Call to Order, Roll Call and Introductions Commissioner Winn called the meeting to order at 5:32 p.m. 2. Approval of Minutes —June 8, 2011 Commissioner Buehner moved to approve the June 8, 2011 minutes. Commissioner Stone seconded the motion. The motion passed by unanimous vote of the Commissioners present, with Commissioners Buehner, Henschel,Jehnke, Stone and Winn voting yes. 3. Public Comments There were no comments from the public. 4. Water Supply Update Mr. Goodrich reported: ■ Average water use for the month of June was 5.5 million gallons per day (mgd). This is two mgd less than past consumption for the same the month. ■ Tigard sold 1,912 million gallons of water for the fiscal year ending June 30, 2011. Water sales have not been this low since 1994-1995. ■ Portland water supply should be sufficient for the summer season. ■ Aquifer storage and recovery (ASR) wells 1 and 2 are ready for the summer season. A 70-day water supply is stored in the wells. ■ Tigard crews are replacing aging 2-inch water lines with 4-inch ductile iron pipe lines at 10 locations throughout King City. Crews will also replace a water line in Monaco Lane in King City. 5. Atiyeh Brothers Credit for Leak Request Mr. Goodrich provided background information on this credit for leak request for $700.34. Credits over $500 must be approved by the Board. Commissioner Henschel moved to approve the credit as noted on the request form. Commissioner Buehner seconded the motion. Commissioner Winn asked for any further discussion. Hearing none, the motion passed by unanimous vote of the Commissioners present, with Commissioners Buehner, Henschel,Jehnke, Stone and Winn voting yes. 6. Briefing on Area 64 River Terrace Annexation Request Mr. Prosser briefed the Board on an annexation request received by the City of Tigard. The information was brought before the Board because eventually a water provider will need to be identified for the annexation area. Mr. Prosser distributed three maps related to the River Terrace annexation request. The maps are on file in the I" record. Mr. Prosser stated presentations on this topic were made at Tigard Water District and Beaverton City Council meetings. Mr. Prosser reported: ■ Property owners within Area 64, located in unincorporated Washington County, approached the City of Tigard with an annexation request. ■ For annexation to occur, the annexed territory must be contiguous to Tigard. ■ The annexation request must meet specific criteria. In this request, the criteria was met when 80 percent of the property owners, owning 90 percent of the land within the annexation area, requested annexation. Tigard was not interested in partial annexation. ■ Tigard worked with Washington County and the City of Beaverton on a plan to accomplish the annexation. The plan calls for territory along the old Barrows Road area to be withdrawn (withdrawal of annexation) from Beaverton and annexed by Tigard. This territory will create a "cherry stem" connection between Tigard and Area 64. This plan does not affect residential properties within the area. ■ The first of two public hearings regarding the proposed withdrawal of annexation by Beaverton occurred on Tuesday,July 12, 2011. The Tigard City Council will hold a public hearing to consider the annexation request on Tuesday, August 26, 2011. If approved, annexation will take effect on September 30, 2011. ■ Through an intergovernmental agreement, Tigard is working with Washington County to prepare a community plan for the territory to be annexed (Area 64) and for Area 63, additional unincorporated territory that falls within the urban growth boundary. ■ Area 64 will be renamed River Terrace. Mr. Prosser concluded his presentation and the following topics were discussed: ■ Most of the larger pieces of property adjacent Barrows Road are detention ponds owned by Clean Water Services (CWS). CWS was a petitioner on the annexation request. ■ The community plan will address the provision of water service to the annexation area. ■ There is a 16-inch water line that extends west of 154th Avenue on Barrows Road. ■ There are no Beaverton water facilities within the proposed withdrawal area. ■ The county is not part of the annexation approval process, but county staff will be involved through intergovernmental agreements (IGAs). An example is the IGA that will split ownership of the Barrows Road right-of-way. ■ An IGA will also be required for a Tualatin Hills Park and Recreation trail within the annexation area. ■ There is a 16-inch water line that terminates near Roshak Road in the vicinity of the annexation area. ■ Expansion of the urban growth boundary was anticipated in Tigard's 2010 Water System Master Plan. ■ Current IGAs between Tigard and other IWB jurisdictions pledge all water lines and infrastructure to Tigard as shared system assets. ■ The annexation area is outside the Tigard Water District boundary. ■ Based on previous IWB discussions, the working assumption is that existing ratepayers would not bear the cost of expansion. Some type of supplemental water system development charge or other assessment would be needed to pay for infrastructure expansion. ■ Tigard does not control the east portion of the housing developments as noted on the map. ■ Roadway ownership will need to be worked out with the county. ■ Tigard will fund the community plan, although this funding may be supplemented by Metro, developer contributions, etc. ■ Commissioner Stone said the City of Wilsonville used a master planning fee and suggested Tigard might consider something similar. ■ Community planning will begin in July 2012. ■ Tigard will use the Bull Mountain concept plan as a framework for future planning. The concept plan's market analysis needs to be updated and the transportation analysis and resulting mitigation need further development. Tigard's standards differ from the county standards used to create the concept plan. Commissioner Winn, who worked on the concept plan, said the county implied the community plan would follow the concept plan. ■ The annexation territory is approximately 200 acres. ■ The current plan is for water SDCs, not the existing rate payers, to fund the annexation and subsequent infrastructure investments. He said the annexed ratepayers would share in the costs associated with Lake Oswego-Tigard Water Partnership. Overall, this may reduce future costs to ratepayers. ■ Mr. Prosser said Tigard was trying to communicate with everyone affected by the annexation and to provide a forum for comments and questions. Further information will be published in Tigard's Cityscape newsletter and on Tigard's web site. Tigard's