SDR1995-00025 SD R95 - 00025 SHAW DEVELOPMENT COMPANY CITY OF TIGARD NOTICE OF DECISION SITE DEVELOPMENT REVIEW (SDR) 95-0025 SHAW DEVELOPMENT COMPANY APPLICATION: The applicant requests Site Development Review approval to allow the construction of a 10,789 square foot commercial office building. LOCATION: (WCTM 2S1 1AB, tax lot 2000). ZONING: C-P (Professional Commercial). SECTION ] -D CISIQ11 Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted in Section II. CONDITIONS OF APPROVAL THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO THE ISSUANCE OF BUILDING PERMITS. 1. Standard half-street improvements, including concrete sidewalk, driveway apron, curb, asphaltic concrete pavement, storm drainage, streetlights, and underground utilities shall be installed along the SW 72nd Avenue collector frontage. Improvements shall be designed and constructed to major street standards and shall conform to the alignment of existing adjacent improvements or to an alignment approved by the Engineering Department. Three (3) sets of detailed public improvement plans and profile construction drawings shall be submitted for preliminary review to the Engineering Department. Seven (7) sets of approved drawings and one (1) itemized construction cost estimate, all prepared by a Professional Engineer, shall be submitted for final review and approval (NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements. Additional right-of-way shall be dedicated to the Public along the frontage to increase the right-of-way to 25 and 30 feet from the centerline for SW Beveland Street and SW 72nd Avenue, respectively. The description shall be tied to the existing right-of-way centerline for SW Beveland Street and SW 72nd Avenue, respectively. The dedication document shall be on City forms. The applicant shall provide an on-site water quality facility as required by Unified Sewerage Agency Resolution and Order No. 91-47. 6. Storm drainage details and calculations shall be submitted as part of the public improvement plans. The submittal shall include an evaluation of the adequacy of the public storm drain in SW 72nd Avenue. 7. The portion of the proposed storm drain from the proposed swale to the public line in SW 72nd Avenue that is not within the right-of-way, shall be provided with a public easement. 8. The applicant shall submit an approved permit from Washington County Department of Environmental Health to abandon the existing septic system. The applicant shall provide a written letter of authorization from the adjacent property owner to allow alteration of the existing swale as shown on the proposed plans. 10. A mitigation plan which provides for no net loss of trees in accordance with Section 18.150.025.B.2.b. and Section 18.150.070.D. The plan shall demonstrate mitigation of 162 caliper inches. 11. A tree protection plan showing how the trees will be protected and screened during construction. This plan shall be prepared by a certified arborist. This plan must be followed during construction to protect the designated trees and to avoid issuance of a stop work order for violation of the tree protection plan. Revised site and landscaping plans shall be submitted for review by the Planning Division, Staff Contact: Will D'Andrea, Planning Department (639-4171). The revised plans shall include the following: a. Impervious surface/landscaping calculations. The plan shall provide a minimum 15% landscaping. c. Screening of the eastern parking area from the adjacent property. d. One (1) additional Red Cedar tree is necessary in order to provide the required row of trees. e. A walkway connection to SW 72nd Avenue. This walkway shall connect with the walkway along the north side of the building. f. A plan which shows compliance with Community Development Code Chapter 18.116, Mixed Solid Waste and Recyclable Storage. The applicant shall choose one of the following four methods to demonstrate compliance: Minimum Standard, Waste Assessment, Comprehensive Recycling Plan or Franchised Hauler Review and Sign-off. Regardless of which method chosen, the applicant shall submit a letter from the franchise disposal company related to facility design and compatibility. 13. An exterior lighting plan shall be submitted to the Police Department for review and approval. Staff Contact: Kelly Jennings, Police Department (639-4171). THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO THE ISSUANCE OF OCCUPANCY PERMITS: 14. All site improvements shall be installed as approved per the revised site plan. IN ADDITION, THE APPLICANT SHOULD BE AWARE OF THE FOLLOWING SECTIONS OF THE COMMUNITY DEVELOPMENT CODE; THIS IS NOT AN EXCLUSIVE LIST 1. SECTION 18.160.170 Improvement Agreement A. Before approved construction plans are issued by the City, the Applicant (subdivider) shall: NOTICE OF DECISION SDR 95-0025 SHAW DEVELOPMENT PAGE 3 1. Execute and file an agreement with the City Engineer specifying the period within which all required improvements and repairs shall be completed; and 2. Include in the agreement provisions that if such work is not completed within the period specified, the City may complete the work and recover the full cost and expenses from the applicant. B. The agreement shall stipulate improvement fees and deposits as may be required to be paid and may also provide for the construction of the improvements in stages and for the extension of time under specific conditions therein stated in the contract. 2. SECTION 18.120.060 BONDING AND ASSURANCES A. On all projects where public improvements are required the Director shall: 1. Require a bond in an amount not greater than 100 percent of other adequate assurances as a condition of approval of the site development plan in order to ensure the completed project is in conformance with the approved plan; and 2. Approve and release such bonds. B. The bond shall be released when the Director finds the completed project conforms to the approved site development plan and all conditions of approval are satisfied. 3. SECTION 18.164 STREET AND UTILITY IMPROVEMENT STANDARDS. A. Section 18.164.180 Notice to City Required 1. Work shall not begin until the City has been notified in advance. If work is discontinued for any reason, it shall not be resumed until the City is notified. