NOTICE OF TYPE II DECISION Apfr. HOME OCCUPATION PERMIT (HOP) 2004-00130 CITY OF TIGARD CHARETTE HOME OCCUPATION CommunityDeveropment Shaping A Better Community DBA: SHAWN'S DOG GROOMING 120 DAYS = 2/23/2005 SECTION I. APPLICATION SUMMARY FILE NAME: CHARETTE HOME OCCUPATION FILE NO.: Home Occupation Permit (HOP) HOP2004-00130 APPLICANT: Shawn and Edward Charette OWNER: Same 8280 SW Fanno Creek Drive Tigard, OR 97224 PROPOSAL: The applicant requests approval for a Type II Home Occupation permit to allow a dog grooming business. The applicant has indicated that there will be occasional clients visiting the site (approximately 3 per day), no outside employees, and no exterior signage. The applicant has proposed that the hours of operation will be between 10 AM to 4:30 PM. COMPREHENSIVE PLAN DESIGNATION: Medium Density Residential. ZONING DESIGNATION: R-7. The R-7 zoning district is designed to accommodate attached single-family homes, detached single-family homes with or without accessory residential units, at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. Mobile home parks and 'subdivisions are also permitted outright. Some civic and institutional uses are also permitted conditionally. LOCATION: 8280 SW Fanno Creek Drive, WCTM 2S112BB, Tax Lot 07700. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.385, 18.390, 18.510 and 18.742. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. HOP2004-00130/TYPE II CHARETTE HOME OCCUPATION PAGE 1 OF 6 CONDITIONS OF APPROVAL UNLESS OTHERWISE NOTED, THE STAFF CONTACT SHALL BE MORGAN TRACY IN THE PLANNING DIVISION AT (503) 639-4171. 1. All Home Occupation standards discussed in this decision and detailed in the Tigard Development Code Chapter 18.742 must be complied with at all times. 2. There shall be no signs for the Home Occupation, without reapplication through the Type II Home Occupation process. 3. The applicant shall note that the property is subject to CC&R's that may limit or restrict the proposed use. The City's approval does not constitute a waiver of those requirements. 4. The applicant shall park any vehicles, including trailers, in the driveway or garage. Likewise, clients shall be directed to park in the driveway. 5. The applicants will be required to sign an acknowledgement that they understand and will abide by the home occupation rules and these additional conditions. If the City receives repeated complaints, the operation may be required to cease, until such time that proper measures can be implemented to prevent further violations. SECTION III. PUBLIC COMMENTS RECEIVED The City mailed notice to property owners within 500 feet of the subject site providing them an opportunity to comment. The City received numerous letters and emails regarding the request. Most of these pertained to the fact that Colony Creek Estates does not allow home based businesses pursuant to their Covenants, Conditions, and Restrictions (CC&R's). RESPONSE: CC&R's are essentially a private agreement between the seller of property and the purchaser. They can address issues such as street maintenance, architectural style, paint colors, and any other sorts of controls that the seller deems necessary (provided such restrictions do not violate one's constitutional rights). The City is not party to this private agreement, and is therefore not able to base its decisions on provisions within the CC&R s. For instance, some CC&R's require a minimum size house be built on property, but the City could not require through its building permit process that a house be a certain size, so long as the house met all other State Building and Local Zoning codes. Similarly, the City cannot deny the home based business, provided it meets all the criteria identified in this report. The homeowner's association is empowered to enforce the CC&R's by seeking an injunction or other corrective action, but the City cannot. Other concerns include the changing character of home based businesses, traffic impacts, parking and other general safety concerns. RESPONSE: The Home Occupation standards, while they allow for some external indications of a business (such as a small sign and limited customers) the limitations on their size and external appearance have been designed to ensure that the business activity is not disruptive to abutting neighbors. These are addressed in greater detail throughout this report. To address concerns regarding parking, a condition will be imposed that the owner's vehicles (including trailers) and any clients be parked off street. Safety concerns were primarily about the location of the proposed home occupation in the curve of Fanno Creek Drive. The nature of the business is that approximately 3 people per day will stop off at the house to drop off their dogs, and then return to pick them up. There is little difference between that activity and friends or relatives stopping by. The proposal represents no greater risk than what is presently allowed. By requiring the owners to park their vehicles as well as directing clients to park off street, there is a greater reduction in risk of accidents from travelers veering around the parked cars. However, it should be noted that by removing this obstruction, it may encourage drivers to move through faster. This is not a risk borne by the home occupation, but rather the individual driver's behavior. HOP2004-00130/TYPE II CHARETTE HOME OCCUPATION PAGE 2 OF 6 SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Section 18.390.040 states that the applicant shall provide an impact study to quantify