The surrounding properties are zoned C-P (Professional Commercial) and are generally developed with commercial uses. 3. Site information and Proposal Description: The subject site is currently vacant and is approximately 14,980 square feet in size. The applicant is proposing to construct a 4,748 square foot office building with access onto SW 68th Avenue. 4. Other Staff Comments: The City of Tigard Building Division has reviewed this proposal and has offered the following comments: NOTICE CF DECISION SDR 95-0020 FERNANDEZ'CASCADE TECH. PAGE 3 1-hour construction at the east wall with the parapet in the area encroaching within 10 feet of property fine. The City of Tigard Police Department has reviewed this proposal and has offered the following comments: The proposed exterior lighting specifications cannot be found. The landscaping plan is satisfactory. This department cannot sign off on this SDR until the applicant provides all of the exterior lighting plans for the building and parking area. 5. Agency Comments: General Telephone and Electronics has reviewed this proposal and has offered the following comments: Developer to place conduit for telephone service to GTE specifications. The City of Tigard Maintenance Services Department, Unified Sewerage Agency, Tualatin Valley Fire District, Portland General Electric, has reviewed this application and have offered no comments or objections. No other comments have been received. SECTION III. ANALYSIS AND CONCLUSION A. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing to construct an office building. Offices are classified in Code Section 18.42 (Use Classifications) as Professional and Administrative Services. Code Section 18.64.030 allows Professional and Administrative Services as a permitted use in the C-P zoning district. Minimum Lot Area: Section 18.64.050 states that the minimum lot area for parcels in the C-P zoning district shall be 6,000 square feet, and the minimum lot width shall be 50 feet. Developments within the C-P zone are required to provide a minimum of 15% landscaping. The subject site contains approximately 14,980 square feet with a width of approximately 100 feet, thereby satisfying the minimum dimensional requirements. The applicant's statement indicates that approximately 5,316 square feet (35%) is devoted for landscaping/walks. A walkway is considered an impervious surface, therefore a revised landscape calculation shall be submitted which calculates the amount of landscaping exclusive of walks. NOTICE OF DECISION SDR 95-0020 FERNANDEZ/CASCADE TECH. PAGE 4 Setbacks: Section 18.64.050 states that, except as otherwise provided in Chapter 18. 100. 130 (Buffer Matrix), there is no front yard setback and no side or rear yard setback except 20 feet shall be required where the C-P zone abuts a residential zone. The maximum building height is 45 feet. The side and rear yard setbacks do not apply to this site because it does not abut a residential zone. The building elevation drawings show a height of 15 feet, well under the maximum allowed. Section 18. 120. 180(A)(1) (Site Development Review - Approval Standards) requires that a development proposal be found to be consistent with the various standards of the Community Development Code. The applicable criteria in this case are chapters 18.100, 18.102, 18.106, 18.108, 18.114, 18.120, 18.150, and 18.164. The proposal's consistency with these Code Chapters is reviewed in the following sections. The proposal contains no elements related to the provisions of Code Chapters 18.84 (Sensitive Lands), 18.92 (Density Computations), 18.94 (Manufactured/ Mobile Home Regulations), 18.98 (Building Height Limitations: Exceptions), or 18.144 (Accessory Use and Structures) which are also listed under section 18.120.180.A.1. These Chapters are therefore found to be inapplicable as approval standards. Code section 18. 120. 180.A.2 provides other Site Development Review approval standards not necessarily covered by the provisions of the previously listed sections. These other standards are addressed immediately below. The proposal contains no elements related to the provisions of 18.120.180.3 (Exterior Elevations), 18.120.108.5 (Privacy and Noise), 18.120.180.6 (Private Outdoor Areas: Residential Use), 18.120.180.7 (Shared Outdoor Recreation Areas: Residential Use), 18.120.180.8 (Sensitive Lands), 18.120.180.9 (Demarcation of Spaces), and are therefore found to be inapplicable as approval standards. Relationship to the Natural and Physical Environment Section 18.120. 