The MU-CBD zoning district is designed to provide a pedestrian friendly urban village in Downtown Tigard. A wide variety of commercial, civic, employment, mixed-use, multi- family and attached single family residences are permitted. New development and re-development is required to conform to the standards of Chapter 18.610. SUB-AREA: Fanno -Burnham Street. This sub-area provides an opportunity for medium scale residential or mixed use development. Compatible mixed uses (live-work, convenience retail,office and civic uses) are encouraged on the frontage of Burnham Street. The area in proximity to Fanno Creek Park will be an opportunity to create a high quality residential environment with views and access to the natural amenity of Fanno Creek Park. Building heights will step down to three stories so as not to overwhelm or cast shadows on the park. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.610.030 SECTION II. The findings and conclusions on which the decision is based are noted in Section IV. 1. Prior to issuance of a site permit, the applicant shall submit a landscape plan showing the species of trees to be planted as replacement trees. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. SITE AND PROPOSAL INFORMATION Site Information& History The site is located on SW Hall Boulevard, and is developed with a building and associated landscaping and parking. The site and surrounding properties were rezoned from CBD (Central Business District) to MU- CBD (Mixed Use —Central Business District) in 2010 to create the Tigard Downtown District. Sub-areas were established within the downtown,and this site is located within the Fanno- Burnham Street sub-area. Proposal Information The applicant's proposal includes the following: 1. Removal and replacement of the Exterior Insulation Finishing System (EIFS). 2. Facade improvements include modifications to the entryway canopy between City Hall and the Permit Center and a new window on the south side of the Permit Center building. 3. Demolition of existing landscaping and replanting of new landscaping. There will not be a change in square footage of landscaping. 4. Removal of 26 trees along the perimeter of the building and within the parking area. The replacement trees are on the city's approved tree lists. Because the proposal meets the threshold of a Track 1 Design Review Compliance Letter (Tigard Development Code Section 18.610.010.E.1), the application is being processed through a Type I procedure. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Tigard Downtown District Development and Design Standards (18.610) 18.610 TIGARD DOWNTOWN PLAN DISTRICT 18.610.030 Building and Site Design Standards A. Create Vibrant ground floors, streetscapes and rights-of-way; provide weather protection; and promote safety and security. Design standards in this section are intended to foster vibrant, inviting streetscapes and sidewalk-facing ground floors and entryways. They also will help ensure that the ground floor promotes a sense of interaction between activities in the building and activities in the public realm. 5. Weather Protection. For non-residential and mixed use buildings: a. A projecting façade element (awning, canopy, arcade, or marquee) is required on the street-facing facade of the street with the highest functional classification. b. Awnings/marquees/canopies may project a minimum of three feet and a maximum of six feet from the facade (a maximum of four feet into the public right- of-way). c. The element shall have a minimum 10-foot clearance from the bottom of the element to the sidewalk. d. Awnings must match the width of storefronts or window openings. e. Internally lit awnings are not permitted. f. Awnings must be made of glass, metal, or exterior grade fabric (or a combination of these materials). There is an existing canopy above the entry to the building; however the entry does not face the street. The proposal only includes minor modifications to the existing canopy. The entryway will remain easily accessible and protection from the elements for pedestrians will be improved.This standard is met. E. Assure building quality, permanence and durability - Building Materials: The following exterior building materials or finishes are prohibited: 1. Vinyl siding; 2. T-111 or similar sheet materials; 3. Plain concrete block (not including split faced, colored, or other block designs that mimic stone, brick, or other masonry); foundation material may be skim- coated concrete block where the foundation material is not revealed for more than two feet; 4. Mirrored glass. The proposal does not include any of the prohibited materials. This standard is met. SECTION V. This application includes the required materials for the Downtown Design Review-Type I Application, including: • Completed Application Form with owner's signatures/written authorization • Applicant's Statement/Narrative (this memo) • Ownership documentation • Landscape Removal Plan • Landscape Material List • Site/Plot Plans Project Description Several areas of failing or compromised Exterior Insulation Finishing System (EIFS) stucco on the Permit Center,City Hall,and Police Department buildings will be removed and replaced. Along with these improvements, facade modifications will also be made to the entryway canopy