SDR1995-00012 SD R95 - 00012 LANDMARK FORD PARKING LOT CITY OF TIGARD NOTICE OF DECISION SITE DEVELOPMENT REVIEW (SDR) 95-0012 LANDMARK FORD PARKING LOT APPLICATION: The applicant requests Site Development Review approval to allow the construction of 162 parking spaces on seven parcels comprising 2.59 acres. Zoning: Commercial Professional (C-P). Location: (WCTM 2S1 1AA, tax lot 2000, 2400, 2600, 2700, 4300, 5100 and 5200 ). SECTION I - DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted in Section II. CONDITIONS OF APPROVAL THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO THE ISSUANCE OF BUILDING PERMITS. 1. The applicant shall complete installation of curbs and sidewalks along the SW Dartmouth Street and SW 68th Avenue frontages to City standards. STAFF CONTACT: John Hagman, Engineering Department. 2. Standard-street improvements, including concrete sidewalk, driveway apron, curb, asphaltic concrete pavement, storm drainage, streetlights, and underground utilities shall be installed along the SW Elmhurst Street frontage. Full-street improvements shall be installed where there is frontage on both sides of the street and two-thirds-street improvements shall be installed where frontage is along only one side of the street. Improvements shall be designed and constructed to local commercial street standards and shall conform to the alignment of existing adjacent improvements or to an alignment approved by the Engineering Department. Standard two-thirds-street improvements, including concrete sidewalk, driveway apron, curb, asphaltic concrete pavement, storm drainage, street lights, and underground utilities shall be installed along the SW Franklin Street frontage. Improvements shall be designed and constructed to local commercial street standards and shall conform to the alignment of existing adjacent improvements. Three (3) sets of detailed public improvement plans and profile construction drawings shall be submitted for preliminary review to the Engineering Department. Seven (7) sets of approved drawings and one (1) itemized construction cost estimate, all prepared by a Professional Engineer, shall be submitted for final review and approval (NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements. STAFF CONTACT: John Hagman, Engineering Department . 5. The applicant shall pay the Water Quantity fee as established by Unified Sewerage Agency Resolution and Order #91-47. The proposed privately operated and maintained storm drainage system plan- profile details shall be provided as part of the public improvement plans. STAFF CONTACT: Greg Berry, Engineering Department. 7. An erosion control plan shall be provided as part of the public improvement drawings. The plan shall conform to "Erosion Control Plans - Technical Guidance Handbook, November 1989." STAFF CONTACT: Greg Berry, Engineering Department. 8. Detailed construction plans and calculations, prepared by a registered engineer, shall be submitted for the water quality facilities in accordance with Unified Sewerage Agency Resolution Order #91-47. An agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against a future Local Improvement District formed to improve SW 69th Avenue. STAFF CONTACT: Diane Jelderks, Engineering Department. 10. The site shall comply with the required ADA ratio of existing handicapped parking spaces to the total existing and proposed parking spaces. A minimum of eight handicapped parking spaces shall be provided if 301-400 total spaces are constructed, a minimum of nine spaces if 401 to 500 parking spaces are provided or 2% of the total of all parking spaces if 501-999 parking spaces are constructed. Where necessary, handicapped accessible parking on the existing Landmark Ford Dealership shall be redesignated such that the number of spaces provided is based on the total number of parking spaces to serve the facility. Any spaces which are required to be redesignated may be dispersed among the various departments within the facility. STAFF CONTACT: Jim Funk, Building Department. A tree protection plan showing how the trees will be protected and screened during construction shall be provided and followed during construction to protect the designated trees and to avoid issuance of a stop work order due to damage to the protected trees. A tree removal permit is required prior to removal of trees greater than six inches in diameter. Staff Contact: Mark Roberts, Planning Division. 12. Revised site and landscaping plans shall be submitted for review, Staff Contact: Mark Roberts, Planning Division. The revised plans shall include the following: a. An exterior lighting plan shall be submitted to the Police Department for review and approval. Staff Contact: Kelly Jennings, Police Department. b. A revised landscape plan shall be submitted which matches the current proposed development plan. c. A revised site plan shall be submitted which complies with the clear vision development standards. d. A revised Landscape Plan shall be submitted which provides additional street trees along the SW Elmhurst Street frontage where existing trees don't preclude their planting. e. The applicant shall demonstrate that the existing vegetation will provide equivalent buffering to a fence, hedge or wall, a row of trees of varying spacing depending on their size at maturity, a minimum of ten five gallon shrubs or 20 one gallon shrubs for each 1,000 square feet of ground area, a second row of evergreen shrubs, earthen berm, fence or wall. Alternatively the applicant will be required to construct all or a part of these buffer improvements where the existing vegetation does not provide land use buffering. 13. All site improvements shall be installed and maintained as per the approved revised site plan prior to use of the parking lots. IN ADDITION THE APPLICANT SHOULD BE AWARE OF THE FOLLOWING SECTIONS OF THE COMMUNITY DEVELOPMENT CODE: THIS IS NOT AN EXCLUSIVE LIST. 1. SECTION 18.160.170 IMPROVEMENT AGREEMENT A. Before approved construction plans are issued by the City, the Applicant shall: NOTICE OF DECISION SDR 95-00f2 LANDMARK FORD PARKING LOT PAGE 3 1. Execute and file an agreement with the City Engineer specifying the period within which all required improvements and repairs shall be completed; and 2. Include in the agreement provisions that if such work is not completed within the period specified, the City may complete the work and recover the full cost and expenses from the applicant. B. The agreement shall stipulate improvement fees and deposits as may be required to be paid and may also provide for the construction of the improvements in stages and for the extension of time under specific conditions therein stated in the contract. 2. SECTION 18.120.060 BONDING AND ASSURANCES A. On all projects where public improvements are required the Director shall: 1. Require a bond in an amount not greater than 100 percent of other adequate assurances as a condition of approval of the site development plan in order to ensure the completed project is in conformance with the approved plan; and 2. Approve and release such bonds. B. The bond shall be released when the Director finds the completed project conforms to the approved site development plan and all conditions of approval are satisfied. 