180.2 states that buildings shall be located to preserve existing trees, topography, and natural drainage and that trees having a six inch caliper or greater shall be preserved or replaced by new plantings of equal character. The site contains approximately 25 trees which vary in size from 6 inches to 30 inches in diameter. The majority of the trees are located in the middle of the lot, which makes preservation difficult. The applicant is proposing to incorporate approximately 6 trees (#3,16,21 ,22,24,25) into the site plan. Four of the trees will be located around the building with an additional two around the parking area. The applicant shall provide a plan showing how the trees will be protected and screened during construction. This plan shall be prepared by a certified arborist. NOTICE OF DECISION SDR 95-0020 FERNANDEZ/CASCADE TECH. PAGE 5 • Buffering, Screening and Compatibility between adjoining uses: Section 18. 120. 108.4(A) states that buffering shall be provided between different types of land uses. Section 18. 120. 108.4(B) states that on-site screening from view of adjoining properties of such things as service and storage areas, parking lots, and mechanical devices on roof tops shall be provided. This site does not adjoin a use which would require buffering and screening as contained in the Buffer Matrix (18.100.130). As indicated on the site plans, screening shall be provided in accordance with this section. Crime Prevention and Safety: Section 18. 120. 108. 10 requires that exterior lighting levels be selected and the angles shall be oriented towards areas vulnerable to crime and shall be placed in areas having heavy pedestrian or vehicular traffic. A condition of approval will be required to provide an exterior lighting plan to be submitted for review and approval. Landscaping Plan: Section 18. 100.015 requires that the applicant submit a landscaping plan. This requirement has been satisfied as the applicant has submitted a plan indicating the number, type and location of trees and shrubs. This requirement has been satisfied as the applicant has submitted a plan indicating the number, type and location of trees and shrubs. Street Trees: Section 18. 100.033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with section 18.100.035. Section 18. 100.035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large). The preliminary landscape plan shows the provision of 7 Raywood Ash trees along both street frontages, satisfying this requirement. Screening: Special Provisions: Section 18.100. 110(A) requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one tree for each seven parking spaces in order to provide a canopy effect. The minimum dimension on the landscape islands shall be three feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. The landscape plan shows the provision of parking lot trees and screening of the parking lot in accordance with this section. NOTICE OF DECISION SDR 95-0020 FERNANDEZ/CASCADE TECH. PAGE 6 Screening of Refuse Containers and Service Facilities : Section 18. 100. 110(B) and (D) requires that such facilities be screened or enclosed from view by placement of a solid wood fence, masonry wall or evergreen hedge. A revised plan shall be submitted which indicates how the trash enclosure will be screened in accordance with this criteria. Visual Clearance Areas: Section 18. 