the effect of development on public facilities and services. For each public facility system and type of impact, the study shall propose improvements necessary to meet City standard, and to minimize the impact of the development on the public at large, public facilities systems, and affected private property users. In situations where the Community Development Code requires the dedication of real property interests, the applicant shall either specifically concur with a requirement for public right-of-way dedication, or provide evidence that supports that the real property dedication is not roughly proportional to the projected impacts of the development. Section 18.390.040 states that when a condition of approval requires the transfer to the public of an interest in real property, the approval authority shall adopt findings which support the conclusion that the interest in real property to be transferred is roughly proportional to the impact the proposed development will have on the public. The applicant has submitted an impact study that addresses the impacts to the public systems. As there is no additional development or construction proposed or necessary to accommodate the use, there are few impacts that will be attributable to the Home Occupation. The nature of the business (dog grooming) is not expected to contribute additional sewage, require significant additional water supply, increase storm drainage, detract from school capacity, require additional utility service, add demand to the park system, or generate noise beyond what is typical for a single family residence. The applicant notes that to address parking concerns, clients will be directed to park in the applicant's driveway, and that no more than one client will be parked in the driveway at a time. The transportation system will experience an additional 6 to 8 trips per day as a result of the business, which is within the street's current capacity. Therefore this standard is satisfied. Section 18.742.040 states that all home occupations except those that have proven non- conforming status, shall observe the following criteria in addition to the standards established for Type I and Type II uses described in 18.742.050: Home occupations may be undertaken only by the principal occupant(s) of a residential property; The proposed Home Occupation is being undertaken by the property owner who is a principal occupant of the property. There shall be no more than three deliveries per week to the residence by suppliers; There are no deliveries required for this type of business. There shall be no offensive noise, vibration, smoke, dust, odors, heat or glare noticeable at or beyond the property line resulting from the operation. Home occupations shall observe the provisions of the Tigard Community Development Code (TCDC) Chapter 18.725, Environmental Performance Standards; A dog grooming business is not expected to generate smoke, dust, or glare. There is potential for noise and odors from such a use however. To mitigate for this potential, the operation will be conducted wholly indoors. The applicants will be required to sign an acknowledgement that they understand and will abide by these rules. If the City receives repeated complaints, the operation may be required to cease, until such time that proper measures can be constructed to prevent further violations. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area which may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25% of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation HOP2004-00130/TYPE II CHARETTE HOME OCCUPATION PAGE 3 OF 6 occupying the accessory use exceed 528 square feet. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health and housing codes; The maximum area the code allows is 528 square feet to be used for a home occupation or 25% of the home area, whichever is less. Twenty-five percent of the 1,500 square foot home size is 375 square feet. The applicant has proposed to use approximately 80 square feet of space in the attached shed exclusively for the home occupation. FINDING: The size limitations for Home Occupations are satisfied as shown on the site plan. A home occupation shall not make necessary a change in the Uniform Building Code use classification of a dwelling unit. Any accessory building that is used must meet Uniform Building Code requirements and be in conformance with TCDC Chapter 18.710 of this title; No changes to the dwelling are proposed which would reclassify the occupancy type of the structure. More than one (1) business activity constituting two or more home occupations shall be allowed on one property, only if the combined floor space of the business activities does not exceed 25 percent of the combined gross floor area of the residence and accessory structure. Each home occupation shall apply for a separate home occupation permit. NOTE: The Tigard Business Tax requires payment for only one (1) Business Tax if the same owner is operating more than one approved business at the same location. Although payment for each separate business is not required, it is required that all names of the businesses' which are currently in operation at that location be specifically listed on the Business Tax Certificate and be visibly posted at the business location. There are no other Home Occupations approved for this site, therefore, this criterion does not apply. There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable material which in the judgment of the Fire Marshall pose a dangerous risk to the