SDR1995-00011 SD R95 - 00011 ME RCE R/ABELL - MERCER OFFICE BUILDING CITY OF TIGARD NOTICE OF DECISION SITE DEVELOPMENT REVIEW SDR 95-0011 MERCER - OWNER ABELL - APPLICANT APPLICATION: The applicant requests for Site Development Review approval to allow the construction of a 1, 931 square foot commercial office building. Zoning: C-P (Professional Commercial) . Location: 11565 SW 68th Avenue (WCTM 1S1 36DD, tax lot 801) . SECTION I - DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted in Section II . THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO THE ISSUANCE OF BUILDING PERMITS. 1 . The applicant shall connect to the underground storm drain system and sewer main in SW 68th Avenue in a location approved by the Engineering Department. STAFF CONTACT: John Hagman, Engineering Department (639-4171) 2 . The applicant shall demonstrate that storm drainage runoff can be discharged into the existing drainageways without significantly impacting properties downstream. STAFF CONTACT: Greg Berry, Engineering Department (639- 4171) . 3 . Washington County has established and the City has agreed to collect Traffic Impact Fees in accordance with Resolution No. 94-18 . The applicant shall pay the fee established for the proposed use. 4 . The applicant shall pay the fees as established under the guidelines of Unified Sewerage Agency Resolution and Order No. 91-47 . NOTE: This is a two part fee which is paid at different times. The first part is paid with any associated public improvements which is for that portion of the development which increases the impervious area within the public right-of-way. The second part is paid at Building Permit issuance which is for each individual lot . 5 . A joint use and maintenance agreement shall be executed and recorded on City standard forms for all common driveways . The agreement shall be referenced on and become part of all applicable parcel Deeds. The agreement shall be approved by the Engineering Department prior to recording. The applicant shall obtain a Street Opening Permit from the Engineering Department that will provide for the construction of a six (6 ' ) foot wide sidewalk in SW 68th Avenue and the sewer and storm drain connections in SW 68th Avenue. STAFF CONTACT: John Hagman, Engineering Department (639-4171) 7 . Revised site and landscaping plans shall be submitted for review by the Planning Division, Staff Contact : Will D'Andrea. The revised plans shall include the following: a. Landscape / impervious surface calculations. The minimum amount of landscaping to be provided is 15 percent. Calculations shall also be provided for the adjoining property which reflect the driveway modification. b. Type and size of plant material . c . Parking lot trees which provide the required canopy coverage. d. Location and screening of the trash facility / Ov 117�fl enclosure . (NI00 P,S e . Fifteen (15) parking spaces, six (6) compact, for both office buildings. f . One (1) bicycle parking space. g. Twenty-four (24) foot access drive. h. Walkway connection from the office to SW 67th Avenue. I . Street trees, to be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large) . NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 2 8 . A plan which shows compliance with Community Development Code Chapter 18 . 116, Mixed Solid Waste and Recyclable Storage. The applicant shall choose one of the following four methods to demonstrate compliance : Minimum Standard, Waste Assessment, Comprehensive Recycling Plan or Franchised Hauler Review and Sign-off. Regardless of which method chosen, the applicant shall submit a letter from the franchise disposal company related to facility design and compatibility. 9 . A tree removal permit for removal of trees having a trunk six inches or more in diameter when measured four feet above the ground. THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO THE ISSUANCE OF OCCUPANCY PERMITS : 10 . All site improvements shall be installed as approved per the revised site plan. 11 . An exterior lighting plan for the building and parking lot area shall be submitted for review and approval of the City of Tigard Police Department . SECTION 18 . 164 STREET AND UTILITY IMPROVEMENT STANDARDS A. 18 . 164 . 180 Notice to City Required Work shall not begin until the City has been notified in advance. If work is discontinued for any reason, it shall not be resumed until the City is notified. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE DATE OF THE FINAL DECISION. SECTION II . FINDINGS OF FACT 1 . Backround: No land use or development applications have been reviewed by the City of Tigard. NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 3 2 . Vicinity Information: The subject site is located east of SW 68th Avenue, west of SW 67th Avenue, south of SW Atlanta Street and north of SW Baylor Street . The surrounding properties are zoned C-P (Professional Commercial) and are generally developed with commercial uses. The adjacent properties to the east and south are developed with an office building and a church. 