materials, and spray painting or spray finishing operations that involve
toxic or flammable material which in the judgement of the Fire Marshall
pose a dangerous risk to the residence, its occupants, and/or surrounding
properties. Those individuals which are engaged in home occupations shall
make available to the fire marshall for review the Material Safety Data
Sheets which pertain to all potentially toxic and/or flammable materials
associated with the use;
8) No home occupation shall require any on or off-street parking other than
that normally required for a residence;
9) The following uses are not allowed as home occupations:
a) Auto-body repair and painting
b) Ongoing mechanical repair conducted outside of an entirely
enclosed building
c) Junk and salvage operations
d) Storage and/or sale of fireworks
10) There shall be no exterior storage of vehicles of any kind used for the
business except one commercially licensed vehicle of not more than three-
quarters ton GVW which may be parked outside of a structure or screened
area.
Type II home occupations allow the following according to TDC Chapter 18.142.050:
a) One non-illuminated sign, not exceeding 1.5 square feet, which shall
be attached to the residence or accessory structure or placed in a
window;
b) No more than one outside volunteer or employee who is not a
principal resident of the premises;
c) No more than six daily customers or clients. Customers and clients
may not visit the business between the hours of 10:00 p.m. and 8:00
a.m. and shall not generate excessive traffic or monoploize on-
street parking;
d) Storage of materials, goods, and equipment which is screened
entirely from view by a solid fence. Storage shall not exceed five
percent of the total lot area and shall not occur within the front
yard or the required side yard setback;
If any of the preceding conditions are not met, this Home Occupation Permit will
be immediately invalidated.

occupy more than 25 percent of the combined residence and accessory
structure gross floor area. The indoor storage of materials or products
shall not exceed the limitations imposed by the provisions of the
building,fire,health and housing codes;
5) A home occupation shall not make necessary a change in the Uniform
Building Code use classification of a dwelling units. Any accessory
building that is used must meet Uniform Building Code requirements and be
in conformance with TDC Chapter 18.144 of this title;
6) More than one business activity constituting two or more home occupations
shall be allowed on one property only if the combined floor space of the
business activities does not exceed 25 percent of the combined gross floor
area of the residence and accessory structure. Each home occupation shall
apply for a separate home occupation permit.

Dear Mr. Pomeroy:
I am writing to you in reference to the notice we received
regarding the issuance of a home occupation permit at the above
described address. The nature of the business is wholesale
automobiles.
Quite frankly, I was totally taken by surprise that the City of
Tigard planning department has total disregard for its residents.
Specifically, the permit has been issued before notice was given
to neighbors affected by the decision, which would give them a
chance to voice their opinions or concerns about the situation.
Please believe me this is not due to any conflict with Mr. Wu as a
neighbor. (Quite honestly, I hardly know the gentleman. ) I also
have the deepest respect for a person wanting to start or maintain
their own business.
I am however very concerned that due to the nature of the
business, it will bring additional traffic to the neighborhood.
There are a lot of children playing in the street constantly. one
of the advantages of this street is the fact there isn' t an
outlet, which reduces traffic flow.
Along with more traffic you are allowing more strangers to be in
the neighborhood which will almost certainly raise the incidence
for crime. We have enjoyed a relatively crime free neighborhood,
at least up until now.

Mr. Pomeroy, I understand that since the permit has been approved,
the burden of proof to appeal the situation rests on the adjacent
homeowners, and unless Mr. Wu is in violation of conditions
outlined, it will be nearly impossible to cancel the permit.
Of the neighbors I have talked to, there hasn' t been one who has
favored your decision.
Who is responsible for excessive noise and traffic?
who is responsible for injuries, especially to children, as a
result of extra vehicular traffic?
Who is responsible for increased crime in the neighborhood as a
result of the decision?
I 'd be willing to bet money the city of Tigard won' t accept any of
the responsibility.
For the record, I want to state I am in total disagreement of this
decision. Any violations of the conditions for the permit will be
noted and reported to the proper authorities.
It would be appreciated if the City of Tigard would let its
established residents know what they are planning for them ahead
of time, rather than spring it on them by surprise, when it' s too
late to do anything about it!

Thank you for your letter dated May 12, 1993 regarding concerns,
and objections related to both the approval of HOP 93-0052 and the
City of Tigards' Home Occupation Permit process.
The City of Tigard Planning Division does not have "total
disregard" for the residents of this city, as stated in your
letter. The review of a Home Occupation Permit application by the
Planning Division, as well as any other land use application, is
entirely nondiscretionary. If an applicant meets the applicable
requirements for approval, the legal obligation of the Planning
Division is to approve that application. To do otherwise would be
to deny the applicant their legal right to the opportunities
provided by City Council through the Community Development Code and
the Comprehensive Plan..
This permit (HOP 93-0052) has been issued in accordance with the
code standards which were approved by the City Council. The City
Council approved the existing Home Occupation Permit process
through a series of evening meetings with all Neighborhood Planning
Organizations as well as public hearings held before the City
Council. The Planning Division now administers this process.
The City of Tigard does not require a public hearing for
nondiscretionary land use decisions. Due to the sensitive nature
of Home Occupation Permits and the information which was presented
through the public hearing process, the standard 10 day "request
for comment" period and the 10 day public appeal period required by
the ORS was lengthened by the City Council to 20 days. "
You are correct in stating that, unless Mr. Wu is in violation of
the conditions outlined in the approval, the Planning Division will
not revoke his permit. The burden of proof is always on the one
who is making the accusation of illegal behavior, whether it be a
neighbor, the City, another business owner, or someone else. Prior
to revocation, it must be demonstrated that the guidelines of the
permit have been violated and the person(s) will not bring the
situation back into compliance.

If you, or anyone else, are witness to any violations of this
permit approval, please contact the City of Tigard Code Enforcement
Officer, Mr. Ken Schreindl, at 639-4171. If the activities which
are witnessed necessitate immediate emergency response, please
contact the City of Tigard Police Department by dialing 911.
Mr. Eldridge, I am placing your letter in Mr. Wu's Home Occupation
Permit file (HOP 93-0052) for permanent reference. The concerns of
the citizens of this City are not taken lightly. Although your
concerns are understood, there must first be legal and defensible
grounds for the removal of the rights of any citizen regardless of
the situation.