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE DATE OF THE FINAL DECISION. NOTICE OF DECISION SDR 95-0025 SHAW DEVELOPMENT PAGE 4 SECTION II. FINDINGS OF FACT Background: No land use or development applications have been reviewed by the City of Tigard. Vicinity Information: The subject site is located at the northeast corner of SW 72nd Avenue and SW Beveland Street. The property to the north is zoned R-25 (Residential, 25 units per acre) and is developed with multi-family residential development. Property to the west is zoned R-3.5 (Residential, 3.5 units per acre) and is developed with single family residential units. Adjacent property to the east and south is zoned C-P (Professional Commercial) and is generally developed with a mix of commercial and residential uses. Site Information and Proposal Description: The site is approximately 26,136 square feet in size and is currently developed with a single family residence. The property slopes from 236 feet in the northeast corner of the site to a low of about 224 feet along the SW 72nd frontage. An existing drainage swale crosses the property. The applicant is proposing to remove the existing residence and construct a 10,789 square foot office building with access onto SW Beveland Street. Other Staff Comments: The City of Tigard Police Department has reviewed this proposal and has offered the following comments: This department cannot sign off on this SDR until the applicant provides all of the exterior lighting plans for the building and parking area. Agency Comments: Unified Sewerage Agency has reviewed this proposal and has offered the following comments: Water quality and water quantity must be addressed. Tualatin Valley Water District has reviewed this proposal and has offered the following comments: Contact the Water District or review plans on file for acceptable alternatives to provide fireline to fire hydrant. Submit 3 copies of final plans for review. NOTICE OF DECISION SDR 95-0025 SHAW DEVELOPMENT PAGE 5 Northwest Natural Gas has reviewed this proposal and has offered the following comments: This agency has no objection, however we do have an existing service to the existing structure and a gas line main on SW Beveland Street as per site plan on file. General Telephone and Electronics has reviewed this proposal and has offered the following comments: Developer to place conduit for telephone service to GTE specifications. The City of Tigard Maintenance Services Department, City of Tigard Building Division, Tualatin Valley Fire District and Portland General Electric, have reviewed this application and have offered no comments or objections. No other comments have been received. SECTION III. ANALYSIS AND CONCLUSION A. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing to construct an office building. Offices are classified in Code Section 18.42 (Use Classifications) as Professional and Administrative Services. Code Section 18.64.030 allows Professional and Administrative Services as a permitted use in the C-P zoning district. Minimum Lot Area.: Section 18.64.050 states that the minimum lot area for parcels in the C-P zoning district shall be 6,000 square feet, and the minimum lot width shall be 50 feet. Developments within the C-P zone are required to provide a minimum of 15% landscaping. The subject site contains approximately 26,136 square feet with a width of approximately 140 feet, thereby satisfying the minimum dimensional requirements. The plans do not indicate the amount of impervious surface/landscaping provided by this proposal. The applicant shall provide impervious surface/landscaping calculations. The plan shall provide a minimum 15% landscaping. Setbacks: Section 18.64.050 states that, except as otherwise provided in Chapter 18.100.130 (Buffer Matrix), there is no front yard setback and no side or rear yard setback except 20 feet shall be required where the C•P zone abuts a residential zone. The maximum building height is 45 feet. The rearyard setback applies to this site because it abuts a residential zone to the north. As indicated on the site plan, the rearyard setback is satisfied. The building elevation drawings show a height of 36 feet, well under the maximum allowed. Section 18.120.180(AX1) (Site Development Review - Approval Standards) requires that a development proposal be found to be consistent with the various standards of the Community Development Code. The applicable criteria in this case are Chapters 18.100, 18.102, 18.106, 18.108, 18.114, NOTICE OF DECISION SDR 95-0025 SHAW DEVELOPMENT PAGE 6 18.120, 18.150, and 18.164. The proposal's consistency with these Code Chapters is reviewed in the following sections. The proposal contains no elements related to the provisions of Code Chapters 18.84 (Sensitive Lands), 18.92 (Density Computations), 18.94 (Manufactured/ Mobile Home Regulations), 18.98 (Building Height Limitations: Exceptions), or 18.144 (Accessory Use and Structures) which are also listed under Section 18.120.180.A.1. These Chapters are therefore, found to be inapplicable as approval standards. Code section 18.120.180.A.2 provides other Site Development Review approval standards not necessarily covered by the provisions of the previously listed sections. These other standards are addressed immediately below. The proposal contains no elements related to the provisions of 18.120.180.3 (Exterior Elevations), 18.120.108.5 (Privacy and Noise), 18.120.180.6 (Private Outdoor Areas: Residential Use), 18.120.180.7 (Shared Outdoor Recreation Areas: Residential Use), 18.120.180.8 (Sensitive Lands), 18.120.180.9 (Demarcation of Spaces), and are therefore, found to be inapplicable as approval standards. Relationship to the Natural and P ysical Environment: Section 18.120.180.2 states that buildings shall, be located to preserve existing trees, topography, and natural drainage and that trees having a six inch caliper or greater shall be preserved or replaced by new plantings of equal character. The site contains a number of trees on site. Due to right-of-way improvements, site regrading, and the limited area for building and parking lot siting, the majority of the existing trees will be removed. The applicant is proposing to incorporate approximately four (4) trees, along the north property line, into the site plan. The applicant shall provide a plan showing how the tree to be saved will be protected and screened during construction. This plan shall be prepared by a certified arborist. Buffering. Screening and Compatibility between adjoining uses: Section 18.120.108.4(A) states that buffering shall be provided between different types of land uses. This criteria shall be satisfied as addressed in the Buffer Matrix (18.100.130) section below. Section 18.120.108.4(B) states that on-site screening from view of adjoining properties of such things as service and storage areas, parking lots, and mechanical devices on roof tops shall be provided. As indicated on the site plans, screening is generally provided in accordance with this section. A revised plan shall be submitted which provides screening of the eastern parking area from the adjacent property. Crime Prevention and Safety: Section 18.120.108.10 requires that exterior lighting levels be selected and the angles shall be oriented towards areas vulnerable to crime and shall be placed in areas having heavy pedestrian or vehicular traffic. A condition of approval will be required to provide an exterior lighting plan to be submitted for review and approval. Landscaping Plan: Section 18.100.015 requires that the applicant submit a landscaping plan. This requirement has been satisfied as the applicant has submitted a plan indicating the number, type and location of trees and