between the Permit Center and City Hall,a window will be added on the south wall of the Permit Center. Because of the proximity of the vegetation surrounding the structures,demolition of the existing landscaping and installation of new landscaping will also be included;however all landscaping activity will remain in the existing beds and no additional beds will be created. Compatible mixed uses (live-work, convenience retail, office and civic uses) are encouraged on the frontage of Burnham Street. The area in proximity to Fanno Creek Park will be an opportunity to create a high quality residential environment with views and access to the natural amenity of Fanno Creek Park. Building heights will step down to three stories so as not to overwhelm or cast shadows on the park. Response: According to Map 18.610.A the project lies within the boundaries of the Fanno-Burnham Street sub-area. B. Development standards. Development standards apply to all new development in the MU-CBD zone,including developments utilizing the Track 3 approval process.Variances or adjustments may be granted if the criteria found in Chapter 18.370 are satisfied. 1. Development standards matrix. See Table 18.610.1 and Map 18.610.A. Response: Per footnote ' for table 16.610, the standards do not apply to existing structures such as the one indicated in this application. • 18.610.025 Connectivity A. Purpose statement.The purpose of this section is to implement the City of Tigard 2035 Transportation System Plan which describes a more complete system of streets and pathways to improve multi-modal access to, from and within the downtown mixed use central business district.The standards in this section are intended to execute connectivity improvement projects that will foster creation of smaller block sizes, efficient routes into and within downtown, and new streets to accommodate and encourage downtown development.The standards are also intended to solve some existing connectivity issues, such as access across railroad tracks. B. Applicability. The connectivity standards in this section apply only to those properties with designated streets or alleys as shown on Figures 5-14A through 5-14I of the City of Tigard 2035 Transportation System Plan. Development on properties with designated streets or alleys is subject to the connectivity requirements below. CITY OF TIGARD URBAN FORESTRY MANUAL (Section 7) • Section 7 -Development Tree Removal and Replacement Standards Part 1. Development Tree Removal Standards: A. Trees subject to the requirements of Chapter 8.12 shall be removed in a manner consistent with tree care industry standards. Response: Trees will be removed in a manner which conforms to the standards. B. The city manager or designee shall approve the removal of trees subject to the requirements of Chapter 8.12 if any one of the following criteria [on page 7-1 of the Urban Forestry Manual] are met: Response:Trees to be removed have been determined to be in advanced stages of decline with insufficient live foliage. In addition,some trees are causing damage to the sidewalks. These responses meet two of the needed one criterion for accepted removal. C. Unless removed for thinning purposes (Part 1.B.11 above) the city manager or designee shall condition the removal of each tree upon the planting of a replacement tree in accordance with City of Tigard:Downtown Design Review Application (City Hall,police and permit Center Re-skin TL 2S102DA00401) Page 7 the Development'free Replacement Standards in Section 7,part 2 of the Urban Forestry Manual. Response:Trees will be removed in accordance with Section 7, Part 2 of the Urban Forestry Manual. D. If the Development Tree Replacement Standards in Section 7,part 2 preclude replanting within the same property as the tree that was removed, the applicant shall be exempt from planting a replacement tree. Response: Trees will be planted on the same property in approximately the same location. Part 2. Development Tree Replacement Standards: A. Replacement trees shall be planted in a manner consistent with tree care industry standards. Response:Trees will be removed in a manner which conforms to the Urban Forestry Manual standards. B. The replacement tree shall be located so as to replace the function of the tree that was removed. Response: Trees will be planted in approximately the same location as the removed tree. C. The replacement species shall be the same stature or greater (at maturity) as the tree that was removed. Response: Trees to be planted will be the same stature or greater than those which are to be removed. See Tree Replacement List. D. If the tree that was removed was part of a stand of trees, then the following standards apply to the replacement tree: Response: Trees to be removed are not part of a stand of trees. E. If the tree that was removed was an open grown tree, then the following standards apply to the replacement tree: 1. The replacement tree shall be selected from any of the tree lists in the Urban Forestry Manual (except the nuisance tree list) unless otherwise approved by the city manager or designee; Response: Trees to be replaced have been selected from the recommended tree list shown as Appendix 3 of the Urban Forestry Manual and are specified on the memo from the Mears Design Group (see attached). 2.