residence, its occupants, and/or surrounding properties. Those individuals which are engaged in home occupations shall make available to the Fire Marshal, for review, the Material Safety Data Sheets which pertain to all potentially toxic and/or flammable materials associated with the use; No storage or distribution of toxic or flammable materials is necessary for the proposed use therefore; this criterion has been satisfied. No home occupation shall require any on or off-street parking other than that normally required for a residence; The applicant has proposed that no more than 4 clients will visit the site, and will be received one at a time. Further the applicant states that clients drop off their dogs and come later to pick them up. There are no long term impacts to on-street parking. Neighbors commented that the owners park a trailer on the street that obstructs traffic. To mitigate for the occasional drop offs and pick ups, the applicant shall park any vehicles, including trailers, in the driveway or garage. Therefore, this criterion is satisfied. HOP2004-00130/TYPE II CHARETTE HOME OCCUPATION PAGE 4 OF 6 The following uses are not allowed as home occupations: a b O Auto-body md atngoing echanical repair an repair pin ing. conducted outside of an entirely enclosed building. c Junk and salvage operations. d Storage and/or sale of fireworks. The proposed Home Occupation does not involve any of the above uses, and will be a dog grooming business use only; therefore, this criterion has been satisfied. There shall be no exterior storage of vehicles of any kind used for the business except one commercially licensed vehicle of not more than three-quarters ton GVW which may be parked outside of a structure or screened area; No exterior storage of vehicles is proposed or anticipated, therefore, this criterion has been satisfied. There shall be no storage of materials, goods, and equipment unless screened entirely from view by a solid fence. Storage shall not exceed five (5) percent of the total lot area and shall not occur within the front yard or the required side yard setback; No outdoor storage of materials, goods or equipment is proposed or anticipated, therefore, this criterion has been satisfied. In addition to the general approval criteria, Type-II home occupations allow the following according to the TDC chapter 18.742.050: (a) One non-illuminated sign, not exceeding 1.5 square feet, which shall be attached to the residence or accessory structure or placed in a window; (b) No more than one outside volunteer or employee who is not a principal resident of the premises; (c) No more than six daily customers or clients. Customers and clients may not visit the business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive traffic or monopolize on-street parking; (d) Storage of materials, goods, and equipment which is screened entirely from view by a solid fence. Storage shall not exceed five (5) percent of the total lot area and shall not occur within the front yard or the required side yard setback. The applicant has indicated that there will be no signage. There will be no outside employees related to the Home Occupation business. Up to 4 clients or customers will visit the site. The hours of operation for the business will be between 10 a.m. and 4:30 p.m. Parking will not be impacted since clients are only there to drop off and pick up their dogs. Therefore, these standards are met. SECTION V. AGENCY COMMENTS The City of Tigard Police Department has reviewed the proposal and has no objections. Tualatin Valley Fire and Rescue has reviewed the proposal and offered the following comment: Thank you for the opportunity to review the proposal surrounding the above named development project. Any party with standing as provided in Section 18.390.040.G.1. may appeal this decision in accordance with Section 18.390.040.G.2. of the Tigard Community Development Code which provides that a written appeal together with the required fee shall be filed with the Director within ten (10) business days of the date the Notice of Decision was mailed. Unless the applicant is the appellant, the hearing on an appeal from the Director's Decision shall be confined to the specific issues identified in the written comments submitted by the parties during the comment period. I do serve as a board member at large on the Colony Creek Estates Homeowners Association (CCEHOA). In the association CC&R's, it clearly and unequivocally states that home based businesses are NOT permitted. I believe this section is being forwarded to you in a formal response by the CCEHOA. As of Sunday, November 7th, 2003, the CCEHOA met formally and voted to not permit home based businesses in the community. If for some reason you need an entire copy of the CC&R's, please let myself or another board member know asap and we can deliver you a copy. The Charettes have always been amiable, responsible, and valued neighbors, and a decision to disallow this request should not be seen as a personal referendum on them in any way. But it raises the larger issue of community viability and livability. To allow a home based business sets the dangerous precedent for more in the future. The Colony Creek Estates neighborhood has seen significant traffic increases in the last 5 years and with the new development at the end of SW Fannow Creek DR and Bonita, traffic will undoubtedly increase yet more. A home based business does nothing for the neighborhood; there simply is no added value to the community by any metric used. The bottom line is that the Charettes, as with all CCEHOA homeowners, received a copy of the CC&R's when they bought their house. Home based businesses have never been and should not now be permitted. The Charettes have had access to these documents and their directives and should've consulted them before initiating this action. I only ask that the CC&R's of our community are honored by the City of Tigard in rendering its decision on this proposal. The homeowners are already operating a business at the property. A wooden trailer is generally kept on Fanno Creek Drive filled with glass windows, and frankly, it's an "eye-sore". 