The R-7 zoning district is designed to accommodate attached single-family homes, detached single-family homes with or without accessory residential units, at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. Mobile home parks and subdivisions are also permitted outright. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: The applicable Community Development Code Chapters for the proposed modification is 18.790. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request.The findings and conclusions on which the decision is based are noted in Section IV. MMD2014-00021 Lukar Ridge UFP Modification Page 1 of 3 SECTION III. BACKGROUND INFORMATION Site History: The site was initially developed with a single-family dwelling built in 1940 and several outbuildings. SUB2013-00001 approved a six-lot subdivision of a 1.25-acre property located north of SW Fern Street, east of SW Windsong Court, and extending SW Lukar Court. In addition, adjustments to the minimum residential density requirements (from a minimum of 7 lots to 6 lots) and to the street improvement requirements for cul-de-sac length (from a maximum of 200 lineal feet to 210 lineal feet) were approved. Site Information and Proposal Description: The applicant proposes to modify the Urban Forestry Plan approved under SUB2013-00001. The modifications include removing two trees planned for preservation that conflict with the proposed siting of single family dwellings. Vicinity Information: The site is zoned R-7 with R-7 to the north and east and R-7(PD) to the west and south across Fern. The neighborhood is primarily single-family dwellings on 5,000 square foot developed lots to the north and west. In contrast, the areas to the east and south are characterized by forested north facing slopes of Bull Mountain and dotted with five islands of unincorporated Washington County, commonly known as the "Fern Street Islands." SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Urban Forestry (18.790) 18.790.030 Urban Forestry Plan Requirements A. Urban forestry plan requirements. An urban forestry plan shall: 1. Be coordinated and approved by a landscape architect (the project landscape architect) or a person that is both a certified arborist and tree risk assessor (the project arborist), except for minor land partitions that can demonstrate compliance with effective tree canopy cover and soil volume requirements by planting street trees in open soil volumes only; 2. Meet the tree preservation and removal site plan standards in the Urban Forestry Manual; 3. Meet the tree canopy site plan standards in the Urban Forestry Manual; and 4. Meet the supplemental report standards in the Urban Forestry Manual. The application included a revised Urban Forestry Plan Supplemental Report (August 27, 2014) by Morgan Holen, the project arborist, a certified arborist and tree risk assessor. The revised plan meets the tree preservation and removal site plan standards, the tree canopy site plan standards, and the supplemental report standards in the Urban Forestry Manual as attested to by the project arborist. 18.790.070 Modification to the Urban Forestry Plan Component of an Approved Land Use Permit C. Application procedures. Modifications to the urban forestry plan component of an approved land use permit that are not exempted by subsection B of this section shall be processed as a Type I procedure, using approval criteria contained in subsection D of this section. The proposed modification to the Urban Forestry Plan Component of SUB2013-00001, Lukar Ridge Subdivision, does not meet any of the exemptions of subsection B and therefore shall be processed as a Type I procedure using the following approval criteria: D. Approval criteria. The director shall approve the modification to the urban forestry plan component of an approved land use permit upon determining: MMD2014-00021 Lukar Ridge UFP Modification Page 2 of 3 1. Tle project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The project arborist has provided a report and statement (Supplemental Report,dated August 27, 2014) certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification. Tree 10189 shown on Lot 6 appears to the arborist to be progressively declining and is not a suitable long-term amenity and is recommended for removal. Tree 10506 on Lot 3 is also recommended for removal as the proposed house and landscaping of a useable rear yard are in conflict with the preserved tree. This criterion is met. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The project arborist has provided a revised report and statement (Supplemental Report, dated August 27, 2014) certifying that there is no practicable alternative to the proposed modification. This criterion is met. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan,compliance with Section 18.790.030. As shown above, the revised urban forestry plan complies with Section 18.790.030. This criterion is met. FINDING: As shown in the analysis above, the proposed modification to the urban forestry plan component of SUB2013-00001 meets the applicable approval criteria and can be approved. SECTION V. The February 27, 2013 arborist report recommended preservation of two of eight non-hazardous and viable trees measuring larger than 12-inches in diameter.The City's previous tree code required mitigation for two-thirds of trees larger than 12-inches in diameter to be removed for construction based on 25% retention of existing trees over 12-inches in diameter. The previous tree code provided the option of replanting of suitable trees on site or in an approved location in the city, or payment in lieu. The 2013 arborist report noted that the specific mitigation option would be decided later, but stated that 109 diameter inches would require mitigation, which was equivalent to planting 55 trees of 2-inch caliper or payment in lieu of approximately$13,625, based on a cost of$125 per inch removed. Now,the two trees planned for preservation are recommended for removal. Under the City's new tree code, a minor modification to an existing tree plan requires a Type I land use decision. This Urban Forestry Plan demonstrates compliance with Section 18.790.030 of the current code and satisfies the approval criteria of Section 18.790.070.D. General Description The site is currently under construction.The trees originally planned for removal have been removed and the two trees planned for preservation (plus two trees located on a neighboring property to the west) have been satisfactorily protected.The trees located on neighboring property will continue to be protected, but the two on-site trees are recommended for removal. A complete description of individual trees located on and adjacent to the project site is included in the enclosed existing tree inventory (attachment A). The previously approved tree plan did not account for the circumstances leading to the proposed modifications. • Tree 10189,an 18-inch diameter Douglas-fir(Pseudotsuga menziesii) located on lot 5 near the western property boundary, was originally noted as being in fair condition with an irregular crown. This tree remains in fair condition, but with reduced vigor,small needles, and a relatively thin crown.Tree 10189 appears to be progressively declining and is not a suitable long-term amenity. Removal is recommended because of its condition. • Tree 10506, a 42-inch diameter Douglas-fir located on lot 6 was originally noted as being in fair condition, having been topped in the past and having multiple new tops. This tree is physiologically sustainable, but has structural defects including an asymmetrical crown to the west. At the time of original tree plan submittal, the exact house to be built on this lot was not Urban Forest Plan—Supplemental Report 14235 SW Fern Street,Tigard,Oregon Page 2 known and the tree was to be protected with tree protection fencing at the dripline. Now, the house plans have been submitted and extensive grading is required within the dripline area in order to construct the home and create a useable backyard. Removal is recommended for the purposes of construction and landscaping. Tree 10189 is not suitable for retention and tree 10506 must be removed to accommodate the proposed building on lot 3.There are no practicable alternatives to the proposed modification. Effective Tree Canopy Cover In order to comply with the City's new Urban Forestry Plan requirements, 16 new trees are proposed for planting, including seven street trees along Fern Street, five street trees along Lukar Court, and four trees to be planted on each of lots 2, 3, 4 and 5. In addition,Tract A will be planted with a mix of native species per Clean Water Services requirements. A summary of the effective tree canopy cover by lot and across the overall development site is included as attachment B. Attachment C provides the planted tree inventory. Lot 1 is 6,460 square feet and has 27%effective tree canopy cover. Lot 2 is 9,760 square feet and has 34%effective tree canopy cover. Lot 3 is 7,258 square feet and has 46%effective tree canopy cover. Lot 4 is 5,318 square feet and has 17%effective tree canopy cover. Lot 5 is 5,255 square feet and has 64% effective tree canopy cover. Lot 6 is 10,055 square feet and has 34%effective tree canopy cover.Tract A is 3,602 square feet and has 101% effective tree canopy cover. The minimum required effective tree canopy for each lot is 15%;therefore,the effective tree canopy cover requirement is met for each lot. The overall development site is 47,708 square feet and has 41.4% effective tree canopy cover.The minimum required effective tree canopy for the overall development site is 40%;therefore, the effective tree canopy cover requirement for the overall development site is also met. The Tree Preservation and Removal Site Plan and Tree Canopy Site Plan are enclosed as attachments D and E as required by Section 10 of the Urban Forestry Manual, which illustrate how the Urban Forestry Plan requirements are met. Street Trees The required number of street trees is based on the linear right-of-way frontage divided by 40.The frontage