102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height. The code provides that obstructions which may be located in this area shall be visually clear between three and eight feet in height (trees may be placed within this area provided all branches below eight feet are removed). A visual clearance area is the triangular area formed by measuring a 30 foot distance along the street right-of-way and then connecting these two 30 foot distance points with a straight line. The proposed plan does not comply with this requirement as landscaping and the proposed building is within the clearance area at the SW Hampton Street and SW 68th Avenue intersection. As a condition of approval a revised site plan shall be submitted which guaranties compliance with this section. Minimum Off-Street Parking: Section 18.106.030(C)(1) requires a minimum of one parking space for every 350 square feet of gross floor area. The total number of required parking spaces for a 4,748 square foot office is 14 spaces. The applicant is proposing to provide 19 parking spaces, thereby satisfying this requirement. The Americans with Disabilities Act (ADA), which became effective on January 26, 1992, requires 1 disabled parking spaces if 1 to 25 parking spaces are provided. The proposed site plan shows the provision of 1 disabled person parking spaces, thereby satisfying this requirement. Bicycle Parking: Section 18. 106.020(P) requires one bicycle parking rack space for each 15 vehicular parking spaces in any development. Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian ways. Two (2) bicycle parking spaces will be required for this development. The site plan does not indicate the location of bicycle racks. A revised site plan shall be submitted which provides for 2 bicycle spaces. Access: Section 18. 108.080 requires that commercial and industrial uses which require less than 100 parking spaces provide one access with a minimum access width of 30 feet and a minimum pavement width of 24 feet. Curbs are required as well. NOTICE OF DECISION SDR 95-0020 FERNANDEZ/CASCADE TECH. PAGE 7 The plan shows the provision of one access drive with a width of 24 feet, thereby satisfying this criteria. Walkways: Section 18. 108.050(A) requires that a walkway be extended from the ground floor entrance of the structure to the street which provides the required ingress and egress. Unless impractical, walkways should be constructed between a new development and neighboring developments. Walkways shall be a minimum of four feet in width, exclusive of vehicle overhangs and obstructions such as mailboxes, benches, bicycle racks, and sign posts, and shall be in compliance with ADA standards. This criteria is partially satisfied as a walkway has been provided from the entrance to SW 68th Avenue. The plan also shows a walkway along the east property line which provides ingress to the southeast corner of the building. This walkway is approximately 27 feet from SW Hampton Street. The applicant shall provide an extension of this walkway to connect with SW Hampton Street. Signs: Section 18. 114.130 (D) lists the type of allowable signs and sign area permitted in the C-P zone. All signs shall conform to the provisions listed in this code section. All signs shall be approved through the Sign Permit process as administered by the Planning Division. Mixed Solid Waste and Recyclables Storage: Section 18. 116 requires that new construction incorporates functional and adequate space for on-site storage and efficient collection of mixed solid waste and source separated recyclables prior to pick-up and removal by haulers. The applicant shall choose one of the following four methods to demonstrate compliance: Minimum standard, Waste assessment, Comprehensive recycling plan, or Franchised hauler review and sign-off. The applicant shall submit evidence or a plan which indicates compliance with this section. Regardless of which method chosen, the applicant shall provide a written hauler sign-off regarding the location and compatibility of the trash facility. Tree Removal: Section 18.150 contains standards for obtaining a permit for removal of trees having a trunk six inches or more in diameter when measured four feet above the ground. This requirement will be satisfied as a tree removal permit will be required for the removal of trees with trunk diameters of six inches or more in diameter. B. PUBLIC FACILITY CONCERNS: Sections 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: NOTICE OF DECISION SDR 95-0020 FERNANDEZJCASCADE TECH. PAGE 8 1. STREETS: The site is located at the northeast corner of the intersection of SW 68th Parkway and SW Hampton Street. Both streets are classified as a Major Collector streets on the Comprehensive Plan, and the site is within the Tigard Triangle planning area. The site plan shows a driveway connection to SW 68th Parkway, approximately 100 