shrubs. NOTICE OF DECISION SDR 95-0025 SHAW DEVELOPMENT PAGE 7 Street Trees: Section 18.100.033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with section 18.100.035. Section 18.100.035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large). The preliminary landscape plan shows the provision of four (4) Red Sunset Maple trees along SW 72nd Avenue and three (3) Armstrong Maple trees on SW Beveland Street, satisfying this requirement. The trees along SW 72nd Avenue have been located such that any future widening of SW 72nd Avenue will not require removal of these trees. Screening: Special Provisions: Section 18.100.110(A) requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one (1) tree for each seven (7) parking spaces in order to provide a canopy effect. The minimum dimension on the landscape islands shall be three(3)feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. The landscape plan shows the provision of parking lot trees in accordance with this section. As discussed previously, additional screening of the property to the east shall be provided. Screening of Refuse Containers and Service Facilities : Section 18.100.110(B) and (1)) requires that such facilities be screened or enclosed from view by placement of a solid wood fence, masonry wall or evergreen hedge. The applicant is proposing to screen the trash enclosure with a six (6) foot-tall brick wall with a metal gate with wooden slats, thereby, satisfying this criteria. The orientation of the proposed trash enclosure may pose a problem for service providers. The applicant should contact the service provider and provide the City a written sign-off regarding the location and orientation of the proposed container. Buffer Matrix: Section 18.100.130 contains the buffer matrix to be used in calculating widths of buffering and screening to be installed between proposed uses. The Matrix indicates that where a commercial development abuts an adjoining residential structure the required buffer and screening width shall be 20 feet. The site abuts a residential development on the north property line. A 20 foot buffer and screening area shall therefore, be required along this property line. The minimum improvements within a buffer area shall consist of the following: 1) At least one (1)row of trees shall be planted. They shall be not less than ten(10) feet high for deciduous trees and five (5) feet high for evergreen trees at the time of planting. Spacing of the trees depends on the size of the tree at maturity; 2) In addition, at least ten (10), five-gallon shrubs, or 20, one-gallon shrubs shall be planted for each 1000 square feet of required buffer area 3) The remaining area shall be planted in lawn, ground cover or spread with bark mulch. NOTICE OF DECISION SDR 95-0025 SHAW DEVELOPMENT PAGE 8 The north buffer area contains approximately 2,600 square feet. Therefore, the buffer shall contain 20, five-gallon; or 40, one-gallon shrubs in addition to the one (1) row of trees. The plan shows the provision of 61 one-gallon shrubs and five (5) Red Cedar trees within the buffer. This section is partially satisfied as the number of shrubs exceeds what is required. However, it appears that an additional Red Cedar is necessary in order to provide the required row of trees. Visual Clearance Areas: Section 18.102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height. The code provides that obstructions which may be located in this area shall be visually clear between three(3)and eight (8) feet in height(trees may be placed within this area provided all branches below eight(8) feet are removed). A visual clearance area is the triangular area formed by measuring a 30 foot distance along the street right-of-way and then connecting these two (2), 30 foot distance points with a straight line. As indicated on the site plan, this criteria is satisfied. Minimum Off-Street Parking: Section 18.106.030(CX1) requires a minimum of one parking space for every 350 square feet of gross floor area. Section 18.106040(AX1) allows up to 40 percent of the required parking spaces to be compact spaces.. The total number of required parking spaces for a 10,789 square foot office is 31 spaces. The applicant is proposing to provide 31 parking spaces, thereby, satisfying this requirement. The plan also shows the provision of ten (10) compact spaces which is under the maximum 12 spaces allowed. The Americans with Disabilities Act (ADA), which became effective on January 26, 1992, requires 1 disabled parking spaces if 26 to 50 parking spaces are provided. The proposed site plan shows the provision of two (2) disabled person parking spaces, thereby satisfying this requirement. Bicycle Parking: Section 18.106.020(P) requires one (1) bicycle parking rack space for each 15 vehicular parking spaces in any development. Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian ways. Two (2) bicycle parking spaces will be required for this development. The site plan shows the provision of three (3) bike racks, thereby satisfying this requirement. Access: Section 18.108.080 requires that commercial and industrial uses which require less than 100 parking spaces provide one access with a minimum access width of 30 feet and a minimum pavement width of 24 feet. Curbs are required as well. The plan shows the provision of one (1) access drive with a width of 24 feet, thereby satisfying this criteria. Walkways: Section 18.108.050(A) requires that a walkway be extended from the ground floor entrance of the structure to the street which provides the required ingress and egress. Unless impractical, walkways should be constructed between a new development and neighboring developments. Walkways shall be a minimum of four feet in width, exclusive of vehicle overhangs NOTiCE OF DECISION SDR 95-0025 SHAW DEVELOPMENT PAGE 9 and obstructions such as mailboxes, benches, bicycle racks, and sign posts, and shall be in compliance with ADA standards. This criteria is partially satisfied as a walkway has been provided from the entrance to SW Beveland Street. A sidewalk has been provided along the north side of the proposed building which stubs approximately 40 feet from the sidewalk on SW 72nd Avenue. A revised plan shall be submitted which provides for a walkway connection to SW 72nd Avenue. Signs: Section 18.114.130(D)lists the type of allowable signs and sign area permitted in the C-P zone. All signs shall conform to the provisions listed in this code section. All signs shall be approved through the Sign Permit process as administered by the Planning Division. Mixed Solid Waste and Recyclables Storage: Section 18.116 requires that new construction incorporates functional and adequate space for on-site storage and efficient collection of mixed solid waste and source separated recyclables prior to pick-up and removal by haulers. The applicant shall choose one of the following four(4) methods to demonstrate compliance: Minimum standard, Waste assessment, Comprehensive recycling plan, or Franchised