ROTH OFFICE BUILDING CITY OF TIGARD NOTICE OF DECISION SITE DEVELOPMENT REVIEW SDR 95-0015 ROTH OFFICE BUILDING APPLICATION: The applicant requests site development review approval to allow construction of a 4, 726 square foot office building. Zone : C-P (Commercial Professional) . Location: 12500 SW 68th Avenue (WCTM 2S1 01AA, tax lot 8200) . The site is located at the south west corner of SW Franklin Street and SW 68th Street SECTION I - DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above request subject to the following Conditions of Approval . The findings and conclusions on which the decision is based are noted in Section II . Conditions of Approval : PRIOR TO THE ISSUANCE OF A BUILDING PERMIT THE FOLLOWING. CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED: 1 . Standard half-street improvements, including concrete sidewalk, driveway apron, curb, asphaltic concrete pavement, sanitary sewer, and storm drainage shall be installed along the SW Franklin Street frontage . Improvements shall be designed and constructed to local street standards and shall conform to the alignment of existing adjacent improvements or to an alignment approved by the Engineering Department . STAFF CONTACT: Michael Anderson, Engineering Department . 2 . The applicant shall construct sidewalk along the frontage of SW 68th Parkway and a new common driveway. The underground storm drain connection to the existing system shall be included in the public improvement plans. 3 . Three (3) sets of detailed public improvement plans and profile construction drawings shall be submitted for preliminary review to the Engineering Department . Seven (7) sets of approved drawings and one (1) itemized construction cost estimate, all prepared by a Professional Engineer, shall be submitted for final review and approval (NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements . The applicant shall pay the fees as established under the guidelines of Unified Sewerage Agency Resolution and Order NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 1 No. 91-47. NOTE: This is a two part fee which is paid at different times . The first part is paid with any associated public improvements which is for that portion of the development which increases the impervious area within the public right-of-way. The second part is paid at Building Permit issuance which is for each individual lot . 5 . A joint use and maintenance agreement shall be executed and recorded on City standard forms for all common driveways. The agreement shall be referenced on and become part of all applicable parcel Deeds. The agreement shall be approved by the Engineering Department prior to recording. The applicant shall provide hydrology and hydraulic calculations prepared by a Professional Civil Engineer for the proposed storm drain system. 8 . The applicant shall demonstrate that storm drainage runoff can be discharged into the existing drainageways without significantly impacting properties downstream. NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 2 1 THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE DATE OF THE FINAL DECISION. SECTION II . FINDINGS OF FACT 1 . Background: The subject property is presently undeveloped. The site is thickly grown with trees and undergrowth. 2 . Vicinity Information: The site is located on the south west corner of SW Franklin Street and SW 68th Street . The property has been zoned C-P (Commercial Professional) since the Comprehensive Plan was acknowledged. The adjoining properties to the site are also zoned C-P. Properties to the north, south and east are developed with professional office uses or with the Landmark Ford Dealership. The property to the west of the site is presently undeveloped. 3 . Site Information and Proposal Description: The site has street frontage on SW 68th Street and SW Franklin Street . The site measures 100 by 150 feet . The site slopes approximately eight feet in grade from a high point towards SW Franklin and SW 68th to the south west . 4 . Other Staff Comments : The Engineering Department has reviewed this application and provided the following findings : Findings : STREETS : The site is contiguous to SW 68th Parkway, which is classified as a Major Collector street on the Comprehensive Plan, and SW Franklin Street, a local street, and is located within the Tigard Triangle Planning Area. The site plan shows a driveway to SW Franklin Street and a joint use driveway onto SW 68th Parkway, combined with the property to the south. The existing SW 68th Parkway right-of-way is 30 feet from center line and no further dedications are required. SW 68th Parkway has been improved with curbs and pavement . The applicant should be required .to construct sidewalk along this NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 3 frontage, together with the new driveway construction. In addition, the applicant shall provide a joint use and maintenance agreement for the common driveway. The existing SW Franklin Street right-of-way is also 30 feet from center line. The roadway was partly constructed in 1995 with a 2/3 street improvement with the development of the Louie Photography Studio on the property located across from the site, on the northerly side of the street . The applicant should complete the improvement of SW Franklin to City Standards and construct a new curb at 17 feet from centerline, together with the unfinished pavement and utilities to join the existing construction. Overhead utilities are existing on the southerly side of SW Franklin