feet north of SW Hampton Street. The existing rights-of-way for both streets are 30 feet from center line and no further dedications are required with the exception that the applicant shall dedicate a corner cut- off of 17 feet. Each street has been improved with curb and pavement. However, along SW 68th Parkway, the applicant should be required to construct sidewalk along this frontage, together with the new driveway construction. Overhead utilities are existing on the northerly side of SW Hampton Street and the poles are being utilized for the street lighting system. The applicant shall place the overhead facilities underground or pay the fee in-lieu of undergrounding. If the overhead facilities are placed underground with the new construction, the street lighting may be affected and the applicant should be required to maintain the present level of street lighting by the installation of new street light poles. 2. SANITARY SEWER: The site is currently served by the 8 inch public sanitary sewer line located in both SW 68th Parkway. The existing sewer has sufficient capacity for this project. 3. STORM SEWER: The site slopes in a southwesterly direction towards the contiguous streets. The applicant should grade the parking lot and site to a new underground on-site drainage system that will connect to the existing system in SW 68th Parkway. The applicant shall prepare a hydrology and hydraulic study to determine if the existing system has sufficient capacity and is not unduly affected by the additional runoff from the site. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91-47) Surface Water Management Regulations requiring the construction of on-site water quality facilities or fees in-lieu of their construction. Section 7.10b of the above noted Resolution and Order cites conditions under which the fee in- lieu may be accepted. Specifically, it provides, that if, "The site is small compared to the development plan, and the loss of area for the on-site facility would preclude the effective development.", the fee may apply. It is our opinion that this site is consistent with this criteria, and we recommend that a fee in-lieu be required. NOTICE OF DECISION SDR 95-0020 FERNANDEZ/CASCADE TECH. PAGE 9 SECTION V. Background: No land use or development applications have been reviewed by the City of Tigard. 2. Vicinity Information: The subject site is located at the northeast corner of SW 68th Avenue and SW Hampton Street. 4. Other Staff Comments: The City of Tigard Building Division has reviewed this proposal and has offered the following comments: NOTICE OF DECISION SDR 95-0020 FERNANDEZ/CASCADE TECH. PAGE 3 1-hour construction at the east wall with the parapet in the area encroaching within 10 feet of property line. PAGE 4 ' Setbacks: Section 18.64.050 states that, except as otherwise provided in Chapter 18. 100. 130 (Buffer Matrix), there is no front yard setback and no side or rear yard setback except 20 feet shall be required where the C-P zone abuts a residential zone. The maximum building height is 45 feet. The side and rear yard setbacks do not apply to this site because it does not abut a residential zone. The building elevation drawings show a height of 15 feet, well under the maximum allowed. Section 18. 120.180(A)(1) (Site Development Review - Approval Standards) requires that a development proposal be found to be consistent with the various standards of the Community Development Code. Code section 18. 120.180.A.2 provides other Site Development Review approval standards not necessarily covered by the provisions of the previously listed sections. Relationship to the Natural and Physical Environment Section 18. 120.180.2 states that buildings shall be located to preserve existing trees, topography, and natural drainage and that trees having a six inch caliper or greater shall be preserved or replaced by new plantings of equal character. Section 18. 120.108.4(B) states that on-site screening from view of adjoining properties of such things as service and storage areas, parking lots, and mechanical devices on roof tops shall be provided. This site does not adjoin a use which would require buffering and screening as contained in the Buffer Matrix (18.100.130). As indicated on the site plans, screening shall be provided in accordance with this section. Crime Prevention and Safety: Section 18.120. 