APPLICATION SUMMARY FILE NAME: SR TURNER CONSTRUCTION, LLC FILE NO.: Home Occupation Permit (HOP) HOP2003-00061 APPLICANT: Steve and Jena Turner OWNER: Same 12933 SW 113th Place Tigard, OR 97223 PROPOSAL: The applicant requests approval for a Type II Home Occupation permit to allow an office for a residential home building business. COMPREHENSIVE PLAN DESIGNATION: R-4.5; Low Density Residential. ZONING DESIGNATION: R-4.5; The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes are permitted conditionally. Some civic and institutional uses are also permitted conditionally. LOCATION: The subject site is located at 12933 SW 113th Place; WCTM 2S103AC, Tax Lot 6900. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.385, 18.390, 18.510 and 18.742. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. HOP2003-00061/TYPE II TURNER HOME OCCUPATION PAGE 1 OF 6 CONDITIONS OF APPROVAL UNLESS OTHERWISE NOTED, THE STAFF CONTACT SHALL BE MORGAN TRACY IN THE PLANNING DIVISION AT (503) 639-4171. 1. All Home Occupation standards discussed in this decision and detailed in the Tigard Development Code Chapter 18.742 must be complied with at all times; including the following additional limitations: A. hours of operation shall be between the hours of 7am and 4pm B. maximum 3 clients per week C. one monthly accountant visit D. no additional signage 2. The applicant/owner shall direct the employee or any customers who visit the site to park in the driveway and not utilize on street parking. 3. Any large vehicle (>1,500 lbs GVW) associated with the business shall be stored in a structure or screened area. One commercially licensed vehicle may be stored outside of a structure or screened area, so long as it is parked in the driveway. Storage means the keeping of a vehicle overnight. 4. The applicant shall not allow customers or clients to visit the site before 8:00am or after 10:00pm. 5. The applicant shall not permit employees (other than the single once-a-month accountant), subcontractors, or associates to assemble, congregate, or meet at the site. SECTION III. PUBLIC COMMENTS RECEIVED The City mailed notice to property owners within 500 feet of the subject site providing them an opportunity to comment. The City received seven written responses (three letters, and four e-mails) from neighboring residents. Four of the responses were in support of the application. A response from `Mike and Sharon B." notes that the applicant should be held to the proposal as requested (2-3 clients per week, one outside consultant once a month, and 7am-4pm on weekdays only). They also mention their concern of workers assembling at the home site and general noise issues. STAFF RESPONSE: The application does not specify that the business will occur only on weekdays. It is reasonable that the applicant should be held to the proposed extent of business, in terms of hours, signage, number of clients, and an outside employee, as these matters are described in the public notice. The Development Code limits client visits between the hours of 10:00 pm and 8:00 am, and this will be addressed later within this decision. Neither the applicant nor the public notice indicate that there will not be weekend client visits. Assembling employees at the home is not permitted and will be further restricted by a condition of this approval. General noise complaints are handled through nuisance code enforcement. Pierre and Patty Gohier raised six issues with regard to the narrow street, limited parking, impact to property values, child safety, allowing a business to operate until 10:00 PM, and the applicant's history of non-compliance. In addition, Russ and Tena Oehler commented about their concerns with added traffic, limited parking, safety of children playing in the street, and construction vehicles coming down the cul-de-sac. HOP2003-00061/TYPE II TURNER HOME OCCUPATION PAGE 2 OF 6 STAFF REPONSE: 113' Place was constructed to a 28-foot pavement section standard which limits parking to one side of the street, this is neither out of compliance or unusual for many of Tigard's local streets. With regard to p arking, the code permits the Director to place conditions on the application to ensure that off parking is not monopolized. A condition will be imposed such that business related parking be required to occur in the driveway. With regard to potential loss of property values, the code does not distinguish property value as a review criterion, and there is no evidence to support that such a loss would occur. With regard to child safety impacted by increased traffic, this argument is difficult to assess, since the increase expected from the business is 3 clients per week, and one accountant per month, or 26 additional round trips per month, or an average of 1 additional trip per day. The street is designed to a standard that will accommodate up to 500 vehicles per day (the rough equivalent of 50 houses). With the 12 homes on the cul-de-sac, there is adequate available capacity for the proposed home occupation. With regard to allowing the business to operate until 10:00 PM the code does not limit the hours a business may operate, but rather restricts the times at which off-site clients or an employee may visit the site for the business purpose. Nevertheless, the applicant has proposed that the hours will be between lam and 4pm. Clients will not be permitted to visit the site before 8:00am. This will be limited by a condition of this approval. Issues related to non-compliance will be appropriately handled through code enforcement proceedings as necessary. There is nothing within the code to restrict or prevent construction vehicles from using a public street, however, the code does limit the ability to store such vehicles on the site. In this decision, a condition will be imposed to ensure such overnight storage of heavy vehicles occurs inside a structure and not outside. