Beaverton - Tigard Police Dog Selection ~
CITY OF TIGARD, OREGON INTERGOVERNMENTAL AGREEMENT Tigard Police Dog Selection This Agreement is entered into pursuant to ORS 190.003 to ORS 190.118, by and between the City of Tigard ("City"), a political subdivision of the State of Oregon, and City of Beaverton ("Agency"), a political subdivision of the State of Oregon. WHEREAS, ORS 190.010 authorizes the parties to enter into this Agreement for the performance of any or all functions and activities that a party to the Agreement has authority to perform; j WHEREAS, the City has asked the Agency to accompany the City during the City's selection of a police dog; and WHEREAS,the Agency disclaims that it is an expert in police dog selection but, out of professional courtesy and without compensation, has agreed to accompany the City during the City's selection of a police dog; THEREFORE, the parties agree as follows: 1. This Agreement shall be in effect upon the signature of both parties and shall remain in effect until June 30,2015,unless otherwise terminated or extended. This Agreement may be terminated with or without cause and at any time by a party by providing thirty (30) days'written notice of intent to the other party. 2. The parties agree to the scope of services set forth in Exhibit A,which is incorporated herein,and describes the responsibilities of the parties,including the City's payment and reimbursement of the Agency's expenses. i 3. The parties agree that both shall comply with all federal, state, and local laws and ordinances applicable to the work to be done under this Agreement.The parties agree that this Agreement shall be administered and construed under the laws of the state of Oregon. i I 4. The parties agree to comply with all applicable requirements of federal and state civil rights and rehabilitation statutes,rules and regulations in the performance of this Agreement. 5. No party is an agent or employee of the other party. 6. No party or its employees is entitled to participate in a pension plan,insurance,bonus, or similar benefits provided by any other patty. 7. The Agency expressly disclaims any representations or warranties regarding the police dog selection. 8. Subject to the limitations of liability for public bodies set forth in the Oregon Tort Claims Act, ORS 30.260 to 30.300, and the Oregon Constitution, the City agrees to hold harmless, defend, and indemnify the Agency,including its officers, employees, agents and representatives, against all claims,demands, actions,and suits (including all attorney fees and costs) arising from the Agency's performance of this Agreement,unless a claim of damages results from the sole willful misconduct of the Agency. ij i 9. Each party shall give the other irmnediate written notice of any action or suit filed or any claim made against that party that may result in litigation in any way related to this Agreement. 10. Each party shall insure or self-insure for claims within the scope of the Oregon Tort Claims Act. 11. Each party shall be solely liable for its employees'workers' compensation claims,regardless of which party is exercising supervision and control when the claim arises. 12. This Agreement is expressly subject to the debt limitations set forth in Article XI, Section 9 of the Oregon Constitution,and is contingent upon funds being appropriated therefore. 13. Both parties concur and agree that this Agreement constitutes the entire Agreement between the parties. No waiver, consent,modification, or change to the terms of this Agreement shall bind either party unless in writing and signed by both parties. There are no understandings,agreements,or representations, oral or written,not specified herein regarding this Agreement. Signatureignat Alan Orr, Chief of Police .Jeff Williams, Captain © 4-- n , IS z6u5 Date Date ii EXHIBIT A Scope Beaverton Police Officer Robert Wolfe will accompany Tigard Police Officers to the Vohn Liche Kennels located in Denver, Indiana. Officer Wolfe will share his previous experience in dog selection with the Tigard Police Officers and return to Oregon with the officers and dog.The dates of travel will be between April 20th and April 23rd2015. Payment and Reimbursement of Expenses The City of Tigard will be responsible for making all travel arrangements,including securing all necessary airline tickets,hotel rooms,and rental cars.The City of Tigard will pay for travel and lodging costs directly on behalf of Officer Wolfe. The City of Tigard will also pay for Officer Wolfe's meal requirements (per diem) according to the travel policies of the City of Beaverton.The City of Beaverton is responsible for providing Officer Wolfe with a per diem check and will submit an invoice to the City of Tigard afterwards for reimbursement.
