I have approved the plans as drawn.The dimensions of the building footprint and building height were not measurable
at any scale I tried (printed at either 8.5x11 or 11x17), so I am relying on the dimensions as written. Ordinarily this would
not be acceptable, but I do not wish to delay your application any further. However, be prepared for the possibility that
Building will not accept these plans for their structural review, in which case I will have to ask you to resubmit once
more. I am satisfied for my review that you acknowledge by the dimensions you specified that the structure shall not
encroach into the 5' side yard setback or into the 5' rear public utility easement, irrespective of what footprint and what
dimensions are shown on the approved plan. Likewise, the structure shall not exceed 15' in height as measured from the
midpoint of the plane of the highest roof to the paved surface below.
Additionally, I neglected to require that you submit the following two application materials:
1. Service Provider Letter(SPL)from Clean Water Services. For information on the process (which I understand to
be relatively simple and quick),you may contact them at 503-681-5100.
2. One additional site plan showing erosion control measures to be employed around the area of disturbance.
You may send these two items to me directly, and I will attach them to the other application materials,which have been
routed to Building for their review.

Thanks for working through this with John. He handed over all the materials you submitted, including the
application with updated valuation that you just sent. I'lI take a final look at the plans. If there are no additional
changes needed I will sign off and hand over to Building right away. One question: are the plans to scale at
11 x 17? I have them in front of me at 8.5x11, and they do not match the scale specified, so I suspect I need to
reprint at 11 x17.
Also, please accept my apology for the delays in processing that resulted from my previous errant guidance. I
appreciate your patience, as did the others who worked with you during my absences.

Mr. Tegner,
I have reviewed your application for a setback adjustment at 8580 SW Inez Street here in
Tigard. Unfortunately we have discovered a conflict that prevents us from approving the requested
adjustment. The conflict originates from the presence of a five foot wide utility easement along all side
and rear property lines within the Greensward Subdivision. As detailed on the attached map, the
subject property is located within this subdivision (Lot 29), and as such we cannot allow construction of
a permanent structure atop the easement.
As the city cannot approve any sort of setback adjustment for a shed on this property, you may wish to
withdraw the application and apply for a refund. Please contact me at your earliest convenience so we
can discuss this further.