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Section 18.742.040 states that all home occupations except those that have proven non- conforming status, shall observe the following criteria in addition to the standards established for Type I and Type II uses described in 18.742.050: Home occupations may be undertaken only by the principal occupant(s) of a residential property; The proposed Home Occupation is being undertaken by the property owner who is a principal occupant of the property. There shall be no more than three deliveries per week to the residence by suppliers; The applicant has indicated there will be no more than three deliveries per week of products or supplies to the residence. There shall be no offensive noise, vibration, smoke, dust, odors, heat or glare noticeable at or beyond the property line resulting from the operation. Home occupations shall observe the provisions of the TDC Chapter 18.725, Environmental Performance Standards; No offensive noise, vibration, smoke, dust, odors, etc. are anticipated based on the proposed Home Occupation business since it will be conducted indoors and involves no manufacturing or assembly. The two responses in opposition to the proposed Home Occupation note that they are concerned with potential noise from the business. To this regard, the provisions of the Tigard Municipal Code, Chapter 7.40, apply. Violations of the noise standards are addressed through code enforcement proceedings. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area which may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25% of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation occupying the accessory use exceed 528 square feet. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health and housing codes; HOP2003-00061/TYPE II TURNER HOME OCCUPATION PAGE 3 OF 6 Twenty-five percent of the 2,750 square foot home size is 687 square feet, however, the maximum area the code allows is 528 square feet to be used for a home occupation. The applicant has proposed to use approximately 441 square feet of the residence for the home occupation. Therefore, this standard has been met. A home occupation shall not make necessary a change in the Uniform Building Code use classification of a dwelling unit. Any accessory building that is used must meet Uniform Building Code requirements and be in conformance with TCDC Chapter 18.144 of this title; No additional changes to the dwelling are proposed. More than one (1) business activity constituting two or more home occupations shall be allowed on one property, only if the combined floor space of the business activities does not exceed 25 percent of the combined gross floor area of the residence and accessory structure. Each home occupation shall apply for a separate home occupation permit. NOTE: The Tigard Business Tax requires payment for only one (1) Business Tax if the same owner is operating more than one approved business at the same location. Although payment for each separate business is not required, it is required that all names of the businesses' which are currently in operation at that location be specifically listed on the Business Tax Certificate and be visibly posted at the business location. There are no other Home Occupations approved for this site, therefore, this criterion does not apply. There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable material which in the judgment of the Fire Marshall pose a dangerous risk to the residence, its occupants, and/or surrounding properties. Those individuals which are engaged in home occupations shall make available to the Fire Marshal, for review, the Material Safety Data Sheets which pertain to all potentially toxic and/or flammable materials associated with the use; No storage or distribution of toxic or flammable materials is necessary for the proposed use, therefore, this criterion has been satisfied. No home occupation shall require any on or off-street parking other than that normally required for a residence; The applicant has indicated that the driveway is capable of accommodating 4 vehicles. Given the neighbors concerns with adequacy of available parking, the narrow street width that limits parking, and the narrow frontages of the homes around the cul-de-sac that limit on street parking spaces due to the closeness of driveway aprons, staff finds that it is reasonable to require visitors and the off-site employee to park in the driveway. In addition, the large vehicle (>1,500 pound gross vehicle weight) used for the business shall additionally be required to be parked in the garage to satisfy the requirements of Section 18.742.040(A)(10), as discussed later. The applicants' personal vehicles need not necessarily park in the driveway, as these vehicles are not exclusively used for the business; however, the applicants are encouraged to use the driveway and or garage for these vehicles to help alleviate the parking situation. FINDING: The standards related to parking have not been fully addressed. CONDITION: The applicant/owner shall direct the employee and any customers who visit the site to park in the driveway and not utilize on street parking. The following uses are not allowed as home occupations: a Auto-bd a .conducted b Ongoinody m g echanical repair an repair p inting outside of an entirely enclosed building. c Junk and salvage operations. d Storage and/or sale of fireworks. HOP2003-00061/TYPE II TURNER HOME OCCUPATION PAGE 4 OF 6 The proposed Home Occupation does not involve any of the above uses, and will be an office use only, therefore, this criterion has been satisfied. There shall be no exterior storage of vehicles of any kind used for the business except one commercially licensed vehicle of not more than three-quarters ton GVW which may be parked outside of a structure or screened area; The applicant discusses a large, approximately 26,000 GVW landscape