Street and the poles are being utilized for the street lighting system. No additional street lighting is required for SW Franklin Street . The applicant has indicated that the overhead facilities will be placed underground as a part of the street construction. SANITARY SEWER: The site is currently served by the eight inch public sanitary sewer line that is located in SW 68th Parkway. The existing sewer has sufficient capacity for this project . STORM SEWER: The site slopes in a southwesterly direction towards the adjacent undeveloped property. The applicant proposes to grade the parking lot and site to a new underground on-site drainage system that will connect to the existing system in SW 68th Parkway. The applicant shall prepare a hydrology and hydraulic study to determine if the existing system has sufficient capacity and is not unduly affected by the additional runoff from the site . The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91-47) Surface Water Management Regulations requiring the construction of on-site water quality facilities or fees in-lieu of their construction. Section 7 . 10b of the above noted Resolution and Order cites conditions under which the fee in-lieu may be accepted. Specifically, it provides, that if, "The site is small compared to the development plan, and the loss of area for the on-site facility would preclude the effective development . " , the fee may apply. It is our opinion that this site is consistent with this criteria, and we recommend that a fee in-lieu be required. NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 4 Agency Comments : The Tualatin Valley Fire District reviewed this application and provided the following comments concerning this development : 1) Provide fire flow calculations for the building. Submit plans to the Fire District to perform this review. 2) A fire hydrant shall be placed no more than 250 feet from all portions of the building. 3) Emergency vehicle access appears to have been met . No other comments have been received. SECTION III . ANALYSIS AND CONCLUSION COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The subject property is zoned Commercial Professional (C-P) . The applicant is proposing to develop vacant property with a professional office building. The professional office use is the primary permitted use for property within this zoning district as provided in Section 18 . 64 (Commercial Professional) and as further defined in Section 18 .42 (Use Classifications) . Minimum Lot Area: Section 18 . 64 the Commercial Professional Zoning District states that there is a minimum lot area requirement of 6, 000 square feet . The site is approximately . 34 acres or 15, 000 square feet which is in excess of the minimum requirement . The average parcel width required within the Commercial Professional Zoning District is 50 feet . The site has an average width of approximately 100 feet which exceeds the standard. Setback and Height : Section 18 . 64 . 050 states that there is no front, side or rear yard setbacks. Except that clear vision area and parking lot screening requirements must be met . These standards are reviewed elsewhere within this report . The building as proposed comply with the Special Setback requirement which is 30 feet from the centerline of SW 68th Street . The building is proposed to be located 33 feet from the centerline of SW 68th Street . The maximum allowed building height is 45 feet in the Commercial Professional Zoning District . The proposed NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 5 buildings would not exceed a maximum height of approximately 21 feet in compliance with the maximum height standard. Landscaping Plan: Section 18 . 100 requires that the applicant submit a landscape plan which provides landscaping for a minimum of 15% of the site. The C-P zone allows a maximum of 85% of the site to be covered with buildings and impervious surfaces . The applicant has submitted a plan indicating the type and location of landscaping to be provided. This plan proposes 85% lot coverage with 15% of the site to be developed with landscaping which complies with landscape development standards . Street Trees : Section 18 . 100 . 035 states that all development projects fronting on a public street shall be required to plant street trees . Section 18 . 100 . 035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large) . The site has approximately 140 feet of frontage along SW 68th Street which is available from planting. The landscape plan indicates that a total of four new Norway Maple trees would be provided at a spacing of approximately 35 feet on center. The site has approximately 75 feet of frontage on SW Franklin Street . Two Norway Maple trees would be provided also at a spacing of 35 feet on center on the SW Franklin Street frontage . Based on their large size at maturity these trees satisfy the street tree planting requirement . Screening: Special Provisions : Section 18 . 100 . 110 (A) requires the screening of parking and loading areas . Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees . Trees shall also be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one tree for each seven parking spaces in order to provide a canopy effect . The preliminary site plan provides planting details concerning the location of five Chanticlear Pear trees which are proposed to provide shade for the 17 parking spaces . These trees exceed the minimum ratio of one tree for each seven parking spaces . Landscape islands require a minimum of three feet of width. Landscaping shall be protected from vehicular damage by some form of wheel guard or curb. The applicant has provided NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 6 landscape islands which vary between 10 and 18 feet in width. Due to the location of the building and the size of these planter areas the parking lot areas is effectively screened from the view of adjoining street rights-of-way. The landscape plan provides planter orientation in such a manner that the proposed plantings can be protected from damage by vehicles using the adjoining parking spaces . Buffer Matrix: Section 18 . 100 . 130 contains the buffer matrix to be used in calculating widths of buffering and screening to be installed between different types of land uses . A land use buffer is not required because the adjoining properties are not developed with existing non-conforming residential uses . Visual Clearance Areas : Section 18 . 102 requires that a clear vision area be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, temporary, or permanent obstruction exceeding three feet in height . The code provides that obstructions which may be located in this area shall be visually clear between three and eight feet in height . Trees may be placed within this area provided all branches below eight feet are removed. A visual clearance area is the triangular area formed by measuring a 30 foot distance from the corner of two intersecting street rights-of-way. The clear vision rule also includes triangular areas on either side of a proposed driveway. For driveways in excess of 24 feet in width such as those proposed to serve this site the clear vision area is measured a 30 foot distance back from the driveway and 30 feet along the adjoining street right-of-way and then connecting these two points . The plan as proposed complies with these requirements both at the intersection of SW 68th Street and SW Franklin Street and within areas adjoining both driveways which are controlled by the applicant. Minimum Off-Street Parking: Section 18 . 106 requires a minimum of one off-street parking space for each 350 square feet of gross floor area. The floor plan of the structure states that 4, 726 square feet of gross square footage is proposed which requires a minimum of 14 parking spaces . A total of 17 spaces have been provided with six spaces having NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 7 been sized as compact spaces and one space having been designated as a Handicapped Accessible. The Americans with Disabilities Act (ADA) : Revised regulations became effective on January 26, 1992 . A minimum of two disabled parking spaces are required if one to 25 parking spaces are required. The proposed site plan provides one disabled person parking spaces which complies with the total number of spaces required given the number of required parking spaces . It is suggested that the handicapped parking space be relocated to an area which is directly in front of the main building entrance from the parking lot rather than its current location some 45 feet to the south. Bicycle Parking: Section 18 . 106 requires one bicycle parking rack for each 15 required parking spaces in any commercial development . Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian pathways. The current site plan does not show the provision for a bicycle parking rack. The revised site plan shall provide bicycle parking rack to serve this development designed to serve a minimum of one bicycle . If possible the bicycle rack should be located near a main building entrance and under cover for ease of use . Access : Section 18 . 108 . 080 states that commercial and industrial uses which require less than 100 parking spaces provide one access with a minimum width of 30 feet of paved width. The preliminary site plan shows the provision of two access driveways onto SW 68th Street and SW Franklin Street to serve both phases which are proposed to be developed. The access provided is 30 feet in paved width thereby satisfying this requirement . The Engineering Department has recommended that a reciprocal access agreement be created for the proposed common driveways on SW 68th and SW Franklin Street frontages in order to reduce the need for a future driveways . Walkways : Section 18 . 108 . 050 (A) requires that a walkway be extended from the ground floor entrance of all new structures to the street which provides the required ingress and egress . The sidewalk shall be designed to minimize the distance in which pedestrians must cross vehicle access driveways or parking lots . Such crossings shall be designed and located for pedestrian safety and to minimize conflicts . Required walkways shall be physically separated from motor vehicle traffic and parking by either a six inch minimum curbed vertical separation or a minimum three foot horizontal separation. NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 8 Pedestrian walkways which cross traffic aisles are permitted for distances no greater than 36 feet when appropriate pavement markings, or contrasting pavement materials are used. Walkways shall also be a minimum of four feet in width, exclusive of vehicle overhangs and obstructions such as mailboxes, benches, bicycle racks, and sign posts . The current site plan provides a walkway to SW 68th Street and a walkway to SW Franklin Street. The walkways as designed do not require pedestrians to cross vehicular driveways. The plan as designed complies with the Development Code Standards for pedestrian access . Signs : Section 18 . 