The modular classroom would remain in this location for the foreseeable future,pending redevelopment of the site. Relocation would temporarily reduce the number of parking spaces to less than required during construction of the Phase 1B community center building and the associated parking improvements permitted in CUP2002- 00006. On completion of Phase 1B, the temporary parking spaces will be removed and returned to playground use. COMPREHENSIVE PLAN AND ZONING DESIGNATION: R-12: Medium-Density Residential District. The R-12 zoning district is designed to accommodate a full range of housing types at a minimum lot size of 3,050 square feet. A wide range of civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: The applicable Community Development Code Chapters for the proposed modifications include: 18.330, 18.390,and 18.510. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. BACKGROUND INFORMATION Site Information and Site I listory: CUP2002-00006 permitted a two-phase improvement plan for modification to the existing Middle School and a new Gymnasium (Phase 1A) and a new 15,000 square foot Community Center, on-street parking, and a circulation connection between SW Johnson and SW Grant to facilitate drop-off of students (Phase 1B). MMD2007-00031 approved a modification to increase the approved area of the Community Center to 18,500 square feet. The additional 3,500 square feet is to enlarge the lobby and circulation by 2,500 square feet, to enlarge the kitchen and pantries by 500 square feet and to replace the existing 1,000 square foot non-accessible nursery. The G sium and Community Center building have now been built. This minor modification acknowledges the relocation of a modular classroom unanticipated in the CUP2002-00006 application. Vicinity Information: The subject site is zoned R-12 and is bounded by SW Pacific Hwy on the south, SW McKenzie on the west, SW Grant on the north, and SW Johnson on the east. The property is bordered by R-12 to the west and east, R-4.5 to the north,and C-G to the southwest and southeast. Description of the Request: The applicant proposes to relocate one of two modular classrooms to the southwest corner of the Elementary School parking lot. The modular classroom would remain in this location for the foreseeable future, pending redevelopment of the site. APPLICABLE REVIEW CRITERIA AND FINDINGS • Minor modification of approved or existing conditional use. 1. Any modification which is not within the description of a major modification as provided in subsection B of this section shall be considered a minor modification. 2. An applicant may request approval of a minor modification by means of a Type I procedure, as regulated by Section 18.390.030,using approval criteria in paragraph 3 of this subsection C. 3. A minor modification shall be approved, approved with conditions, or denied following the director's review based on the findings that: The proposed development is in compliance with all applicable requirements of this title; and The proposed relocation of the existing modular classroom is permitted in the R-12 Residential zoning district, as a conditional school use. No new uses are proposed with this application. The proposed relocation does not change the amount of activity on the site. As shown on the Site Plan (Sheet A 1.04 A), the relocation site preserves adequate area for the needs of the school use. The impact of the relocation is to temporarily displace parking until the Phase 1B improvements are met. Temporary parking in the play area is adequate to off-set the parking lost to relocation. The applicant proposes to move an existing modular classroom from a location central to the site to the perimeter of the site. The proposed relocation would not change with respect to the applicable residential development standards in Table 18.510.2: the coverage amount on the site or the height of the structure. Setbacks are modified by the conditional use chapter. The applicable R-12 zoning district standards remain met. The subject site is almost a full block with streets on four sides. The proposed relocation site is setback 20 feet from SW Pacific Hwy and 20 feet from the adjacent parcel. A 20-foot setback is required pursuant to Section 18.330.050.7 for schools. The applicable conditional use standards for school development are met. The modification is not a major modification as defined in subsection A of this section. FINDING: Staff finds that based on the applicant's narrative and plan set, the threshold changes to determine a major modification of a conditional use, listed in TDC 18.330.030.A(1-6),have not been exceeded,or do not apply.