3. SECTION 18.164 STREET AND UTILITY IMPROVEMENT STANDARDS. Section 18.164.180 NOTICE TO CITY REQUIRED Work shall not begin until the City has been notified in advance. If work is discontinued for any reason, it shall not be resumed until the City is notified. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE DATE OF THE FINAL DECISION. SECTION II. FINDINGS OF FACT 1. Background: No previous development applications have been reviewed by the City of Tigard for the subject properties. Vicinity Information: The subject site is approximately two-thirds of the land area within SW 69th, SW 68th, SW Franklin Street and SW Dartmouth Street. The surrounding properties are zoned Commercial Professional and General Commercial. These properties are either vacant , developed with older single family residences or are developed with the Landmark Ford Dealership and office building uses. 3. Site Information and Proposal Description: The subject properties are currently vacant and total approximately 2.59 acres. The applicant proposes to construct a total of 162 parking spaces. 4. Other Staff and Agency Comments: The City of Tigard Building Department reviewed this application and provided the following comments concerning this proposal: A ratio of existing handicapped parking spaces to total existing and proposed parking spaces shall be provided. Where necessary, Handicapped Accessible parking on the existing Landmark Ford Dealership shall be redesignated such that the number of spaces provided is based on the total number of parking spaces to serve the facility. Any spaces which are required to be redesignated may be dispersed among the various departments within the facility. The Police Department also reviewed this application and provided the following comments concerning this proposal: I'll need to see the on-site lighting proposal as stated lighting will be consistent with current industry standards. Maintenance Services Departments, Unified Sewerage Agency, Tualatin Valley Fire District, Portland General Electric, has reviewed this application and have offered no comments or objections. No other comments have been received. SECTION III. ANALYSIS AND CONCLUSION A. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing to construct parking lots. Parking facilities are classified in Section 18.42(Use Classifications)as a permitted use. Under Civic uses, as a Quasi-Public use the property owner is permitted to develop a parking lot. The Parking Facility refers to parking which has been provided in excess of the on-site parking required to serve an existing use. Section 18.64.030 lists Parking Facilities as one of the permitted use in the site's Commercial Professional Zoning District. NOTICE OF DECISION SR 95-00/2 LANDMARK FORD PARKING LOT PAGE 5 Minimum Lot Area: Section 18.64.050 states that the minimum lot area for parcels in the C-P zoning district shall be 6,000 square feet, and the minimum lot width shall be 50 feet. Developments within the C-P zone are required to provide a minimum of 15% landscaping. The applicant would create two (2) sites of 67,500 and 55,000 square feet of parking lot area respectively. The applicant's site plan states that approximately 16,444 and 16,771 square feet or approximately 24.50 and 30% respectively are to be developed with landscaping which exceeds the 15% minimum required landscape area requirement. Setbacks: Section 18.64.050 states that, except as otherwise provided in Chapter 18.100.130 (Buffer Matrix), there is no front yard setback and no side or rear yard setback except 20 feet shall be required where the C-P zone abuts a residential zone. The maximum building height is 45 feet. Setback and height limitation requirements do not apply to this site because no structure has been proposed. Section 18.120.180(AX1) (Site Development Review • Approval Standards) requires that a development proposal be found to be consistent with the various standards of the Community Development Code. The applicable criteria in this case are Chapters 18.100, 18.102, 18.106, 18.120, 18.150, and 18.164. The proposal's consistency with these Code Chapters is reviewed in the following sections. The proposal contains no elements related to the provisions of Code Chapters 18.84 (Sensitive Lands), 18.92 (Density Computations), 18.94 (Manufactured/ Mobile Home Regulations), 18.98 (Building Height Limitations: Exceptions), 18.108 (Access and Egress), 18.116 (Waste and Recycling Facilities) or 18.144 (Accessory Use and Structures) which are also listed under section 18.120.180.A.1. These Chapters are therefore, found to be inapplicable as approval standards. Section 18.120.180.A.2 provides other Site Development Review approval standards not necessarily covered by the provisions of the previously listed sections. These other standards are addressed immediately below. The proposal contains no elements related to the provisions of 18.120.180.3 (Exterior Elevations), 18.120.108.5 (Privacy and Noise), 18.120.180.6 (Private Outdoor Areas: Residential Use), 18.120.180.7 (Shared Outdoor Recreation Areas: Residential Use), 18.120.180.8 (Sensitive Lands), and 18.120.180.9 (Demarcation of Spaces), and are therefore, found to be inapplicable as approval standards. Relationship to the Natural and Physical Environment: Section 18.120.180.2 states that buildings shall be located to preserve existing trees, topography, and natural drainage and that trees having a six inch caliper or greater shall be preserved or replaced by new plantings of equal character. The site contains approximately 144 significant trees which vary in size from six inches to 40 inches in diameter. The applicant has proposed to work around and maintain some 78 of these trees. The majority of the trees which are proposed to be removed are single stand alone specimens or are located towards the middle of the development site which makes preservation difficult. Due to potential impacts to the trees during construction the applicant shall provide a plan showing how the trees will be protected. This plan shall be submitted for review and approval. The applicant is required to construct these protection measures prior to commencement of work on the site. NOTICE OF DECISION SR 95-0012 LANDMARK FORD PARKING LOT PAGE 6 Buffering. Screening and Compatibility between adjoining uses: Section 18.120.108.4(A) states that buffering shall be provided between different types of land uses. Section 18.120.108.4(B) states that on-site screening from view of adjoining properties of such things as service and storage areas, parking lots, and mechanical devices on roof tops shall be provided. The site directly adjoins two (2) existing detached, single-family residential home sites. The parking lots require buffering and screening as contained in the Buffer Matrix (18.100.130). Because the portion of each parking lot which adjoins these homes is less than 50 parking spaces, a minimum of a 10 foot buffer width is required. The site plan indicates that a 10-20 foot buffer width has been proposed. The Landscape Plan indicates