The findings and conclusions on which the decision is based are noted in Section IV. NO 1 ICF OF TYPE I DECISION PAGE.1 OF 4 L.1.A2013-00007-I IUI)SON PLAZA LLA CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED: UNLESS OTHERWISE NOTED, THE STAFF CONTACT SHALL BE CHERYL CAINES IN THE PLANNING DIVISION AT 503-718-2437. 1. Following recording, the applicant shall provide evidence to the City that the Lot Line Adjustment survey map was recorded within 18 months of this decision. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information and Proposal Description: Parcel 1 is a .56 acre site, zoned C-G (General Commercial) and developed with two large buildings with a mix of commercial uses. The development is known as Hudson Plaza. Parcel two is 3.71 acres, zoned R-12 (Medium Density Residential). The site is developed with a religious facility (Tigard Community Methodist Church). Staff conducted a search of City records for the subject property and found the following minor modifications approved on Parcel 1 (Hudson Plaza): a change of use (MMD2004-00018) was approved for an auto broker, construction of a 1,107 square foot storage building with ADA restroom (MMD2006-00010), and construction of a coffee stand within the parking lot (MMD2006-00012). A Conditional Use Permit (CUP96-00002) was approved for an 8,00( square foot addition to the church facility. This proposal is for a lot line adjustment between two parcels. Parcel 1 (.56 acre) will be .62 acre, and Parcel 2 (3.71 acres) will be 3.65 acres. The proposed lot line adjustment will eliminate an encroachment of one of the Hudson Plaza commercial buildings onto Parcel 2 and within an existing 15-foot public sanitary sewer easement in the area of the proposed lot line adjustment. The easement will now be exclusively on Parcel 1. Vicinity Information: Parcel 1 is located on SW Pacific Highway. Parcel 2 is to the southwest. Other adjacent properties along Pacific Highway are zoned C-G and developed with commercial uses. With the exception of those properties abutting Pacific Highway, adjacent properties are zoned R-12 and developed with a mix of multi-family residential uses. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No new lots will be created as part of this adjustment; two (2) lots exist and two (2) lots will remain after the proposed adjustment. Parcel 1 is zoned C-G, which has no minimum lot size. Parcel 2 is zoned R-12. Minimum lot sizes in this zone are (3,050 square feet) based on housing type; however NOTICE OF TYPE I DECISION PAGE 2 OF 4 IJ.A2013-00007-HUDSON PLAZA ILA religious facilities are required to be at least 20,000 square feet (approximately .5 acre). Therefore, the proposed .62 acre C-G site and 3.65 acre church site will not be reduced below the required minimum lot sizes. This criterion is met. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; The C-G zone has no minimum setbacks except a 20 foot rear and side yard setback is required where the site abuts a residential zone. The proposed property line adjustment will bring the Hudson Plaza development with this requirement because the proposed setback is over 22 feet. The existing church facility will still be more than 200 feet from the proposed property line, which exceeds the 20-foot setback requirement. The minimum landscape requirements will still be satisfied on both parcels. Therefore, this criterion has been satisfied. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: • The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and • Setbacks shall be as required by the applicable zoning district. Minimum lot size and setbacks have been previously discussed. There are no average minimum lot width requirements for the C-G or R-12 zones. Both parcels have more than 15 feet of frontage on a public street (SW Pacific Highway and/or SW Walnut Place). This criterion is satisfied. With regard to flag lots: • When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. • A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The proposed lot line adjustment does not include flag lots; therefore this criterion does not apply. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. I No new access_ways are being created with this application. This criterion does not apply. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. Each parcel fronts a public street and there are no common drives. This criterion does not apply. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. I No new access_ways are proposed with this application. Each site will continue to have access to SW Pacific Highway and SW Walnut Place. This criterion does not apply. Floodplain, greenway and right-of-way dedication is not required as part of this application. Therefore, this criterion does not apply. Variances to development standards: An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370,Variances and Adjustments. The applicant has not requested a variance or an adjustment with this application. This criterion does not apply. FINDING: Based on the analysis above, Staff finds that all of the applicable Lot Line Adjustment criteria have been satisfied. SECTION V.