3 . Site Information and Proposal Description: The subject site is approximately 9, 583 square feet in size, vacant, and contains a number of mature trees . The applicant is proposing to construct a 1, 931 square foot office building with access onto SW 67th Avenue. The applicant is proposing a joint access drive with the property to the east. 4 . Other Staff Comments : The City of Tigard Building Division has reviewed this proposal and has offered the following comments : 1) Sheet DR3 shows proper storm sewer improvements, DR1 shows drywells . Will DR3 be implemented? ; 2) the building may be required to have an elevator; 3) DR1 does not show accessible parking. 5 . Agency Comments : The Unified Sewerage Agency has reviewed this proposal and has offered the following comments : A water quality facility is needed. General Telephone and Electronics has reviewed this proposal and has offered the following comments : Developer to place conduit for telephone service to GTE specifications . The City of Tigard Maintenance Services Department, City of Tigard Police Department, Tualatin Valley Fire and Rescue, Tualatin Valley Water District, Portland General Electric, has reviewed NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 4 this application and have offered no comments or objections . No other comments have been recieved. SECTION III . ANALYSIS AND CONCLUSION A. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS : Use Classification: The applicant is proposing an office building. Offices are classified in Code Section 18 .42 (Use Classifications) as Professional and Administrative Services . Code Section 18 . 64 . 030 allows Professional and Administrative Services as a permitted use in the C-P zoning district . Minimum Lot Area: Section 18 . 64 .050 states that the minimum lot area for parcels in the C-P zoning district shall be 6, 000 square feet, and the minimum lot width shall be 50 feet . The subject site contains approximately 9, 583 square feet with a width of approximately 80 feet, thereby satisfying the minimum dimensional requirements . Developments within the C-P zone are required to provide a minimum of 15% landscaping. The applicant has not indicated the square footage to be devoted for landscaping. Therefore, calculations for landscaped area shall be submitted for review for compliance with this section. The applicant shall also provide landscape calculations for the adjoining property which reflect the driveway modification. Setbacks : Section 18 . 64 . 050 states that, except as otherwise provided in Chapter 18 .100 . 130 (Buffer Matrix) , there is no front yard setback and no side or rear yard setback except 20 feet shall shall be required where the C-P zone abuts a residential zone. The side and rear yard setbacks do not apply to this site because it does not abut a residential zone . The building elevation drawings show a height of 35 feet, well under the maximum 45 feet allowed. Section 18 . 120 . 180 (A) (1) (Site Development Review - Approval Standards) requires that a development proposal be found to be consistent with the various standards of the Community Development Code. The applicable criteria in this case are chapters 18 . 100, 18 . 102, 18 . 106, 18 . 108, 18 . 114, 18 . 120, 18 . 150, and 18 . 164 . The proposal ' s consistency with these Code Chapters is reviewed in the following sections . The proposal contains no elements NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 5 related to the provisions of Code Chapters 18 . 84 (Sensitive Lands) , 18 . 92 (Density Computations) , 18 . 94 (Manufactured/ Mobile Home Regulations) , 18 . 98 (Building Height Limitations: Exceptions) , or 18 . 144 (Accessory Use and Structures) which are also listed under section . 18 . 120 . 180 .A. 1 . These Chapters are therefore found to be inapplicable as approval standards. Code section 18 . 120 . 180 .A.2 provides other Site Development Review approval standards not necessarily covered by the provisions of the previously listed sections. These other standards are addressed immediately below. The proposal contains no elements related to the provisions of 18 . 120 . 180 .3 (Exterior Elevations) , 18 . 120 . 180 . 6 (Private Outdoor Areas : Residential Use) , 18 . 120 . 180 .7 (Shared Oudoor Recreation Areas : Residential Use) , 18 . 120 . 180 . 8 (Sensitive Lands) , 18 . 120 . 180 . 9 (Demarcation of Spaces) , and are therefore found to be inapplicable as approval standards . Relationship to the Natural and Physical Environment : Section 18 . 120 . 