1. Call to Order, Roll Call and Introductions
Commissioner Carroll called the meeting to order at 5:35 p.m.
2. Approval of Minutes — December 12, 2007
Commissioner Buehner motioned to approve the December 12, 2007 minutes;
Commissioner Russell seconded the motion. The minutes were approved by unanimous
vote, with Commissioners Buehner, Carroll, Russell, and Scheiderich voting yes.
3. Public Comments: None
4. Cedar Park Manor Appeal of Leak Credit
Ms. Bewersdorff provided background information on this credit for leak appeal.
Based upon past practice, Commissioner Carroll suggested the Board split the
remaining balance with the property owner. This would result in an additional credit of
about $1,130. He confirmed that the actual cost of the water would be recouped if this
additional credit was approved.
Commissioner Buehner motioned to split the remaining balance; Commissioner Russell
seconded the motion. The credit was approved by unanimous vote, with Commissioners
Buehner, Carroll, Russell, and Scheiderich voting yes.
5. Review Credit for Leak Policy
Mr. Koellermeier described the materials in the Board's packet. He explained other local
water providers allow for larger customer credits, so staff was not recommending any

changes to this portion of the policy. He suggested some revisions the Board may wish
to consider:
■ Increasing the $500 limit which requires staff to bring credits to the Board for
approval. The $500 limit has been in place since at least 1993. Increasing the
limit would mean fewer requests would come before the Board, and more
requests would be handled at the staff level.
■ Altering shut off processing fees. Water service providers, including the City of
Tigard, typically issue three notices prior to turning someone's water off for
nonpayment. Most service providers assess a fee at the time each notice is
issued. The City of Tigard only assesses fees at shut off. By assessing some of
these fees when the first and second notices are issued, customers may be more
motivated to bring their accounts into good standing prior to the third notice and
subsequent shut off.
Commissioner Scheiderich suggested requiring a deposit when a past-due accounts are
paid.
Mr. Koellermeier suggested staff could present the Board with a proposal that would
implement the revisions described above. The Board discussed increasing the $500 limit
to between $750 and $1,000.
Commissioner Scheiderich proposed:
• Calculating the credit based upon excess water use when compared to average
usage during previous time period.
■ Capping the maximum credit issued to $1,000 or $2,000. Water customers
should be aware of a leak of this magnitude.
■ Removing the Board appeal option from the process; all credits would be
processed by staff.
■ Verifying the City of Tigard always recovers its water wholesale costs with regard
to credit for leak requests.
Board consensus was for staff to prepare the necessary documents to implement
Commissioner Scheiderich's suggestions. Mr. Koellermeier said this would likely come
before the Board as a policy and would then go before the Tigard City Council as an
ordinance to amend Tigard's municipal code.
Ms. Bewersdorff described the shut off process and timeline. Commissioner Buehner
suggested a door hanger notice fee be instituted. Commissioner Russell expressed
support for a deposit when past-due accounts are paid.
6. Renewable Energy Options
At the Board's December 12, 2007 meeting, the Commissioners requested information
on the actual cost of renewable energy options. Mr. Koellermeier introduced this item
and summarized the packet materials.
The Commissioners expressed concern that energy received through this program may
not actually be from a renewable energy source. They questioned whether money for
renewable energy could be better spent on something else.
Commissioner Buehner said the Tigard City Council wanted to discuss the purchase of
renewable energy and seek citizen input on the matter. Mr. Koellermeier said the
Council's presentation would not focus on the use of renewable energy for the water