114 lists the type of allowable signs and sign area permitted in the C-P zone. All signage shall be reviewed through the sign permit process as administered by the Planning Division. Mixed Solid Waste and Recyclable Storage : Section 18 . 116 requires that new construction incorporate functional and adequate space for on-site storage and efficient collection of mixed solid waste and source separated recyclable prior to pick-up and removal by haulers . The minimum standard for the type of development which has been proposed is four square feet of storage area for each 1, 000 square feet of floor area. The current trash and recycling enclosures as proposed complies with the minimum standards for size . It is recommended that the applicant contact Mr. Lenny Hing with pride Disposal at 625-6177, in order to review the design and location of the proposed enclosure to ensure ease of optimal daily site servicing issues . Tree Removal : Section 18 . 150 . 020 (E) requires a permit for removal of trees having a trunk six inches or more in diameter measured four feet above the ground level . The applicant has proposed to remove eight trees in excess of six inches in height as measured four feet above the existing grade elevations . A permit for tree removal must comply with the following criteria as specified in Section 18 . 150 . 030 (A) : 1. The trees are diseased, present a danger to property, or interfere with utility service or traffic safety; If preserved in place certain trees would interfere with the construction of necessary site improvements such as driveways, service areas and the industrial buildings to be developed. Locating the proposed development on alternate portions of the site is difficult due to the limited size of the site and the NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 9 widely dispersed nature of the existing significant trees on site. The site is relatively narrow in width 100 feet . To preserve trees substantial numbers of trees would require that the site improvements be greatly reduced in size. 2 . The trees have to be removed to construct proposed improvements or to otherwise utilize the applicant' s property in a reasonable manner; See statement above. 3 . The trees are not needed to prevent erosion, instability, or drainage problems; Due to the limited slope of the property no unusual erosion problems, slope instability or drainage problems are expected either on-site or off-site with the removal of these trees . The recommended conditions of approval included a requirement that the applicant demonstrate that off- site drainage will not adversely impact properties which are upstream and downstream of the subject property. 4 . The trees are not needed to protect nearby trees as windbreaks or as a desirable balance between shade and open space; Due to the limited number of trees which are to be removed it is not expected that the remaining trees will be impacted. The site plan has been required to be modified to comply with the landscape percentage requirements or to upgrade plant materials within the areas which are provided. 5 . The aesthetic character in the area will not be visually adversely affected by the tree removal; and A recent Forest Resources study for this area concluded that this forested area would be a poor candidate for preservation as a natural open space area. These findings were based on the overall condition of the trees and the development constraints of this area. 6 . New vegetation planted by the applicant, if any, will replace the aesthetic value of trees to be cut. The applicant has proposed new vegetation in excess of the minimum standards required for a Commercial Professional development site. Based on these findings removal of the 30 to 40 trees shown within the existing conditions plan complies with the applicable criteria for tree removal . Prior to the issuance of Building Permits the applicant is required to obtain a tree removal permit from the .City. NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 10 Transportation Planning Rule : The portion of the Transportation Planning Rule, which became effective May 8, 1994, that applies to this application is OAR 660-12-045 (4) and (5) . This section states that new retail, office and institutional buildings at or near existing or planned transit stops to provide preferential access to transit through the following measures : a. Orienting building entrances to the transit stop or station; b. clustering buildings around transit stops; and, c. locating buildings as close as possible to transit stops. The intent of this requirement is to provide preferential access to transit by locating building entrances at a direct, safe, and convenient distance from the transit street and by removing other barriers to pedestrian access . Building entrances should be located in a way that allows a direct, safe and convenient pedestrian link between the development and the transit stop. New retail and office buildings located on transit streets should have at least one public entrance facing the transit street . If it is not possible to orient an entrance facing the street the entrance shall be as close as possible to a transit route. A combination of building orientation, distance and pedestrian amenities are required to display the main entrance and direct pedestrians to that entrance . This site adjoins a Major Collector facility SW 68th Street . This portion of SW 68th Street is not presently a transit served facility. For this reason the proposed development is not required to orient or locate the building structure towards the SW 68th Street . The applicant has proposed to locate the building towards both streets and has provided pathway connections to the building which do not require pedestrians to cross vehicular driveways to access the site . If SW 68th Street became a transit served facility in the future, the proposed design of this office is expected to provide ease of access for pedestrians . It is suggested that an additional building entrance be provided along the building elevation facing SW 68th Street or SW Franklin Street to provide a clearly marked pedestrian entrance to the development . Appeal : Any party to the decision may appeal this decision in accordance with Section 18 . 