2. Mr. and Mrs. Ed Charette are the owners of the residence at 8280 SW Fanno Creek Drive, Tigard, the site of the proposed home-based business, and are part of the Colony Creek Estates Homeowners Association. A Declaration of Protective Covenants for Colony Creek Estates was executed on June 13, 1979 and recorded on August 6, 1979. As set forth in Section 4.1.4 Business and Commercial Uses, "No trade, craft, business, profession, commercial or similar activity of any kind shall be conducted on any lot, nor shall any goods, equipment, vehicles, materials or supplies used in connection with any trade, service or business be kept or stored on any lot...." New homeowners receive a copy of the Declaration at the time of closing. The intent of the Declaration of Protective Covenants is to ensure that the Colony Creek Estates subdivision remains residential. Residents of the area have contacted members of the Board of Directors stating their concerns that there is no guarantee the visits will be limited to three a day and that a home-based business is not allowed as set forth in the Declaration. The bottom line is a home-based business in Colony Creek Estates is not permitted by the Declaration of Protective Covenants. To do so changes the "residential" aspect of Colony Creek Estates which is the expectation of every homeowner when they purchase a residence and become part of the Colony Creek Estates Homeowners Association as set forth in Declaration of Protective Covenants. The Charette home is in an area of the neighborhood where there is a curve in the road which already makes visibility while driving difficult especially when there are vehicles parked along the roadway. This is a residential area which is already increasing in residents due to new developments. The roads are already heavily travelled and the additional customer vehicles would have an impact on the area. While I am not against people earning a living, I believe the CC&R's for Colony Creek Estates prohibit this type of home based business. I would request that this permit be denied. The Charette's are thoughtful and gracious neighbors. Their property is immaculate and well maintained. I know of no time in which they have disturbed the serenity of the neighborhood. I am fully in favor of granting Mrs. Charettee the right to conduct a dog grooming business from her home and I am looking forward to becoming one of her clients. I see no obstacles in clients coming to her home to drop off and pick up their small dogs. There is security benefit to the neighborhood when a neighbor is working from home during the day as it safeguards against theft or vandalism. Predators look for neighborhoods that are silent and empty during the day. With so many families working away from the home, movement and some daily activity on our block would deter intruders who might be casing our neighborhood for purposes of crime. There is no downside to this proposal. I welcome this entrepreneur and wish her much success in her venture. There are many areas throughout the Portland area that are mixed residential, farming, business, industrial. Very patchy and at times, very unsightly. We liked the area because it's a NICE residential area. It doesn't need to have small businesses, no matter what size, start moving in. There are plenty of other areas they could fit this type of business into that are close enough. There shall be no signs for the Home Occupation, without reapplication through the Type II Home Occupation process. 3. The applicant shall note that the property is subject to CC&R's that may limit or restrict the proposed use. The City's approval does not constitute a waiver of those requirements. 4. The applicant shall park any vehicles, including trailers, in the driveway or garage. Likewise, clients shall be directed to park in the driveway. 5. The applicants will be required to sign an acknowledgement that they understand and will abide by the home occupation rules and these additional conditions. If the City receives repeated complaints, the operation may be required to cease, until such time that proper measures can be implemented to prevent further violations. SECTION III. PUBLIC COMMENTS RECEIVED The City mailed notice to property owners within 500 feet of the subject site providing them an opportunity to comment. The City received numerous letters and emails regarding the request. Most of these pertained to the fact that Colony Creek Estates does not allow home based businesses pursuant to their Covenants, Conditions, and Restrictions (CC&R's). RESPONSE: CC&R's are essentially a private agreement between the seller of property and the purchaser. They can address issues such as street maintenance, architectural style, paint colors, and any other sorts of controls that the seller deems necessary (provided such restrictions do not violate one's constitutional rights). The City is not party to this