APPLICATION SUMMARY FILE NAME: GWEN'S SKINCARE FILE NO.: Home Occupation Permit (HOP) Type II HOP2014-00038 PROPOSAL: The proposal would allow a Type II Home Occupation, Gwen's Skincare,at 11200 SW Errol Street. The home occupation is for an esthetician with six daily customers. The home occupation would occupy approximately 154 square feet of an existing residence. No external changes are proposed as part of the application. APPLICANT: Gwen Block OWNER: Same as applicant Gwen's Skincare 11200 SW Errol Street Tigard,OR 97223 LOCATION: 11200 SW Errol Street;WCTM 2S103AB,Tax Lot 00502. ZONING DESIGNATION: R-4.5: low-density residential district. The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single- family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Sections 18.742. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to the following conditions of approval. The findings and conclusions on which the decision is based are discussed in Section V. CONDITIONS OF APPROVAL Unless noted otherwise,the staff contact shall be Agnes Kowacz,Associate Planner,503-718-2427. 1. Customers, clients, and employees may not park in the public right of way. All parking shall be accommodated on-site. The home occupation shall not require more on-site parking than a single family residence. 2. The applicant shall obtain and annually renew a City of Tigard business license and any and all State and Federal approvals,permits,and licenses. SECTION III. BACKGROUND INFORMATION & PROJECT DESCRIPTION The project site is located at 11200 SW Errol Street, directly across from SW 112`h Avenue. The property is 19,602 square feet in size and contains a single-family home, two car garage and driveway. The site is surrounded by single family homes on all four sides. The proposal would allow a Type II Home Occupation, Gwen's Skincare, at 11200 SW Errol Street. The home occupation is for an in-home beauty salon with six daily customers. The home occupation would occupy approximately 154 square feet,approximately 8%, of an existing residence. SECTION IV. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET A notice of a pending land use action was sent to neighboring property owners within 500 feet of the subject site on September 11, 2014. The City received an anonymous phone call from a citizen who resides on SW Errol Street expressing concerns about crime in the neighborhood, noisy neighbors, overflow parking onto the street and how the city will ensure that the business does not have more than six clients coming to the home. On September 19, the city received an email from Ms. Donna Anderson expressing concerns about increased traffic, noise, parking problems and change of atmosphere in the neighborhood. Ms. Anderson stated that a commercial zoned property would be more suitable. On September 22, 2014, the city received and email from Janice Frantz, expressing concerns about speeding traffic, through traffic and the preservation of the residential neighborhood. On September 23, 2014, the city received a letter from Karen Hall expressing concerns about transportation, cut through traffic and speeding, and the presence of a business in a residential neighborhood. On September 24, 2014, the city received a letter from Delina Carpenter expressing concerns about the condition of the existing narrow streets without sidewalks, speeding cars, the abundance of walkers and keeping this area residential only. RESPONSE: The call was forwarded to the police department to address issues relating to crime. Concerns relating to transportation were forward to the engineering department. Home occupations are permitted in all residential zones. Home occupations are allowed to have up to six daily customers. Certain conditions of approval and limitations of the home occupations will ensure that the business does not exceed the parameters of what the code allows. Any resident may file a complaint with the city if the home occupation is in violation of its approval, the city will investigate and corrective action will be pursued. SECTION V. APPLICABLE REVIEW CRITERIA& FINDINGS As set forth in Table 18.520.1 of the Tigard Development Code, home occupations are an allowed land use in all commercial zones, subject to the approval standards and criteria contained in Chapter 18.742 (Home Occupations). Relevant standards and approval criteria are addressed below. 18.742 Home Occupations 18.742.040 General Approval Criteria A. General criteria. All home occupations except those that have proven nonconforming status shall observe the following criteria in addition to the standards established for Type I and Type II uses described in Section 18.742.050 of this chapter. 110P2014-00038 GWEN'S SKINCAR1 I IOME OCCUPATION PERMIT PAGE 2 OF 7 1. Home occupations may be undertaken only by the principal occupant(s) of a residential property. The applicant is the owner and occupant of the residence that will be undertaking the proposed home occupation. The owner does not have any employees. This criterion is met. 2. There shall be no more than three deliveries per week to the residence by suppliers. The applicant states that the home occupation only generates one delivery per month. This criterion is met. 3. There shall be no offensive noise,vibration, smoke, dust, odors, heat or glare noticeable at or beyond the property line resulting from the operation. Home occupations shall observe the provisions of Chapter 18.725, Environmental Performance Standards. The home occupation is for an in-home beauty salon and does not generate any of the items listed above. All activities will be conducted indoors between the hours of 10 AM and 6 PM. This criterion is met. 4. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area which may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25% of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation occupying the accessory use exceed 528 feet. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health and housing codes. All activities associated with the home occupation will be within the primary residence. The home occupation will occupy approximately 154 square feet, approximately 8%, of the existing 2,106 square foot residence. This criterion is met. 5. A home occupation shall not make necessary a change in the State Building Code use classification of a dwelling unit. Any accessory building that is used must meet State Building Code requirements. No changes are proposed to the dwelling unit and the home occupation is not proposed within an accessory building. This criterion is met. 6. More than one business activity constituting two or more home occupations shall be allowed on one property only if the combined floor space of the business activities does not exceed the limitation of space imposed in Subsection 4 above. Each home occupation shall apply for a separate home occupation permit, if required as per this chapter, and each shall also have separate Business Tax Certificates. A search of city records shows no other home occupations at this site. This standard is met. 7. There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable materials which in the judgment of the Fire Marshal pose a dangerous risk to the residence, its occupants, and/or surrounding properties. Those individuals which are engaged in home occupations I10P2014-00038 G\V'I?N'S SKIN(;.ARI{ 1101\IF OCCUPATION PER.vII"I' P\G1•:3 01.7 shall make available to the Fire Marshal for review the Material Safety Data Sheets which pertain to all potentially toxic and/or flammable materials associated with the use. The home occupation will not have any storage or distribution of toxic or flammable materials. The proposal was referred to the Tualatin Valley Fire & Rescue for review and comments. TVF& R reviewed the proposal and stated no concerns. This criterion is met. 8. No home occupation shall require any on or off-street parking other than that normally required for a residence. The project will not require any additional parking than is already provided for the existing residence. The existing residence has a two car garage and a large driveway available for use by the occupants or any visitors. This criterion is met. 9. The following uses are not allowed as home occupations: a. Auto-body repair and painting; b. Ongoing mechanical repair conducted outside of an entirely-enclosed building; c.Junk and salvage operations; d. Storage and/or sale of fireworks The proposed home occupation does not involve any of the above land uses.This criterion is met. 10. There shall be no exterior storage of vehicles of any kind used for the business except that one commercially licensed vehicle of not more than three-quarters ton gross vehicle weight (GVW) may be parked outside of a structure or screened area. The applicant stated that she will not be utilizing a vehicle for the home occupation. This criterion does not apply. 18.742.050 Type I and Type II Home Occupations Defined A. Type I and II home occupations defined. Home occupations shall be administered as either Type I or Type II uses.A separate home occupation permit and/or fee is required for each property on which a Type II home occupation is undertaken. In addition to the general criteria outlined in Section 18.742.040, home occupations shall observe the following additional standards: 2. Type II home occupations. Property on which a Type II home occupation is located may show evidence that a business is being conducted from the premises. Therefore the following is allowed for Type II home occupations: a. One non-illuminated sign, not exceeding 1.5 square feet,which shall be attached to the residence or accessory structure or placed in a window; The applicant is proposing a 1.5-foot sign that will be attached to the fence and not visible from the street. Signage not legible from the right-of-way, other property or from the air is exempt from a sign permit. This standard does not apply. b. No more than one outside volunteer or employee who is not a principal resident of the premises; I10I'2014-00038 G\V'1:A'S SI'I\C\RI. 11O\II{()(;(a'1'.A'I I()N YI:R\IIT I'.AGI{4 OF The applicant indicted that she will have no employees that will participate in the home occupation. This standard is met. c. No more than six daily customers or clients. Customers and clients may not visit the business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive traffic or monopolize on-street parking; The narrative states that the business will not generate more than 6 daily customers between the hours of 10AN1 and 6P1M1. Clients will be by appointment only. This standard is met. d. Storage of materials, goods, and equipment which is screened entirely from view by a solid fence. Storage shall not exceed five percent of the total lot area and shall not occur within the front yard or the required side yard setback. The applicant has not proposed any outdoor storage of materials. Waste associated with the home occupation will be disposed of with normal household garbage and recycling. This standard does not apply. 