180 .2 states that buildings shall be located to preserve existing trees, topography, and natural drainage and that trees having a six inch caliper or greater shall be preserved or replaced by new plantings of equal character. The proposed location and construction of the building and driveway, and the corresponding grading required to accomodate these improvements will require the removal of trees on the site. The applicant is limited in the location of the building and drive given the site' s size, topography and the adjoining development ' s driveway location. The applicant is however incorporating a few of the existing trees into the site plan. Buffering. Screening and Compatibility between adjoining uses : Section 18 . 120 . 180 .4 (A) states that buffering shall be provided between different types of land uses . This criteria is not applicable as the adjoining uses are not residential uses which need buffering as contained in the buffer matrix. Section 18 . 120 . 108 .4 (B) states that on- site screening from view of adjoining properties of such things as service and storage areas, parking lots, and mechanical devices on roof tops shall be provided. The site plans shows the provision of rhododendrons which screen the parking area from the adjoining church, thereby satisfying this criteria. NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 6 • Privacy and Noise: Section 18 . 120 . 180 . 5 requires that on- site uses which create noise, lights, or glare shall be buffered from adjoining residential uses. This criteria is not applicable as this proposal does not abut a residential use, however the site plan shows the provision of landscaping to screen the parking area from the adjoining church. Crime Prevention and Safety: Section 18 . 120 . 180 . 10 requires that exterior lighting levels be selected and the angles shall be oriented towards areas vulnerable to crime and shall be placed in areas having heavy pedestrian or vehicular traffic. An exterior lighting plan shall be submitted for review and approval. Landscaping Plan: Section 18 . 100 . 015 requires that the applicant submit a landscaping plan. This requirement shall be satisfied as the applicant shall submitted a plan indicating the number, type and location of trees and shrubs . The proposed plan indicates the location of landscaping but does not indicate the type or size of plant material . A revised plan shall be submitted which specified the type and size of plant material to be installed. Street Trees : Section 18 . 100 . 033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with section 18 . 100 . 035 . Section 18 . 100 .035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large) . A revised site plan shall be submitted which provides for street trees along SW 68th in accordance with this section. Screening: Special Provisions : Section 18 . 100 . 110 (A) requires the screening of parking and loading areas . Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees . Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one tree for each seven parking spaces in order to provide a canopy effect . The minimum dimension on the landscape islands shall be three NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 7 feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. A revised site plan shall be submitted which provides for parking lot trees in accordance with this provision. Screening of Refuse Containers and Service Facilities : Section 18 . 100 . 110 (B) and (D) requires that such facilities be screened or enclosed from view by placement of a solid wood fence, masonry wall or evergreen hedge. The preliminary plan does not show the provision of a refuse container or service facility. A revised plan shall be sumbitted which shows the provision of a facility and indicates how the trash enclosure will be screened in accordance with this criteria. Visual Clearance Areas : Section 18 . 102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height . The code provides that obstructions which may be located in this area shall be visually clear between three and eight feet in height (trees may be placed within this area provided all branches below eight feet are removed) . A visual clearance area is the triangular area formed by measuring a 30 foot distance along the street right-of-way and then connecting these two 30 foot distance points with a straight line . As indicated on the site plan, this criteria is satisfied. Minimum Off-Street Parking: Section 18 . 106 . 