APPLICATION SUMMARY FILE NAME: Alberta Rider Elementary CASE NO.: Minor Modification (MMD) MMD2014-00022 PROPOSAL: The proposed minor modifications to a conditional use would allow the construction of a shelter area and shed, approximately 760 square feet, located in a grassy area north of the school. The new building would provide an outdoor classroom area. The R-7 zoning district is designed to accommodate attached single-family homes, detached single-family homes with or without accessory residential units, at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. Mobile home parks and subdivisions are also permitted outright. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.330.020.C.3 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. BACKGROUND INFORMATION Site Information: The project is located at 14850 SW 132"d Terrace; bordered by SW Bull Mountain Road to the north and SW 132nd Terrace to the west. The site is developed with Alberta Rider Elementary School through a conditional use permit, CUP2003-00012. The site is approximately 9.25 acres in size. The site includes the school building and other site improvements such as landscaping and an associated parking lot on the south portion of the property. The north portion is developed with a log cabin and accessory buildings. Proposal Description: The proposed minor modifications to a conditional use would allow the construction of a shelter area and shed,approximately 760 square feet,located in a grassy area north of the school. The new building would provide an outdoor classroom area. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: The proposed site improvements will modify the existing conditional use on the site. Therefore, compliance with applicable development standards must be demonstrated. MINOR MODIFICATION OF APPROVED OR EXISTING CONDITIONAL USE: Section 18.330.020.C.3 states a Minor Modification shall be approved, approved with conditions, or denied following the Director's review based on the following findings: 1. The proposed development is in compliance with all applicable requirements of this title. FINDING: Upon review of the proposal's plans and narrative, staff finds that all applicable requirements of this title are satisfied. 2. The modification is not a major modification. FINDING: Staff finds that the changes listed in TDCI8.360.050.B.1-11 are either satisfied or do not apply. Therefore, the proposed development is not a major modification.This criterion is met. CONCLUSION: The proposal is in compliance with the applicable requirements of this title and is a minor modification of existing conditional use. SECTION V.