truck and small John Deere tractor and trailer. As the landscape truck exceeds the 3/4 ton limit, it will need to be parked inside the garage or within a screened area. If the John Deere tractor and trailer are commercially licensed, they may be parked outside on the driveway. If they are not commercially licensed, they will likewise be required to be parked in the garage. For purposes of this section, "exterior storage" means the keeping of a vehicle overnight in plain view of neighbors. FINDING: The applicant has vehicles used for the business that may run afoul of this standard. CONDITION: Any large vehicle (>1,500 lbs GVW) associated with the business shall be stored in a structure or screened area. One commercially licensed vehicle may be stored outside of a structure or screened area, so long as it is parked in the driveway. Storage means the keeping of a vehicle overnight. There shall be no storage of materials, goods, and equipment unless screened entirely from view by a solid fence. Storage shall not exceed five (5) percent of the total lot area and shall not occur within the front yard or the required side yard setback; The applicant has proposed that materials associated with this business shall be stored in the office or garage storage area. No outdoor storage of materials, goods or equipment is proposed or anticipated, therefore, this criterion has been satisfied. In addition to the general approval criteria, Type-II home occupations allow the following according to the TCDC chapter 18.142.050: (a) One non-illuminated sign, not exceeding 1.5 square feet, which shall be attached to the residence or accessory structure or placed in a window; (b) No more than one outside volunteer or employee who is not a principal resident of the premises; (c) No more than six daily customers or clients. Customers and clients may not visit the business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive traffic or monopolize on-street parking; (d) Storage of materials, goods, and equipment which is screened entirely from view by a solid fence. Storage shall not exceed five (5) percent of the total lot area and shall not occur within the front yard or the required side yard setback. The applicant has indicated that there will be no signage. There will be one outside employee who is not a principal resident. The applicant has indicated that there will be 2-3 customers visiting the site per week. As previously stated, no storage of materials is proposed or anticipated. The hours of operation for the business will be between 7:00 a.m. and 4:00 p.m. While the code does not restrict the times at which a business may operate provided the environmental performance standards (including noise limits) are abided by the code does prohibit customers and clients from visiting the site between the hours of 10:00pm and 8:00am. With the following conditions, these standards will be met. FINDING: The business will be operating during a time when customer and client visits are restricted. CONDITIONS: The applicant shall not allow customers or clients to visit the site before 8:00am or after 10:00pm. HOP2003-00061/TYPE II TURNER HOME OCCUPATION PAGE 5 OF 6 The applicant shall not permit employees (other than the single once a month accountant), subcontractors, or associates to assemble, congregate, or meet at the site. SECTION V. OTHER STAFF COMMENTS The City of Tigard Engineering Department, Residential Plans Examiner, Crime Prevention Officer, and Water Department have all reviewed the proposal and have no objections to it. SECTION VI. AGENCY COMMENTS Tualatin Valley Fire and Rescue has reviewed the proposal and found no conflicts with their interests. SECTION VII. Appeal The Director's Decision is final on the date that it is mailed. Any party with standing as provided in Section 18.390.040.G.1. may appeal this decision in accordance with Section 18.390.040.G.2. of the Tigard Community Development Code which provides that a written appeal together with the required fee shall be filed with the Director within ten (10) business days of the date the Notice of Decision was mailed. The appeal fee schedule and forms are available from the Planning Division of Tigard City Hall, 13125 SW Hall Boulevard, Tigard, Oregon 97223. Unless the applicant is the appellant, the hearing on an appeal from the Director's Decision shall be confined to the specific issues identified in the written comments submitted by the parties during the comment period. Additional evidence concerning issues properly raised in the Notice of Appeal may be submitted by any party during the appeal hearing, subject to any additional rules of procedure that may be adopted from time to time by the appellate body. First of all, we'd like to say that we live only one lot away from the Turners in the turnaround loop. When we look out our front windows, we have a direct view of the drive-way and curb in front of their home. Tracy has a varied work schedule and is in and out of the house at various times during the day, so she is home to see or hear traffic entering the cul-de-sac. In the time that the Turners have lived here, we have not noticed any unusual traffic coming to their home. During the first few months of completion of the home there were different service trucks that would arrive to do certain installations, etc., however, we have noticed many installation or delivery trucks at every home in this cul-de-sac at some time. After the first few months, we would rarely see a service truck there. We do not feel that visitors to their home is excessive and seems to be in line with the number of visitors to every home in the cul-de-sac. Because parking is at a premium (as it is in most cul-de-sacs)when other homes in the cul-de-sac need additional parking, they sometimes use the curb in front of the Turner home, or the space in front of the Oehler home. We rarely see someone