Staff would like to update the Planning Commission on the UFCR process background and next steps. Background In February 2010, Council directed staff to pursue a comprehensive update of the city's urban forestry related code provisions. The UFCR has followed the process in the attached diagram as further described below. CAC Process A Citizen Advisory Committee (CAC) was appointed by council to allow staff to receive input from a broad set of viewpoints during the update process. This committee included two planning commissioners, two tree board members, two parks board members, two developers (including a representative for the Home Builder's Association), one certified arborist, one natural resource advocate and one at-large citizen. In January 2011, the CAC timeline was extended to ensure ample time for the committee to discuss code topics. In finalization, the committee reached consensus on a set of guiding principles for the following four code topic areas: 1. Urban Forestry Standards for Development 2. Tree Grove Preservation Incentives 3. Tree Permit Requirements 4. Hazard Trees Staff used the guiding principles to develop and refine the draft UFCR. A public involvement plan was developed specifically for the project to provide enhanced opportunities for participation for the overall community throughout the process. This plan included outreach at city events like the Tigard Balloon Festival and Tigard Area Farmers 1 Market; an email newsletter specific to the code revisions project; open houses; and other methods for community feedback. The CAC considered community feedback in developing their guiding principles. Technical Review A Technical Advisory Committee (TAC) was formed at the same time as the CAC. The TAC included city staff and representatives from outside agencies to advise the project management team on the technical aspects of the code during the update process. The draft urban forestry code was also peer reviewed by outside development and urban forestry experts in October 2011 to provide additional assurance of technical soundness. Consultants tested the draft code on actual development projects to identify issues for further refinement in advance of the approval process. Input Process Staff has been gathering and evaluating input on the draft code from the community and technical experts during the input process. This has involved further refinement of the draft code from a technical and legal standpoint. However, staff has been careful to ensure any changes to the draft code are consistent with the guiding principles developed by the CAC. A community wide open house was held in December 2011 to receive input and answer questions on the draft code in advance of the Planning Commission and Council approval process. Advance notice of the community wide open house was provided to every Tigard resident and property owner. Advance notice of the approval process will be provided to every Tigard property owner as required by state law (Measure 56). The Measure 56 notice is required to say adoption of the proposed code "may affect the permissible uses of your property." Next Steps Approval Process From this collaborative process will emerge the staff-proposed draft to the Planning Commission at a workshop scheduled for January 16, 2012. Staff will summarize the previous steps in the process, answer questions, and receive preliminary Planning Commission feedback at the workshop. Following the workshop, Planning Commission will hold a public hearing on February 6, 2012 and consider recommending Council adoption of the UFCR. On March 20, 2012, staff is tentatively scheduled to present on the UFCR project at a Council workshop. Following the Council workshop, Council is scheduled to hold a public hearing on the adoption of the UFCR on April 24, 2012. This timeline assumes single meetings for both the Planning Commission and City Council public hearings. If additional dates are needed, this timeline will likely shift. CITY OF TIGARD PLANNING COMMISSION Meeting Minutes December 19,2011 CALL TO ORDER President Walsh called the meeting to order at 7:02 p.m.The meeting was held in the Tigard Civic Center,Town Hall, at 13125 SW Hall Blvd. ROLL CALL Present: President Walsh Vice President Anderson Commissioner Doherty Commissioner Muldoon Commissioner Rogers Commissioner Schmidt Commissioner Shavey Absent: Commissioner Hasman; Commissioner Ryan Staff Present: Susan Hartnett, Assistant Community Development Director; Doreen Laughlin, Executive Assistant; Tom McGuire,Principal Planner;Todd Prager, Associate Planner/Arborist Also Present: Calista Fitzgerald, incoming Planning Commissioner;Andrew Miller and Dianne Armstrong, incoming Alternate Commissioners. COMMUNICATIONS—President Walsh noted that Commissioner Stu Hasman was not present due to business reasons and also noted that this would have been the last official Planning Commission meeting that he would have attended. He said that Commissioner Hasman would be very much missed by the commission and acknowledged the many years of excellent service that Commissioner Hasman had devoted to the city. President Walsh then introduced the three visitors present as the incoming commissioners; one voting member, and two alternates. He advised the commissioners that these individuals hadn't been officially appointed yet but that they were on the consent agenda of the City Council for the upcoming meeting scheduled for the next night (December 20). He welcomed the incoming commissioners and said they would be officially introduced at the January 9th meeting. CONSIDER MINUTES November 21st Meeting Minutes: President Walsh asked if there were any additions, deletions, or corrections to the November 21st minutes; there being none, Walsh declared the minutes approved as submitted. Page 1of4 UPDATE —URBAN FORESTRY CODE REVISIONS PROCESS Todd Prager, Project Manager for the Urban Forestry Code Revisions project, gave a brief update on the process. He explained the public engagement that had occurred to this point including the Balloon Festival; the Farmer's Market; a project website; opportunities for on-line comments; an email newsletter; three open houses; and Cityscape articles that had gone out to all Tigard residents, keeping them in the loop. He said the culmination of all these activities was that the Citizen Advisory Committee (CAC) had reached consensus through the set of guiding principles which explain the main elements of each code topic. He noted they represent a compromise view between the diverse interests that were on that citizen committee. The CAC physically signed off on each of those guiding principles and were successful in that every member agreed they were comfortable with the way the city was pursuing the future for the Urban Forestry Code. There was also a technical review. Part of the technical review involved a peer review by outside development in urban forestry experts hired to test the draft code on a range of actual development