DESIGNATION: R-4.5:Low-Density Residential District. The R-4.5 zoning district is designed to
accommodate detached single-family homes with or without accessory residential
units at a minimum lot size of 7,500 square feet. Duplexes and attached single-
family units are permitted conditionally. Some civic and institutional uses are also
permitted conditionally.

SECTION II. DECISION
Notice is hereby given that the City of Tigard Community Development Director's designee has
APPROVED the above request subject to the following conditions of approval. The findings and
conclusions on which the decision is based are discussed in Section V.
CONDITIONS OF APPROVAL
Unless noted otherwise,the staff contact shall be Agnes Kowacz,Associate Planner; 503-718-2427.
1. Customers and clients may not ark in the public right of way.All parking shall be accommodated on-
site.The home occupation shall not require more on-site parking than a single family residence.
2. The applicant shall obtain all necessary permits for any structural, mechanical, electrical, or plumbing
work performed as part of the home occupation.

3. The applicant shall obtain and annually renew a City of Tigard business license and any and all State
and Federal approvals,permits,and licenses.
SECTION III. BACKGROUND INFORMATION AND PROJECT DESCRIPTION
"The project site is located at 14170 SW 93'd Avenue, south of SW McDonald Street and east of SW 93`d
Avenue. The property is 15,681 square feet in size and contains a single-family home, two car garage and
driveway. The site is surrounded by single family homes on all four sides.
This application for a Type II Home Occupation would permit the owner to provide counseling services
as a licensed social worker to clients at the existing residence. The owner will see four to six clients daily
and parking will be provided at the residence. The clients are high functioning members of society; the
applicant does not work with clients who suffer from serious mental illness, addictions or have a history of
criminal behaviors. All activities will be contained within a 260 square foot area of the existing residence.
SECTION IV. PUBLIC COMMENTS RECEIVED
The city mailed notice to property owners within 500 feet of the subject site,providing them an opportunity
to comment. The city received two written responses,which are summarized below:
1. On June 30, 2014, the City received a letter from Larry Caufield expressing concerns about increased
crime or violence in the neighborhood due to the type of clients. Secondly, Mr. Caufield inquired
whether similar businesses would be permitted in the area.
2. On July 1,2014, the City received a letter from Jane Smith expressing concerns about increased traffic
and parking problems. Ms. Smith feels that there is ample space in commercial zones to
accommodate these types of uses instead of disrupting the neighborhood.
The Home Occupation Permit (Type II) allows property owners to obtain a permit to operate a business out
of their home that will not generate more impact than a single family home would. The applicant mentions in
her application that he clients are high functioning members of society. In addition, the approval has been
conditioned for parking to occur on-site only. The sections below further address the public'concerns.
SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS
As set forth in Table 18.510.1 of the Tigard Development Code, home occupations are an allowed land use
in all residential zones, subject to the approval standards and criteria contained in Chapter 18.742 (Home
Occupations). Relevant standards and approval criteria are addressed below.
18.742 Home Occupations
18.742.040 General Approval Criteria
General criteria. All home occupations except those that have proven nonconforming status shall
observe the following criteria in addition to the standards established for Type I and Type II uses
described in Section 18.742.050 of this chapter.
A. Home occupations may be undertaken only by the principal occupant(s) of a residential
property.
The applicant is the owner and occupant of the residence that will be undertaking the proposed home
occupation. This standard is met.

B. There shall be no more than three deliveries per week to the residence by suppliers.
The applicant states that deliveries to the residence are not anticipated. This standard is met.
C. There shall be no offensive noise,vibration, smoke,dust, odors, heat or glare noticeable at
or beyond the property line resulting from the operation. Home occupations shall observe
the provisions of Chapter 18.725,Environmental Performance Standards.
The home occupation is to provide counseling services which do not generate any of the items listed
above. All services will be conducted indoors between the hours of 8 AM and 10 PM. This standard is
met.
D. The home occupation shall be operated entirely within the dwelling unit and a conforming
accessory structure. The total area which may be used in the accessory building for either
material product storage and/or the business activity shall not exceed 528 square feet.
Otherwise, the home occupation and associated storage of materials and products shall
not occupy more than 25%of the combined residence and accessory structure gross floor
area,but in no case shall the portion of the home occupation occupying the accessory use
exceed 528 feet. The indoor storage of materials or products shall not exceed the
limitations imposed by the provisions of the building, fire, health and housing codes.
All activities associated with the home occupation will be within the primary residence. The home
occupation will occupy approximately 260 square feet,approximately 12%,of the existing residence. This
standard is met.
E. A home occupation shall not make necessary a change in the State Building Code use
classification of a dwelling unit.Any accessory building that is used must meet State
Building Code requirements.
No changes are proposed and the home occupation is not proposed within an accessory building. This
standard is met.
F. More than one business activity constituting two or more home occupations shall be
allowed on one property only if the combined floor space of the business activities does not
exceed the limitation of space imposed in Subsection 4 above. Each home occupation
shall apply for a separate home occupation permit, if required as per this chapter, and each
shall also have separate Business Tax Certificates.
A search of city records shows no other home occupations at this site. This standard is met.
G. There shall be no storage and/or distribution of toxic or flammable materials, and spray
painting or spray finishing operations that involve toxic or flammable materials which in
the judgment of the Fire Marshal pose a dangerous risk to the residence, its occupants,
and/or surrounding properties.Those individuals which are engaged in home occupations
shall make available to the Fire Marshal for review the Material Safety Data Sheets which
pertain to all potentially toxic and/or flammable materials associated with the use.
The home occupation will not have any storage or distribution of toxic or flammable materials. The
proposal was referred to the Tualatin Valley Fire&Rescue for review and comments. TVF& R reviewed
the proposal and stated no concerns.This standard is met.