030 (C) (1) requires a minimum of one parking space for every 350 square feet of gross floor area. The total number of required parking spaces for a 1, 931 square foot office is 5 spaces . The applicant is proposing to provide 6 parking spaces . The applicant is proposing to share an access drive with the adjoining property. This property is developed with a 3 , 460 square foot office building which requires 10 parking spaces, as approved in a 1988 Site Development Review (SDR 18-86) application. In providing the shared driveway, two of the existing parking spaces will be removed. The site plan shall be revised to provide for a total of 15 parking spaces to accomodate both office buildings . A joint use agreement shall be NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 8 provided for access and shared parking between the two properties . The Americans with Disabilities Act (ADA) , which became effective on January 26, 1992, requires 1 disabled parking spaces if 1 to 25 parking spaces are provided. The proposed site plan does not show the provision of a disabled person parking space . A revised plan shall be submitted which provides for 1 disabled parking space, thereby satisfying this requirement . Compact Parking Spaces : Section 18 . 106 . 040 (A) allows up to 40 percent of the required parking spaces to be compact spaces . Two (2) of the required 5 parking spaces for the proposed building or six (6) of the required 15 spaces for the combined uses may be compact spaces. The proposed plan indicates the provision of 3 compact spaces, thereby satisfying this requirement . Bicycle Parking: Section 18 . 106 . 020 (P) requires one bicycle parking rack space for each 15 vehicular parking spaces in any development . Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian ways. One (1) bicycle parking space will be required for this development . The site plan does not indicate the location of bicycle racks . A revised site plan shall be submitted which provides for 1 bicycle space. Access : Section 18 . 108 . 080 requires that commercial and industrial uses which require less than 100 parking spaces provide one access with a minimum access width of 30 feet and a minimum pavement width of 24 feet. Curbs are required as well. The proposed parking spaces are served by a 15 foot wide driveway which connects with the adjoining property' s parking lot . The adjoining parking lot provides a 24 foot wide driveway onto SW 67th Avenue. This existing 24 foot wide driveway satisfies the access criteria. However, the 15 foot drive serving the proposed parking area is inadequate. A revised site plan shall be submitted which provides for a 24 foot wide driveway to serve the proposed parking area. The proposed plan indicates that a shared driveway will be provided with the property to the east . The applicant shall be required to obtain an access easement from the adjoining property to the east . The applicant shall also provide reciprocal parking agreements for shared parking. NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 9 Walkways : Section 18 . 108 .050 (A) requires that a walkway be extended from the ground floor entrance of the structure to the street which provides the required ingress and egress. Unless impractical, walkways should be constructed between a new development and neighboring developments . Walkways shall be a minimum of four feet in width, exclusive of vehicle overhangs and obtructions such as mailboxes, benches, bicycle racks, and sign posts, and shall be in compliance with ADA standards . The preliminary plan does not provide for a walkway to either SW 67th or SW 68th Avenue. A revised plan shall be submitted which provides for a walkway connection to SW 67th Street . Signs : Section 18 . 114 . 130 (D) lists the type of allowable signs and sign area permitted in the C-P zone. All signs shall conform to the provisions listed in this code section. All signs shall be approved through the Sign Permit process as administered by the Planning Division. Mixed Solid Waste and Recyclables Storage : Section 18 . 116 requires that new construction incorporates functional and adequate space for on-site storage and efficient collection of mixed solid waste and source separated recyclables prior to pick-up and removal by haulers . The applicant shall choose one of the following four methods to demonstrate compliance : Minimum standard, Waste assessment, Comprehensive recycling plan, or Franchised hauler review and sign-off. The applicant shall submit evidence or a plan which indicates compliance with this section. Regardless of which method chosen, the applicant shall submit written documentation from the franchise hauler regarding the location and compatibility of service facilities . Tree Removal : Section 18 . 150 contains standards for obtaining a permit for removal of trees having a trunk six inches or more in diameter when measured four feet above the ground. This requirement will be satisfied as a tree removal permit will be required for the removal of trees with trunk diameters of six inches or more in diameter. B. PUBLIC FACILITY CONCERNS : NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 10 Sections 18 . 164 . 030 (E) (1) (a) (Streets) , 18 .164. 