hauler review and sign-off. The applicant shall submit evidence or a plan which indicates compliance with this section. Regardless of which method chosen, the applicant shall provide a written hauler sign-off regarding the location and compatibility of the trash facility. Tree Removal: Section 18.150.025 requires that a tree plan for the planting,removal and protection of trees prepared by a certified arborist shall be provided with a site development review application. The tree plan shall include identification of all existing trees, identification of a program to save existing trees or mitigate tree removal over 12 inches in caliper, which trees are to be removed, protection program defining standards and methods that will be used by the applicant to protect trees during and after construction. The applicant has provided a plan which identifies all existing trees greater than six (6) inches in caliper. This section requires a program to save existing trees or mitigate tree removal for trees over 12 inches in caliper. The inventory identified 13 trees greater than 12 inch caliper. Three (3) of these trees were blown down during the wind storm and will not be counted as trees which will require mitigation, since these trees were lost to natural causes. There remains nine (9) trees which total approximately 162 caliper inches. The proposed site plan identifies one (1) tree which will be saved. Since the applicant is retaining less than 25 percent (saving 11%) of the existing trees, Section 18.150.025(B)(2)(b) requires a mitigation program according to Section 18.150.070.D of no net loss of trees. The applicant shall therefore, provide a mitigation plan which provides for no net loss of trees in accordance with this section. The plan shall demonstrate mitigation of 162 caliper inches. NOTICE OF DECISION SDR 95-0025 SHAW DEVELOPMENT PAGE 10 B. PUBLIC FACILITY CONCERNS: Sections 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: 1. STREETS: Access to the site is provided by SW Beveland Street, 110 feet east of SW 72nd Avenue. No access to SW 72nd Avenue is proposed. Southwest Beveland Street is currently improved with a 24 foot wide paved surface within a 50 foot wide right-of-way. Half street improvements, including curb and sidewalks, should be completed. Southwest 72nd Avenue, a major collector, is currently improved with a 22 foot paved surface within a right-of-way 25 feet from center line. North of this site, the street has been improved with curb and sidewalk. 2. SANITARY SEWER: The applicant proposes to provide service by extending a line within SW Beveland Street from the existing line in SW 72nd Avenue. The septic system for an existing house on the site should be abandoned as required by Washington County Department of Environmental Health. 3. DRAINAGE: A drainageway from the east crosses the site and is collected in an existing storm drain at SW 72nd Avenue. The applicant proposes to relocate the drainageway to along the north edge of the site then collect the run-off in a proposed storm drain that connects to the existing drain at SW 72nd Avenue. Because this drain is for a large off-site area, it should be designed and built to public standards so that it may be City maintained. Surface water treatment will be provided by an on-site detention facility. NOTICE OF DECISION SDR 95-0025 SHAW DEVELOPMENT PAGE 11 SECTION n. MEMORANDUM CITY OF TIGARD TO: Will D'Andrea FROM: Greg Berry.V13 DATE: October 30, 1995 SUBJECT: SDR 95-0025, Shaw Development Company Description: The applicant proposes to construct a 2-story, 10, 789 square foot commercial office building at the northeast corner of SW 72nd Avenue and SW Beveland Street . Findings : 1 . STREETS: Access to the site is provided by SW Beveland Street, 110 feet east of SW 72th Avenue. No access to SW 72nd Avenue is proposed. Southwest Beveland Street is currently improved with a 24 foot wide paved surface within a 50 foot wide right-of-way. Half street improvements, including curb and sidewalks, should be completed. Southwest 72nd Avenue, a major collector, is currently improved with a 22 foot paved surface within a right-of-way 25 feet from center line. North of this site, the street has been improved with curb and sidewalk. 2 . SANITARY SEWER: The applicant proposes to provide service by extending a line within SW Beveland Street from the existing line in SW 72nd Avenue . The septic system for an existing house on the site should be abandoned as required by Washington County Department of Environmental Health. 3 . DRAINAGE: ENGINEERING COMMENTS - SDR 95-0025 Shaw Dev. Co. Page 1 MEMORANDUM December 5, 1995 Page 2 A drainageway from the east crosses the site and is collected in an existing storm drain at SW 72nd Avenue. The applicant proposes to relocate the drainageway to along the north edge of the site then collect the run-off in a proposed storm drain that connects to the existing drain at SW 72nd Avenue . Because this drain is for a large off-site area, it should be designed and built to public standards so that it may be City maintained. Surface water treatment will be provided by an on-site detention facility. Recommendations: PRIOR TO THE ISSUANCE OF A BUILDING PERMIT. THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED: 1 . Standard half-street improvements, including concrete sidewalk, driveway apron, curb, asphaltic concrete pavement, storm drainage, streetlights, and underground utilities shall be installed along the SW 72nd Avenue collector frontage. Improvements shall be designed and constructed to major street standards and shall conform to the alignment of existing adjacent improvements or to an alignment approved by the Engineering Department . Storm drainage details and calculations shall be submitted as part of the public improvement plans. The submittal shall include an evaluation of the adequacy of the public storm drain in SW 72nd Avenue. 7. The portion of the proposed storm drain from the proposed swale to the public line in SW 72nd Avenue that is not within the right-of-way, shall be provided with a public easement. 8. The applicant shall submit an approved permit from Washington County Department of Environmental Health to abandon the existing septic system. The applicant shall provide a written letter of authorization from the adjacent property owner to allow alteration of the existing swale as shown on the proposed plans. 10. A mitigation plan which provides for no net loss of trees in accordance with Section 18.150.025.B.2.b. and Section 18.150.070.D. The plan shall demonstrate mitigation of 162 caliper inches. 