32 . 290 (A) and Section 18 . 32 . 370 of the Community Development Code which provides that a written appeal must be filed with the City Recorder within 10 days after notice is given and sent . ROTH OFFICE BUILDING Description: The applicant requests Site Development Review approval to construct a 4, 726 sft office building at the southwest corner of SW 68th Parkway and SW Franklin Street . The site consists of Tax Lot 2S1 01AA 8200 with an area of 0 .34 ac. Findings : 1 . STREETS : The site is contiguous to SW 68th Parkway, which is classified as a Major Collector street on the Comprehensive Plan, and SW Franklin Street, a local street, and is located within the Tigard Triangle planning area. The site plan shows a driveway to SW Franklin Street and a joint use driveway onto SW 68th Parkway, combined with the property to the south. The existing SW 68th Parkway right-of-way is 30 feet from center line and no further dedications are required. SW 68th Parkway has been improved with curbs and pavement. The applicant should be required to construct sidewalk along this frontage, together with the new driveway construction. In addition, the applicant shall provide a joint use and maintenance agreement for the common driveway. The existing SW Franklin Street right-of-way is also 30 feet from center line . The roadway was partly constructed in 1995 with a 2/3 street improvement with the development of the Louie Photography Studio on the property located across from the site, on the northerly side of the street. The applicant should complete the improvement of SW Franklin to City Standards and construct a new curb at 17 feet from centerline, together with the un-completed pavement and utilities to join the existing construction. Overhead utilities are existing on the southerly side of SW Franklin Street and the poles are being utilized for the street lighting system. No additional street lighting is required for SW Franklin Street. The applicant has indicated that the overhead facilities will be placed underground as a part of the street construction. ENGINEERING COMMENTS SDR 95-0015 J.T. ROTH OFFICE BLDG PAGE 1 2 . SANITARY SEWER: The site is currently served by the 8 inch public sanitary sewer line that is located in SW 68th Parkway. The existing sewer has sufficient capacity for this project. 3 . STORM SEWER: The site slopes in a southwesterly direction towards the adjacent un-developed property. The applicant proposes to grade the parking lot and site to a new underground on-site drainage system that will connect to the existing system in SW 68th Parkway. The applicant shall prepare a hydrology and hydraulic study to determine if the existing system has sufficient capacity and is not unduly affected by the additional runoff from the site. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91-47) Surface Water Management Regulations requiring the construction of on-site water quality facilities or fees in-lieu of their construction. Section 7 . 10b of the above noted Resolution and Order cites conditions under which the fee in-lieu may be accepted. Specifically, it provides, that if, "The site is small compared to the development plan, and the loss of area for the on-site facility would preclude the effective development . ", the fee may apply. It is our opinion that this site is consistent with this criteria, and we recommend that a fee in- lieu be required. Recommendations : PRIOR TO THE ISSUANCE OF A BUILDING PERMIT THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED: 1 . Standard half-street improvements, including concrete sidewalk, driveway apron, curb, asphaltic concrete pavement, sanitary sewer, and storm drainage shall be installed along the SW Franklin Street frontage. Improvements shall be designed and constructed to local street standards and shall conform to the alignment of existing adjacent improvements or to an alignment approved by the Engineering Department . The site is located at the south west corner of SW Franklin Street and SW 68th Street SECTION I - DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above request subject to the following Conditions of Approval . The findings and conclusions on which the decision is based are noted in Section II . Conditions of Approval : PRIOR TO THE ISSUANCE OF A BUILDING PERMIT THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED: 1 . Standard half-street improvements, including concrete sidewalk, driveway apron, curb, asphaltic concrete pavement, sanitary sewer, and storm drainage shall be installed along the SW Franklin Street frontage. NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 2 THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE DATE OF THE FINAL DECISION. SECTION II . FINDINGS OF FACT 1 . Background: The subject property is presently undeveloped. The site is thickly grown with trees and undergrowth. 