090 (Sanitary Sewer) , and 18 .164 . 100 (Storm Drains) shall be satisfied as specified below: • 1 . STREETS : The site plan shows a joint use driveway onto SW 67th Avenue across the parking lot that serves the office development on the property contiguous to the east . The applicant should be required to provide a joint use and maintenance agreement for the proposed common driveway. No vehicular access is proposed to SW 68th Avenue which is a major collector street as shown on the City Comprehensive Plan. SW 68th Avenue was previously improved to its full width, with the exception of sidewalks . The applicant should be required to construct a six (6) foot wide sidewalk in accordance with City standards for the full length of the site frontage of SW 68th Avenue . With respect to SW 67th Avenue, the street has been constructed to current City Standards and no further construction is required. 2 . SANITARY SEWER: The site is served by the existing 8 inch public sanitary sewer line located in the SW 68th Avenue. The main line has sufficient capacity for this development . 3 . STORM SEWER: The site currently drains toward SW 68th Avenue. The site plan indicates that a new underground storm drain system will be constructed to drain the building and parking areas, and connect to the existing storm drain located within SW 68th Avenue . The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91-47) Surface Water Management Regulations requiring the construction of on-site water quality facilities or fees in-lieu of their construction. Section 7. 10b of the above noted Resolution and Order cites conditions under which the fee in-lieu may be accepted. Specifically, it NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 11 provides, that if, "The site is small compared to the development plan, and the loss of area for the on-site facility would preclude the effective development . " , the fee may apply. It is our opinion that this site is consistent with this criteria, and we recommend that a fee • in-lieu be required. SECTION V. PROCEDURE 1 . The applicant shall choose one of the following four methods to demonstrate compliance: Minimum Standard, Waste Assessment, Comprehensive Recycling Plan or Franchised Hauler Review and Sign-off . Regardless of which method chosen, the applicant shall submit a letter from the franchise disposal company related to facility design and compatibility. 9 . A tree removal permit for removal of trees having a trunk six inches or more in diameter when measured four feet above the ground. FINDINGS OF FACT 1 . Backround: No land use or development applications have been reviewed by the City of Tigard. NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 3 2 . Vicinity Information: The subject site is located east of SW 68th Avenue, west of SW 67th Avenue, south of SW Atlanta Street and north of SW Baylor Street . The surrounding properties are zoned C-P (Professional Commercial) and are generally developed with commercial uses . The adjacent properties to the east and south are developed with an office building and a church. 3 . Site Information and Proposal Description: The subject site is approximately 9, 583 square feet in size, vacant, and contains a number of mature trees . The applicant is proposing to construct a 1, 931 square foot office building with access onto SW 67th Avenue . The applicant is proposing a joint access drive with the property to the east . 4 . Other Staff Comments : The City of Tigard Building Division has reviewed this proposal and has offered the following comments : 1) Sheet DR3 shows proper storm sewer improvements, DR1 shows drywells . Will DR3 be implemented? ; 2) the building may be required to have an elevator; 3) DR1 does not show accessible parking. 5 . Agency Comments : The Unified Sewerage Agency has reviewed this proposal and has offered the following comments : A water quality facility is needed. General Telephone and Electronics has reviewed this proposal and has offered the following comments : Developer to place conduit for telephone service to GTE specifications . The City of Tigard Maintenance Services Department, City of Tigard Police Department, Tualatin Valley Fire and Rescue, Tualatin Valley Water District, Portland General Electric, has reviewed NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 4 this application and have offered no comments or objections . No other comments have been recieved. SECTION III . ANALYSIS AND CONCLUSION A. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing an office building. Offices are classified in Code Section 18 .42 (Use Classifications) as Professional and Administrative Services . Code Section 18 .64 . 030 allows Professional and Administrative Services as a permitted use in the C-P zoning district . Minimum Lot Area: Section 18 . 64 . 