace area, approximately 500 acres. • Task 1-The City developed a work program for the River Terrace Community Plan, and held a community meeting in October 2012 to introduce the planning process to stakeholders and the public. The City prepared a public involvement plan for the River Terrace planning effort which was approved by the Tigard Committee for Citizen Involvement in November 2012. The Stakeholder Working Group(SWG)was approved by the Tigard City Council in December 2012. • Task 2-The City adopted a Comprehensive Plan amendment in December 2012 incorporating recommended land use designations from the Concept Plan and associated Goal 14 policies into the Tigard Comprehensive Plan. See Figure 2. • Task 3-The City completed a Goal 5 Natural Resources planning effort that will result in Comprehensive Plan amendments for Goal 5 elements(significant tree groves, significant habitat, and wetlands and stream corridors)for the River Terrace area. These amendments are expected to be taken to the Tigard City Council for adoption by July 2013. Task 3 work products were reviewed by the project TAC and SWG in March 2013, and were discussed at a public open house in April 2013. • Task 4-The City completed a review and refinement of land use assumptions, plan designations and potential zoning map designations for the Community Plan. Task 4 work products were reviewed by the project TAC and SWG in March 2013,and were discussed at a public open house in April 2013. Evaluation Criteria: The Grant Application Handbook indicates that evaluation criteria must be addressed in the application. Two sets of criteria are provided: Set 1 for areas located within the UGB prior to 2009 and Set 2 for areas added since 2009 and urban reserves. Since the River Terrace area includes land added to the UGB before and after 2009, both sets of criteria are addressed below. Evaluation Criteria for Projects within the Current UGB: Expected Development Outcomes: Opportunity sites with catalyst potential: Three major development companies have acquired sites within River Terrance ranging in size from 10 to 40 acres. Some of these sites are shown on Figure 3. Arbor/West Hills Development, Polygon Northwest, and Metropolitan Land Group are established residential development/construction firms active in the west-side market. Together they control over 120 acres and are actively looking for additional properties. Each of these firms is poised to begin development upon completion of the River Terrace Community Plan, and extension of public infrastructure. Average densities will be over 10 units/net acre. Probability that development permits will be issued within two years: Arbor/West Hills-250 apartment, condominium,townhome and single family units; Polygon Northwest- 250 townhome, single-family attached and detached units. Probability that development permits will be issued within five years:Arbor/West Hills-500 apartment, condominium, townhome and single family units; Polygon Northwest-250 townhome, single-family attached and detached units; Metropolitan Land Group-100 attached and detached units 4 Level of community readiness and local commitment:Completion of the River Terrace Community Plan will provide property owners with appropriate zoning and clear and objective development standards for a variety of housing types, and a mixed-use commercial center. The City of Tigard has committed to be the urban service provider for the area,and completion of the Public Facility Plan update and Infrastructure Financing Strategy will provide the tools to assure that transportation,sewer, water and parks are available to support development. Roles and responsibilities of applicant:The City of Tigard will take the lead role to complete the River Terrace Community Plan, and will engage stakeholders, owners and the public in the preparation of the Plan. Regionally Significant: The Concept Plan and subsequent Comprehensive Plan designations for River Terrace approved by the City include the key elements of a great community, and achieve many of the six Desired Outcomes adopted by Metro to guide future planning and development. 1. Vibrant communities. The Community Plan will provide for affordable and diverse housing types and density ranges averaging over 10 units/net acre; active and passive recreational uses; neighborhood commercial uses to provide for general shopping and service needs of the community; institutional uses including schools to provide places of learning; and a multi-modal transportation network consisting of walkable streets,trails and pedestrian and bike pathways, and tree-lined streets. River Terrace neighborhoods will be places where people can choose to walk for pleasure and to meet their everyday needs. 2. Benefit from economic prosperity. River Terrace will not include significant employment opportunities, but it is situated in close proximity to job centers in Tigard, Beaverton and Washington County and service centers nearby. Affordable and diverse housing will allow a wide range of residents easy access to local jobs and services, and to the regional transportation system linking River Terrace to metropolitan-wide employment opportunities. 3. Safe and reliable transportation choices. The local transportation system is planned as a multi-modal transportation network consisting of walkable streets, trails and pedestrian and bike pathways, and tree- lined streets. Residents will have multiple transportation choices in River Terrace,whether it's accessing a local school, parks, open spaces or a mixed-use neighborhood commercial center. 4. Minimizing contributions to global warming. River Terrace is planned as a relatively compact, connected community where a range of local needs can be met without driving a car. Sustainability best practices are built into the Community Plan: average residential densities exceed 10 units/net acre; a variety of housing types and mix of uses are provided in close proximity; natural areas are preserved as open space and parks are located throughout the neighborhood; and stormwater is managed and is linked to natural area and stream corridor protection. Public infrastructure is provided in efficient and equitable ways. All elements of the Community Plan will be subject to performance measures, strategies and recommendations contained in the "City of Tigard Sustainability Action Plan: A Vision for 2013-2020," January 2013. 5. Clean air, water and healthy ecosystems. As discussed above,the River Terrace Community Plan ensures that existing natural resources are protected and enhanced, and opportunities for sustainable development practices are incorporated in all aspects of planning and development. 