parked there, however we realize that even one vehicle there could be misconstrued as a visitor to the Turner home, when in fact it could be a visitor for any home in the loop. We feel that the Turners could have managed their business with a Type I permit but they are being forced by some to get the Type II permit, in hopes of creating some sense of peace. Even if the Turners receive approval for a Type II permit, we know that they will not start parking large vehicles in front of their home or put a sign in the window. This is not our experience of the Turners. From what we know of the Turners, they see their structure first as a home and then second, a place to take care of business. We have no concerns about their business whether operating under a Type I or Type II permit. We feel this whole situation has been blown out of proportion. We have no concerns, nor anticipate any, in the manner in which their business has or is being run out of their home. We list the following reasons why we feel that this permit should not be granted: 1. Our cul-de-sac's access is a narrow street (parking only allowed on one side of street due to narrowness) that creates an unsafe place for additional large commercial, construction and delivery trucks to drive through. 2. There is insufficient parking as a result of the narrow street. 3. Type II Home Occupation will adversely affect neighborhood property values. No one in the neighborhood purchased $300,000+ homes thinking that a business would be allowed to operate next door. It is very unfair of the city to even be considering this permit. 4. There are over 20 children that live in the cul-de-sac who would be put at higher risk due to increased traffic. 5. With respect to noise, we think it is unsuitable to allow business traffic to occur through 10:00 PM in a residential neighborhood. Families would be adversely affected. 6. The Turner's have continually shown a disregard for city code. Even after being asked to conform to them, they have only done so when threatened. Examples of their disregard: a. Operating a Type I business without any permit until forced to comply. b. Operating a Type II business with a Type I permit. c. Continuously parking his 11/2-ton work truck in driveway for several days at a time until forced to comply. d. Repeatedly using fire hydrant water to wash off driveway, sidewalk and street until forced to comply. e. Inconsistent administering of Fonner Woods CC&Rs. More than likely, this type of disregard for city code will manifest itself in the Turners exceeding the bounds of the Type II Home occupation rules (give them an inch and they will take a mile). As you can tell, we feel very strongly that this permit should not be granted. We feel that a construction company should be operated out of an office in an appropriate commercial area, as is the case with the vast majority of construction companies. Mr. Turner could then store all of his equipment and have customers and employees visit him freely without negatively affecting our nice quiet neighborhood. In the past, when he cleared the land here and built houses, his employees violated the permitted hours of construction, cut trees they weren't supposed to cut, threw metal into a shredder which became lethal flying shrapnel in the neighborhood, and set illegal bonfires of wood and debris, + a number of other violations of city and building codes, etc. Accordingly, if the city should approve his application, please make it conditional on his fulfilling and abiding 100% by the terms stated on his request: i.e. only 2-3 clients per week, one outside accountant once a month and 7-4 pm on weekdays [not weekends]. It is our concern that the city also please make sure he will not have construction workers assembling construction components there on the property, or otherwise be engaged in noise nuisances [either commercial business related or by prohibited outside stereo systems], and also any potential parking nuisances/problems on the street. Since most of the people at 113th Pl. bought their properties from him, you might not find some folks a little uneasy about being forthcoming with their legit concerns. Anyway, we just want to keep our neighborhood appropriate to its designated residential zoning. July 18, 2003 S✓�yZZtoe City of Tigard Planning Division ATTN: Morgan Tracy 13125 SW Hall Blvd Tigard, OR 97223 Dear Morgan Tracy, We are writing to you concerning Steve Turner's application for a Home Occupation Permit Type II (HOP 2003-00061). We understand that he is stating that there will be a minimum of clients visiting his home a week but we are concerned that with a Type II permit he can have up to 6 people visit per day. He can also put a sign outside his house under the Type II guidelines, which worries us as well. We do not mind him having a Type I permit and running his business from his home, but we moved to a cul de sac to minimize traffic. Our cul de sac has a problem with parking. There is limited parking at best in the cul de sac. There is parking in front of our home and that is all for 6 neighbors. Steve has a fire hydrant in front of his home that limits parking even further. We also have no parking signs on one side of the street leaving no parking on one side of 113th place. Our cul de sac is also home to 20 children age 1 to 16. At any given time there are anywhere from 3 to 15 children with parents out playing in the cul de sac on bikes, trikes, scooters, and big wheels. The people who live in the cul de sac know to slow down but we had seen a fair share of people who speed in and out of the street. We firmly believe that our neighborhood should not have construction type trucks coming in and out of the neighborhood, or any other excess vehicles, as they would have a hard time seeing a 3 year old on a big wheel or scooter or bike. People who come into our cul de sac do not realize that there are a lot of children playing outside almost all year around. If Steve needs to have clients or sub contractors visit maybe they could meet at the work site alleviating the traffic and parking problems in our neighborhood. Thanks. HOP2003-00061/TYPE II TURNER HOME OCCUPATION PAGE 1 OF 6 CONDITIONS OF APPROVAL UNLESS OTHERWISE NOTED, THE STAFF CONTACT SHALL BE MORGAN TRACY IN THE PLANNING DIVISION AT (503) 639-4171. 