APPLICATION SUMMARY FILE NAME: Arellano's Market Expansion CASE NO.: Minor Modification (MMD) MMD2014-00013 PROPOSAL: The proposed minor modifications to existing development would allow a change of land use of approximately 1,440 square feet from personal services (a former dry-cleaning store) to an eating and drinking establishment with table service. The proposed eating and drinking establishment would have internal circulation with the adjoining retail use (Arellano's Market) and would share kitchen space. No exterior changes are proposed with this application. The MU-CBD zoning district is designed to provide a pedestrian friendly urban village in Downtown Tigard. A wide variety of commercial, civic, employment, mixed-use, multi-family and attached single family residences are permitted. New development and re-development is required to conform to the standards of Chapter 18.610. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to one condition of approval as described in Section III. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION IV. CONDITIONS OF APPROVAL 1. Prior to final occupancy of the proposed restaurant space, the applicant shall remove all solid waste and recycling presently stored in the southern setback adjacent to Hall Boulevard, to be permanently relocated to the existing garbage and recycling pickup area on the north side of the building. SECTION IV. BACKGROUND INFORMATION Site Information: The project is located in a strip mall near the intersection of Hall Boulevard and Pacific highway. The existing building is approximately 10,955 square feet, is divided into five tenant suites containing a variety of uses, and has 39 parking spaces on site. Existing uses include Napa Auto Parts, Secret Beauty Salon, Maddy's, a vacant tenant suite that formerly housed a dry cleaner, and Arellano's Market. Proposal Description: The applicant proposes to convert the former dry cleaning space into a site-down restaurant space that would share a kitchen with Arellano's Market. While there would be internal circulation with the market, the two spaces may operate independently with varied hours of operation. Staff noted during a site visit that a significant amount of recycling and solid waste was being stored in the setback area between Hall Boulevard and the structure. Plans submitted show a trash enclosure proposed to enclose that area, but per a conversation with the business owner Omar Arellano, that proposal is to be removed and his business will place all garbage and recycling within the existing solid waste pickup area on the north side of the building. As a result there are no external changes proposed to the structure or sight, and as such the Downtown Design Review does not apply and the change of use is to be processed under a Minor Modification to Existing Development. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: The proposed change in use requires a Minor Modification to approved plans or existing development. Section 18.360.060.0 states that a minor modification shall be approved, approved with conditions or denied following the Director's review and as follows: 1. The proposed development is in compliance with all applicable requirements of this title; and MMI)2014-00013:Arcllanos Market Expansion 2 of 3 FINDING: The proposed change in land use complies with standards applicable to the MU-CBD zone. Off-street parking and loading standards are met. As discussed above, the applicant's existing market is not in compliance with standards pertaining to the storage of solid waste and recycling, and a condition of approval has been applied that will require compliance with this standard. As conditioned, this criterion is met. 2. The modification is not a major modification. FINDING: Staff finds that the changes listed in TDC18.360.050.B.1-11 are either satisfied or do not apply. No relevant conditions of approval were discovered during a review of the site's permit history. No additional parking or change in site access is proposed or required. Not more than 100 new trips per day are anticipated. Therefore, the proposed development is not a major modification. This criterion is met. CONCLUSION: The proposal is a minor modification of existing site development and is in compliance with the applicable requirements of this title. SECTION V. Based on this information, one can conclude that the shopping center with the proposed tenant change would be unlikely to generate more than 100 trips more than reasonably anticipated for the existing building.