050 states that the minimum lot area for parcels in the C-P zoning district shall be 6, 000 square feet, and the minimum lot width shall be 50 feet . The subject site contains approximately 9, 583 square feet with a width of approximately 80 feet, thereby satisfying the minimum dimensional requirements . Developments within the C-P zone are required to provide a minimum of 150 landscaping. The applicant has not indicated the square footage to be devoted for landscaping. Therefore, calculations for landscaped area shall be submitted for review for compliance with this section. The applicant shall also provide landscape calculations for the adjoining property which reflect the driveway modification. Setbacks : Section 18 . 64 . 050 states that, except as otherwise provided in Chapter 18 .100 . 130 (Buffer Matrix) , there is no front yard setback and no side or rear yard setback except 20 feet shall shall be required where the C-P zone abuts a residential zone. The side and rear yard setbacks do not apply to this site because it does not abut a residential zone. The building elevation drawings show a height of 35 feet, well under the maximum 45 feet allowed. Section 18 . 120 . 180 (A) (1) (Site Development Review - Approval Standards) requires that a development proposal be found to be consistent with the various standards of the Community Development Code . The applicable criteria in this case are chapters 18 . 100, 18 . 102, 18 . 106, 18 . 108, 18 . 114, 18 . 120, 18 .150, and 18 . 164 . The proposal ' s consistency with these Code Chapters is reviewed in the following sections. The proposal contains no elements NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 5 related to the provisions of Code Chapters 18 . 84 (Sensitive Lands) , 18 . 92 (Density Computations) , 18 . 94 (Manufactured/ Mobile Home Regulations) , 18 . 98 (Building Height Limitations : Exceptions) , or 18 . 144 (Accessory Use and Structures) which are also listed under section 18 . 120 . 180 .A. 1 . These Chapters are therefore found to be inapplicable as approval standards. Code section 18 . 120 . 180 .A. 2 provides other Site Development Review approval standards not necessarily covered by the provisions of the previously listed sections . These other standards are addressed immediately below. The proposal contains no elements related to the provisions of 18 . 120 . 180 . 3 (Exterior Elevations) , 18 . 120 . 180 . 6 (Private Outdoor Areas : Residential Use) , 18 . 120 . 180 . 7 (Shared Oudoor Recreation Areas : Residential Use) , 18 . 120 . 180 . 8 (Sensitive Lands) , 18 . 120 . 180 . 9 (Demarcation of Spaces) , and are therefore found to be inapplicable as approval standards. Relationship to the Natural and Physical Environment : Section 18 . 120 . 180 . 2 states that buildings shall be located to preserve existing trees, topography, and natural drainage and that trees having a six inch caliper or greater shall be preserved or replaced by new plantings of equal character. The proposed location and construction of the building and driveway, and the corresponding grading required to accomodate these improvements will require the removal of trees on the site. The applicant is limited in the location of the building and drive given the site' s size, topography and the adjoining development ' s driveway location. The applicant is however incorporating a few of the existing trees into the site plan. Buffering, Screening and Compatibility between adjoining uses : Section 18 . 120 . 180 .4 (A) states that buffering shall be provided between different types of land uses . This criteria is not applicable as the adjoining uses are not residential uses which need buffering as contained in the buffer matrix. Section 18 . 120 . 108 .4 (B) states that on- site screening from view of adjoining properties of such things as service and storage areas, parking lots, and mechanical devices on roof tops shall be provided. The site plans shows the provision of rhododendrons which screen the parking area from the adjoining church, thereby satisfying this criteria. NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 6 Privacy and Noise : Section 18 . 120 . 180 . 5 requires that on- site uses which create noise, lights, or glare shall be buffered from adjoining residential uses. This criteria is not applicable as this proposal does not abut a residential use, however the site plan shows the provision of landscaping to screen the parking area from the adjoining church. Crime Prevention and Safety: Section 18 . 120 . 180 . 10 requires that exterior lighting levels be selected and the angles shall be oriented towards areas vulnerable to crime and shall be placed in areas having heavy pedestrian or vehicular traffic. An exterior lighting plan shall be submitted for review and approval. Landscaping Plan: Section 18 . 100. 