that the existing vegetation is to be preserved within these areas wherever possible to serve as buffer materials. The Landscape Plan provides little detail concerning the extent of the existing vegetation. To comply with the buffering requirements the applicant must demonstrate that the existing vegetation will provide equivalent buffering to a fence, hedge or wall, a row of trees of varying spacing depending on their size at maturity, a minimum of ten five gallon shrubs or 20, one-gallon shrubs for each 1,000 square feet of ground area. In addition, the applicant is required to provide one (1) of the following: a row of evergreen shrubs, or earthen berm, fence or wall. Alternatively, the applicant will be required to construct all, or a part of these buffer improvements where the existing vegetation does not provide this level of land use buffering. Crime Prevention and Safety: Section 18.120.108.10 requires that exterior lighting levels be selected and the angles shall be oriented towards areas vulnerable to crime and shall be placed in areas having heavy pedestrian or vehicular traffic. A security lighting plan shall be submitted for review and approval by the Police Department. Landscaping Plan: Section 18.100.015 requires that the applicant submit a landscaping plan. The applicant has submitted a plan indicating the number, type and location of trees and other proposed landscape improvements. The applicant shall provide a revised landscape plan which matches the current proposed development plan and addresses the related conditions of approval concerning land use buffering, street trees and parking lot trees. Street Trees: Section 18.100.033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with section 18.100.035. Section 18.100.035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity(small, medium or large). The preliminary landscape plan shows the provision for 19 Red Sunset Maple trees along both the SW 68th Street frontage and SW Franklin Street frontages. The applicant has proposed to space these trees at 35 feet on center which satisfies this requirement along these frontages. Additional street trees are required to be provided along portions of the SW Elmhurst Street frontage where existing trees don't preclude their planting. It is recommended that street trees be deferred along the SW 69th Street frontage until such time as street improvements are constructed. NOTICE OF DECISION SDR 95-0012 LANDMARK FORD PARKING LOT PAGE 7 Screening: Special Provisions: Section 18,1OO,11O(A) requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one tree for each seven parking spaces in order to provide a canopy effect. The minimum dimension on the landscape islands shall be three feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. The landscape plan shows the provision for a combination of low lying landscaping, street trees and parking lot trees to serve the 162 proposed parking spaces. The site plan presently provides 12 parking lot trees. A minimum of 23 parking lot trees are required to serve this number of parking spaces. Because the applicant is preserving approximately 78 significant trees, the existing trees are expected to provide additional parking lot shading as would have been provided by the required parking lot trees. Visual Clearance Areas: Section 18.102 requires that a clear vision area be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height. The code provides that obstructions which may be located in this area shall be visually clear between three and eight feet in height (trees may be placed within this area provided all branches below eight feet are removed). A visual clearance area is the triangular area formed by measuring a 30 foot distance along the street right-of-way and then connecting these two 30 foot distance points with a straight line. The proposed plan does not comply with this requirement as a six foot chain link fence has been proposed to be developed up to the corner of intersecting streets and up to the intersection of the proposed driveways and adjoining streets. A revised site plan shall be submitted which modifies the fencing plan to comply with all clear vision requirements. The Americans with Disabilities Act(ADA), requires six disabled parking spaces if 151 to 200 parking spaces are provided. The proposed site plan does not provide handicapped accessible parking spaces, therefore the applicant shall provide a ratio of existing handicapped parking spaces which equals the existing and proposed parking spaces. The dealership shall provide a minimum of eight handicapped parking spaces if 301-400 total spaces are provided, a minimum of nine spaces if 401 to 500 parking spaces are provided or 2% of the total of all parking spaces if 501-999 parking spaces are provided. Where necessary, Handicapped Accessible parking on the existing Landmark Ford Dealership shall be redesignated such, that the number of spaces provided is based on the total number of parking spaces constructed to serve the facility. Any spaces which are required to be redesignated may be dispersed among the various departments. NOTICE OF DECISION SDR 95-0012 LANDMARK FORD PARKING LOT PAGE 8 Off Street Parking; Section 18.106 sets minimum standards for parking space size and two-way driveway aisle widths within parking lots. This section requires that at a minimum, all parking spaces measure eight foot, eight inches in width and 18 feet in depth. This section also requires that all two-way driveways measure a minimum of 24 feet in width. The site plan as proposed provides parking spaces and two way driveways which exceed these minimum dimensional requirements. Signs: Section 18.114.130(D)lists the type of allowable signs and sign area permitted in the C-P zone. All signs shall conform to the provisions listed in this code section. The applicant has not proposed any signs along with this proposal but all future proposed signs shall be approved through the Sign Permit process as administered by the Planning Division. Tree Removal: Section 18.150.020(E)requires a permit for removal of trees having a trunk six inches or more in diameter measured four feet above the ground level. A permit for tree removal must comply with the following criteria as specified in Section 18.150.030(A): 1. The trees are diseased,present a danger to property,or interfere with utility service or traffic safety; 2. The trees have to be removed to construct proposed improvements or to otherwise utilize the applicant's property in a reasonable manner, 3. The trees are not needed to prevent erosion,instability, or drainage problems; 4. The trees are not needed to protect nearby trees as windbreaks or as a desirable balance between shade and open space; 5. The aesthetic character in the area will not be visually adversely affected by the tree removal; and 6. New vegetation planted by the applicant, if any, will replace the aesthetic value of trees to be cut This application was filed prior to adoption of new regulations concerning tree removal. Due to the date of its filing this application has been evaluated under those regulations. Under the old rules a tree removal