18.742.060 Permit Procedures for Type I and Type II Home Occupations B. Type II home occupation permit. A Type II home occupation permit will be processed by means of a Type II procedure, as governed by Section 18.390.040, after a demonstration that the proposal complies with all development criteria in Sections 18.742.040.A and 18.742.050.A.2 and subject to the following approval criteria: 1. Is in conformance with the standards contained in this chapter; and As discussed in this report, the application is consistent with the standards of this chapter, or will be consistent with conditions of approval. This standard is met. 2. Will be subordinate to the residential use of the property; and The home occupation will be subordinate to the residential use of the property. The home occupation will only occupy 154 square feet of the existing residence, or approximately 8% of the total square footage of all structures on the property. This standard is met. 3. Is undertaken in a manner that is not detrimental nor disruptive in terms of appearance or operation to neighboring properties and residents. The home occupation is entirely contained within the residence and will not be detrimental or disruptive in terms of appearance or operation. This standard is met. C. Conditions of approval. The Director may impose conditions upon the approval of a Type II home occupation permit to ensure compliance with the requirements of this chapter. These conditions may include, but are not limited to, the following: 6. Requiring street right-of-way to be free at all times of vehicles associated with the home occupation; A condition of approval has been added that prohibits customers, clients, and employees from parking in the public right of way,in compliance with this provision. Any other limitations which the Director considers to be necessary or desirable to make the use comply with the purposes stated in Sections 18.745.040 and 18.742.050. As discussed above, conditions of approval have been added to ensure any improvements to the existing residence or property are in compliance with all building division requirements and that parking is accommodated on site. FINDING: As discussed in the analysis above,the proposal meets,or can meet with conditions of approval, all standards and approval criteria pertaining to Type II Home Occupations. SECTION VI. OTHER STAFF COMMENTS The Development Engineering Division had no objections to the proposal. SECTION VII. AGENCY COMMENTS On September 15, 2014, Tualatin Valley Fire and Rescue stated they reviewed the proposal and have no objections to the proposal. SECTION VIII. I do not believe that this proposed home business is a good fit for this neighborhood. This is a quiet cul-de-sac area that has a tremendous number of young families with children who ride their bikes and play in the street. This area has very low traffic and the addition of a home business is not a good idea because of the traffic it will bring. I realize that Gwen's Skincare says 6 cars a day, but I do not believe this will hold. What if the business grows? Where will they park? This street does not even have sidewalks. What if there are more cars, more traffic? What recourse would the neighbors have once the zoning was changed? What would stop more home businesses from opening in the same neighborhood? We have one neighbor who would hold a yard sale every weekend if it were allowed. Most people do not buy a home in on a quiet street and want business traffic. Not just the traffic, but the noise, the parking problems and the change in atmosphere. I think that if Gwen's Skincare wants to have a small business, the owner should look for space that is already zoned for that, not impose changes on a quiet neighborhood that wants to stay residential. Even though the posted speed is 25 mph "residential" the street is 17 feet wide, chip sealed, no sidewalks, no street lights, etc and even this posted speed is too fast. People also park on both sides of the street in front of their homes and it limits through traffic even more to a very narrow path. This is known by all that live here but others speed by unaware. This street also has many children that go to school and people walk this street all the time. Generating more traffic for a business to move into a residential area is unacceptable. That is why we moved here 18 years ago because it is zoned "Residential" I'm not opposed to home businesses but one that has a customer base to visit the home and generate unwanted persons to our neighborhood and generate more traffic is not what this neighborhood needs/wants.
