DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request for lot line adjustment LLA2014-00001 and LLA2014-00002 subject to conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITIONS OF APPROVAL THE FOLLOWING CONDITIONS SHALL BE SATISFIED: UNLESS OTHERWISE NOTED, THE STAFF CONTACT SHALL BE CHERYL CAINES IN THE PLANNING DIVISION AT 503-718-2437. 1. The applicant shall provide evidence to the City that a conveyance instruments conforming to the approved lot line adjustments has been recorded at Washington County. 2. The applicant shall file a record of survey with Washington County as required by Oregon Revised Statutes Chapter 92. Following recording, the applicant shall provide evidence to the City that the survey map was recorded within 18 months of this decision. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION This is a combined review and decision for two lot line adjustment applications in the same location. Because the lot line adjustments involve a common property they are being processed together in a single staff report. The proposal seeks to enlarge Parcel 2 through two separate lot line adjustments. The first (LLA2014-00001) will adjust the property lines between Parcels 1 and 2 resulting in a smaller side and rear yard for the home on Parcel 1. The second (LL.A2014-00002)will adjust the property line between Parcels 2 and 3 resulting in a smaller side and rear yard for the home on Parcel 3. The adjusted parcel sizes will be: Parcel 1 — 10,095 square feet, Parcel 2— 128,031 square feet and Parcel 3 - 9,672 square feet. The subject site is located within a residential neighborhood. The properties involved and surrounding areas are developed with single-family homes of various ages. -Zoning in the area is R-4.5: Low Density Residential. Staff conducted a search of City records for the subject properties and found pre-application meetings for possible subdivision of the lots in 2006 and 2013. A Lot Line Adjustment (MIS94-000) was approved in 1994 adjusting the property line between 9720 SW Frewing Street (Parcel 1 — tax lot 500) and 9700 SW Frewing Street(Parcel 2—tax lot 600) to make tax lot 600 larger. According to Washington County Assessment and Taxation, a survey was filed for the 1994 lot line adjustment, but the names on the recorded deed failed to match the vested owners of the adjacent taxlot 600. Therefore, the adjusted area could not be consolidated with tax lot 600 and a separate tax lot was created (501). The applicant originally requested adjusting the line between tax lots 500 and 501. Because tax lot 501 was not created through a partition process, it was not considered a legal lot of record and could not be adjusted. That consolidated tax lot is now Parcel 2. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No new lots will be created as part of this adjustment; three (3) lots exist and three (3) lots will remain after the proposed adjustments. The R-4.5 zone has a minimum lot size of 7,500 square feet. The proposed lots will be 10,095, 128,031 and 9,672 square feet after the adjustment. Therefore, this criterion is met. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; The proposed lots will meet the development regulations of the R-4.5 zone as shown in the table below. The proposal only impacts the lot size, lot width, rear and side yard setbacks. Other standards are not applicable to this proposal. "Therefore, this criterion has been satisfied. Parcels 2 & 3 front both SW Frewing Street and SW Ash Avenue; therefore no flag lots are created. This criterion is satisfied. With regard to flag lots: • When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. • A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The proposed lot line adjustments do not involve flag lots. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. No new accessways are being created with this application. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. A common drive is not proposed. The existing homes on all three parcels will continue to utilize individual access drives until the sites are redeveloped. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. No new accessways are proposed with this application. Each site will continue to have access to SW Frewing Street or Ash Avenue. The purpose of the proposed lot line adjustment is to create a smaller lot for an existing residential dwelling on Tax Lot 100. This application includes the required materials for a property line adjustment application, including: • An original and one (1) copy of the signed application form, including owner's signature (see Exhibit A) • Ownership documentation (see Exhibit A) • Filing fee (see Exhibit A) • Two (2) copies of preliminary site plan (see Exhibit B) • Two (2) copies as this memo, which serves as Applicant's Statement This application is submitted as a Type I procedure. The proposed lot line adjustment complies with Tigard Development Code Section 18.410.040 (Lot Line Adjustment Approval Criteria), as demonstrated below. No variance from the applicable standards is needed or requested. 18.410.040 Approval Criteria A. Approval criteria. The Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; 12564 SW Main Street,Tigard,OR 97223• [T]503-941-9484[F]503-941-9485 Response: No additional parcels are created by the proposed lot line adjustment. The size of existing Tax Lot 100 will be reduced as a result of the proposed lot line adjustment. The size of both parcels will exceed the minimum lot size of 7,500 square feet. As shown on the attached preliminary site plan (see Exhibit B), the resulting size of Tax Lot 600 will be 96, 956 square feet. The resulting size of Tax Lot 100 will be 9,787 square feet. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Response: As described above, the size of Tax Lot 100 is reduced with the proposed lot line adjustment. As shown on the attached preliminary plans, Tax Lot 100 and its existing dwelling will be able to comply with the standards of the R-4.5 District. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation; c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and d. Setbacks shall be as required by the applicable zoning district. Response: As shown on the attached preliminary plans, both parcels will be able to meet the minimum width for the building envelope, minimum lot area, and setbacks of the R-4.5 District. Lots retain adequate access as each lot fronts a public right-of-way by at least 15 feet. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within 10 feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Response: No flag lots exist or are proposed within the subject site. This standard is not applicable. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. Response: The proposed lot line adjustment does not create or alter any accessways. No changes are proposed to driveway access to the existing dwelling within Lot 100. Additionally, each lot fronts a public right-of-way by at least 15 feet. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. Response: No common drives are proposed. This standard is not applicable. 7. Any accessway shall comply with the standards set forth in Chapter 18.705, Access, Egress, and Circulation. Response: Per Section 18.705.020(A), Access, Egress and Circulation Standards apply to development including the construction of new structures, the remodeling of existing structures, and to a change of use that increases the on-site parking or loading requirements or that changes access requirements. The proposed lot line adjustment does not involve any development meeting this definition. Therefore, Chapter 18.705 is not applicable. B. Exemptions from dedications. A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. Response: This is an application for a lot line adjustment. Therefore, this request is exempt from floodplain, greenway, and right-of-way dedication. C. Variances to development standards. An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370, Variances and Adjustments. Response: As demonstrated by this report and the attached preliminary plans (see Exhibit B), the proposed lot line adjustment complies with the standards of Chapter 18.410. No variances or adjustments per Chapter 18.370 are needed or requested. Conclusion In summary, no lots are created by the proposed lot line adjustment. Tax Lots 100 and 600 will continue to comply with the lot size, lot dimension, and setback requirements of the R-4.5 District.
