The MUC-1 zoning district, which is designed to apply to that portion of the Durham Quarry site within the City of Tigard, is a mixed-use commercial district bounded by 72nd Avenue, Findlay Street and the Tigard, Tualatin and Durham city limits. This zoning district is intended to mirror the City of Tualatin's Mixed Use Commercial Overlay District (I'DC, Chapter 57). It permits a wide range of uses including commercial lodging, general retail, offices and housing; the latter includes multi-family housing at a minimum density of 25 units/acre and a maximum of 50 units/acre. Additional uses, including but not limited to major event entertainment and motor vehicle retail fuel sales, are permitted conditionally. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located in Bridgeport Village, a regional shopping center located on the border of Tigard and Tualatin. The majority of the center is located within the City of Tualatin, with a smaller portion located within the City of Tigard. Both the base zone (MUC-1) and the plan district overlay (Bridgeport Village Plan District) were adopted in 2001 in coordination with the City of Tualatin in an effort to achieve consistent land use regulations across the entirety of the site. The project site is an existing 2,300 square foot retail space immediately adjacent to the movie theater entrance. The space formerly hosted a series of specialty clothing stores, including Levi's and Romy. Proposal Description: The proposed minor modifications to existing development include the following use and building modifications: ➢ Change of land use to convert the entirety of the space from sales-oriented retail to a "fast casual dining" restaurant. Floor plans submitted with the application contain an order line where the pizza will be assembled and quickly cooked to order, and associated indoor and outdoor seating areas for consumption. > The replacement of existing storefronts for the purpose of relocating access doors, with no change in the percentage of glazing on each affected facade. > Construction of a new painted metal railing to delineate the boundary of a new, outdoor seating area. As the space will remain uncovered, this additional seating area does not meet the definition of floor area. As a result no additional parking is required per Director's Interpretation DIR2014-00001. ➢ Sign permits were not included as part of the application, but new signs are proposed in the application materials. As the affected area is internal to the site and the signs not oriented to, or visible from, a public right-of-way they are exempted from sign permit requirements per 18.780.060.A.2 (Permit Exceptions). APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: The proposed change in use requires a Minor Modification to approved plans or existing development. Section 18.360.060.0 states that a minor modification shall be approved, approved with conditions or denied following the Director's review and as follows: 1. The proposed development is in compliance with all applicable requirements of this title; and FINDING: The proposed change in land use and building modifications comply with standards applicable to the MUC-1 zone and Bridgeport Village Plan District. Off-street parking and loading standards are not applicable to this project does not increase square footage (see Director's Interpretation DIR2014-00001). This criterion is met. 2. The modification is not a major modification. FINDING: Staff finds that the changes listed in TDC18.360.050.B.1-11 are either satisfied or do not apply. No relevant conditions of approval were discovered during a review of the site's permit history. No additional parking or change in site access is proposed or required. Not more than 100 new trips per day are anticipated. Therefore, the proposed development is not a major modification. This criterion is met. CONCLUSION: The proposal is a minor modification of existing site development and is in compliance with the applicable requirements of this title. SECTION V.