1. All Home Occupation standards discussed in this decision and detailed in the Tigard Development Code Chapter 18.742 must be complied with at all times; including the following additional limitations: A. hours of operation shall be between the hours of 7am and 4pm B. maximum 3 clients per week C. one monthly accountant visit D. no additional signage 2. The applicant/owner shall direct the employee or any customers who visit the site to park in the driveway and not utilize on street parking. 3. One commercially licensed vehicle may be stored outside of a structure or screened area, so long as it is parked in the driveway. Storage means the keeping of a vehicle overnight. 4. The applicant shall not allow customers or clients to visit the site before 8:00am or after 10:00pm. 5. The applicant shall not permit employees (other than the single once-a-month accountant), subcontractors, or associates to assemble, congregate, or meet at the site. SECTION III. PUBLIC COMMENTS RECEIVED The City mailed notice to property owners within 500 feet of the subject site providing them an opportunity to comment. The City received seven written responses (three letters, and four e-mails) from neighboring residents. Four of the responses were in support of the application. A response from Mike and Sharon B." notes that the applicant should be held to the proposal as requested (2-3 clients per week, one outside consultant once a month, and 7am-4pm on weekdays only). They also mention their concern of workers assembling at the home site and general noise issues. STAFF RESPONSE: The application does not specify that the business will occur only on weekdays. It is reasonable that the applicant should be held to the proposed extent of business, in terms of hours, signage, number of clients, and an outside employee, as these matters are described in the public notice. The Development Code limits client visits between the hours of 10:00 pm and 8:00 am, and this will be addressed later within this decision. Neither the applicant nor the public notice indicate that there will not be weekend client visits. Assembling employees at the home is not permitted and will be further restricted by a condition of this approval. General noise complaints are handled through nuisance code enforcement. Pierre and Patty Gohier raised six issues with regard to the narrow street, limited parking, impact to property values, child safety, allowing a business to operate until 10:00 PM, and the applicant's history of non-compliance. In addition, Russ and Tena Oehler commented about their concerns with added traffic, limited parking, safety of children playing in the street, and construction vehicles coming down the cul-de-sac. HOP2003-00061/TYPE II TURNER HOME OCCUPATION PAGE 2 OF 6 STAFF REPONSE: 1131 Place was constructed to a 28-foot pavement section standard which limits parking to one side of the street, this is neither out of compliance or unusual for many of Tigard's local streets. With regard to parking, the code permits the Director to place conditions on the application to ensure that off street parking is not monopolized. A condition will be imposed such that business related parking be required to occur in the driveway. With regard to potential loss of property values, the code does not distinguish property value as a review criterion, and there is no evidence to support that such a loss would occur. With regard to child safety impacted by increased traffic, this argument is difficult to assess, since the increase expected from the business is 3 clients per week, and one accountant per month, or 26 additional round trips per month, or an average of 1 additional trip per day. The street is designed to a standard that will accommodate up to 500 vehicles per day (the rough equivalent of 50 houses). With the 12 homes on the cul-de-sac, there is adequate available capacity for the proposed home occupation. With regard to allowing the business to operate until 10:00 PM the code does not limit the hours a business may operate, but rather restricts the times at which off-site clients or an employee may visit the site for the business purpose. Nevertheless, the applicant has proposed that the hours will be between lam and 4pm. Clients will not be permitted to visit the site before 8:00am. This will be limited by a condition of this approval. Issues related to non-compliance will be appropriately handled through code enforcement proceedings as necessary. There is nothing within the code to restrict or prevent construction vehicles from using a public street, however, the code does limit the ability to store such vehicles on the site. In this decision, a condition will be imposed to ensure such overnight storage of heavy vehicles occurs inside a structure and not outside. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Section 18.742.040 states that all home occupations except those that have proven non- conforming status, shall observe the following criteria in addition to the standards established for Type I and Type II uses described in 18.742.050: Home occupations may be undertaken only by the principal occupant(s) of a residential property; The proposed Home Occupation is being undertaken by the property owner who is a principal occupant of the property. There shall be no more than three deliveries per week to the residence by suppliers; The applicant has indicated there will be no more than three deliveries per week of products or supplies to the residence. There shall be no offensive noise, vibration, smoke, dust, odors, heat or glare noticeable at or beyond the property line resulting from the operation. Home occupations shall observe the provisions of the TDC Chapter 18.725, Environmental Performance Standards; No offensive noise, vibration, smoke, dust, odors, etc. are anticipated based on the proposed Home Occupation business since it will be conducted indoors and involves no manufacturing or assembly. The two responses in opposition to the proposed Home Occupation note that they are concerned with potential noise from the business. To this regard, the provisions of the Tigard Municipal Code, Chapter 7.40, apply. Violations of the noise standards are addressed through code enforcement proceedings. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area which may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25% of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation occupying the accessory use exceed 528 square feet. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health and housing codes; HOP2003-00061/TYPE II TURNER HOME OCCUPATION PAGE 3 OF 6 Twenty-five percent of the 2,750 square foot home size is 687 square feet, however, the maximum area the code allows is 528 square feet to be used for a home occupation. The applicant has proposed to use approximately 441 square feet of the residence for the home occupation. Therefore, this standard has been met. A home occupation shall not make necessary a change in the Uniform Building Code use classification of a dwelling unit. Any accessory building that is used must meet Uniform Building Code requirements and be in conformance with TCDC Chapter 18.144 of this title; No additional changes to the dwelling are proposed. More than one (1) business activity constituting two or more home occupations shall be allowed on one property, only if the combined floor space of the business activities does not exceed 25 percent of the combined gross floor area of the residence and accessory structure. Each home occupation shall apply for a separate home occupation permit. NOTE: The Tigard Business Tax requires payment for only one (1) Business Tax if the same owner is operating more than one approved business at the same location. Although payment for each separate business is not required, it is required that all names of the businesses' which are currently in operation at that location be specifically listed on the Business Tax Certificate and be visibly posted at the business location. There are no other Home Occupations approved for this site, therefore, this criterion does not apply. There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable material which in the judgment of the Fire Marshall pose a dangerous risk to the residence, its occupants, and/or surrounding properties. Those individuals which are engaged in home occupations shall make available to the Fire Marshal, for review, the Material Safety Data Sheets which pertain to all potentially toxic and/or flammable materials associated with the use; No storage or distribution of toxic or flammable materials is necessary for the proposed use, therefore, this criterion has been satisfied. No home occupation shall require any on or off-street parking other than that normally required for a residence; The applicant has indicated that the driveway is capable of accommodating 4 vehicles. Given the neighbors concerns with adequacy of available parking, the narrow street width that limits parking, and the narrow frontages of the homes around the cul-de-sac that limit on street parking spaces due to the closeness of driveway aprons, staff finds that it is reasonable to require visitors and the off-site employee to park in the driveway. In addition, the large vehicle (>1 ,500 pound gross vehicle weight) used for the business shall additionally be required to be parked in the garage to satisfy the requirements of Section 18.742.040(A)(10), as discussed later. The applicants' personal vehicles need not necessarily park in the driveway, as these vehicles are not exclusively used for the business; however, the applicants are encouraged to use the driveway and or garage for these vehicles to help alleviate the parking situation. FINDING: The standards related to parking have not been fully addressed. CONDITION: The applicant/owner shall direct the employee and any customers who visit the site to park in the driveway and not utilize on street parking. HOP2003-00061/TYPE II TURNER HOME OCCUPATION PAGE 4 OF 6 The proposed Home Occupation does not involve any of the above uses, and will be an office use only, therefore, this criterion has been satisfied. There shall be no exterior storage of vehicles of any kind used for the business except one commercially licensed vehicle of not more than three-quarters ton GVW which may be parked outside of a structure or screened area; The applicant discusses a large, approximately 26,000 GVW landscape truck and small John Deere tractor and trailer. As the landscape truck exceeds the 3/4 ton limit, it will need to be parked inside the garage or within a screened area. If the John Deere tractor and trailer are commercially licensed, they may be parked outside on the driveway. If they are not commercially licensed, they will likewise be required to be parked in the garage. For purposes of this section, "exterior storage" means the keeping of a vehicle overnight in plain view of neighbors. FINDING: The applicant has vehicles used for the business that may run afoul of this standard. CONDITION: Any large vehicle (>1,500 lbs GVW) associated with the business shall be stored in a structure or screened area. One commercially licensed vehicle may be stored outside of a structure or screened area, so long as it is parked in the driveway. Storage means the keeping of a vehicle overnight. There shall be no storage