11. A tree protection plan showing how the trees will be protected and screened during construction. This plan shall be prepared by a certified arborist. The revised plans shall include the following: a. Impervious surface/landscaping calculations. The plan shall provide a minimum 15% landscaping. c. Screening of the eastern parking area from the adjacent property. d. One (1) additional Red Cedar tree is necessary in order to provide the required row of trees. e. A walkway connection to SW 72nd Avenue. This walkway shall connect with the walkway along the north side of the building. f. A plan which shows compliance with Community Development Code Chapter 18.116, Mixed Solid Waste and Recyclable Storage. The applicant shall choose one of the following four methods to demonstrate compliance: Minimum Standard, Waste Assessment, Comprehensive Recycling Plan or Franchised Hauler Review and Sign-off. Regardless of which method chosen, the applicant shall submit a letter from the franchise disposal company related to facility design and compatibility. 13. The agreement shall stipulate improvement fees and deposits as may be required to be paid and may also provide for the construction of the improvements in stages and for the extension of time under specific conditions therein stated in the contract. 2. SECTION 18.120.060 BONDING AND ASSURANCES A. On all projects where public improvements are required the Director shall: 1. Require a bond in an amount not greater than 100 percent of other adequate assurances as a condition of approval of the site development plan in order to ensure the completed project is in conformance with the approved plan; and 2. Approve and release such bonds. B. The bond shall be released when the Director finds the completed project conforms to the approved site development plan and all conditions of approval are satisfied. 3. SECTION 18.164 STREET AND UTILITY IMPROVEMENT STANDARDS. A. Section 18.164.180 Notice to City Required 1. Work shall not begin until the City has been notified in advance. If work is discontinued for any reason, it shall not be resumed until the City is notified. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE DATE OF THE FINAL DECISION. Vicinity Information: The subject site is located at the northeast corner of SW 72nd Avenue and SW Beveland Street. The property to the north is zoned R-25 (Residential, 25 units per acre) and is developed with multi-family residential development. Property to the west is zoned R-3.5 (Residential, 3.5 units per acre) and is developed with single family residential units. Adjacent property to the east and south is zoned C-P (Professional Commercial) and is generally developed with a mix of commercial and residential uses. Site Information and Proposal Description: The site is approximately 26,136 square feet in size and is currently developed with a single family residence. The property slopes from 236 feet in the northeast corner of the site to a low of about 224 feet along the SW 72nd frontage. An existing drainage swale crosses the property. The applicant is proposing to remove the existing residence and construct a 10,789 square foot office building with access onto SW Beveland Street. Other Staff Comments: The City of Tigard Police Department has reviewed this proposal and has offered the following comments: This department cannot sign off on this SDR until the applicant provides all of the exterior lighting plans for the building and parking area. The City of Tigard Maintenance Services Department, City of Tigard Building Division, Tualatin Valley Fire District and Portland General Electric, have reviewed this application and have offered no comments or objections. No other comments have been received. SECTION III. ANALYSIS AND CONCLUSION A. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing to construct an office building. Offices are classified in Code Section 18.42 (Use Classifications) as Professional and Administrative Services. Code Section 18.64.030 allows Professional and Administrative Services as a permitted use in the C-P zoning district. Minimum Lot Area: Section 18.64.050 states that the minimum lot area for parcels in the C-P zoning district shall be 6,000 square feet, and the minimum lot width shall be 50 feet. Developments within the C-P zone are required to provide a minimum of 15% landscaping. The subject site contains approximately 26,136 square feet with a width of approximately 140 feet, thereby satisfying the minimum dimensional requirements. The plans do not indicate the amount of impervious surface/landscaping provided by this proposal. The applicant shall provide impervious surface/landscaping calculations. The plan shall provide a minimum 15% landscaping. Setbacks: Section 18.64.050 states that, except as otherwise provided in Chapter 18.100.130 (Buffer Matrix), there is no front yard setback and no side or rear yard setback except 20 feet shall be required where the C-P zone abuts a residential zone. The maximum building height is 45 feet. The rearyard setback applies to this site because it abuts a residential zone to the north. As indicated on the site plan, the rearyard setback is satisfied. The building elevation drawings show a height of 36 feet, well under the maximum allowed. Section 18.120.180(AX1)(Site Development Review - Approval Standards) requires that a development proposal be found to be consistent with the various standards of the Community Development Code. The applicable criteria in this case are Chapters 18.100, 18.102, 18.106, 18.108, 18.114, NOTICE OF DECISION SDR 95-0025 SHAW DEVELOPMENT PAGE 6 18.120, 18.150, and 18.164. The proposal's consistency with these Code Chapters is reviewed in the following sections. The proposal contains no elements related to the provisions of Code Chapters 18.84 (Sensitive Lands), 18.92 (Density Computations), 18.94 (Manufactured/ Mobile Home Regulations), 18.98 (Building Height Limitations: Exceptions), or 18.144 (Accessory Use and Structures) which are also listed under Section 18.120.180.A.1. These Chapters are therefore, found to be inapplicable as approval standards. Code section 18.120.180.A.2 provides other Site Development Review approval standards not necessarily covered by the provisions of the previously listed sections. These other standards are addressed immediately below. The proposal contains no elements related to the provisions of 18.120.180.3 (Exterior Elevations), 18.120.108.5 (Privacy and Noise), 18.120.180.6 (Private Outdoor Areas: Residential Use), 18.120.180.7 (Shared Outdoor Recreation Areas: Residential Use), 18.120.180.8 (Sensitive Lands), 18.120.180.9 (Demarcation of Spaces), and are therefore, found to be inapplicable as approval standards. Relationship to the Natural and Physical Environment: Section 18.120.180.2 states that buildings shall be located to preserve existing trees, topography, and natural drainage and that trees having a six inch caliper or greater shall be preserved or replaced by new plantings of equal character. The site contains a number of trees on site. Due to right-of-way improvements, site regrading, and the limited area for building and parking lot siting, the majority of the existing trees will be removed. The applicant is proposing to incorporate approximately four (4) trees, along the north property line, into the site plan. The applicant shall provide a