015 requires that the applicant submit a landscaping plan. This requirement shall be satisfied as the applicant shall submitted a plan indicating the number, type and location of trees and shrubs. The proposed plan indicates the location of landscaping but does not indicate the type or size of plant material . A revised plan shall be submitted which specified the type and size of plant material to be installed. Street Trees : Section 18 . 100 . 033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with section 18 . 100 . 035 . Section 18 . 100 . 035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large) . A revised site plan shall be submitted which provides for street trees along SW 68th in accordance with this section. Screening: Special Provisions : Section 18 . 100 . 110 (A) requires the screening of parking and loading areas . Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one tree for each seven parking spaces in order to provide a canopy effect . The minimum dimension on the landscape islands shall be three NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 7 feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. A revised site plan shall be submitted which provides for parking lot trees in accordance with this provision. Screening of Refuse Containers and Service Facilities : Section 18 . 100 . 110 (B) and (D) requires that such facilities be screened or enclosed from view by placement of a solid wood fence, masonry wall or evergreen hedge . The preliminary plan does not show the provision of a refuse container or service facility. A revised plan shall be sumbitted which shows the provision of a facility and indicates how the trash enclosure will be screened in accordance with this criteria. Visual Clearance Areas : Section 18 . 102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height. The code provides that obstructions which may be located in this area shall be visually clear between three and eight feet in height (trees may be placed within this area provided all branches below eight feet are removed) . A visual clearance area is the triangular area formed by measuring a 30 foot distance along the street right-of-way and then connecting these two 30 foot distance points with a straight line. As indicated on the site plan, this criteria is satisfied. Minimum Off-Street Parking: Section 18 . 106 . 030 (C) (1) requires a minimum of one parking space for every 350 square feet of gross floor area. The total number of required parking spaces for a 1, 931 square foot office is 5 spaces. The applicant is proposing to provide 6 parking spaces. The applicant is proposing to share an access drive with the adjoining property. This property is developed with a 3, 460 square foot office building which requires 10 parking spaces, as approved in a 1988 Site Development Review (SDR 18-86) application. In providing the shared driveway, two of the existing parking spaces will be removed. The site plan shall be revised to provide for a total of 15 parking spaces to accomodate both office buildings. A joint use agreement shall be NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 8 provided for access and shared parking between the two properties . The Americans with Disabilities Act (ADA) , which became effective on January 26 , 1992 , requires 1 disabled parking spaces if 1 to 25 parking spaces are provided. The proposed site plan does not show the provision of a disabled person parking space . A revised plan shall be submitted which provides for 1 disabled parking space, thereby satisfying this requirement . Compact Parking Spaces : Section 18 . 106 . 040 (A) allows up to 40 percent of the required parking spaces to be compact spaces . Two (2) of the required 5 parking spaces for the proposed building or six (6) of the required 15 spaces for the combined uses may be compact spaces . The proposed plan indicates the provision of 3 compact spaces, thereby satisfying this requirement . Bicycle Parking: Section 18 . 106 . 020 (P) requires one bicycle parking rack space for each 15 vehicular parking spaces in any development . Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian ways . One (1) bicycle parking space will be required for this development . The site plan does not indicate the location of bicycle racks. A revised site plan shall be submitted which provides for 1 bicycle space . Access : Section 18 . 108 . 