The C-G zoning district is designed to accommodate a full range of retail, office and civic uses with a city-wide and even regional trade area. Except where non-conforming, residential uses are limited to single-family residences which are located on the same site as a permitted use. A wide range of uses,including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports,medical centers, major event entertainment, and gasoline stations, are permitted conditionally. BACKGROUND INFORMATION Site Information: The project is located at 9855 SW Walnut Place; bordered by SW Walnut Place to the south and west. The parcel, approximately .43 acres, contains two commercial buildings and associated parking lot. The parcel has 7 parking spaces. Proposal Description: The proposed minor modifications to existing development would allow construction of a 400 square foot building for a the expansion of an existing motor vehicle servicing/repair use, United Car Wash and Detail. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: The proposed change in use requires a Minor Modification to approved plans or existing development. Section 18.360.060.0 states that a minor modification shall be approved, approved with conditions or denied following the Director's review and as follows: 1. The proposed development is in compliance with all applicable requirements of this title; and FINDING: There are two issues with the proposal: Off-street Parking - The addition of floor area sometimes requires additional parking be provided. Upon review of the proposal's plans and narrative, staff finds that in accordance with TDC 18.765, the proposed use does not require additional parking. In accordance with Chapter 18.765 Off-street parking and loading requirements, the parking requirements for a motor vehicle servicing/repair is 2.0 spaces per 1,000; but not less than 4. The existing building is approximately 2,640 square feet (24 feet by 110 feet). With the 400 square foot addition, the motor vehicle servicing/repair business is required to provide 7 spaces. As demonstrated in the applicant's site plan, the proposal has 7 parking spaces. Therefore, the proposal has sufficient off-street parking and additional parking is not required. Visual Clearance Areas - The proposed building is near one of the access points and is located within the vision clearance area per the site plan. Pictures and measurements provided by the applicant show it is outside the vision clearance area. In addition, staff noted that the site plan was not accurately drawn to scale based upon aerial photos. The proposed building meets visual clearance requirements; however it should be noted that landscaping in this area is limited to three feet in height. All other applicable requirements of this title are satisfied. This includes but is not limited to building height, setbacks, and landscaping requirements. This criterion is met. FINDING: Staff finds that the changes listed in TDC18.360.050.B.1-11 are either satisfied or do not apply. Therefore, the proposed development is not a major modification.This criterion is met. CONCLUSION: The proposal is a minor modification of existing site development and is in compliance with the applicable requirements of this title. SECTION V. AGENCY COMMENTS The city's engineering department (Greg Berry; 503-718-2468) provided comments dated November 19, 2014. Mr. Berry stated that there is a five feet sewer easement from the center of the sewer pipe that extends towards the proposed building, leaving approximately 2.5' between the easement and the new building. Any excavation shall not extend into the easement. SECTION VI. An as-built drawing shows that the easement for the sewer extends 5 feet towards the building from the center of the sewer pipe. The center of the cover may not coincide with the pipe centerline,but the additional 2.5 feet should ensure the building isn't within the easement. In addition to the building, any proposed excavation should not extend into the easement. Recommendation: No excavation is permitted within 5 feet of the sewer pipe centerline. Determination request. An applicant may request approval of a modification to an approved plan or existing development by: 1. Providing the director with three copies of the proposed modified site development plan; and 2. A narrative which indicates the rationale for the proposed modification addressing the changes listed in subsection B of this section. B. Evaluation criteria. The director shall determine that a major modification(s) will result if one or more of the following changes are proposed. There will be: 1. An increase in dwelling unit density,or lot coverage for residential development; This applicant is not proposing an increase in residential density. 2. A change in the ratio or number of different types of dwelling units; This applicant is not proposing any additional dwelling units. 3. A change that requires additional on-site parking in accordance with Chapter 18.765; This applicant is not proposing any activity that will require increased on-site parking. There is more than adequate parking on and around the contiguous businesses in the existing area. Any increases to parking during inclement weather will not exceed natural increases during non-inclement weather days. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code; This minority owned small business currently offers all of the same vehicle cleaning and polishing services to the general public, year around. However, during inclement weather the detailing portion of the business decreases drastically and the small business owner financially struggles to meet payroll and rent obligations. This small business is forced to layoff local workers during the inclement weather induced slower times, and desires to retain them by offering a covered detailing business all year around. 5. An increase in the height of the building(s) by more than 20%; This building will not exceed existing building heights by more than 20 percent. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected; The contractor has verified that the "triangle" sight lines to the access and egress of Walnut Street are not affected by the proposed structure. No changes to accessways or public parking areas are affected by this proposed building. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day: The small business owner "hopes" that by offering covered detailing services to the public, fall and winter traffic will increase his business traffic by 10 cars per day. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet;Site Development Review 18.360-5 AP Update: 2/14 9. A reduction in the area reserved for common open space and/or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%; The area affected, is currently a driveway to an existing garage (that has been turned into a customer waiting room) and is currently used as the detail area, during days where weather permits. This is neither"open space" nor does it reduce "open space". 10. A reduction of project amenities below the minimum established by this code or by more than 10%where specified in the site plan: a. Recreational facilities; b. Screening; and/or c. Landscaping provisions. There are no "reductions" of recreational, screening, or landscaping proposed. The business is planning on planting bushes along a two foot by twenty foot area along the end of the new building in the existing sewer easement area, which will enhance the customer approach experience to the car wash: Also, there is a triangular area behind the existing waiting room where the owner currently stores unsightly 55 gallon drums of soap and polish that are visible from both Walnut Street and Walnut Place. The owner will be planting tall bushes (likely arborvitae) to disguise this area from street view, which will enhance the view of the area for the apartment dwellers across the street, pedestrians, and citizens merely driving by the business. New landscaping will increase by approximately of 2% of the lot. 11. A modification to the conditions imposed at the time of site development review approval which are not the subject of paragraphs 1 through 10 of this subsection. No known modifications of conditions/restrictions of the original site development review are known to the present landowners or the current business owner. C. When the determination is made.