H. No home occupation shall require any on or off-street parking other than that normally
required for a residence.
The project will not require any additional parking than is already provided for the existing residence. The
existing residence has a two car garage and a large driveway available for use by the occupants and any
visitors. This standard is met.
I. The following uses are not allowed as home occupations:
1. Auto-body repair and painting;
2. Ongoing mechanical repair conducted outside of an entirely-enclosed building;
3.Junk and salvage operations;
4. Storage and/or sale of fireworks
The proposed home occupation does not involve any of the above listed land uses. This standard is met.
J. There shall be no exterior storage of vehicles of any kind used for the business except that
one commercially licensed vehicle of not more than three-quarters ton gross vehicle weight
(GVW) may be parked outside of a structure or screened area.
The applicant states there will not be any exterior vehicle storage of any kind. The applicant's personal
vehicle will be stored inside the garage. This standard is met.
18.742.050 Type I and Type II Home Occupations Defined
A. Type I and II home occupations defined. Home occupations shall be administered as either
Type I or Type II uses. A separate home occupation permit and/or fee is required for each
property on which a Type II home occupation is undertaken. In addition to the general criteria
outlined in Section 18.742.040, home occupations shall observe the following additional standards:
2. Type II home occupations. Property on which a Type II home occupation is located may
show evidence that a business is being conducted from the premises. Therefore the
following is allowed for Type II home occupations:
a. One non-illuminated sign, not exceeding 1.5 square feet,which shall be attached to the
residence or accessory structure or placed in a window;
Signage is not proposed with this application. However,if the applicant decides to have a sign, a permit
will be required. This standard does not apply.
b. No more than one outside volunteer or employee who is not a principal resident of the
premises;
The application states that only the applicant will engage in the home occupation and no volunteers or
employees will be on site. This standard is met
c. No more than six daily customers or clients. Customers and clients may not visit the
business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive
traffic or monopolize on-street parking;

The narrative states that services will be provided between the hours of 8 AM and 10PM. The business
will not generate more than six daily customers,who will park on site. This standard is met.
d. Storage of materials,goods, and equipment which is screened entirely from view by a solid
fence. Storage shall not exceed five percent of the total lot area and shall not occur within
the front yard or the required side yard setback.
The applicant has not proposed any outdoor storage of materials.Waste associated with the home
occupation will be disposed of with normal household garbage and recycling. This standard does not apply.
18.742.060 Permit Procedures for Type I and Type II Home Occupations
B. Type II home occupation permit.A Type II home occupation permit will be processed by
means of a Type II procedure,as governed by Section 18.390.040, after a demonstration that the
proposal complies with all development criteria in Sections 18.742.040.A and 18.742.050.A.2 and
subject to the following approval criteria:
1. Is in conformance with the standards contained in this chapter; and
As discussed above and below in this report, the application is consistent with the standards of this
chapter,or will be consistent with conditions of approval. This standard is met.
2. Will be subordinate to the residential use of the property; and
As discussed above, the home occupation will be subordinate to the residential use of the property. The
home occupation will only occupy 260 square feet of the existing residence,or approximately 12% of the
total square footage of all structures on the property. This standard is met.
3. Is undertaken in a manner that is not detrimental nor disruptive in terms of appearance or
operation to neighboring properties and residents.
As discussed above and below,and as conditioned in Section II of this report, the home occupation is
entirely contained within the residence and will not be detrimental or disruptive in terms of appearance or
operation. This standard is met.
C. Conditions of approval. The Director may impose conditions upon the approval of a Type II
home occupation permit to ensure compliance with the requirements of this chapter. These
conditions may include,but are not limited to, the following:
6. Requiring street right-of-way to be free at all times of vehicles associated with the home
occupation;
As discussed above,a condition of approval has been added that prohibits customers or clients from
parking in the public right of way,in compliance with this standard.
14. Any other limitations which the Director considers to be necessary or desirable to make
the use comply with the purposes stated in Sections 18.745.040 and 18.742.050.
As discussed above, conditions of approval have been added to ensure any improvements to the existing
residence or property are in compliance with all building division requirements and that parking is
accommodated on site.

FINDING: As discussed in the analysis above, the proposal meets,or can meet with conditions of
approval,all standards and approval criteria pertaining to Type II Home Occupations.
SECTION VI. OTHER STAFF COMMENTS
The Development Engineering Division had no objections to the proposal.
SECTION VII. AGENCY COMMENTS
On July 3, 2014, Tualatin Valley Fire and Rescue stated they reviewed the proposal and have no
objections to the proposal.