080 requires that commercial and industrial uses which require less than 100 parking spaces provide one access with a minimum access width of 30 feet and a minimum pavement width of 24 feet . Curbs are required as well . The proposed parking spaces are served by a 15 foot wide driveway which connects with the adjoining property' s parking lot . The adjoining parking lot provides a 24 foot wide driveway onto SW 67th Avenue . This existing 24 foot wide driveway satisfies the access criteria. However, the 15 foot drive serving the proposed parking area is inadequate . A revised site plan shall be submitted which provides for a 24 foot wide driveway to serve the proposed parking area. The proposed plan indicates that a shared driveway will be provided with the property to the east . The applicant shall be required to obtain an access easement from the adjoining property to the east . The applicant shall also provide reciprocal parking agreements for shared parking. NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 9 Walkways: Section 18 . 108 . 050 (A) requires that a walkway be extended from the ground floor entrance of the structure to the street which provides the required ingress and egress . Unless impractical, walkways should be constructed between a new development and neighboring developments . Walkways shall be a minimum of four feet in width, exclusive of vehicle overhangs and obtructions such as mailboxes, benches, bicycle racks, and sign posts, and shall be in compliance with ADA standards . The preliminary plan does not provide for a walkway to either SW 67th or SW 68th Avenue. A revised plan shall be submitted which provides for a walkway connection to SW 67th Street . Signs : Section 18 . 114 . 130 (D) lists the type of allowable signs and sign area permitted in the C-P zone. All signs shall conform to the provisions listed in this code section. All signs shall be approved through the Sign Permit process as administered by the Planning Division. Mixed Solid Waste and Recyclables Storage: Section 18 . 116 requires that new construction incorporates functional and adequate space for on-site storage and efficient collection of mixed solid waste and source separated recyclables prior to pick-up and removal by haulers. The applicant shall choose one of the following four methods to demonstrate compliance : Minimum standard, Waste assessment, Comprehensive recycling plan, or Franchised hauler review and sign-off . The applicant shall submit evidence or a plan which indicates compliance with this section. Regardless of which method chosen, the applicant shall submit written documentation from the franchise hauler regarding the location and compatibility of service facilities. Tree Removal : Section 18 . 150 contains standards for obtaining a permit for removal of trees having a trunk six inches or more in diameter when measured four feet above the ground. This requirement will be satisfied as a tree removal permit will be required for the removal of trees with trunk diameters of six inches or more in diameter. B. PUBLIC FACILITY CONCERNS: NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 10 Sections 18 . 164 . 030 (E) (1) (a) (Streets) , 18 . 164 . 090 (Sanitary Sewer) , and 18 . 164 . 100 (Storm Drains) shall be satisfied as specified below: 1 . STREETS : The site plan shows a joint use driveway onto SW 67th Avenue across the parking lot that serves the office development on the property contiguous to the east . The applicant should be required to provide a joint use and maintenance agreement for the proposed common driveway. No vehicular access is proposed to SW 68th Avenue which is a major collector street as shown on the City Comprehensive Plan. SW 68th Avenue was previously improved to its full width, with the exception of sidewalks . The applicant should be required to construct a six (6) foot wide sidewalk in accordance with City standards for the full length of the site frontage of SW 68th Avenue . With respect to SW 67th Avenue, the street has been constructed to current City Standards and no further construction is required. 2 . SANITARY SEWER: The site is served by the existing 8 inch public sanitary sewer line located in the SW 68th Avenue. The main line has sufficient capacity for this development . 3 . STORM SEWER: The site currently drains toward SW 68th Avenue . The site plan indicates that a new underground storm drain system will be constructed to drain the building and parking areas, and connect to the existing storm drain located within SW 68th Avenue. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91-47) Surface Water Management Regulations requiring the construction of on-site water quality facilities or fees in-lieu of their construction. Section 7 . 10b of the above noted Resolution and Order cites conditions under which the fee in-lieu may be accepted. Specifically, it NOTICE OF DECISION SDR 95 - 0011 ABELL / MERCER PAGE 11 provides, that if, "The site is small compared to the development plan, and the loss of area for the on-site facility would preclude the effective development . " , the fee may apply. It is our opinion that this site is consistent with this criteria, and we recommend that a fee in-lieu be required. SECTION V. PROCEDURE 1 .