permit was required for removal of trees over six inches in diameter. The proposed construction of parking lots as well as related grading will require the removal of trees. A detailed tree survey plan was submitted as part of this application. The removal of certain trees on-site appears warranted based on the following criteria: Criteria 1 and 2 are addressed because requiring all of the trees to be left in place would severely limit the size and extent of the construction of any parking lot improvements on this site. Criteria 3 is addressed because the site has a slope of approximately three to six percent. The trees which are proposed to be removed are not needed for erosion control because the site is generally not steeply sloping. The impervious surfaces to be developed for the parking lot will also provide erosion control for the majority of the site. NOTICE OF DECISION SDR 95-00(2 LANDMARK FORD PARKING LOT PAGE 9 Criteria 4 has been addressed because the trees which are proposed to be removed are primarily single trees which are bent or unsuitable for incorporation into the site. The applicant has proposed to incorporate groups of trees into the site. Based on the size of the buffer areas to be provided it does not appear that • the groups of trees to be preserved pose a hazard to adjoining properties. It is recommended that the during the construction process that tree protection measures be taken to ensure that the trees to be incorporated into the site are not damaged so as to create a hazard. Criteria 5 has been addressed because the aesthetic character of the larger area is not visually impacted because the site is not visually prominent due to the topography of the properties. The applicant has also proposed to incorporate substantial numbers of groups of trees into the site through careful site planning. Criteria 6 has been addressed because of the site constraints such as the types of improvements which are existing and the limited remaining areas which would be left to be develop if all of the trees were left in place. It does not appear to be feasible to plant replacement trees on this site given the numbers of trees to be maintained and the street and parking lot trees to be planted. This requirement will be satisfied as a tree removal permit will be required for the removal of trees with trunk diameters of six inches or more in diameter. B. PUBLIC FACILITY CONCERNS: Sections 18.164.030(EX1Xa)(Streets), 18.164.090(Sanitary Sewer), and 18.164.100(Storm Drains)shall be satisfied as specified below: Findings: 1. STREETS: Access is provided by a driveway along the north side of Franklin Street as well as a driveway on each side of Elmhurst Street. Southwest Dartmouth Street fronts along the northern frontage of the project. Except for curb and sidewalk, the street is fully improved and has an adequate right-of-way. The east side of the site fronts along SW 68th Avenue. It is also fully improved except for a sidewalk. NOTICE OF DECISION SDR 95-0012 LANDMARK FORD PARKING LOT PAGE 10 Southwest Elmhurst Street has a 60 foot right-of-way within the site and is improved only with gravel surfacing. The applicant proposes to provide full-street improvements extending from SW 68th Avenue west about 75 feet to the proposed driveways. These full-street improvements should be extended to include the portion of the street with frontage on both sides. Where frontage is limited to one side, the street should be improved with half-street improvements plus, paving 12 feet past the centerline. The south frontage of the site is along SW Franklin Street. This is a 60 foot right- of-way that should be improved to local street standards including, paving 12 feet past the centerline. The western frontage is along SW 69th Street, an unimproved street within a 60 foot right-of-way. No access to this street is proposed and no improvements are required. 2. SANITARY SEWER: Sanitary sewer service is not required for this project. Service is available from SW 68th Avenue and development at other sites will require the extension of a public sanitary sewer within SW 69th Avenue when the street is improved. 3. STORM SEWER: Run-off from each block of the development will be directed to a detention pond that will discharge to ditches along SW 69th Avenue. The applicant proposes to provide surface water treatment with a detention pond on each block. SECTION V. PROCEDURE 1. A total of 253 parking spaces are proposed between SW 68th Avenue, SW Franklin Street, SW 69th Avenue, and SW Dartmouth Street . Findings : 1 . STREETS: Access is provided by a driveway along the north side of Franklin Street as well as a driveway on each side of Elmhurst Street. SW Dartmouth Street fronts along the northern frontage of the project. Except for a sidewalk, the street is fully improved and has an adequate right-of-way. The east side of the site fronts along SW 68th Avenue. It is also fully improved except for a sidewalk. SW Elmhurst Street has a 60 foot right-of-way within the site and improved only with gravel surfacing. The applicant proposes to provide full-street improvements extending from SW 68th Avenue west about 75 feet to the proposed driveways . These full-street improvements should be extended to include the portion of the street with frontage on both sides . Where frontage is limited to one side, the street should be improved with half-street improvements plus paving 12 feet past the centerline. The south frontage of the site is along SW Franklin Street . This is a 60 foot right-of-way that should be improved to local street standards including paving 12 feet past the centerline. The western frontage is along SW 69th Street, an unimproved street within a 60 foot right-of-way. No access to this street is proposed and no improvements are required. ENGINEERING COMMENTS SDR 95-0012 LANDMARK FORD PARKING LOT PAGE 1 2 . SANITARY SEWER: Sanitary sewer service is not required for this project. Service is available from SW 68th Avenue and development at other sites will require the extension of a public sanitary sewer within SW 69th Avenue when the street is improved. 3 . STORM SEWER: Run-off from each block of the development will be directed to a detention pond that will discharge to ditches along SW 69th Avenue. The applicant proposes to provide surface water treatment with a detention pond on each block. Recommendations : PRIOR TO THE ISSUANCE OF A BUILDING PERMIT THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED: 1. The applicant shall complete installation of curbs and sidewalks along the SW Dartmouth Street and SW 68th Avenue frontages to City standards. A tree protection plan showing how the trees will be protected and screened during construction shall be provided and followed during construction to protect the designated trees and to avoid issuance of a stop work order due to damage to the protected trees. A revised Landscape Plan shall be submitted which provides additional street trees along the SW Elmhurst Street frontage where existing trees don't preclude their planting. e. The applicant shall demonstrate that the existing vegetation will provide equivalent buffering to a fence, hedge or wall, a row of trees of varying spacing depending on their size at maturity, a minimum of ten five gallon shrubs or 20 one gallon shrubs for each 1,000 square feet of ground area, a second row of evergreen shrubs, earthen berm, fence or wall. Alternatively the applicant will be required to construct all or a part of these buffer improvements where the existing vegetation does not provide land use buffering. 