APPLICATION SUMMARY FILE NAME: Centrex Construction. Inc. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. MMD2015-00009 1 of 3 THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 8250 SW Hunziker Road, south of SW Hunziker Road, east of SW Hall Boulevard,and west of SW Wall Street. The 1.36 acre development site is made up of two buildings,36 parking spaces, and associated landscaping. The site is located in the Light-Industrial (I-L) zone. The subject property is an approximately 6,710 square foot industrial building that currently houses an industrial services use, Centrex Construction, Inc. The second building on site is a 12,600 square foot industrial building that currently houses a light industrial use, Horizon Distributors, Inc. There are two primary use categories present on this development site and,"when the primary uses of a development fall within different use categories,each primary use is classified in the applicable category and is subject to the regulations for that category," (1 DC 18.130.015.B). Proposal Description: The applicant is proposing to expand the office space inside an existing 6,710 square foot industrial building from approximately 1,600 square feet to 3,260 square feet.The building is located at 8250 SW Hunziker Road,and is currently an industrial services use,Centrex Construction,Inc. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.360.060.0 states that a minor modification shall be approved, approved with conditions or denied following the Director's review and as follows: 1. The proposed development is in compliance with all applicable requirements of this title;and FINDING: The applicant is proposing to expand the office space inside an existing 6,710 square foot industrial building from approximately 1,600 square feet to 3,260 square feet. There are two primary use categories present on this 1.36 acre development site and, "when the primary uses of a development fall within different use categories,each primary use is classified in the applicable category and is subject to the regulations for that category," (TDC 18.130.015.B). This review will focus on the subject 6,710 square foot Centrex Construction, Inc. building, and the applicable regulations for the industrial services use category. As described in TDC 18.130.070.C, the industrial services use category, "Contractors and others who perform services off-site are included in the Office category if equipment and materials storage does not constitute 50% or more of occupied space and fabrication or similar work is not carried out at the site." In order to avoid being categorized as an office use (which is not permitted in the I-L zone, per TDC Table 18.530.1), the new total square footage of office space must constitute less than 50% of the 6,710 square foot industrial building's space. Staff reviewed the applicant's plans and narrative to determine that the new total office space will constitute 49% of the industrial building's square footage. Therefore, the proposed modification is in compliance with applicable regulations for the industrial services use category and the I-L zone. Staff also calculated off- street vehicle parking requirements (TDC Table 18.765.2) for the 6,710 square foot building (0.8/1,000 square feet) and the 12,600 foot building (1.6/1,000 square feet) to determine that a minimum of 26 parking spaces is required. Staff reviewed the applicant's submitted site plan and found there is adequate off-street parking,with 36 spaces provided. Upon review of the proposal's plans and narrative,staff finds that all other applicable requirements are met.This criterion is met. yIN!I)2015-( )9 2of3 2. The modification is not a major modification. FINDING: Staff finds that the changes listed in TDC 18.360.050.B.1-11 are either satisfied or do not apply. Therefore,the proposed development is not a major modification.This criterion is met. CONCLUSION: The proposal is a minor modification of existing site development and is in compliance with the applicable requirements of this tide. SECTION V.