system. He will inform the Commissioners of the meeting in the event they wish to
attend.
Unless he receives further instruction from the Board, Mr. Koellermeier said he would
not include the cost of renewable energy in the fiscal year 2008-2009 water budget.
Commissioner Buehner confirmed the purchase of renewable energy could be
addressed via a white paper to the City of Tigard's Budget Committee.
7. Briefing on City of Tigard and Tigard Water District Administrative Services
Proposal
Mr. Koellermeier noted this information was an update for the Board and no action was
required.
He explained the City of Tigard had been providing services to the Tigard Water District.
These services had been under negotiation since July. The District rejected Tigard's
recent proposal and has elected not to have Tigard provide services. Mr. Koellermeier
reported:
■ District records, previously under Tigard's custodial control, have been turned
over to the District.
■ District funds, previously managed by Tigard, have been turned over to District.
■ The auditorium of the Tigard Public Works Building will be made available to the
District for their 2008 regularly scheduled meetings.
■ Tigard's web site has been modified to explain the change in the relationship
between the District and the City. Tigard will provide a link to the District's web
site when it is operational.
8. Water Supply Update
Mr. Goodrich and Mr. Koellermeier reported:
• Current water demand is about four million gallons per day.
■ Aquifer storage and recovery 2 (ASR2) is being injected at a rate of 1.67 million
gallons per day.
■ 188 million gallons are in storage.
■ ASR 2 goals will be met in February or March, and then injection will begin at
ASR 1.
• On the City's progress to bring two private wells into compliance. The City has
offered to pay to properly abandon the wells if the work can be completed by
June 2008. Several Commissioners expressed urgency in getting the wells
capped. The Board discussed the status of City wells and ASR.
■ Construction of the 550-foot Zone Reservoir#2 is on time. Piping from the new
reservoir to the 10-million-gallon reservoir will require construction work on Bull
Mountain Road in the near future.
9. Informational Items
Automated Meter Reading
Mr. Koellermeier informed the Board that Portland General Electric (PGE) has made the
decision to automate their meter reading. Other jurisdictions may be able to take
advantage of PGE's system; the City of Tigard and PGE have entered into preliminary
discussions on the matter. The infrastructure for automated meter reading is expected to
be operational in about three years. The Board discussed the costs associated with
manual and automated meter reading.

10. Non-Agenda Items
IWB Term Expirations
Ms. Gaston informed the Board that Commissioner Carroll's and Commissioner
Scheiderich's terms expired as of December 31, 2007. According to IWB bylaws,
Commissioners can serve on the Board until a successor is appointed. The City of
Durham will consider an appointment to Commissioner Carroll's position on January 22.
Commissioner Carroll motioned to elect Bill Scheiderich to fill the new term as the
member-at-large representative to the IWB. There was no second and the motion was
not placed before the Board for consideration.
Commissioner Russell requested the member-at-large position be filled on a rotating
basis by someone from each jurisdiction. It was noted such a change would require an
amendment to the 1993 intergovernmental agreements.
Joint Meeting with the Tigard City Council
Based on anticipated timelines and availability of the Commissioners, the Board decided
it would hold its regular April meeting on Tuesday, April 8 at 5:30 p.m., followed by a
joint meeting with the Tigard City Council that same evening.

Commissioner Scheiderich called the meeting to order at 5:31 p.m.
2. Approval of Minutes — November 28, 2007
Commissioner Buehner motioned to approve the November 28, 2007 minutes;
Commissioner Russell seconded the motion. The minutes were approved by unanimous
vote, with Commissioners Buehner, Carroll, Russell, Scheiderich, and Winn voting yes.
3. Public Comments:
Mr. Phil Decker, 14540 SW 148 l Place, Tigard, Oregon, explained he was a retired
California attorney and wished to update the IWB on Tigard Water District (TWD)
activities. He stated the annual income of the TWD was approximately $17,000. New
TWD Commissioners took office about six months ago and filed suit against the City of
Tigard. In their six month tenure, the District has spent about $17,000 in attorney fees.
Mr. Decker expressed concern over the District's spending on non-water related
activities and said he hoped this spending would not continue.
4. Potential Water Partnership with the City of Sherwood
This item was postponed to a future meeting.
5. Renewable Energy Options
Mr. Koellermeier introduced this topic and explained some water utilities had decided to
purchase renewable energy. He said participation was voluntary, and he had no
recommendation for the Board. If the Board was interested in purchasing renewable
energy, these costs could be incorporated into the upcoming budget.
Two representatives from Portland General Electric (PGE) were introduced: Manager of
the Renewable Power Program Thor Hinckley and Key Customer Manager Paula

