MMD2000-00007 MMD2000 - 00007 LOWE ' S (Eagle Hardware and Garden Center Store) May 5, 2000 CITY OF TIGARD Michael Robinson OREGON Standard Insurance Center 900 SW Fifth Avenue, Suite 2600 Portland, OR 97204 Dear Mr. Robinson: This letter is in response to your request for Minor Modification (MMD2000-00007) approval to modify the approved site plan for the Eagle Hardware store approved by SDR 98-0007. The modification requested will relocate the location of proposed bicycle racks, move the building entrance, modify the loading area, increase the height of the wall adjacent to the outdoor garden area to 20 feet and change the building materials to split- face block. The requested modifications are primarily in response to differences in the current owner's building design (Lowe's) from the Eagle Hardware building design in regards to the building entrance. In addition, the garden area is used slightly differently necessitating the need for a higher wall to screen pallets stored overhead. This property is zoned General Commercial (CG). The Tigard Community Development Code, Site Development Review Section states: "if the requested modification meets any of the major modification criteria, the request shall be reviewed as a new Site Development Review application." Section 18.120.070(B) states that the Director shall determine that a major modification(s) will result if one (1) or more of the following changes are proposed: 1. An increase in dwelling unit density, or lot coverage for residential development. The proposal does not involve a residential development, therefore, this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criteria is not applicable as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.106. The modification will not increase or decrease floor area, therefore, there is no change in the number of parking spaces required. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. An increase in the height of the building(s) by more than 20 percent. No change in the height of any building is proposed. The height of a wall is being increased to 20 feet adjacent to the garden center, however, this wall is not part of the main building and will not be higher than the existing building or the roof of the garden center. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. This request will not require a change in accessways or parking areas where off-site traffic would be affected. 7. An increase in vehicular traffic to, and from the site, and the increase can be expected to exceed 20 vehicles per day. There is no increase in floor area, therefore, there is not increase in vehicular traffic anticipated as a result of this modification. 8. An increase in the floor area proposed for a non-residential use by more than 10 percent excluding expansions under 5,000 square feet. The modification will not increase the floor area, therefore, this standard has been met. 9. A reduction in the area reserved for common open space and/or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10 percent. There is no area reserved for common open space, therefore, this standard does not apply. 10. A reduction of project amenities (Recreational facilities, Screening; and/or, Landscaping provisions) below the minimum established by this code or by more than 10 percent where specified in the site plan. The proposed modifications will not result in a reduction in project amenities as they are simply minor modifications necessary to accommodate the interior floor plan changes as a result of a change in ownership. 11. A modification to the conditions imposed at the time of Site Development Review approval which are not the subject of B. 1 through 10 above. The proposed modifications do not modify conditions previously approved. The modifications are not in conflict with the development code standards or the DET recommendation to the Planning Commission. The applicant has revised the location of the icons on the building adjacent to the wall area being increased to insure that the tiles requested by the DET are visible.