13. All site improvements shall be installed and maintained as per the approved revised site plan prior to use of the parking lots. IN ADDITION THE APPLICANT SHOULD BE AWARE OF THE FOLLOWING SECTIONS OF THE COMMUNITY DEVELOPMENT CODE: THIS IS NOT AN EXCLUSIVE LIST. 1. SECTION 18.160.170 IMPROVEMENT AGREEMENT A. Before approved construction plans are issued by the City, the Applicant shall: NOTICE OF DECISION SDR 95-00f2 LANDMARK FORD PARKING LOT PAGE 3 • 1. Execute and file an agreement with the City Engineer specifying the period within which all required improvements and repairs shall be completed; and 2. Include in the agreement provisions that if such work is not completed within the period specified, the City may complete the work and recover the full cost and expenses from the applicant. B. The agreement shall stipulate improvement fees and deposits as may be required to be paid and may also provide for the construction of the improvements in stages and for the extension of time under specific conditions therein stated in the contract. 2. SECTION 18.120.060 BONDING AND ASSURANCES A. On all projects where public improvements are required the Director shall: 1. Require a bond in an amount not greater than 100 percent of other adequate assurances as a condition of approval of the site development plan in order to ensure the completed project is in conformance with the approved plan; and 2. Approve and release such bonds. B. The bond shall be released when the Director finds the completed project conforms to the approved site development plan and all conditions of approval are satisfied. 3. SECTION 18.164 STREET AND UTILITY IMPROVEMENT STANDARDS. Section 18.164.180 NOTICE TO CITY REQUIRED Work shall not begin until the City has been notified in advance. If work is discontinued for any reason, it shall not be resumed until the City is notified. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE DATE OF THE FINAL DECISION. SECTION II. FINDINGS OF FACT 1. Background: No previous development applications have been reviewed by the City of Tigard for the subject properties. NOTICE OF DECISION SDR 95-0012 LANDMARK FORD PARKING COT PAGE 4 2. Vicinity Information: The subject site is approximately two-thirds of the land area within SW 69th, SW 68th, SW Franklin Street and SW Dartmouth Street. The surrounding properties are zoned Commercial Professional and General Commercial. These properties are either vacant , developed with older single family residences or are developed with the Landmark Ford Dealership and office building uses. 3. Site Information and Proposal Description: The subject properties are currently vacant and total approximately 2.59 acres. The applicant proposes to construct a total of 162 parking spaces. 4. Other Staff and Agency Comments: The City of Tigard Building Department reviewed this application and provided the following comments concerning this proposal: A ratio of existing handicapped parking spaces to total existing and proposed parking spaces shall be provided. Where necessary, Handicapped Accessible parking on the existing Landmark Ford Dealership shall be redesignated such that the number of spaces provided is based on the total number of parking spaces to serve the facility. Any spaces which are required to be redesignated may be dispersed among the various departments within the facility. The Police Department also reviewed this application and provided the following comments concerning this proposal: I'll need to see the on-site lighting proposal as stated lighting will be consistent with current industry standards. Maintenance Services Departments, Unified Sewerage Agency, Tualatin Valley Fire District, Portland General Electric, has reviewed this application and have offered no comments or objections. No other comments have been received. SECTION III. ANALYSIS AND CONCLUSION A. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing to construct parking lots. Parking facilities are classified in Section 18.42(Use Classifications)as a permitted use. Under Civic uses, as a Quasi-Public use the property owner is permitted to develop a parking lot. The Parking Facility refers to parking which has been provided in excess of the on-site parking required to serve an existing use. Section 18.64.030 lists Parking Facilities as one of the permitted use in the site's Commercial Professional Zoning District. NOTICE OF DECISION SDR 95-0012 LANDMARK FORD PARKING LOT PAGE 5 Minimum Lot Area: Section 18.64.050 states that the minimum lot area for parcels in the C-P zoning district shall be 6,000 square feet, and the minimum lot width shall be 50 feet. Developments within the C-P zone are required to provide a minimum of 15% landscaping. The applicant would create two (2) sites of 67,500 and 55,000 square feet of parking lot area respectively. The applicant's site plan states that approximately 16,444 and 16,771 square feet or approximately 24.50 and 30% respectively are to be developed with landscaping which exceeds the 15% minimum required landscape area requirement. Setbacks: Section 18.64.050 states that, except as otherwise provided in Chapter 18.100.130 (Buffer Matrix), there is no front yard setback and no side or rear yard setback except 20 feet shall be required where the C-P zone abuts a residential zone. The maximum building height is 45 feet. Setback and height limitation requirements do not apply to this site because no structure has been proposed. Section 18.120.180(AX1)(Site Development Review - Approval Standards) requires that a development proposal be found to be consistent with the various standards of the Community Development Code. The applicable criteria in this case are Chapters 18.100, 18.102, 18.106, 18.120, 18.150, and 18.164. The proposal's consistency with these Code Chapters is reviewed in the following sections. The proposal contains no elements related to the provisions of Code Chapters 18.84 (Sensitive Lands), 18.92 (Density Computations), 18.94 (Manufactured/ Mobile Home Regulations), 18.98 (Building Height Limitations: Exceptions), 18.108 (Access and Egress), 18.116 (Waste and Recycling Facilities) or 18.144 (Accessory Use and Structures) which are also listed under section 18.120.180.A.1. These Chapters are therefore, found to be inapplicable as approval standards. Section 18.120.180.A.2 provides other Site Development Review approval standards not necessarily covered by the provisions of the previously listed sections. These other standards are addressed immediately below. The proposal contains no elements related to the provisions of 18.120.180.3 (Exterior Elevations), 18.120.108.5 (Privacy and Noise), 18.120.180.6 (Private Outdoor Areas: Residential Use), 18.120.180.7 (Shared Outdoor