2 . Vicinity Information: The site is located on the south west corner of SW Franklin Street and SW 68th Street . The property has been zoned C-P (Commercial Professional) since the Comprehensive Plan was acknowledged. The adjoining properties to the site are also zoned C-P. Properties to the north, south and east are developed with professional office uses or with the Landmark Ford Dealership. The property to the west of the site is presently undeveloped. 3 . Site Information and Proposal Description: The site has street frontage on SW 68th Street and SW Franklin Street . The site measures 100 by 150 feet . The site slopes approximately eight feet in grade from a high point towards SW Franklin and SW 68th to the south west . 4 . Other Staff Comments : The Engineering Department has reviewed this application and provided the following findings : Findings : STREETS: The site is contiguous to SW 68th Parkway, which is classified as a Major Collector street on the Comprehensive Plan, and SW Franklin Street, a local street, and is located within the Tigard Triangle Planning Area. The site plan shows a driveway to SW Franklin Street and a joint use driveway onto SW 68th Parkway, combined with the property to the south. The existing SW 68th Parkway right-of-way is 30 feet from center line and no further dedications are required. SW 68th Parkway has been improved with curbs and pavement . The applicant should be required to construct sidewalk along this NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 3 frontage, together with the new driveway construction. In addition, the applicant shall provide a joint use and • maintenance agreement for the common driveway. The existing SW Franklin Street right-of-way is also 30 feet from center line . The roadway was partly constructed in 1995 with a 2/3 street improvement with the development of the Louie Photography Studio on the property located across from the site, on the northerly side of the street . The applicant should complete the improvement of SW Franklin to City Standards and construct a new curb at 17 feet from centerline, together with the unfinished pavement and utilities to join the existing construction. Overhead utilities are existing on the southerly side of SW Franklin Street and the poles are being utilized for the street lighting system. No additional street lighting is required for SW Franklin Street . The applicant has indicated that the overhead facilities will be placed underground as a part of the street construction. SANITARY SEWER: The site is currently served by the eight inch public sanitary sewer line that is located in SW 68th Parkway. The existing sewer has sufficient capacity for this project . STORM SEWER: The site slopes in a southwesterly direction towards the adjacent undeveloped property. The applicant proposes to grade the parking lot and site to a new underground on-site drainage system that will connect to the existing system in SW 68th Parkway. The applicant shall prepare a hydrology and hydraulic study to determine if the existing system has sufficient capacity and is not unduly affected by the additional runoff from the site. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91-47) Surface Water Management Regulations requiring the construction of on-site water quality facilities or fees in-lieu of their construction. Section 7 . 10b of the above noted Resolution and Order cites conditions under which the fee in-lieu may be accepted. Specifically, it provides, that if, "The site is small compared to the development plan, and the loss of area for the on-site facility would preclude the effective development. " , the fee may apply. It is our opinion that this site is consistent with this criteria, and we recommend that a fee in-lieu be required. NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 4 Agency Comments : The Tualatin Valley Fire District reviewed this application and provided the following comments concerning this development : 1) Provide fire flow calculations for the building. Submit plans to the Fire District to perform this review. 2) A fire hydrant shall be placed no more than 250 feet from all portions of the building. 3) Emergency vehicle access appears to have been met . No other comments have been received. SECTION III . ANALYSIS AND CONCLUSION COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS : Use Classification: The subject property is zoned Commercial Professional (C-P) . The applicant is proposing to develop vacant property with a professional office building. The professional office use is the primary permitted use for property within this zoning district as provided in Section 18 . 64 (Commercial Professional) and as further defined in Section 18 .42 (Use Classifications) . Minimum Lot Area : Section 18 . 64 the Commercial Professional Zoning District states that there is a minimum lot area requirement of 6 , 000 square feet . The site is approximately . 34 acres or 15, 000 square feet which is in excess of the minimum requirement . The average parcel width required within the Commercial Professional Zoning District is 50 feet . The site has an average width of approximately 100 feet which exceeds the standard. Setback and Height : Section 18 . 64 . 