6. Equitable benefits and burdens of growth. Not only will the Community Plan provide affordable and diverse housing, but this desired outcome most closely aligns with this CET grant request. This grant application will fund two critical implementation elements of the River Terrace Community Plan: a Public Facility Plan Update and the Infrastructure Financing Strategy. Developing an infrastructure financing strategy that delivers financial resources where and when they are needed and involves the City, major property owners and future residents in finding equitable funding solutions will serve as a regional community development model. The infrastructure financing strategy will also address the need for new and 5 creative approaches to provide infrastructure as outlined in the "Regional Infrastructure Analysis," Metro, 2008. River Terrance is included within the planning area of the SW Corridor Plan currently being prepared by Metro. While not a focus for HCT service, River Terrace will be important new housing area supporting the future growth expected for the Corridor. Location.- The ocation.The River Terrace Community Plan Implementation Project meets the location criterion for areas where concept planning has been completed, but additional work is necessary to make the area development ready. A concept plan has been completed and land use designations adopted by the City. More detailed implementation work is needed so that development can proceed in a predictable manner. Evaluation Criteria for Projects added to the UGB since 2009 and Urban Reserves: Title 11 Requirements: A Concept Plan has already been prepared for the River Terrace area, and the City of Tigard has committed to be the urban service provider. This grant application will fund preparation of a Public Facility Plan Update and an Infrastructure Financing Strategy. The City of Tigard will adopt the updated Public Facility Plan as an element of the Tigard Comprehensive Plan. The Infrastructure Financing Strategy will lead to actions by the City, property owners and future residents securing needed infrastructure funding. Local and Regional Needs. The City of Tigard is currently updating the Goal 10-Housing element of the Tigard Comprehensive Plan and prepared forecasts of housing need over the next 20 years. The results show a need for over 6,500 new housing units by 2030, with a stronger emphasis on new ownership units. The forecasts included the River Terrace area. The River Terrace Community Plan will provide for needed housing, a variety of housing types and densities targeted to a range of household incomes. Commitments for a Successful Planning and Adoption Process: The City of Tigard has committed to be the urban service provider for the River Terrace Community Plan area, and has adopted land use designations as part of the Tigard Comprehensive Plan. The City annexed the entire area in 2011 and 2013. Readiness of Land for Development: As summarized in the response to the Expected Development Outcomes criteria above, major development companies have acquired significant lands within the River Terrace area, and are posed to proceed with development when the land use entitlements are approved by the City, and when public infrastructure is available to serve individual development sites. The Community Plan will result in approval of appropriate zoning for the area, and development of a financing strategy that will secure needed infrastructure funding. Evaluation Criteria Common to Both Project Areas: Best Practices Model: This grant application will fund two elements of the River Terrace Community Plan: a Public Facility Plan Update and the Infrastructure Financing Strategy. Developing a realistic infrastructure financing strategy that delivers financial resources where and when they are needed and involves the City, major property owners and future residents in finding equitable funding solutions, will serve as a regional community development best practices model. As a follow up to this project, a "Lessons Learned" presentation will be prepared that highlights infrastructure financing challenges and successful strategies developed for River Terrace. City staff and key consultants will be available to present these findings at MTAC, MPAC or Metro Council as requested. 6 Leverage: This planning grant will leverage significant in-kind contributions from Washington County, the City of Beaverton, Clean Water Services,and major property owners/developers who are significant stakeholders in the project. Table 1 found in the Budget Documents section of the application summarizes budget estimates by task for the full River Terrace Community Plan. This grant application is for$245,000 for consulting services related to Phase 2 of the overall project. The City of Tigard is committing significant staff time and additional consulting services amounting to a total of$432,473. The grant application represents 36%of the overall project cost. Matching Fund/Potential: The City of Tigard intends to undertake all work tasks of the River Terrace Community Plan using existing resources except for the tasks to be funded by the CET grant. As noted above and summarized in Table 1, the City will commit$375,973 in staff time and $56,500 for consulting services using existing resources. The consulting services budget is included in the proposed FY2013-14 Community Development Department budget. The City does not have adequate resources to fund the entire project, particularly if the Community Plan is to be adopted in a timely manner. Without the CET grant,completion of the River Terrace Community Plan will be significantly delayed. Equity: During the past 7 years,a total of$348,542 in CET revenues has been generated by the City of Tigard. The City has received no direct CET grants during that same period. Washington County was awarded a CET Grant in 2007 for the West Bull Mountain Concept Plan. The original grant amount was$670,500. The remaining funds assigned to the City of Tigard by the County to complete the River Terrace Community Plan are $134,100. The City of Tigard is committed to providing housing at a range of prices and that commitment is reflected in the range of housing types planned for the River Terrace area.The most recent Regional Inventory of Affordable Housing compiled by Metro in 2011, identified 18 separate subsidized housing properties in Tigard offering 705 units.This is roughly 10%of the units in the County. In terms of number