Recreation Areas: Residential Use), 18.120.180.8 (Sensitive Lands), and 18.120.180.9 (Demarcation of Spaces), and are therefore, found to be inapplicable as approval standards. Relationship to the Natural and Physical Environment: Section 18.120.180.2 states that buildings shall be located to preserve existing trees, topography, and natural drainage and that trees having a six inch caliper or greater shall be preserved or replaced by new plantings of equal character. The site contains approximately 144 significant trees which vary in size from six inches to 40 inches in diameter. The applicant has proposed to work around and maintain some 78 of these trees. The majority of the trees which are proposed to be removed are single stand alone specimens or are located towards the middle of the development site which makes preservation difficult. Due to potential impacts to the trees during construction the applicant shall provide a plan showing how the trees will be protected. This plan shall be submitted for review and approval. The applicant is required to construct these protection measures prior to commencement of work on the site. NOTICE OF DECISION SDR 95-0012 LANDMARK FORD PARKING IOT PAGE 6 Buffering, Screening and Compatibility between adjoining uses: Section 18.120.108.4(A) states that buffering shall be provided between different types of land uses. Section 18.120.108.4(B) states that on-site screening from view of adjoining properties of such things as service and storage areas, parking lots, and mechanical devices on roof tops shall be provided. The site directly adjoins two (2) existing detached, single-family residential home sites. The parking lots require buffering and screening as contained in the Buffer Matrix (18.100.130). Because the portion of each parking lot which adjoins these homes is less than 50 parking spaces, a minimum of a 10 foot buffer width is required. The site plan indicates that a 10-20 foot buffer width has been proposed. The Landscape Plan indicates that the existing vegetation is to be preserved within these areas wherever possible to serve as buffer materials. The Landscape Plan provides little detail concerning the extent of the existing vegetation. To comply with the buffering requirements the applicant must demonstrate that the existing vegetation will provide equivalent buffering to a fence, hedge or wall, a row of trees of varying spacing depending on their size at maturity, a minimum of ten five gallon shrubs or 20, one-gallon shrubs for each 1,000 square feet of ground area. In addition, the applicant is required to provide one (1) of the following: a row of evergreen shrubs, or earthen berm, fence or wall. Alternatively, the applicant will be required to construct all, or a part of these buffer improvements where the existing vegetation does not provide this level of land use buffering. Crime Prevention and Safety: Section 18.120.108.10 requires that exterior lighting levels be selected and the angles shall be oriented towards areas vulnerable to crime and shall be placed in areas having heavy pedestrian or vehicular traffic. A security lighting plan shall be submitted for review and approval by the Police Department. Landscaping Plan: Section 18.100.015 requires that the applicant submit a landscaping plan. The applicant has submitted a plan indicating the number, type and location of trees and other proposed landscape improvements. The applicant shall provide a revised landscape plan which matches the current proposed development plan and addresses the related conditions of approval concerning land use buffering, street trees and parking lot trees. Street Trees: Section 18.100.033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with section 18.100.035. Section 18.100.035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity(small, medium or large). The preliminary landscape plan shows the provision for 19 Red Sunset Maple trees along both the SW 68th Street frontage and SW Franklin Street frontages. The applicant has proposed to space these trees at 35 feet on center which satisfies this requirement along these frontages. Additional street trees are required to be provided along portions of the SW Elmhurst Street frontage where existing trees don't preclude their planting. It is recommended that street trees be deferred along the SW 69th Street frontage until such time as street improvements are constructed. NOTICE OF DECISION SDR 95-0012 LANDMARK FORD PARKING LOT PAGE 7 Screening: Special Provisions: Section 18.100.110(A) requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one tree for each seven parking spaces in order to provide a canopy effect. The minimum dimension on the landscape islands shall be three feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. The landscape plan shows the provision for a combination of low lying landscaping, street trees and parking lot trees to serve the 162 proposed parking spaces. The site plan presently provides 12 parking lot trees. A minimum of 23 parking lot trees are required to serve this number of parking spaces. Because the applicant is preserving approximately 78 significant trees, the existing trees are expected to provide additional parking lot shading as would have been provided by the required parking lot trees. Visual Clearance Areas: Section 18.102 requires that a clear vision area be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height. The code provides that obstructions which may be located in this area shall be visually clear between three and eight feet in height (trees may be placed within this area provided all branches below eight feet are removed). A visual clearance area is the triangular area formed by measuring a 30 foot distance along the street right-of-way and then connecting these two 30 foot distance points with a straight line. The proposed plan does not comply with this requirement as a six foot chain link fence has been proposed to be developed up to the corner of intersecting streets and up to the intersection of the proposed driveways and adjoining streets. A revised site plan shall be submitted which modifies the fencing plan to comply with all clear vision requirements. The Americans with Disabilities Act(ADA), requires six disabled parking spaces if 151 to 200 parking spaces are provided. The proposed site plan does not provide handicapped accessible parking spaces, therefore the applicant shall provide a ratio of existing handicapped parking spaces which equals the existing and proposed parking spaces. The dealership shall provide a minimum of eight handicapped parking spaces if 301-400 total spaces are provided, a minimum of nine spaces if 401 to 500 parking spaces are provided or 2% of the total of all parking spaces if 501-999 parking spaces are provided. Where necessary, Handicapped Accessible parking on the existing Landmark Ford Dealership shall be redesignated such, that the number of spaces provided is based on the total number of parking spaces constructed to serve the facility. Any spaces which are required to be redesignated may be dispersed among the various departments. NOTICE OF DECISION SDR 95-0012 