Conway. Mr. Hinckley and Ms. Conway distributed information packets and provided an
overview of the renewable energy program. An information packet is on file in the IWB
record.
Costs to operate the Tigard Water Service Area's meters with 100-percent, pollution-
free, wind-generated, renewable energy are as follows:
■ larger meters would be charged at a fixed premium of 1.1 cents per kilowatt hour
■ smaller meters would be charged at a fixed premium of .8 cents per kilowatt hour
These premiums would be in addition to existing energy costs.
Mr. Goodrich said existing energy costs were in the $200,000 range. Commissioner
Buehner estimated the switch to 100-percent, renewable energy would result in a 10-
percent increase, or $20,000 annual premium.
The Board requested staff prepare information on the actual cost of the renewable
energy options.
6. Consider Making a Recommendation to the Tigard City Council Regarding
Approval of the Tualatin Basin Water Supply Partnership Memorandum of
Agreement
This item was continued from the Board's November 28, 2007 meeting.
Commissioner Scheiderich confirmed there was no financial commitment associated
with the agreement.
Commissioner Winn made a motion to recommend approval of the Tualatin Basin Water
Supply Partnership Memorandum of Agreement to the Tigard City Council;
Commissioner Carroll seconded the motion. The recommendation was approved by
majority vote with Commissioners Buehner, Carroll, Scheiderich, and Winn voting yes.
Commissioner Russell had not discussed the matter with the Tigard Water District and
abstained.
7. Consider a Memorandum of Understanding (MOU) with the City of Lake
Oswego and the City of Tigard Regarding a Water Supply Partnership
Mr. Koellermeier distributed two MOUs: one with revisions highlighted in red, and a final
version which included the revisions. These documents are on file in the IWB record.
Commissioners Buehner and Scheiderich had participated in the development of the
MOU.
Commissioner Buehner commented on the positive nature of the discussions and noted
those who worked on developing the MOU had become strong supporters of the
proposed water partnership.
Commissioner Scheiderich said elected officials from Lake Oswego didn't consider the
water partnership as an urgent need. They had expressed concern over placing a
funding issue related to the water partnership on the 2008 ballot.
The MOU specifies the next step in the partnership is the creation of an
intergovernmental agreement (IGA). The deadline for completion of the IGA is the end of
June.
The Board discussed the timeline for selecting a long-term water source.

Commissioner Buehner mentioned the Cities of Tigard and Tualatin were listed as
authorized users of Lake Oswego's water rites. Some of Lake Oswego's water rights
may be lost if the partnership with the City of Tigard is not formed.
Mr. Koellermeier added that at the staff level, the Cities of Tigard and Lake Oswego
have agreed to.
• Let Tigard take the lead in developing the IGA
• Retain Attorney Clark Balfour to prepare the IGA
Mr. Koellermeier recommended the IWB execute the MOU and continue moving forward
with the water partnership.
Commissioner Buehner motioned to approve the MOU between Lake Oswego, the City
of Tigard, and the IWB; Commissioner Carroll seconded the motion. The MOU was
approved by majority vote with Commissioners Buehner, Carroll, Scheiderich, and Winn
voting yes. Commissioner Russell abstained.
8. Update on Property Issues
Mr. Koellermeier mentioned Portland General Electric's (PGE's) request for an
easement and TriMet's request to locate an antenna on the Washington County
Consolidated Communications Agency's (WCCCA's) communication tower. He asked
what level of involvement the Board would like to have regarding temporary or minor real
property issues. The tenancy in common agreements necessitate real property
transactions be considered by the member jurisdictions of the IWB.
Commissioner Buehner said that placing an antenna on the communication tower was
administrative in nature. However, she indicated she had given some earlier input
regarding the PGE easement and thought this type of matter merited a higher level of
Board and IWB member jurisdiction involvement.
The Board confirmed that given the amount of time required for each IWB member
jurisdiction to consider such matters, it was comfortable with Mr. Koellermeier continuing
to grant temporary approvals in order to allow the easement and antenna process to
continue. Ultimately, resolutions will be prepared for each member jurisdiction to
consider.
Commissioner Scheiderich suggested the TriMet antenna agreement contain a non-
interference clause stating the TriMet antenna may not interfere with any City uses
including radio transmissions.
9. Water Supply Update
Mr. Goodrich reported the following:
■ 1.65 million gallons per day are being injected into aquifer storage and recovery
well 2
■ Water demand has been in the 3.45 million gallons per day range, which is
typical for this time of year
■ The water system had not been damaged by the recent rain storm

10. Informational Items
With regard to the Board's previous discussion about additional tenancy in common
agreements, Commissioner Winn reported that when King City was formed in the mid-
1960s the Tigard Water District was the water provider. The District remained the water
provider until the City of Tigard took over in 1994.
11. Non-Agenda Items:
Mr. Koellermeier asked if the Board would like to view the "Water for Tomorrow" DVD
developed to educate water customers about future water sources. Commissioner
Scheiderich directed the DVD be played after the meeting adjourned.