050 states that there is no front, side or rear yard setbacks . Except that clear vision area and parking lot screening requirements must be met . These standards are reviewed elsewhere within this report . The building as proposed comply with the Special Setback requirement which is 30 feet from the centerline of SW 68th Street . The building is proposed to be located 33 feet from the centerline of SW 68th Street . The maximum allowed building height is 45 feet in the Commercial Professional Zoning District . The proposed NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 5 buildings would not exceed a maximum height of approximately 21 feet in compliance with the maximum height standard. Landscaping Plan: Section 18 . 100 requires that the applicant submit a landscape plan which provides landscaping for a minimum of 15% of the site . The C-P zone allows a maximum of 85% of the site to be covered with buildings and impervious surfaces . The applicant has submitted a plan indicating the type and location of landscaping to be provided. This plan proposes 85% lot coverage with 15% of the site to be developed with landscaping which complies with landscape development standards . .Street Trees : Section 18 . 100 . 035 states that all development projects fronting on a public street shall be required to plant street trees. Section 18 . 100 . 035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large) . The site has approximately 140 feet of frontage along SW 68th Street which is available from planting. The landscape plan indicates that a total of four new Norway Maple trees would be provided at a spacing of approximately 35 feet on center. The site has approximately 75 feet of frontage on SW Franklin Street . Two Norway Maple trees would be provided also at a spacing of 35 feet on center on the SW Franklin Street frontage. Based on their large size at maturity these trees satisfy the street tree planting requirement . Screening: Special Provisions: Section 18 . 100 . 110 (A) requires the screening of parking and loading areas . Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees . Trees shall also be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one tree for each seven parking spaces in order to provide a canopy effect . The preliminary site plan provides planting details concerning the location of five Chanticlear Pear trees which are proposed to provide shade for the 17 parking spaces. These trees exceed the minimum ratio of one tree for each seven parking spaces. Landscape islands require a minimum of three feet of width. Landscaping shall be protected from vehicular damage by some form of wheel guard or curb. The applicant has provided NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 6 landscape islands which vary between 10 and 18 feet in width. Due to the location of the building and the size of these planter areas the parking lot areas is effectively screened from the view of adjoining street rights-of-way. The landscape plan provides planter orientation in such a manner that the proposed plantings can be protected from damage by vehicles using the adjoining parking spaces . Buffer Matrix: Section 18 . 100 . 130 contains the buffer matrix to be used in calculating widths of buffering and screening to be installed between different types of land uses . A land use buffer is not required because the adjoining properties are not developed with existing non-conforming residential uses . Visual Clearance Areas : Section 18 . 102 requires that a clear vision area be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, temporary, or permanent obstruction exceeding three feet in height . The code provides that obstructions which may be located in this area shall be visually clear between three and eight feet in height. Trees may be placed within this area provided all branches below eight feet are removed. A visual clearance area is the triangular area formed by measuring a 30 foot distance from the corner of two intersecting street rights-of-way. The clear vision rule also includes triangular areas on either side of a proposed driveway. For driveways in excess of 24 feet in width such as those proposed to serve this site the clear vision area is measured a 30 foot distance back from the driveway and 30 feet along the adjoining street right-of-way and then connecting these two points . The plan as proposed complies with these requirements both at the intersection of SW 68th Street and SW Franklin Street and within areas adjoining both driveways which are controlled by the applicant . Minimum Off-Street Parking: Section 18 . 106 requires a minimum of one off-street parking space for each 350 square feet of gross floor area. The floor plan of the structure states that 4, 726 square feet of gross square footage is proposed which requires a minimum of 14 parking spaces . A total of 17 spaces have been provided with six spaces having NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 7 been sized as compact spaces and one space having been designated as a Handicapped Accessible. The Americans with Disabilities Act (ADA) : Revised regulations became effective on January 26, 1992 . A minimum of two disabled parking spaces are required if one to 25 parking spaces are required. The proposed site plan provides one disabled person parking spaces which complies with the total number of spaces required given the number of required parking spaces . It is suggested that the handicapped parking space be relocated to an area which is directly in front of the main building entrance from the parking lot rather than its current location some 45 feet to the south. Bicycle Parking: Section 18 . 