of materials, goods, and equipment unless screened entirely from view by a solid fence. Storage shall not exceed five (5) percent of the total lot area and shall not occur within the front yard or the required side yard setback; The applicant has proposed that materials associated with this business shall be stored in the office or garage storage area. No outdoor storage of materials, goods or equipment is proposed or anticipated, therefore, this criterion has been satisfied. In addition to the general approval criteria, Type-II home occupations allow the following according to the TCDC chapter 18.142.050: (a) One non-illuminated sign, not exceeding 1.5 square feet, which shall be attached to the residence or accessory structure or placed in a window; (b) No more than one outside volunteer or employee who is not a principal resident of the premises; (c) No more than six daily customers or clients. Customers and clients may not visit the business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive traffic or monopolize on-street parking; (d) Storage of materials, goods, and equipment which is screened entirely from view by a solid fence. Storage shall not exceed five (5) percent of the total lot area and shall not occur within the front yard or the required side yard setback. The applicant has indicated that there will be no signage. There will be one outside employee who is not a principal resident. The applicant has indicated that there will be 2-3 customers visiting the site per week. As previously stated, no storage of materials is proposed or anticipated. The hours of operation for the business will be between 7:00 a.m. and 4:00 p.m. While the code does not restrict the times at which a business may operate provided the environmental performance standards (including noise limits) are abided by the code does prohibit customers and clients from visiting the site between the hours of 10:00pm and 8:00am. With the following conditions, these standards will be met. FINDING: The business will be operating during a time when customer and client visits are restricted. CONDITIONS: The applicant shall not allow customers or clients to visit the site before 8:00am or after 10:00pm. R. Turner Construction LLC and Steve and Mary Jena' Turner Brief Description Our house is one of 12 houses on a cul-de-sac street off of Fonner Street. We are the fifth house in on the left side of the street and the first house as the curve of the cul-de-sac begins. We have a 2 1/2 story house. The first level is a four-car garage. There are two single garage doors on both ends and a double door in the middle. As you face the house there is a French door in place of the right hand garage door,which is the entry to our office. The office occupies one stall of the garage, which is 324 square feet. We use the space under a stairway as storage, which is 36 square feet. Lastly we use one wall of the other single car garage for storage of tools, which is 81 square feet. Our business uses a total of 441 square feet. We do have a 26,000 (GVW) landscape truck and a small John Deere tractor and trailer. We pay to store this equipment off site. On occasion the truck and or tractor does come to our home to load tools, garbage or routine maintenance. However it is not ever here over night and it is usually parked in our driveway. On occasion it is parked on the street if the driveway is occupied. The other vehicles are used part for business and part personal. They are a Chevy pickup and a Chevy Suburban. Proposed Use We are a small residential homebuilder. We build anywhere from 5 to 10 houses a year. The office is used to administer the various aspects of our business. The majority is bookkeeping and scheduling. Occasionally when we are bidding a job subs come and pick up or drop off plans. Most of our contact with our subs or clients is at the job site. Once a month a CPA comes to our office to do monthly close out of our books. Impact Study Project: Home Occupation Permit Type II, S.R. Turner Construction Transportation System and Parking We live and work at 12933 SW 113`h Place, which is off of Fonner Street. One hundred thirteenth is a cul-de-sac and it serves 12 homes. We have a four-car garage and respective four-car driveway., therefore we do not require any additional parking on the street. Since we have very few visits to our office there should not be a noticeable change in traffic on SW 113`h or Fonner Street. We have no permanent employees who work at our office so there will not be any routine traffic. Client and Vender visit will be minimal, less than 3 per week. We do have a 26,000 GVW landscape truck and a small tractor, which we pay to store in a nearby location. We do not store them at our home office however on occasion they will be here several hours for light maintenance or personal use. We will utilize driveway parking for these as well. Drainage and Water System: There will be no impact on the drainage or water system as we do only administration from our home office. Sewer System: Again there will be no impact on the public sewer system as there is only administration and no additional occupants. Noise Impacts: We do not generate any noise as a result of our office work. Restrictions in the Vegetate Corridor: NO structures, development, construction activities, gardens, lawns, application of chemicals, dumping of any materials of any kind, or other activities shall be permitted which otherwise detract from the water quality protection provided by the vegetated corridor, except as provided for in the USA Design and Construction Standards. Location of Vegetated Corridor: IN ANY RESIDENTIAL DEVELOPMENT WHICH CREATES MULTIPLE PARCELS or lots intended for separate ownership, such as a subdivision, the vegetated corridor shall be contained in a separate tract, and shall not be a part of any parcel to be used for the construction of