The attached request for additional credit due to a leak is being forwarded to you for your
consideration at the next scheduled meeting on January 9,2008. The method used in calculating.
the amount of the credit that was given on November 27,2007 was based on existing policy. After
the credit was issued the customer contacted Utility Billing concerned about the amount of the
credit since the mobile home park was down to three tenants at the time of the leak. The customer
is requesting an additional credit be given since the prior years consumption that was used in the
orignial calculation would be when the pari:was at or near full capacity.

Re: Request for adjustment for water bill for Cedar Park Manor
I spoke with you about ten days ago regarding this matter. It took me a while
to gather all the information so as to be accurate. We agreed to sell the park
to Extra Space Storage in 2006. Through our attorney all tenants were
advised that they would have one year to be out of the park. The date they
were to be out was May 15th of this year, 2007. As of May 15'h 2007 there
were only Ripe tenants left, including my brother. There were four left the
first of June which is when had a company called Precision Flooring come in
and start dismantling and take away the rest of the trailers except for my
brothers. By July 1st there were only my brother and the two in the studio
apartment liviag there. I casae Ftp to Oregon in October to move personal
stuff out of the park and at that time there was only two places occupied in
the park. It was at this time that I detected the broken 2 inch pipe which we
had fixed and previously sent to you. All the monies from the sale of the park
have been distributed and I am left to pay the bills. I.feel a fair amount owed
should be approximately$300.00. I sincerely hope you can help me out on
this by reducing the bill by a lot more than a mere $19.56. Again, the park
has been basically empty since the 15m of May. Thank you for your time and
please call if you have any questions.

manner. The city expects leaks to be repaired within ten days of discovery. Credits are
based on your average usage for the same period in previous years. Tills average is deducted W

Re: Water Billing Credit for Leak Policy Survey Results

The IWB recently asked for information regarding the water billing credit for leak policies of
neighboring water utilities. Attached is a table entitled "Water Billing Credit for Leak Policy
Survey" with the results for 9 local water agencies.
I also gathered some additional information from Utility Billing regarding the last three years
of credit for leak account activity. They are provided in a summary below:
Fiscal year 04-05 resulted in 240 accounts receiving $16,985.35
Fiscal year 05-06 resulted in 182 accounts receiving $18,261.98
Fiscal year 06-07 resulted in 191 accounts receiving $22,454.53
Note: FY06-07the was a $3980.08 credit for Royal Mobile Villa
For the last 3 years, the total amount credited equals 613 accounts for $57,701.86
The 3 year average indicates approximately 34 accounts per billing cycle (every two months)
at $94 per account which is approximately 0.2% of the total accounts currently within the
Tigard Water Service Area
A majority of the credit for leak claims are processed through Utility Billing without direct
IWB approval. The current policy is that credit for leak amounts exceeding $500 shall be
required to be approved by the IWB. Under this policy, the average number of credit for
leak claims presented to the IWB are only 1 or 2 per month.

When a water leak occurs on the customer's side of the water meter
resulting in an unusually high water bill, customers may apply for a credit.
Credits are calculated by multiplying the wholesale water markup per ccf by
the estimated size of the leak in ccfs.

Portland General Electric Renewable Energy Proposal
Date: December 14, 2007
At the December 12, 2007 Intergovernmental Water Board (IWB) meeting, Portland General
Electric (PGE) proposed the Board purchase wind generated renewable energy to power water
utilities. The Board requested staff prepare information on the actual cost of switching to renewable
energy.
The monthly premium, at the 100 percent renewable energy level,would cost $1,710 per month, or
$20,520 per year, in addition to existing electrical charges and fees. This cost, if distributed among
our 17,735 accounts, translates to an additional $1.16 per account per year.
Based on these calculations, the switch to renewable energy would not have a significant impact on
the water division budget. In the short-term, a water rate increase would not be warranted.
However, in the long-term, these costs would ultimately be incorporated into our water rates.