mayor sent a letter to every property owner within unincorporated Bull Mountain and people who contributed to the Bull Mountain concept plan. ■ Commissioner Winn expressed concern that Tigard is taking a "start from scratch approach" and disregarding the Bull Mountain concept plan. Mr. Prosser responded Tigard will use the concept plan to the extent possible. Based on previous interactions, Commissioner Winn stated Tigard had been uncooperative, and Tigard "should not go down that road." Mr. Prosser said he understood these concerns;Tigard is not convinced high density makes sense on the outside of the city center. Commissioner Winn stated many people contributed to the concept plan. Mr. Prosser reiterated Tigard would use what it could from the concept plan, but transportation system issues need to be addressed. ■ Until Tigard has a street detail, it is hard to determine what the pipe line layout will be. It was noted the 2010 Water System Master Plan included some loop piping recommendations. ■ Commissioner Buehner stated property owners in the annexation area were eager to complete the planning and move forward. Mr. Prosser agreed, but added that the planning process will take time and must be incorporated into existing city priorities. Planning costs are not in Tigard's budget. ■ Commissioner Henschel asked if the annexation was affected by land use regulations. Mr. Prosser said the annexation territory is rural property, zoning in neighboring cities is not applicable. Property owners in the annexation territory were asked to maintain the current county zoning until the community plan is adopted. He stated that the property owners were in agreement regarding the current zoning, so no land use action is required. The Board thanked Mr. Prosser for his presentation. 7. Informational items ■ Update from Commissioner Buehner on Lake Oswego/City of Tigard Oversight Committee activities. The Committee hasn't met since April. Lake Oswego, as the managing authority, has contracts in process for: — The water treatment plant — Raw water and finished water pipeline design — Supervisory control and data acquisition (SCADA) design — Project management contract ■ Community outreach efforts continue with West Linn Robinwood neighbors and neighbors near the Waluga reservoir site. ■ Commissioner Buehner described her visit to a live pipe drilling demonstration on horizontal directional drilling. This method may be used for the Willamette River and Lake Oswego Lake crossings. ■ Commissioner Buehner discussed the final proposed order (PFO) issued by the water resources department regarding Clackamas River water rights held by Lake Oswego. She also noted, as expected, Water Watch had filed an appeal. She said it could be a year before a final ruling is issued. 8. Non-Agenda Items In response to a question from Commissioner Stone, Mr. Goodrich reported on July 1, 2011, Tigard staff delivered a five-year non-renewal notice as prescribed in the Regional Water Sales Agreement with the Portland Water Bureau (PWB). Commissioner Henschel inquired about a back-up plan for water supply and stated some rate payers might be apprehensive about Tigard having "all their eggs in one basket." The Board discussed that Tigard staff should begin discussions with PWB regarding a future bridge contract. Mr. Koellermeier concurred. 9. Commissioner Jehnke represents the City of Durham. I have contacted Durham to request the City Council appoint a representative to the next two-year term, running from January 2012 through December 2013. Commissioner Stone's term expires in December as well. Commissioner Stone serves as the Board's member-at-large. The member-at-large is selected by a majority vote of the other members. The Board has wide discretion over how it selects the member-at-large. Options range from simply appointing someone to conducting an extensive recruitment, application and interview process. There are no term limits associated with these positions; representatives may be reappointed to successive terms. Commissioners should be prepared to discuss how they would like to fill the at-large member position at their October 12, 2011 meeting. Water Supply Update Mr. Goodrich reported: ■ Average water use for the month of July was about 8 million gallons per day (mgd). This is 2.4 mgd less than the 10-year average for the month of July and 1.2 mgd less than July 2010 demand. ■ Average water use for the month of August was about 8.75 mgd. This is 1.2 mgd less than 10-year average for the month of August and .5 mgd less than August 2010 demand. ■ Average water use for the first two weeks of September was about 8.9 mgd. This is 1.2 mgd more than the 10-year average for the month of September and 2.9 mgd more than September 2010 demand. ■ Although some water was used from aquifer storage and recovery wells this summer; about 200 million gallons (mg) remains in storage. This 200 mg equates to about a 100-day supply. ■ Summer peak demand was 9.8 mgd. This is significantly lower than the typical summer peak of 12.8 to 13 mgd. ■ The City of Tigard is making progress on the implementation of administrative rules on topics such as credit for leak. 5. Discussion on the Clackamas River Watershed Tour Mr. Koellermeier briefed the board on a tour to the Clackamas River Watershed. The tour is hosted by the Clackamas River Water Providers. 6. Informational items ■ Update from Commissioner Buehner on Lake Oswego-City of Tigard Oversight — Lake Oswego has given its city manager additional purchasing authority with regard to the Lake Oswego-Tigard Water Partnership. This increased authority allows for quick, decisive action during construction; projects will not need to be put on hold while funding approval is sought. — The pilot plant is operational, with the exception of active flow. — Plans for the raw water outtake are proceeding to the Gladstone Planning Commission. — Mr. Koellermeier is working on a plan to upsize the pipeline running from Waluga Reservoir to Bonita Pump Station. — Lake Oswego is encouraging Robinwood residents to submit their feedback, so the Good Neighbor Plan can be finalized. — Contracts have been issued for the design of the Bonita Pump Station and Waluga Reservoir No. 2. Mr. Koellermeier said Lake Oswego-Tigard Water Partnership program staff would provide the board with a project update at an upcoming meeting. 7. Non-Agenda Items Mr. Koellermeier reported meals would no longer be provided at board meetings due Internal Revenue Service rules. The City of Tigard has determined meals are a taxable benefit, and there is no feasible way to tax board members. 8.