a dwelling unit. I I TREE REMOVAL PLAN REQUIREMENTS (Refer to Code Section 18.190.030.CJ A TREE PLAN FOR THE PLANTING, REMOVAL AND PROTECTION OF TREES prepared by a certified arborist shall be provided for any lot, parcel or combination of lots or parcels for which a development application for a subdivision, partition, site development review, planned development, or conditional use is filed. Mitigation must follow the replacement guidelines of Section 18.790.060.D according to the following standards and shall be exclusive of trees required by other development code provisions for landscaping, streets and parking lots: • Retainage of less than 25% of existing trees over 12 inches in caliper requires a mitigation program according to Section 18.150.070.D. of no net loss of trees; • Retainage of from 25 to 50% of existing trees over 12 inches in caliper requires that two-thirds of the trees to be removed be mitigated according to Section 18.790.060.D.; • Retainage of from 50 to 75% of existing trees over 12 inches in caliper requires that 50% of the trees to be removed be mitigated according to Section 18.790.060.D.; • Retainage of 75% or greater of existing trees over 12 inches in caliper requires no mitigation; • Identification of all trees which are proposed to be removed; and A protection program defining standards and methods that will be used by the applicant to protect trees during and after construction. TREES REMOVED WITHIN THE PERIOD OF ONE (1) YEAR PRIOR TO A DEVELOPMENT APPLICATION LISTED ABOVE will be inventoried as part of the tree plan above and will be replaced according to Section 18.790.060.D. I I MITIGATION (Refer to Code Section 18.190.0601.1 REPLACEMENT OF A TREE shall take place according to the following guidelines: • A replacement tree shall be a substantially similar species considering site characteristics. If a replacement tree of the species of the tree removed or damages is not reasonably available, the Director may allow replacement with a different species of equivalent natural resource value. • If a replacement tree of the size cut is not reasonably available on the local market or would not be viable, the Director shall require replacement with more than one tree in accordance with the following formula: • The number of replacement trees required shall be determined by dividing the estimated caliper size of the tree removed or damaged, by the caliper size of the largest reasonably available replacement trees. If this number of trees cannot be viably located on the subject property, the Director may require one (1) or more replacement trees to be planted on other property within the city, either public property or, with the consent of the owner, private property. • The planting of a replacement tree shall take place in a manner reasonably calculated to allow growth to maturity. IN LIEU OF TREE REPLACEMENT under Subsection D of this section, a party may, with the consent of the Director, elect to compensate the City for its costs in performing such tree replacement. El CLEAR VISION AREA (Refer to Code Chapter 18.795) The City requires that CLEAR VISION AREAS BE MAINTAINED BETWEEN THREE (3) AND EIGHT (8) FEET IN HEIGHT at road/driveway, road/railroad, and road/road intersections. The size of the required clear vision area depends upon the abutting street's functional classification and any existing obstructions within the clear vision area. The applicant shall show the clear vision areas on the site plan, and identify any obstructions in these areas. The plan shall show the pattern of existing and proposed future streets from the boundaries of the proposed land division and shall include boundaries of the proposed land division and shall include other parcels within 200 feet surrounding and adjacent to the proposed land division. Identify existing or proposed bus routes, pullouts or other transit facilities, bicycle routes and pedestrian facilities on or within 500 feet of the site. Where necessary to give access or permit a satisfactory future division of adjoining land, streets shall be extended to the boundary lines of the tract to be developed. Applications involving difficult or protracted issues or requiring review by other jurisdictions may take additional time to review. Written recommendations from the Planning staff are issued seven (7) days prior to the public hearing. A 10-day public appeal period follows all land use decisions. An appeal on this matter would be heard by the Tigard t-(e 01+1 cX^' . A basic flow chart which illustrates the review process is available from the Planning Division upon request. Land use applications requiring a public hearing must have notice posted on-site by the applicant no less than 10 days prior to the public hearing. The office occupies one stall of the garage,which is 324 square feet. We use the space under a stairway as storage, which is 36 square feet. Lastly we use one wall of the other single car garage for storage of tools, which is 81 square feet. Our business uses a total of 441 square feet. We do have a 32,000(GVW) landscape truck and a small John Deere tractor and trailer. We pay to store this equipment off site. On occasion the truck and or tractor does come to hour home to load tools or garbage or routine maintenance. However it is not ever here over night and it is usually parked in our driveway. On occasion it is parked on the street if the driveway is occupied. The other vehicles are used part for business and part personal. They are a Chevy pickup and a Chevy Suburban. Proposed Use We are a small residential homebuilder. We build anywhere from 5 to 10 houses a year. The office is used to administer the various aspects of our business. The majority is bookkeeping and scheduling. Occasionally when we are bidding a job subs come and pick up or drop off plans. Most of our contact with our subs or clients is at the job site.