plan showing how the tree to be saved will be protected and screened during construction. This plan shall be prepared by a certified arborist. Buffering, Screening and Compatibility between adjoining uses: Section 18.120.108.4(A) states that buffering shall be provided between different types of land uses. This criteria shall be satisfied as addressed in the Buffer Matrix (18.100.130) section below. Section 18.120.108.4(B) states that on-site screening from view of adjoining properties of such things as service and storage areas, parking lots, and mechanical devices on roof tops shall be provided. As indicated on the site plans, screening is generally provided in accordance with this section. A revised plan shall be submitted which provides screening of the eastern parking area from the adjacent property. Crime Prevention and Safety: Section 18.120.108.10 requires that exterior lighting levels be selected and the angles shall be oriented towards areas vulnerable to crime and shall be placed in areas having heavy pedestrian or vehicular traffic. A condition of approval will be required to provide an exterior lighting plan to be submitted for review and approval. Landscaping Plan: Section 18.100.015 requires that the applicant submit a landscaping plan. This requirement has been satisfied as the applicant has submitted a plan indicating the number, type and location of trees and shrubs. NOTICE OF DECISION SDR 95-0025 SHAW DEVELOPMENT PAGE 7 Street Trees: Section 18.100.033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with section 18.100.035. Section 18.100.035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large). The preliminary landscape plan shows the provision of four (4) Red Sunset Maple trees along SW 72nd Avenue and three (3) Armstrong Maple trees on SW Beveland Street, satisfying this requirement. The trees along SW 72nd Avenue have been located such that any future widening of SW 72nd Avenue will not require removal of these trees. Screening: Special Provisions: Section 18.100.110(A) requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one (1) tree for each seven (7) parking spaces in order to provide a canopy effect. The minimum dimension on the landscape islands shall be three(3)feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. The landscape plan shows the provision of parking lot trees in accordance with this section. As discussed previously, additional screening of the property to the east shall be provided. Screening of Refuse Containers and Service Facilities : Section 18.100.110(B) and (D) requires that such facilities be screened or enclosed from view by placement of a solid wood fence, masonry wall or evergreen hedge. The applicant is proposing to screen the trash enclosure with a six (6) foot-tall brick wall with a metal gate with wooden slats, thereby, satisfying this criteria. The orientation of the proposed trash enclosure may pose a problem for service providers. The applicant should contact the service provider and provide the City a written sign-off regarding the location and orientation of the proposed container. Buffer Matrix: Section 18.100.130 contains the buffer matrix to be used in calculating widths of buffering and screening to be installed between proposed uses. The Matrix indicates that where a commercial development abuts an adjoining residential structure the required buffer and screening width shall be 20 feet. The site abuts a residential development on the north property line. A 20 foot buffer and screening area shall therefore, be required along this property line. The minimum improvements within a buffer area shall consist of the following: 1) At least one(1)row of trees shall be planted. They shall be not less than ten(10)feet high for deciduous trees and five (5) feet high for evergreen trees at the time of planting. Spacing of the trees depends on the size of the tree at maturity; 2) In addition, at least ten(10), five-gallon shrubs, or 20, one-gallon shrubs shall be planted for each 1000 square feet of required buffer area; 3) The remaining area shall be planted in lawn,ground cover or spread with bark mulch. NOTICE OF DECISION SDR 95-0025 SHAW DEVELOPMENT PAGE 8 The north buffer area contains approximately 2,600 square feet. Therefore, the buffer shall contain 20, five-gallon; or 40, one-gallon shrubs in addition to the one (1) row of trees. The plan shows the provision of 61 one-gallon shrubs and five (5) Red Cedar trees within the buffer. This section is partially satisfied as the number of shrubs exceeds what is required. However, it appears that an additional Red Cedar is necessary in order to provide the required row of trees. Visual Clearance Areas: Section 18.102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height. The code provides that obstructions which may be located in this area shall be visually clear between three(3)and eight (8) feet in height(trees may be placed within this area provided all branches below eight(8) feet are removed). A visual clearance area is the triangular area formed by measuring a 30 foot distance along the street right-of-way and then connecting these two (2), 30 foot distance points with a straight line. As indicated on the site plan, this criteria is satisfied. Minimum Off-Street Parking: Section 18.106.030(CX1) requires a minimum of one parking space for every 350 square feet of gross floor area. Section 18.106040(AX1) allows up to 40 percent of the required parking spaces to be compact spaces.. The total number of required parking spaces for a 10,789 square foot office is 31 spaces. The applicant is proposing to provide 31 parking spaces, thereby, satisfying this requirement. The plan also shows the provision of ten (10) compact spaces which is under the maximum 12 spaces allowed. The Americans with Disabilities Act (ADA), which became effective on January 26, 1992, requires 1 disabled parking spaces if 26 to 50 parking spaces are provided. The proposed site plan shows the provision of two (2) disabled person parking spaces, thereby satisfying this requirement. Bicycle Parking: Section 18.106.020(P) requires one (1) bicycle parking rack space for each 15 vehicular parking spaces in any development. Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian ways. Two (2) bicycle parking spaces will be required for this development. The site plan shows the provision of three (3) bike racks, thereby satisfying this requirement. Access: Section 18.108.080 requires that commercial and industrial uses which require less than 100 parking spaces provide one access with a minimum access width of 30 feet and a minimum pavement width of 24 feet. Curbs are required as well. The plan shows the provision of one (1) access drive with a width of 24 feet, thereby satisfying this criteria. Walkways: Section 18.108.050(A) requires that a walkway be extended from the ground floor entrance of the structure to the street which provides the required ingress and egress. Unless impractical, walkways should be constructed between a new development and neighboring developments. Walkways shall be a minimum of four feet in width, exclusive of vehicle overhangs NOTICE OF DECISION SDR 95-0025 SHAW DEVELOPMENT PAGE 9 and obstructions such as mailboxes, benches, bicycle racks, and sign posts, and shall be in compliance with ADA standards. This criteria is partially satisfied as a walkway has been provided from the entrance to SW Beveland Street. A sidewalk has been provided along the north side of the proposed building which stubs approximately 40 feet from the sidewalk on SW 72nd Avenue. A revised plan shall be submitted which provides for a walkway connection to SW 72nd Avenue. Signs: Section 18.114.130(D)lists the type of allowable signs and sign area permitted in the C-P zone. All signs shall conform to the provisions listed in this code section. All signs shall be approved through the Sign Permit process as administered by the Planning Division. Mixed Solid Waste and Recyclables Storage: Section 18.116 requires that new construction incorporates functional and adequate space for on-site storage and efficient collection of mixed solid waste and source separated recyclables prior to pick-up and removal by haulers. The applicant shall choose one of the following four(4) methods to demonstrate compliance: Minimum standard, Waste assessment, Comprehensive recycling plan, or Franchised hauler review and sign-off. The applicant shall submit evidence or a plan which indicates compliance with this section. Regardless of which method chosen, the applicant shall provide a written hauler sign-off regarding the location and compatibility of the trash facility. Tree Removal: Section 18.150.025 requires that a tree plan for the planting,removal and protection of trees prepared by a certified arborist shall be provided with a site development review application. The tree plan shall include identification of all existing trees, identification of a program to save existing trees or mitigate tree removal over 12 inches in caliper, which trees are to be removed, protection program defining standards and methods that will be used by the applicant to protect trees during and after construction. The applicant has provided a plan which identifies all existing trees greater than six (6) inches in caliper. This section requires a program to save existing trees or mitigate tree removal for trees over 12 inches in caliper. The inventory identified 13 trees greater than 12 inch caliper. Three (3) of these trees were blown down during the wind storm and will not be counted as trees which will require mitigation, since these trees were lost to natural causes. There remains nine (9) trees which total approximately 162 caliper inches. The proposed site plan identifies one (1) tree which will be saved. Since the applicant is retaining less than 25 percent (saving 11%) of the existing trees, Section 18.150.025(B)(2)(b) requires a mitigation program according to Section 18.150.070.D of no net loss of trees. The applicant shall therefore, provide a mitigation plan which provides for no net loss of trees in accordance with this section. The plan shall demonstrate mitigation of 162 caliper inches. NOTICE OF DECISION SDR 95-0025 SHAW DEVELOPMENT PAGE 10 B. PUBLIC FACILITY CONCERNS: Sections 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: 1. STREETS: Access to the site is provided by SW Beveland Street, 110 feet east of SW 72nd Avenue. No access to SW 72nd Avenue is proposed. Southwest Beveland Street is currently improved with a 24 foot wide paved surface within a 50 foot wide right-of-way. Half street improvements, including curb and sidewalks, should be completed. Southwest 72nd Avenue, a major collector, is currently improved with a 22 foot paved surface within a right-of-way 25 feet from center line. North of this site, the street has been improved with curb and sidewalk. 2. SANITARY SEWER: The applicant proposes to provide service by extending a line within SW Beveland Street from the existing line in SW 72nd Avenue. The septic system for an existing house on the site should be abandoned as required by Washington County Department of Environmental Health. 3. DRAINAGE: A drainageway from the east crosses the site and is collected in an existing storm drain at SW 72nd Avenue. The applicant proposes to relocate the drainageway to along the north edge of the site then collect the run-off in a proposed storm drain that connects to the existing drain at SW 72nd Avenue. Because this drain is for a large off-site area, it should be designed and built to public standards so that it may be City maintained. NEIGHBORHOOD MEETING 7175 SW Beveland Rd. The meeting was held at 7 : 00 to 8 : 45 pm at the Embassy Suites Lobby. Four individuals attended with very few questions but a lot of support and indicated unanimous approval of the proposed office building. Mr. Ted Argo and Mr. Jim Crawford, of Argo Architects, presented preliminary blueprints of the site plan with a rendering, site lay-out, and floor plans. Mr. Mike Summers and Mr. John Berman, of Shaw Development Co. answered questions and discussed the proposed construction. Kathy Godfrey: Just here to see what ' s going on -- no questions. Vi Chase: How are we working with the City of Tigard? Mr. Argo presented his blueprint plans for discussion. Ryan Andrus: Do we have a french drain? Ryan Andrus mentioned the water table. The above were the few questions voiced. The rest of the meeting was held in an informal discussion manner, attendees talking with the architects and builder. The support was obvious and there were no objections to our plan. PROJECT NARRATIVE VICINITY MAP AND SITE PLAN OVERVIEW PROJECT NARRATIVE: The project site, a rectangular shaped property which is comprised of approximately 0.6 acres, is located within Township 2 South, Range 1 West, section 1 of the Willamette Meridian in the City of Tigard, (Washington County) and the State of Oregon. (See vicinity map). The site is bounded to the west by SW 72nd Avenue and to the south by SW Beveland Street, and is situated on the northeast corner of the intersection. The site is located in an area to the north of Highway 217, south of the Pacific Hwy. and to the west of 1-5 in what is referred to as the Tigard Triangle. This area is in the process of changing from an older single-family residential neighborhood to a commercial / retail area with considerable development currently occurring along the Pacific Hwy. edge of the area. There is a concentration of existing professional office uses located in the southeast corner of the triangle near the 1-5 /217 interchange. In addition, some high density residential is occurring in the area. Access to the area is primarily from SW 72nd Avenue which runs north-south through the triangle. The site currently has an older single-family residence with garage and several out buildings, which are to be removed. The site and the properties to the east and south are zoned C-P (Commercial-Professional). Current uses are residential and office (including several businesses being run out of older houses) and includes City College and several small office buildings. The property to the north is zoned R-25 (multi-family), the site directly adjacent to the subject property contains the recently completed Hampton Park Apartments. The Property to the west is zoned R-3.5 (Single-family Residential). This area may eventually be rezoned to be consistent with other land uses in the immediate area. The Phil Lewis Elementary School is located to the southwest, is zoned C-G (PD) (General Commercial) and is expected to be redeveloped in the future. Topographically, this site is relatively flat with gentle slopes descending down towards a swale crossing the site from east to west. Overall topographic relief ranges from a high of elevation 236 feet in the northeast corner of the site to a low of about elevation 224 feet, located along the 72ND frontage. Vegetation across the site consists primarily of grasses and weeds with several small trees along with various landscaping bushes around the existing residence. Due to right-of-way improvements, site regrading and building, parking lot placement, most of the existing site vegetation will be removed. Utilities have previously been extended to the site along SW 72nd as part of the Hampton Park Apartment project and will be extended up SW Beveland Street, from SW 72nd, as part of this development, and will be available to future adjacent development. Street improvements will be made along both frontages and will include paving, curbs and sidewalks. Additional street right-of-way will be dedicated along 72nd Avenue and the curve will be realigned so as to blend with right-of-way work done as part of the Hampton Park Apartment project. The proposed development is a small professional office building consisting of approximately 10,789 square feet of usable floor area on two floors. The building is located on the southwest corner of the site near the intersection with the L-shaped parking lot wrapping around the building. Parking will be provided on site for 31 cars, including 2 accessible spaces, as required by the zoning ordinance at a ratio of 1 per 350 S.F. of building floor area. In addition, a loading area has been provided adjacent to the trash enclosure. Access to the parking lot is from SW Beveland Street via a 24 foot wide driveway. All exterior facades of the building will be finished with a brick veneer. Horizontal soldier courses, in an accent brick color, will be used to add additional architectural interest to the elevations. The building has been designed with a flat roof to limit the buildings overall height. Gables will be used to mark the location of the main entrance and to add architectural interest to the 72nd Avenue facade. Windows will be located on all four elevations to limit blank walls. Access to the building is from the parking lot, with the main entrance on the east elevation and a back entrance on the north elevation. Pedestrian access is provided by a walkway from the Beveland Street sidewalk to the entrance of the building. Bicycle racks will be provided adjacent to the pedestrian walkway in front of the building. Significant landscaping has been provided along the two street elevations, including street trees, in addition to plantings in the parking lot area and adjacent to the building perimeter. All planting areas will be provided with irrigation, the design of which is to be by the installer. A 20 foot wide landscaped buffer area has been maintained between the parking lot and the apartments to the north. A six foot tall brick wall with a metal gate with wooden slats is proposed around the trash /recycling area at the northeast corner of the parking lot. Street trees have been located along SW 72nd Avenue and have been placed inside the property relative to an additional 6 foot future R.O.W. dedication that was discussed at the pre-application. This will eliminate the need to remove the trees in the event that the street is widened. The placement of street trees along the northern portion of the 72nd Avenue has been restricted due to the location of the required water quality feature adjacent to the property line, which is the lowest portion of the site. Erosion control silt fences will remain in place until landscaping has been installed. The office building is to be owned and occupied by the applicant with additional tenant space for lease. The applicants (a lawyer and real estate developer) will use their space for a law office and for administrative functions related to their respective practices. The remaining tenant spaces will be leased to similar professionals. None are known at this time. During the Neighborhood Meeting held May 24, 1995, this Project was seen as an asset to the community. Favorable comments included the high quality materials proposed for the building, the landscaping and street improvements. It was hoped that other future development in the area would be of similar quality. No opposition to the project was voiced during the meeting. Attached is a revised landscape plan to replace the landscape plan originally submitted. This plan should address the remaining issues from Site Design Review(S.D.R.), specifically parking lot screening along the east property line, the additional evergreen in the northern buffer and the replacement trees for trees being removed. The current plan provides a total of 102.5 caliper inches as required from design review, excluding trees that blew over during the wind storm. Per our last discussion, we needed to provide 102 inches. We had General Tree Service visit the site after our meeting and confirmed the tree count and sizes and species. He reviewed the trees also for health and fitness. We had asked him to prepare a tree protection plan for the tree we had discussed which is located just over the north lot line. He has recommended the removal of the cherry tree on the apartment site, overhanging the lot line. This tree was misidentified as a poplar on the site survey. We will be contacting the owners of the apartment complex relative to that removal and will advise you of that discussion. I understand the owners will be sending you a copy of the arborist's report concerning the cherry tree for your file. On our S.D.R site plan, we had indicated that a couple of smaller trees in the northwest corner of the site would be saved if possible (three 8"firs, one 12"fir). As we discussed by phone a while ago, these trees, upon closer inspection, have been topped by the utility company and have been further impacted by fill from previous construction and road widening and will be further impacted by our road widening and regrading, when that occurs, actually ending up in the sidewalk in one case. As such, we will be removing them as part of our site work. These trees are not over 12 inch caliper and we understand that no replacement trees are required per 18.150.