108.10 requires that exterior lighting levels be selected and the angles shall be oriented towards areas vulnerable to crime and shall be placed in areas having heavy pedestrian or vehicular traffic. Street Trees: Section 18.100.033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with section 18. 100.035. Section 18.100.035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity(small, medium or large). The preliminary landscape plan shows the provision of 7 Raywood Ash trees along both street frontages, satisfying this requirement. Screening: Special Provisions: Section 18.100.110(A) requires the screening of parking and loading areas. PAGE 6 • Screening of Refuse Containers and Service Facilities : Section 18.100. 110(B) and (D) requires that such facilities be screened or enclosed from view by placement of a solid wood fence, masonry wall or evergreen hedge. A revised plan shall be submitted which indicates how the trash enclosure will be screened in accordance with this criteria. Visual Clearance Areas: Section 18.102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. Minimum Off-Street Parking: Section 18. 106.030(C)(1) requires a minimum of one parking space for every 350 square feet of gross floor area. Bicycle Parking: Section 18.106.020(P) requires one bicycle parking rack space for each 15 vehicular parking spaces in any development. Walkways: Section 18.108.050(A) requires that a walkway be extended from the ground floor entrance of the structure to the street which provides the required ingress and egress. Siqns: Section 18.114.130 (D) lists the type of allowable signs and sign area permitted in the C-P zone. All signs shall conform to the provisions listed in this code section. All signs shall be approved through the Sign Permit process as administered by the Planning Division. Mixed Solid Waste and Recyclables Storage: Section 18.116 requires that new construction incorporates functional and adequate space for on-site storage and efficient collection of mixed solid waste and source separated recyclables prior to pick-up and removal by haulers. Tree Removal: Section 18. 150 contains standards for obtaining a permit for removal of trees having a trunk six inches or more in diameter when measured four feet above the ground. This requirement will be satisfied as a tree removal permit will be required for the removal of trees with trunk diameters of six inches or more in diameter. B. PUBLIC FACILITY CONCERNS: Sections 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: NOTICE OF DECISION SDR 95-0020 FERNANDEZ/CASCADE TECH. PAGE 8 1 . This letter was previously Interiors submitted in late November or December 1995. As a result of this letter we modified our drawings with the addition of the large note on the Landscape Plan L-1, which has also been submitted previously. This issue was also discussed at the time of the slight shift in the building to the east to accommodate the sight line requirement at the corner of S.W. 68th and Hampton. The site development check list is almost completely signed off, so we would appreciate your assistance in this matter relating to the issuance of tree cutting and site development permits. Beaverton, Oregon 97005 Dear Ms. Fernandez: Thank you for giving Tree Care Unlimited, Inc. the opportunity to be. of service to you. The following is an evaluation and recommendation for six trees at the building project on the corner of 68th and Hampton in Tigard; after your request for a tree preservation- plan. EVALUATION AND RECOMMENDATION AFTER VISITING THE PROPOSED BUILDING SITE AT 68TH AND HAMPTON IN TIGARD AND REVIEWING THE BUILDING PLANS, I RECOMMEND THE SIR TREES THAT YOU ARE MAKING A VALIANT EFFORT TO PRESERVE BE REMOVED. LIST OF SIR TREES TREE # PER PLAN - TREE NAME D.B.H. 3 WHITE OAK 6" 16 WHITE OAK 6" 21 WHITE OAK 16" 22 WHITE OAK 16" 24 OREGON ASH 6 _ 25 WHITE OAK 16" TREE #3 IS A SMALL WHITE OAK THAT IS PLANTED DIRECTLY UNDER THE OVERHEAD POWER LINES. THE FUTURE OF THIS TREE IS GRIM BECAUSE OF THE ADVERSE AFFECTS THAT IT WILL SUFFER DUE TO THE • • TOPPING THAT WILL TAKE PLACE THROUGH P.G.E. IN ORDER TO KEEP IT CLEAR OF THE OVERHEAD POWER