along Fern Street and Lukar Court is approximately 219.12 and 249.39 linear feet respectively. Therefore six street trees are required at Fern Street and seven street trees are required at Lukar Court. However, in order to comply with the street tree planting standards in Section 2 of the Urban Forestry Manual, seven street trees are proposed along Fern Street and five street trees are proposed along Lukar Court.The total number of required street trees is 13, but 12 are proposed for planting in order to comply with the City's planting standards. Pursuant to 18.745.040, in cases where it is not practicable to provide the minimum number of street trees,a payment in-lieu is required at a cost of$537 per tree. Since it is not practicable to plant one fewer street tree than is required, the applicant shall owe$537 as payment-in-lieu of planting. A minimum of 500 cubic feet of soil volume per street tree is available, which satisfies the street tree soil volume standards in Section 12 of the Urban Forestry Manual for right-of-way widths over 10 and up to 12 feet. Urban Forest Plan—Supplemental Report 14235 SW Fern Street,Tigard,Oregon Page 3 Specifications The two neighboring trees shall continue to be protected throughout construction and landscaping. A. Tree Protection Specifications 1. Tree Protection Zone.The project arborist shall designate the Tree Protection Zone (TPZ). Where feasible,the TPZ shall be established at the dripline of protected trees as a minimum. If infrastructure must be installed closer to the trees,the TPZ may be established within the dripline area if the project arborist determines that the trees will not be unduly damaged. The location of the TPZ shall be shown on construction drawings. 2. Protection Fencing.All trees to be retained shall be protected by orange plastic construction fencing or other fencing as approved by the project arborist. Protection fencing shall be secured to steel posts placed no further than 8-feet apart and shall be installed at the edge of the TPZ. 3. Pruning.The project arborist can help identify if and where pruning is necessary once trees recommended for removal have been removed and the site is staked and prepared for construction. Pruning shall be performed by a Qualified Tree Service. 4. Tree Protection Zone Maintenance.The protection fencing shall not be moved, removed,or entered by equipment except under direction of the project arborist. 5. Storage of Material or Equipment.The contractor shall not store materials or equipment within the TPZ. 6. Excavation. Excavation within the TPZ shall be avoided if alternatives are available. If excavation within the TPZ in unavoidable,the project arborist shall evaluate the proposed excavation to determine methods to minimize impacts to trees. All construction within the TPZ shall be under the on-site technical supervision of the project arborist. 7. Tree Protection Inspection.The project arborist shall inspect and verify the location of protection measures prior to construction, monitor tree protection measures regularly,and provide biweekly written reports to the City during periods of active construction. 8. Final Report.After the project has been completed, the project arborist shall provide a final report that describes the measures needed to maintain and protect the remaining trees. B. Soil Characteristics and Specifications for Improvement Native soils at the project site consist of somewhat poorly drained Cascade silt loam (^'65%) and moderately well drained Cornelius and Kinton silt loans (-35%). They are both capable of supporting healthy tree growth with proper site preparation at planting locations. Amended top soil shall be used at all planting locations. In addition, prior to planting along Fern Street, the landscape contractor shall remove all debris from planter areas,excavate to a minimum depth of 36-inches,and place suitable amended topsoil as determined by the landscape contractor.The landscape contractor shall provide soil amendment plans to the City for approval prior to beginning tree installation. If the landscape contractor determines that Urban Forest Plan—Supplemental Report 14235 SW Fern Street,Tigard,Oregon Page 4 irrigation is necessary for successful establishment of new trees,the landscape contractor shall provide irrigation plans to the City for approval prior to beginning irrigation installation. C. Tree Planting Specifications New trees that are planted to meet the effective canopy requirements shall conform to the applicable standards in the Tigard Urban Forestry Manual. They shall be planted in accordance with the American National Standards Institute (ANSI)standards for tree planting(A300, Part 6)and additional standards adopted by the Oregon Landscape Contractors Board. Nursery stock shall meet the requirements of the American Association of Nurserymen for nursery stock(ANSI Z60.1)for Grade No.1 or better. Double stake trees if needed for stability. Install root barriers per manufacturer specifications where indicated on the Tree Canopy Site Plan.