projects. Overall, the results of the peer review showed that the draft code meets the policy intent of the groups that worked on the code. There were a few minor technical issues identified through that peer review which were very helpful. Those issues have since been corrected in the code. Todd went on to tell the commissioners about the successful recent open house. He said the comments had been mainly focused on just minor"tweaks" of language within the code, but no major negative comments were heard such as "Hey—we think this is the wrong direction for the city to go in." Three adoption volumes will be presented to the commission at the workshop on January 9th the volumes will include a summary of the project background, the Citizen and Technical Committee process; the deliberations of those committees including discussions they've had and some of the major issues that they went back and forth on; also what the decisions were on those key issues. At the workshop there will be the opportunity to learn more about the code revisions. The public hearing is scheduled for February 6, 2012.Advance notice of the public hearing will be provided to every property owner within Tigard.Todd explained that this is required by state law, Measure 56. That notice is required to state "The adoption of the proposed code may affect the permissible uses of your property." Todd noted that staff has been preparing the community for this notice. An effective Pre-Measure 56 notice was sent out in advance of the Open House held on December 6. The pre-notice explained that the purpose of the notice they would soon be receiving is to engage the public in the process. Staff is tentatively scheduled to present the project to City Council March 20th at a workshop and then following the council workshop, the Public Hearing on this is tentatively scheduled for April 24th. One of the commissioners wondered what the level of interest was on the part of the citizens, i.e. what will be the "hot topics" —that type of thing. Todd answered that the input received at the open house was focused on property specific questions such as "How would this code Page 2 of 4 apply to my property?" Or "I have a tree I'd like to cut down—how would the code regulate that situation?" A lot of it was answering those types of questions rather than hearing "I don't like what I'm seeing in the code." Todd said "There wasn't an overwhelming flood of people at the recent open house. Earlier in the process there was quite a bit more public engagement as far as people being interested in saying what they felt the code should look like. We kept hearing about the need for flexibility and incentives, rather than punitive measures, and the citizen committee reflected that in their recommendations. As we moved through the process, I believe people were feeling more and more satisfied that their concerns had been heard and addressed and that they were feeling comfortable with the direction the city was taking." The question was asked as to whether written comments had come in. Todd answered that those comments had tapered off as the process went on. He said the likely comments that will come before the Planning Commission will be from the Homebuilders Association. He'd heard they were happy with the general policy direction of the code, but that there are some aspects they feel could be tweaked to facilitate development a bit more. The commissioners said they'd like to have staff explain to them and make it clear in their minds what exactly is in the jurisdiction of the Planning Commission with regard to this. Susan Hartnett, Assistant Community Development Director, said a big part of the January 9th meeting will be breaking down the three documents (Volume I, II, & III —giving a roadmap — where to look for the detail "on this idea" or "how this concept played out." She said they'll have about a month between the workshop and the public hearing to review it. There would not be a second discussion prior to the public hearing but staff would be available to the commissioners should they have questions or need additional information. UPDATE —3RD HCT LAND USE PLAN UPDATE Senior Transportation Planner,Judith Gray, introduced herself and said she's here to give the third update, and the fourth presentation, on the High Capacity Transit Land-Use Plan. She said they'd passed a milestone in that in November the Citizen's Advisory Committee (CAC) completed their work and advanced their final recommendation for the High Capacity Transit (HCT) Land Use Plan. She said she would be updating the commissioners as to where that process is and how it's going to be moving forward in the Regional Southwest Corridor. She would not be presenting the actual report this evening- as that will happen later when the consultant comes in February.Judith presented a PowerPoint presentation (Exhibit A) to the commission. She briefly reviewed the past activities in the Land Use Plan, and gave an overview of the final project report and how it will be used. Judith explained to the commission that, based on interviews and existing conditions analysis and working with the CAC, the team developed a "Typology" for Tigard: Town Center/Main Street; Employment/Retail; Transit Neighborhood; and Corridor. She noted that 2012 will be a very busy year. Because Tigard has completed the Land Use Plan,we: • are better prepared for 2013 actions;we have had many community conversations; and Page 3 of 4 • have an opportunity to focus on the Regional work, including the evaluation of alternatives and trade-offs. She noted that so far as local plans go—Tigard is ahead of other cities in that this was done in 2011. There will just be some refinement needed to finalize it while other cities will just be beginning to develop their plans in 2012. The next steps will include ongoing public involvement for Tigard through the regional process. On January 30th there will be a kick-off called "Tigard Connects" at the library. Details are being developed and invitations will be going out soon. On February 21 the consultant will present the final draft plan in a joint meeting of Planning Commission and City Council. Based on the feedback they receive at that meeting, they'll be giving the final report by March 30th. The action that staff will ask for from the City Council on this plan will be to "accept" the land-use plan—not to adopt it. There won't be any policy changes, but rather an acknowledgement that the work of the Citizen's Advisory Committee has been completed and that we now have this in our hands to move forward into the regional process. BRIEFING—COMMUNITY DEVELOPMENT ORGANIZATIONAL CHART Susan Hartnett, Assistant Community Development Director, reminded the commissioners that at the last meeting they'd asked staff to bring an updated organization chart and go over it with them. She walked them briefly through the Org Chart (Exhibit B) and explained why some of the changes had taken place. OTHER BUSINESS—None.