LINES. AND WOULD BE LOCATED IN THE CENTER OF THE CONSTRUCTION PROJECT IF IT WERE LEFT. IN MY OPINION THIS TREE IS NOT OF SUFFICIENT SIZE AND QUALITY FOR THIS LOCATION. ALSO., THIS TREE MAY INTERFERE WITH YOUR CONSTRUCTION CREWS. TREE # 21 IS A WHITE OAK THAT IS LOCATED SO CLOSE TO THE PROPOSED BUILDING THAT ONE HALF OF THE TREE'S ROOT SYSTEM WOULD BE SEVERED DURING CONSTRUCTION OF THE FOUNDATION. ALSO, THIS TREE HAS A STEEP CANT AND UNEVEN CROWN THAT MAKES IT LEAN HEAVY TOWARD THE PROPOSED BUILDING. THIS TREE SHOULD BE REMOVED SO THAT AFTER CONSTRUCTION YOU ARE NOT LEFT WITH A POTENTIALLY • HAZARDOUS TREE WITH NO GUARANTEE THE TREE CAN BE PRESERVED. TREE # 22 IS A WHITE OAK THAT IS LOCATED SO CLOSE TO THE PROPOSED BUILDING THAT IT WOULD SUFFER A MASSIVE AMOUNT OF ROOT LOSS AND DAMAGE DURING CONSTRUCTION. THE GRADE HAS BEEN CHANGED AROUND THIS TREE. SOIL HAS BEEN PILED UP ON THE EAST SIDE OF THE TREE TO A DEPTH OF ABOUT 12 INCHES. THIS WILL CAUSE SOIL COMPACTION AND ROOT LOSS. THIS TREE HAS ALREADY SUFFERED SOIL COMPACTION AND ROOT LOSS FROM CONSTRUCTION OF THE NEIGHBORING BUILDING TO THE EAST. THIS NEIGHBORING BUILDING IS NOW LOCATED WHERE THIS TREE'S ROOTS USE TO BE. THIS TREE SHOULD BE REMOVED BECAUSE IT HAS BEEN TRAUMATIZED AND IS A POTENTIAL HAZARD. THIS TREE IS LOCATED TO CLOSE TO THE FOUNDATION OF THE PROPOSED BUILDING TO MAKE TRYING TO SAVE IT IMPRACTICAL. TREE # -24 IS A 6" OREGON ASH. THIS TREE LIKE TREE # 22 HAS HAD SOIL PILED AROUND IT ON THE EAST SIDE WHICH CAUSES SOIL COMPACTION. AND ROOT LOSS AND LEADS TO CROWN ROT. THIS TREE IS ALSO POORLY LOCATED FOR IT'S FUTURE. IT IS VERY CLOSE TO THE NEIGHBORING BUILDING. IF THIS TREE COULD BE PRESERVED, IT IS RECOMMENDED THAT A TREE OF ITS KIND BE PLANTED 25 TO 35 FEET FROM A BUILDING. THIS TREE IS WITHIN TEN FEET OF THE BUILDING NOW. THIS TREE SHOULD BE REMOVED WHILE IT IS STILL SMALL AND EASY TO ACCOMPLISH. TREE # 25 IS A 16" WHITE OAK. THIS TREE LIKE ALL THE OTHER TREES ALONG THE EAST PROPERTY LINE HAD SOIL PILED AROUND THE EAST SIDE OF THE TREE. SOIL COMPACTION, ROOT LOSS AND CROWN ROT ARE THE R2ESULT OF THIS- TYPE OF CONSTRUCTION DAMAGE. AFTER THREE TO SEVEN YEARS, AN .OAK TREE WITH THESE PROBLEMS CAN HAVE ENOUGH NEW ROOT GROWTH WHICH KEEPS THE TREE ALIVE AND T,OOKING HEALTHY, BUT NOT -ENOUGH STRUCTURAL SUPPORT FROM LARGER ROOTS WHICH HAVE ROTTED OFF IN ORDER TO HOLD ITS SELF UP IN EVEN A STRONG SUMMER WIND. THIS TREE WOULD ALSO BE SURROUNDED BY ASPHALT WHICH WOULD COMPOUND THE PROBLEM. THIS TREE SHOULD BE REMOVED BECAUSE IT IS A POTENTIAL HAZARD. Beaverton.Oregon 97005 CITY OF TIGARD Attn: Will D'Andrea 13125 S.W. Hall Blvd. Tigard, OR 97223 RE: Site Development at SW 68th and Hampton Dear Mr. D'Andrea: In talking with our architect, Bob Evenson, yesterday I learned that the city would like an explanation for why we have designed in more parking spaces than required by the City of Tigard. Following are the reasons for the amount of parking we are proposing: Spaces Need 12 Cascade Employees Parking 1 Handicap Space 3 Applicant and Temporary Employees Parking 3 Leased Space Parking 19 TOTAL In an effort to be safety conscious, we have tried to minimize the need to park in the street by putting as many parking spaces as possible on our property. Ideally, we would have liked to have had a couple of more spaces, but feel the nineteen spaces is the minimum necessary to operate without relying on off-site parking. Also, originally, we had wanted to save the largest oak in the center of the property. We have gone to great lengths to talk with not only one, but two different arborists to explore the possibility of saving the largest tree in the center of the lot. Both arborists said that trying to keep the tree alive was not very promising considering the conditions of which the tree would have to struggle to live. We have made an effort in designing the landscape to save the smaller, which actually are still large trees, so as not to remove all of the existing trees. The smaller trees, according to the arborists, have a greater chance of surviving. If there is any additional information you need regarding our site development proposal, please don't hesitate to contact me directly. Thank you for your consideration of our project as it was submitted.