private agreement, and is therefore not able to base its decisions on provisions within the CC&R s. For instance, some CC&R's require a minimum size house be built on property, but the City could not require through its building permit process that a house be a certain size, so long as the house met all other State Building and Local Zoning codes. Similarly, the City cannot deny the home based business, provided it meets all the criteria identified in this report. The homeowner's association is empowered to enforce the CC&R's by seeking an injunction or other corrective action, but the City cannot. Other concerns include the changing character of home based businesses, traffic impacts, parking and other general safety concerns. RESPONSE: The Home Occupation standards, while they allow for some external indications of a business (such as a small sign and limited customers) the limitations on their size and external appearance have been designed to ensure that the business activity is not disruptive to abutting neighbors. These are addressed in greater detail throughout this report. To address concerns regarding parking, a condition will be imposed that the owner's vehicles (including trailers) and any clients be parked off street. Safety concerns were primarily about the location of the proposed home occupation in the curve of Fanno Creek Drive. The nature of the business is that approximately 3 people per day will stop off at the house to drop off their dogs, and then return to pick them up. There is little difference between that activity and friends or relatives stopping by. The proposal represents no greater risk than what is presently allowed. By requiring the owners to park their vehicles as well as directing clients to park off street, there is a greater reduction in risk of accidents from travelers veering around the parked cars. However, it should be noted that by removing this obstruction, it may encourage drivers to move through faster. This is not a risk borne by the home occupation, but rather the individual driver's behavior. HOP2004-00130/TYPE II CHARETTE HOME OCCUPATION PAGE 2 OF 6 • SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Section 18.390.040 states that the applicant shall provide an impact study to quantify the effect of development on public facilities and services. For each public facility system and type of impact, the study shall propose improvements necessary to meet City standard, and to minimize the impact of the development on the public at large, public facilities systems, and affected private property users. In situations where the Community Development Code requires the dedication of real property interests, the applicant shall either specifically concur with a requirement for public right-of-way dedication, or provide evidence that supports that the real property dedication is not roughly proportional to the projected impacts of the development. Section 18.390.040 states that when a condition of approval requires the transfer to the public of an interest in real property, the approval authority shall adopt findings which support the conclusion that the interest in real property to be transferred is roughly proportional to the impact the proposed development will have on the public. The applicant has submitted an impact study that addresses the impacts to the public systems. As there is no additional development or construction proposed or necessary to accommodate the use, there are few impacts that will be attributable to the Home Occupation. The nature of the business (dog grooming) is not expected to contribute additional sewage, require significant additional water supply, increase storm drainage, detract from school capacity, require additional utility service, add demand to the park system, or generate noise beyond what is typical for a single family residence. The applicant notes that to address parking concerns, clients will be directed to park in the applicant's driveway, and that no more than one client will be parked in the driveway at a time. The transportation system will experience an additional 6 to 8 trips per day as a result of the business, which is within the street's current capacity. Therefore this standard is satisfied. Section 18.742.040 states that all home occupations except those that have proven non- conforming status, shall observe the following criteria in addition to the standards established for Type I and Type II uses described in 18.742.050: Home occupations may be undertaken only by the principal occupant(s) of a residential property; The proposed Home Occupation is being undertaken by the property owner who is a principal occupant of the property. There shall be no more than three deliveries per week to the residence by suppliers; There are no deliveries required for this type of business. There shall be no offensive noise, vibration, smoke, dust, odors, heat or glare noticeable at or beyond the property line resulting from the operation. Home occupations shall observe the provisions of the Tigard Community Development Code (TCDC) Chapter 18.725, Environmental Performance Standards; A dog grooming business is not expected to generate smoke, dust, or glare. There is potential for noise and odors from such a use however. To mitigate for this potential, the operation will be conducted wholly indoors. The applicants will be required to sign an acknowledgement that they understand and will abide by these rules. If the City receives repeated complaints, the operation may be required to cease, until such time that proper measures can be constructed to prevent further violations. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area which may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25% of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation HOP2004-00130/TYPE II CHARETTE HOME OCCUPATION PAGE 3 OF 6 occupying the accessory use exceed 528 square feet. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health and housing codes; The maximum area the code allows is 528 square feet to be used for a home occupation or 25% of the home area, whichever is less. Twenty-five percent of the 1,500 square foot home size is 375 square feet. The applicant has proposed to use approximately 80 square feet of space in the attached shed exclusively for the home occupation. FINDING: The size limitations for Home Occupations are satisfied as shown on the site plan. A home occupation shall not make necessary a change in the Uniform Building Code use classification of a dwelling unit. Any accessory building that is used must meet Uniform Building Code requirements and be in conformance with TCDC Chapter 18.710 of this title; No changes to the dwelling are proposed which would reclassify the occupancy type of the structure. More than one (1) business activity constituting two or more home occupations shall be allowed on one property, only if the combined floor space of the business activities does not exceed 25 percent of the combined gross floor area of the residence and accessory structure. Each home occupation shall apply for a separate home occupation permit. NOTE: The Tigard Business Tax requires payment for only one (1) Business Tax if the same owner is operating more than one approved business at the same location. There are no other Home Occupations approved for this site, therefore, this criterion does not apply. There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable material which in the judgment of the Fire Marshall pose a dangerous risk to the residence, its occupants, and/or surrounding properties. Those individuals which are engaged in home occupations shall make available to the Fire Marshal, for review, the Material Safety Data Sheets which pertain to all potentially toxic and/or flammable materials associated with the use; No storage or distribution of toxic or flammable materials is necessary for the proposed use therefore; this criterion has been satisfied. No home occupation shall require any on or off-street parking other than that normally required for a residence; The applicant has proposed that no more than 4 clients will visit the site, and will be received one at a time. Further the applicant states that clients drop off their dogs and come later to pick them up. There are no long term impacts to on-street parking. Neighbors commented that the owners park a trailer on the street that obstructs traffic. To mitigate for the occasional drop offs and pick ups, the applicant shall park any vehicles, including trailers, in the driveway or garage. Therefore, this criterion is satisfied. HOP2004-00130/TYPE II CHARETTE HOME OCCUPATION PAGE 4 OF 6 The following uses are not allowed as home occupations: (a Auto-body repair and painting. b Ongoing mechanical repair conducted outside of an entirely enclosed building. (c Junk and salvage operations. (d Storage and/or sale of fireworks. The proposed Home Occupation does not involve any of the above uses, and will be a dog grooming business use only; therefore, this criterion has been satisfied. There shall be no exterior storage of vehicles of any kind used for the business except one commercially licensed vehicle of not more than three-quarters ton GVW which may be parked outside of a structure or screened area; No exterior storage of vehicles is proposed or anticipated, therefore, this criterion has been satisfied. There shall be no storage of materials, goods, and equipment unless screened entirely from view by a solid fence. Storage shall not exceed five (5) percent of the total lot area and shall not occur within the front yard or the required side yard setback; No outdoor storage of materials, goods or equipment is proposed or anticipated, therefore, this criterion has been satisfied. In addition to the general approval criteria, Type-II home occupations allow the following according to the TDC chapter 18.742.050: (a) One non-illuminated sign, not exceeding 1.5 square feet, which shall be attached to the residence or accessory structure or placed in a window; (b) No more than one outside volunteer or employee who is not a principal resident of the premises; (c) No more than six daily customers or clients. Customers and clients may not visit the business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive traffic or monopolize on-street parking; (d) Storage of materials, goods, and equipment which is screened entirely from view by a solid fence. Storage shall not exceed five (5) percent of the total lot area and shall not occur within the front yard or the required side yard setback. The applicant has indicated that there will be no signage. There will be no outside employees related to the Home Occupation business. Up to 4 clients or customers will visit the site. The hours of operation for the business will be between 10 a.m. and 4:30 p.m. Parking will not be impacted since clients are only there to drop off and pick up their dogs. Therefore, these standards are met. SECTION V. AGENCY COMMENTS The City of Tigard Police Department has reviewed the proposal and has no objections.