LANDMARK FORD PARKING LOT PAGE 8 Off Street Parking: Section 18.106 sets minimum standards for parking space size and two-way driveway aisle widths within parking lots. This section requires that at a minimum, all parking spaces measure eight foot, eight inches in width and 18 feet in depth. This section also requires that all two-way driveways measure a minimum of 24 feet in width. The site plan as proposed provides parking spaces and two way driveways which exceed these minimum dimensional requirements. Signs: Section 18.114.130(D)lists the type of allowable signs and sign area permitted in the C-P zone. All signs shall conform to the provisions listed in this code section. The applicant has not proposed any signs along with this proposal but all future proposed signs shall be approved through the Sign Permit process as administered by the Planning Division. Tree Removal: Section 18.150.020(E)requires a permit for removal of trees having a trunk six inches or more in diameter measured four feet above the ground level. A permit for tree removal must comply with the following criteria as specified in Section 18.150.030(A): 1. The trees are diseased,present a danger to property,or interfere with utility service or traffic safety; 2. The trees have to be removed to construct proposed improvements or to otherwise utilize the applicant's property in a reasonable manner; 3. The trees are not needed to prevent erosion,instability, or drainage problems; 4. The trees are not needed to protect nearby trees as windbreaks or as a desirable balance between shade and open space; 5. The aesthetic character in the area will not be visually adversely affected by the tree removal; and 6. New vegetation planted by the applicant,if any, will replace the aesthetic value of trees to be cut. This application was filed prior to adoption of new regulations concerning tree removal. Due to the date of its filing this application has been evaluated under those regulations. Under the old rules a tree removal permit was required for removal of trees over six inches in diameter. The proposed construction of parking lots as well as related grading will require the removal of trees. A detailed tree survey plan was submitted as part of this application. The removal of certain trees on-site appears warranted based on the following criteria: Criteria 1 and 2 are addressed because requiring all of the trees to be left in place would severely limit the size and extent of the construction of any parking lot improvements on this site. Criteria 3 is addressed because the site has a slope of approximately three to six percent. The trees which are proposed to be removed are not needed for erosion control because the site is generally not steeply sloping. The impervious surfaces to be developed for the parking lot will also provide erosion control for the majority of the site. NOTICE OF DECISION SDR 95-0012 LANDMARK FORD PARKING LOT PAGE 9 Criteria 4 has been addressed because the trees which are proposed to be removed are primarily single trees which are bent or unsuitable for incorporation into the site. The applicant has proposed to incorporate groups of trees into the site. Based on the size of the buffer areas to be provided it does not appear that the groups of trees to be preserved pose a hazard to adjoining properties. It is recommended that the during the construction process that tree protection measures be taken to ensure that the trees to be incorporated into the site are not damaged so as to create a hazard. Criteria 5 has been addressed because the aesthetic character of the larger area is not visually impacted because the site is not visually prominent due to the topography of the properties. The applicant has also proposed to incorporate substantial numbers of groups of trees into the site through careful site planning. Criteria 6 has been addressed because of the site constraints such as the types of improvements which are existing and the limited remaining areas which would be left to be develop if all of the trees were left in place. It does not appear to be feasible to plant replacement trees on this site given the numbers of trees to be maintained and the street and parking lot trees to be planted. This requirement will be satisfied as a tree removal permit will be required for the removal of trees with trunk diameters of six inches or more in diameter. B. PUBLIC FACILITY CONCERNS: Sections 18.164.030(EX1Xa)(Streets), 18.164.090(Sanitary Sewer), and 18.164.100(Storm Drains)shall be satisfied as specified below: Findings: 1. STREETS: Access is provided by a driveway along the north side of Franklin Street as well as a driveway on each side of Elmhurst Street. Southwest Dartmouth Street fronts along the northern frontage of the project. Except for curb and sidewalk, the street is fully improved and has an adequate rig ht-of-way. The east side of the site fronts along SW 68th Avenue. It is also fully improved except for a sidewalk. NOTICE OF DECISION SDR 95-00f2 LANDMARK FORD PARKING LOT PAGE 10 • Southwest Elmhurst Street has a 60 foot right-of-way within the site and is improved only with gravel surfacing. The applicant proposes to provide full-street improvements extending from SW 68th Avenue west about 75 feet to the proposed driveways. These full-street improvements should be extended to include the portion of the street with frontage on both sides. Where frontage is limited to one side, the street should be improved with half-street improvements plus, paving 12 feet past the centerline. The south frontage of the site is along SW Franklin Street. This is a 60 foot right- of-way that should be improved to local street standards including, paving 12 feet past the centerline. The western frontage is along SW 69th Street, an unimproved street within a 60 foot right-of-way. No access to this street is proposed and no improvements are required. 2. SANITARY SEWER: Sanitary sewer service is not required for this project. Service is available from SW 68th Avenue and development at other sites will require the extension of a public sanitary sewer within SW 69th Avenue when the street is improved. 3. STORM SEWER: Run-off from each block of the development will be directed to a detention pond that will discharge to ditches along SW 69th Avenue. The project proposed by Jim Corliss, president of Landmark Ford, Inc., will develop 1.2 acres of employee and customer parking providing approximately 245 standard parking spaces for the adjoining dealership located at 12000 SW 68th Avenue in Tigard, Oregon. The current zoning is commercial professional, which allows for auxiliary parking to serve adjacent commercial properties. 2. The site is located in the Triangle Area of the City of Tigard located west of Landmark Ford Inc. and Interstate 5. Specifically, the parking lot will be between SW Dartmouth Street and SW Franklin Street between SW 68th Avenue and SW 69th Avenue. 