Notice is hereby given ven that the City of Tigard Community Development Director's designee has
APPROVED the above request subject to certain conditions of approval. The findings and conclusions
on which the decision is based are noted in Section IV.
1. Prior to October 31, 2014, the applicant shall stripe the required 21 parking spaces. The
parking spaces shall meet the space and aisle dimensions standards as stated in Figure 18.765.1
THIS APPROVAL SHALL BE VALID FOR 18 MONTHS
FROM THE EFFECTIVE DATE OF THIS DECISION.

SECTION III. BACKGROUND INFORMATION
Site Information:
The project is located at 7325 SW Bonita Road; midblock between the railroad tracks and SW 72nd
Avenue. The site is approximately 1.28 acres and contains one commercial buildings and site
improvements that include landscaping and associated parking lot. The site contains a large parking
area;however, the spaces are not clearly marked.
Proposal Description:
The proposed minor modifications to existing development would allow a new motor vehicles sales
and rental use, Luxury Sport Autos. The space, approximately 20,500 square feet in size, is changing
from an industrial services use to a motor vehicles sales and rental use. No interior or exterior changes
to the building are proposed.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW:
The proposed change in use requires a Minor Modification to approved plans or existing
development. Section 18.360.060.0 states that a minor modification shall be approved,
approved with conditions or denied following the Director's review and as follows:
1. The proposed development is in compliance with all applicable requirements of this
title; and
FINDING: Upon review of the proposal's plans and narrative, staff finds that in accordance
with TDC 18.765, the proposed use does not require additional parking.
In accordance with Chapter 18.765 Off-street parking and loading requirements, motor
vehicles sales and rental uses are calculated at a rate of 1.0 parking space per
1,000 square feet,while an industrial service uses are calculated at the rate of 0.8
spaces per 1,000 square feet. Therefore, the new tenant is required to provide
21 off-street parking spaces while the industrial services uses was required to
provide 17 spaces. The parking spaces are not clearly marked; however, from
the aerial photo provided it is clear that the site can accommodate the required
21 spaces. Therefore, the applicant shall be required to stripe the required 21
parking spaces.
All other applicable requirements of this title are satisfied. This includes but is
not limited to building height, setbacks, and landscaping requirements. This
criterion is met.
2. The modification is not a major modification.
FINDING: Staff finds that the changes listed in TDC18.360.050.B.1-11 are either satisfied
or do not apply. Therefore, the proposed development is not a major
modification. This criterion is met.
CONCLUSION: The proposal is a minor modification of existing site development and is in
compliance with the applicable requirements of this title.

Luxury Sport Auto has reached an agreement to lease the building located at 7325 SW Bon t (td,�'�`ia�+�dr�EERING
OR 97205. We are an internet sales auto dealership that has been in business for over 10 years.
Currently, we have four employees and keep an inventory of approximately 50 vehicles. Vehicles are
sold via internet advertising and customer referrals. All vehicles for sale are stored inside the
warehouse.There will be no change to the structure to operate this business. Below the answers to the
following questions will show that this will be a Minor Modification.
360.050 Major Modification(s) to Approved Plans or Existing Development
A. Determination request.An applicant may request approval of a modification to an approved plan or
existing development by:
1. Providing the director with three copies of the proposed modified site development plan; and
2. A narrative which indicates the rationale for the proposed modification addressing the changes
listed in subsection B of this section.
B. Evaluation criteria. The director shall determine that a major modification(s) will result if one or
more of the following changes are proposed. There will be:
1. An increase in dwelling unit density, or lot coverage for residential development; (No Change)
2. A change in the ratio or number of different types of dwelling units; (No Change)
3. A change that requires additional on-site parking in accordance with Chapter 18.765; (Property
currently has 24 marked parking spaces(See Attached Pictures). There is no change needed because the
property already has the required parking (1 spot via 1,000 sqft for Auto Sales use)
4. A change in the type of commercial or industrial structures as defined by the Uniform Building
Code; (No Change)
5. An increase in the height of the building(s) by more than 20%;(No Change)
6. A change in the type and location of accessways and parking areas where off-site traffic would
be affected; (No Change)
7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed
100 vehicles per day; (No Change)
8. An increase in the floor area proposed for a nonresidential use by more than 10%excluding
expansions under 5,000 square feet; (No Change)
9. A reduction in the area reserved for common open space and/or usable open space which reduces
the open space area below the minimum required by this code or reduces the open space area by

10. A reduction of project amenities below the minimum established by this code or by more than

The total square footage of the building is 20,500. The previous use was by a company called Horizon. They
were commercial electrical contractors. The stripes for the spaces on the west side of the building did not show
up well in the pictures. However, they are a little faded. I wouldn't have a problem having them re-striped as a
condition for the approval. There was a total of 24 spaces. Just let me know if you have any other questions.
We are really excited to move forward with our new building.

building? The site plan that you provided does not show the spaces clearly marked, if they are not striped you will be