of subsidized units,Tigard trails Hillsboro and unincorporated areas, but exceeds all other jurisdictions, including the larger City of Beaverton. The Tigard Goal 10 Population and Housing Review underscored the need for more rental units at the bottom end of the price spectrum (below$620 in 2012 dollars).This pattern is common in most communities, because those in the lowest income cohorts generally must stretch to pay for housing near the median rent price. By planning for"a variety of housing types to meet the diverse housing needs of current and future residents" in River Terrace, development will benefit residents at a wide range of income levels (Comprehensive Plan Goal 10.1). The latest Washington County Consolidated Plan, completed in 2010, identifies some areas of Tigard where low-and moderate-income households are the most prevalent (more than 46%of households earn an income of 80%of the local median family income or less).This includes one block group in the North West section of Tigard near River Terrace. Public Involvement: A public involvement plan for the River Terrace Community Plan was adopted by the Tigard Committee for Citizen Involvement in November 2012. A technical advisory committee and stakeholder working group have been formed and approved by the Tigard City Council in December 2012. Both groups held initial meetings in March 2013. A second public open house on the Community Plan was held in April 2013. The project schedule included with this application shows major public involvement activities throughout the preparation of the Community Plan. 7 Collaborations: The primary public partners that have agreed to participate in this project are Washington County, City of Beaverton, Clean Water Services,Oregon Department of Transportation,Oregon Department of Land Use and Development, City of King City, Metro,Tigard-Tualatin School District and Tigard Water District. Private stakeholders, including property owners,developers, area residents and others,will contribute in-kind as advisors throughout the project. Proposed Milestones and Deliverables: As described earlier in the Project Description section, CET grant funding is proposed for consultant created work products associated with Phase 2 of the overall work scope. This Project is unlike a traditional planning project where a final report is produced incorporating all previous work, and resulting in a single plan adopted by a local jurisdiction. Tasks proposed for this work scope result in discrete work product deliverables that all contribute to implementation of the River Terrace Community Plan We propose that the proposed milestones and deliverables be related to tasks proposed to be funded by the CET grant. We also are looking to acquire additional development land sites as they become available. On our existing land,subject to final zoning by the City of Tigard and availability of utilities, we will build apartment units, condominiums,townhomes and single family homes totaling no less than 500 units. There is 100% certainty that we will apply for development permits within 60 days of Community Plan adoption. The grant, if received,would certainly accelerate the community's efforts to ensure a well planned community and to support regional objectives. From our point of view,the grant would be a catalyst to developing our site and others in the River Terrace area. For example, our site,which is nearly 40 acres will provide over 250 homes, community parks and important infrastructure. We will be building several single family homes and townhomes surrounding a much needed community park. As I believe you are aware,the Bull Mountain-area of Tigard and River Terrace specifically lack a strong park presence. The timing for the planning of River Terrace is critical. Market demand in recent months has accelerated. The supply of homes on the other hand has not kept pace. Market forces suggest that development of River Terrace is needed today. Advancing planning efforts therefore is crucial and arguably behind the market curve. Based on communications with Tigard, we are under the impression that development could occur in 2015 after the City has completed the planning process. We will be in a position to develop the site once our approvals are in place. We anticipate that sales will be brisk. With a normal to strengthening market,we anticipate sales of 80 homes a year within our neighborhood. Based on that assumption and provided that we are able to initiate development in 2015, our neighborhood would be completed by 2018. In order to address market demand, it is imperative that the City complete its planning activities expeditiously. A grant would certainly help. The development of our site will generate measureable economic activity. The developed value of our neighborhood will exceed$75,000,000. Moreover,the site will create jobs for architects, engineers, consultants,construction tradespeople and real estate professionals. (River Terrace)since their commencement. Our current interest in the area is approximately 30 acres. With this correspondence we would like to show our support for Tigard's request of Metro CET funding. As you are aware, several significant milestones have been reached since the completion of the West Bull Mt. concept plan. With voluntary annexations in Areas 63, 64 and Roy Rogers West, the governance question has been resolved and community planning represents one final step toward completion of a process that commenced in 2002. We are now at a point where attention must be focused on some of the more detailed technical work. This includes rezoning of the plan area, master plan level service provision analysis, more in-depth transportation assessment,the development of an equitable infrastructure financing strategy, etc. Much of this work will require input from outside consultants and an award of CET dollars will help to address those costs. At completion, an adopted community plan will provide the level of certainty necessary to encourage significant private and public investments and will ultimately result in the development of a beautiful new community for our region. It is hard for us to speculate today as to timelines for development of our specific properties. However, our perception is that there is a very clear and growing demand for serviceable development ground in this area and that there is a very evident shortage of single-family lots across the region. River Terrace represents as good of a candidate as any for an opportunity to invest CET dollars where development can occur in the near term.