3. A mixture of residential and single-story commercial structures border the property. The two residential structures within the boundary of the proposed site will be removed from the property prior to construction of the parking lot. 4. The proposed parking lot improvements will generally slope to the south and west consistent with existing topography. Existing topography generally slopes 2%-4% in these directions. The parking lots will be of asphalt paving with extruded curbs. The main driveway entrances and exists, with a minimum width of 24', will be accessed via one on SW Franklin Street and two on SW Elmhurst Street. Two-third street improvements are proposed for SW Franklin beginning at the adjacent (Louie Photo) property owner's southwest property corner west to the intersection of SW 69th and SW Franklin and full street improvement on SW Elmhurst from SW 68th west approximately 75 lineal feet. The remainder of SW Elmhurst is to remain gravel. Sidewalk improvements are also proposed for the west side of SW 68th. 5. Street trees will be provided along all improved streets. Red Sunset Maples will be used at 40' o.c. with Repens Oregon Grape as groundcover spaced at 24" o.c. to fill in completely. Red Sunset Maple provide a wide canopy for shade and buffering, have beautiful red fall color and make excellent street trees. Repens Oregon Grape is a low growing, spreading form of the native Oregon Grape. It is very hardy and once established, will fill in. 6. The site will have 20' buffers at all the edges bordering sites containing residential structures. 7. In unimproved street frontage areas and buffer areas where the grading and construction will only disturb the natural vegetation on one side and where there is enough width to protect the tree roots from damage, the natural vegetation will be protected and kept. This will help to keep the site looking natural, increase privacy and eliminate adverse noise and visual impacts between adjacent developments, especially between different land uses. The natural vegetation consists of a mixture of mostly Douglas Firs, Hawthorns and Locust. Infill planting will be done in these areas as needed to provide a full buffer. Native plant material and other well adapted plants for the area will be used for this purpose. Douglas Firs and Vine Maple will be used as infill trees, providing a combination of evergreen and deciduous for a variety of color and texture. Oregon Grape, Evergreen Huckleberry and Dwarf Mugho Pine will be used as the evergreen infill shrubs. Redtwig and Yellowtwig Dogwoods, Compact Winged Euonymous and Froebelli Spiraea will be the deciduous infill shrubs. A 6'-0" cyclone chain link fence will run along the property line for security. 8. Existing storm drainage within the two parcels consists of overland flow in the southerly and westerly directions. Existing drainage ditches along SW Franklin, SW Elmhurst and SW 69th channel water to two culverts crossing in a westerly direction under SW 69th. Storm water flows continue generally in a southwesterly direction towards SW 72nd Avenue. 9. Proposed storm drainage improvements consist of onsite "trapped" type catch basins draining to detention ponds via biofiltration swales. Storm water improvements will be consistent with Unified Sewerage Agency of Washington County design standards for phosphorus removal and will utilize existing drainage ways after onsite treatment. Swales plant types will utilize some existing vegetation and will be consistent with USA recommendations. Soil types for the area are typically silty loarns which will provide good soil conditions for these type of facilities. Proposed improvements to an existing 18" outfall which appears to drain catch basins in SW 68th Avenue will consist of piping the outfall to the proposed bioswales/detention pond. 10. Existing sanitary sewer service is located in SW 68th Avenue. Sanitary sewer service will not be required for this project. 11. Onsite lighting for this project is also proposed. Lighting will be consistent with current industry standards. Residents adjacent to site were concerned about their safety after the blackberries and underbrush were removed. They were relieved that a fence was proposed on the property line for security. They were very pleased that the blackberries would be gone. 2. The Snyders were concerned about how we would deal with the steep grade behind their house and how we would move the water off the site. 3. Questions concerning the future development of the site were raised; future buildings, etc. Jim Corliss assured them that he had no plans for a building on this site. 4. Questions about construction schedule and concerns about construction messes on 69th Avenue. 5. We talked about which streets were going to be improved and how the nonremonstrance works in the event of future development on 69th Avenue. 6. The neighbors were interested in the landscaping that we would be providing, especially the properties adjacent to the proposed site. 7. A neighbor asked if there would be speakers on the site. Jim Corliss assured them that there would not be any. 8. Lighting the parking lot was discussed. The neighbors felt that some lighting would discourage loiterers. Meeting notes from Neighborhood Meeting (#2) June 27, 1995 Issues: 1. Louis Photo uses his backyard for photographing. He would like to see some taller landscaping used in order not to disrupt his background scenery. 2. Louis has installed a 6'-0" fence on the property line at his building. He suggested that we connect to his fence with our Cyclone fence instead of running one behind his. S • 3. Max Landon, the property owner on the northeast corner of the proposed site, gave Jim Corliss permission to not have a 20'-0" buffer around his property. He has no problem with a reduced buffer. He stated that even though there currently is a residence on the property, it is zoned commercial-professional. Oregon 97205 Re: Tree Recommendations for Landmark Ford Dear Rich: I made a site visit to the Landmark Ford properties on Wednesday, September 13, 1995, to evaluate which trees should be saved. The criteria for determining which trees to save was based on several factors: tree size, potential for survival during and after construction, tree desirability, and parking lot location. I have included two blueprints with this letter showing the trees I feel should be kept. The majority of these trees are Douglas Firs. Many of the deciduous trees on the site are crooked and thin due to close growth proximity. Very few of them would look good standing by themselves. The Douglas Firs, however, with a little pruning, would look nice and stand a good chance of surviving by themselves or in small groups. The two prints included illustrate which trees these are. I reviewed with Jim Matteson the importance of keeping the heavy construction equipment outside the root zone as much as possible. Compaction of the soils in the root zone is the area of concern. The Tigard Community Development Code, Site Development Review Section, states: "if the requested modification meets any of the major modification criteria, the request shall be reviewed as a new Site Development Review application." Section 18.120.070(B) states that the Director shall determine that a major modification(s) will result if one (1) or more of the following changes are proposed: 1.