I am not in agreement, nor do I support the above request which would negatively affect this estab-
lished neighborhood of single family homes,as well as increase traffic on McDonald St. and 93`d
Avenue. Parking would also be an issue.
There is certainly ample opportunity for the establishment of an independent social work business
within the business district of Tigard—rather than disrupt a neighborhood environment. I consider this

My wife and I object to approval of this Proposed Home Occupation/Type II Home
Occupation for a licensed clinical social worker to see clients by appointment only out of the
home.
First, there is the possibility that at least some of the clients involved with this social worker
might have problems that could lead to actions putting people in the area at physical risk. And in
come cases it's not the client, but other family members who create problems. I have a sister in
law and a daughter in law both of whom have been involved with social services and without
giving up names they have told us several horror stories related to clients. My daughter in law
was punched in the stomach when she was 8 months pregnant causing her to quit her position
for a time. Also we see many stories on the "6:00 O'clock News" involving people who were
thought by family and friends to be quite calm and friendly and who suddenly do violent acts.
Second, permitting this person to have clients come to her home sets a precedent. How do you
allow this person to have this practice and deny others to have similar businesses in their home
in this area?
I will say we don't see a problem with traffic.
If this were a home business repairing refrigerators and air conditioners, for instance, we'd have
no problem, but drawing people who have social problems to this area gives us concern.

Appeal Procedure Details
The decision of the Director (Type II Procedure) or Review Authority (Type II Administrative Appeal or
Type III Procedure) is final for purposes of appeal on the date that it is mailed. Any party with standing as
provided in Section 18.390.040.G.1.may appeal this decision in accordance with Section 18.390.040.G.2. of
the Tigard Community Development Code which provides that a written appeal together with the required
fee shall be filed with the Director within ten (10) business days of the date the notice of the decision was
mailed. The appeal fee schedule and forms are available from the Planning Division of Tigard City Hall,
13125 SW Hall Boulevard,Tigard,Oregon 97223.
Unless the applicant is the appellant, the hearing on an appeal from the Director's Decision shall be

I have worked as Licensed Clinical Social Worker in the Tigard Triangle (at
Commerce Plaza) since 1991. As I get older, I would like to downsize my practice
and decrease expenses by moving my practice home. My plan is to see 20-24 clients
per week in a home office. I would work 4 to 5 days per week, seeing 4 to 6 clients
per day, by appointment only.
The clients I see would not be a disruption to the neighborhood. They are adults,
and some teens,and are generally all higher-functioning, "solid" members of society.

In regard to 18.742.040 General Approval Criteria and Standards
A. I am the principle occupant and owner of the property.
B. I do not anticipate any work-related deliveries being made to the property. If
so,it would be extremely rarely.
C. There will be no offensive noise,vibration,smoke,dust,odors,heat or glare
noticeable at or beyond the property line resulting from the operation. It will just
be somebody sitting inside,talking in a normal tone of voice.
D. My business will occur entirely within the house. The business will use about
260 square feet of my 2157 square-foot home.
E. My home occupation will not make necessary a change in the state building code
use classification of my dwelling unit. There will be no accessory building used.
F. There will be only one business operating out of my home.
G. There will be no storage and/or distribution of toxic or flammable materials,and
spray painting or spray finishing operations that involve toxic or flammable
materials which in the judgment of the fire marshal pose a dangerous risk to the
residence,its occupants,and/or surrounding properties.
H. My home occupation will not require any on or off street parking other than that
normally required for a residence.
I. My home occupation business will not be auto body repair/painting; mechanical
repair conducted outside on an entirely enclosed building; nor a junk and salvage
operation; storage/sale of fireworks
J. There will be no exterior storage of vehicles of any kind.

Hi, Agnes,
Yes, I provide counseling, as do most social workers in private practice. I am a Licensed Clinical Social
Worker with the State of Oregon. I am a counselor in private practice and I see clients, usually for 50 minutes
to an hour at a time. I work a lot with couples, adults and adolescent females. I also work quite a bit with
police officers. My population is higher functioning. I do not work with serious mental illness, addictions or
criminal behaviors, but mostly with people who want to make their lives and relationships better and more
functional.
Here is part of the introductory letter I wrote. I have highlighted the part that describes my practice:
I have worked as Licensed Clinical Social Worker in the Tigard Triangle (at Commerce Plaza) since 1991. As I
get older, I would like to downsize my practice and decrease expenses by moving my practice home. My plan
is to see 20-24 clients per week in a home office. I would work 4 to 5 days per week, seeing 4 to 6 clients per
day, by appointment only.
The clients I see would not be a disruption to the neighborhood. They are adults, and some teens, and are
generally all higher-functioning, "solid"members of society. I do not work at all with people who have active
addictions or criminal records/behaviors.
I have ample parking on my property for clients. Usually, there will be only one car at a time at my house

My home sits on a 0.36-acre lot. The space in which I hope to see my clients is in my 2157 square-foot house,
in the daylight basement, which is approximately 225 square feet. It has a 35 square-foot bathroom off of it,
which my clients would use. In total, I would be using approximately 260 square feet of my home for my
business.
