No business activity shall begin until after the appeal period has expired.
THIS HOME OCCUPATION IS SUBJECT TO THE FOLLOWING CONDITIONS:
1.) Home occupations may be undertaken only by the principal occupant(s) of a residential property;
2.) There shall be no more than three deliveries per week to the residence by suppliers;
3.) There shall be no offensive noise, vibration. smoke, dust, odors. heat or glare noticeable at or beyond the property
line resulting from the operation. Home occupations shall observe the provisions of the Tigard Community
Development Code (TCDC) Chapter 18.090, Environmental Performance Standards;
4.) The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The
total area which may be used in the accessory building for either material product storage and/or the business activity
shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products
shall not occupy more than 25 percent of the combined residence and accessory structure gross floor area. The
indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire,
health and housing codes;
5.) A home occupation shall not make necessary a change in the Uniform Building Code use classification of a dwelling
unit. Any accessory building that is used must meet Uniform Building Code requirements and be in conformance with
TCDC Chapter 18.144 of this title;
6.) More than one (1) business activity constituting two or more home occupations shall be allowed on one property, only
if the combined floor space of the business activities does not exceed 25 percent of the combined gross floor area of
the residence and accessory structure. Each home occupation shall apply for a separate home occupation permit
(The Tigard Business Tax requires payment for only one (1) Business Tax if the same owner is operating more than
one approved business at the same location. Although payment for each separate business is not required, it is
required that all names of the businesses' which are currently in operation at that location be specifically listed on the
Business Tax Certificate and be visibly posted at the business location.

7 ) There shall be no storage ^nd/or distribution of toxic or flammable materials, and spray painting or spray finishing
operations that involve to. r flammable material which in the judgmE the Fire Marshall pose a dangerous risk
to the residence, its occupants, and/or surrounding properties. Tho.._ individuals which are engaged in home
occupations shall make available to the Fire Marshal, for review, the Material Safety Data Sheets which pertain to all
potentially toxic and/or flammable materials associated with the use;
8.) No home occupation shall require any on or off-street parking other than that normally required for a residence.
9.) The following uses are not allowed as home occupations:
(a) Auto-body repair and painting.
(b) Ongoing mechanical repair conducted outside of an entirely enclosed building.
(c) Junk and salvage operations.
(d) Storage and/or sale of fireworks.
10.) There shall be no exterior storage of vehicles of any kind used for the business except one commercially licensed
vehicle of not more than three-quarters ton GVW which may be parked outside of a structure or screened area.
11.) There shall be no storage of materials, goods, and equipment unless screened entirely from view by a solid fence.
Storage shall not exceed five (5) percent of the total lot area and shall not occur within the front yard or the required
side yard setback.
TYPE-II HOME OCCUPATIONS ALLOW THE FOLLOWING ACCORDING TO THE TCDC CHAPTER 18.142.050:
(a) One non-illuminated sign, not exceeding 1.5 square feet, which shall be attached to the residence or
accessory structure or placed in a window;
(b) No more than one outside volunteer or employee who is not a principal resident of the premises;
(c) No more than six daily customers or clients. Customers and clients may not visit the business between
the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive traffic or monopolize on-street
parking;
(d) Storage of materials, goods, and equipment which is screened entirely from view by a solid fence.
Storage shall not exceed five percent of the total lot area and shall not occur within the front yard or the
required side yard setback.
IF ANY OF THE PRECEDING CONDITIONS ARE NOT MET, THIS HOME OCCUPATION PERMIT WILL BE IMMEDIATELY INVALIDA1i 0.

including.but not limited to,at apparatus and equipment,whether affixed to the land or building thereon or not affixed thereto,whether single units or centrally
controlled. used to provide or supply air-cooling. air-conditioning, heat, gas, water. lioht and power. refrigeration. ventilation. laundry, clothes drying,
dishwashing,garbage disposal or other services,waste vent systems.antennas,pool equipment.window coverings,drapes and drapery rods.carpeting and
floor coverings.awnings.ranges and ovens,water heaters,attached cabinets,pumps,pipes,tanks.fire prevention,fire extinguishing and communications
apparatus,elevators.escalators, partitions.and all replacements aria substitutions therefor and all proceeds thereof,and all of the above items are declared
to be and are deemed to be things affixed to and a part of the realty for the purposes of this Deed of Trust.
TOGETHER WITH all interest which Trustor now has or may hereafter acquire in or to said property and in and to:
(a) All Vents,issues,profits.royalties,tolls,earnings and incomes therefrom and installments of money payable pursuant to any agreement for sale of
said property or any part thereof.
(b) All easements,rights of way and other appurtenances thereto;
(c) All shrubs,trees and plants:
(d) All adjacent lands included in enclosure or occupied by buildings located partly on the above described property;
(e) All crops growing or to be grown on said property;
(f) All water and water rights(whether or not appurtenant)and shares of stock pertaining to water or water nghts,ownership of which affects said
property;
(g)All claims,demands or causes of action of any kind,including proceeds of settlement of any such claim,demand or cause of action of any kind.which
Trustor now has or may hereafter acquire,arising out of acquisition or ownership of the property,subject however to the right,power and authority given to
and conferred upon Beneficiary by Paragraph 5 below.Trustee snail have no duty to prosecute any such ciarm.demand or cause of action.
(h) All minerals and mineral rights.
For the purposes of this instrument.including all provisions incorporated by reference herein,all of the foregoing described real property,property rights
and interest shall be referred to as"the property".
THIS DEED OF TRUST SECURES AN ADJUSTABLE RATE NOTE-SEE PARAGRAPH 24.
THIS DEED OF TRUST IS FOR THE PURPOSE OF SECURING THE FOLLOWING:
A.Payment of the Loan Amount above,with interest thereon,according to the terms of a Promissory Note or Notes(herein sometimes referred to as
"the note")of even date herewith.made by Trustor,payable to Beneficiary or order,and any and al modifrcabonsand extensions or renewals thereof(see

B.Payment of such additional sums with interest thereon as may be hereafter borrowed torn Beneficiary by the then record owner or owners of the

C.Payment,performance and discharge of every obligation,covenant and agreement ofTrusior whether contained or incorporated by reference in
this Deed of Trust.or contained in any instrument now or hereafter executed by Trustor ncarnectionweftthe loan evidenced by the Note,including but not
limited to any assignment. construction loan agreement, pledge agreement,seemly agreement,supplemental agreement,assignment of Lessor's
interest in leases,modification agreement or assumption agreement; _
D.Payment of all sums of money with interest which may be paid out or advanced by orally otherwise be due to Trustee or Beneficiary under any
provision of this Deed of Trust;
E.At Beneficiary's option,payment with interest thereon of any other present oiIeI'K *O&1ess or Obligation of Trustor or of any successor in
interest to Trustor to the property)to Beneficiary.whether created directly or acquired bYasiOrreert,whetherabsolute or contingent,whether due or not,
whether otherwise secured or not,or whether existing at the timeof the execubon&thisDeed onhist oransing thereafter.Exercise of such option shall be
evioenced by a notice in writing to Trustor or any successor in interest to Trustor.