106 requires one bicycle parking rack for each 15 required parking spaces in any commercial development . Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian pathways. The current site plan does not show the provision for a bicycle parking rack. The revised site plan shall provide bicycle parking rack to serve this development designed to serve a minimum of one bicycle. If possible the bicycle rack should be located near a main building entrance and under cover for ease of use. Access : Section 18 .108 . 080 states that commercial and industrial uses which require less than 100 parking spaces provide one access with a minimum width of 30 feet of paved width. The preliminary site plan shows the provision of two access driveways onto SW 68th Street and SW Franklin Street to serve both phases which are proposed to be developed. The access provided is 30 feet in paved width thereby satisfying this requirement . The Engineering Department has recommended that a reciprocal access agreement be created for the proposed common driveways on SW 68th and SW Franklin Street frontages in order to reduce the need for a future driveways. Walkways: Section 18 . 108 . 050 (A) requires that a walkway be extended from the ground floor entrance of all new structures to the street which provides the required ingress and egress. The sidewalk shall be designed to minimize the distance in which pedestrians must cross vehicle access driveways or parking lots. Such crossings shall be designed and located for pedestrian safety and to minimize conflicts . Required walkways shall be physically separated from motor vehicle traffic and parking by either a six inch minimum curbed vertical separation or a minimum three foot horizontal separation. NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 8 Pedestrian walkways which cross traffic aisles are permitted for distances no greater than 36 feet when appropriate pavement markings, or contrasting pavement materials are used. Walkways shall also be a minimum of four feet in width, exclusive of vehicle overhangs and obstructions such as mailboxes, benches, bicycle racks, and sign posts. The current site plan provides a walkway to SW 68th Street and a walkway to SW Franklin Street . The walkways as designed do not require pedestrians to cross vehicular driveways. The plan as designed complies with the Development Code Standards for pedestrian access. Signs : Section 18 . 114 lists the type of allowable signs and sign area permitted in the C-P zone. All signage shall be reviewed through the sign permit process as administered by the Planning Division. Mixed Solid Waste and Recyclable Storage: Section 18 . 116 requires that new construction incorporate functional and adequate space for on-site storage and efficient collection of mixed solid waste and source separated recyclable prior to pick-up and removal by haulers . The minimum standard for the type of development which has been proposed is four square feet of storage area for each 1, 000 square feet of floor area. The current trash and recycling enclosures as proposed complies with the minimum standards for size . It is recommended that the applicant contact Mr. Lenny Hing with pride Disposal at 625-6177, in order to review the design and location of the proposed enclosure to ensure ease of optimal daily site servicing issues . Tree Removal : Section 18 . 150 . 020 (E) requires a permit for removal of trees having a trunk six inches or more in diameter measured four feet above the ground level . The applicant has proposed to remove eight trees in excess of six inches in height as measured four feet above the existing grade elevations . A permit for tree removal must comply with the following criteria as specified in Section 18 . 150 . 030 (A) : 1. The trees are diseased, present a danger to property, or interfere with utility service or traffic safety; If preserved in place certain trees would interfere with the construction of necessary site improvements such as driveways, service areas and the industrial buildings to be developed. Locating the proposed development on alternate portions of the site is difficult due to the limited size of the site and the NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 9 widely dispersed nature of the existing significant trees on site. The site is relatively narrow in width 100 feet . To preserve trees substantial numbers of trees would require that the site improvements be greatly reduced in size. 2 . The trees have to be removed to construct proposed improvements or to otherwise utilize the applicant' s property in a reasonable manner; See statement above . 3 . The trees are not needed to prevent erosion, instability, or drainage problems; Due to the limited slope of the property no unusual erosion problems, slope instability or drainage problems are expected either on-site or off-site with the removal of these trees. The recommended conditions of approval included a requirement that the applicant demonstrate that off- site drainage will not adversely impact properties which are upstream and downstream of the subject property. 4 . The trees are not needed to protect nearby trees as windbreaks or as a desirable balance between shade and open space; Due to the limited number of trees which are to be removed it is not expected that the remaining trees will be impacted. The site plan has been required to be modified to comply with the landscape percentage requirements or to upgrade plant materials within the areas which are provided. 5. The aesthetic character in the area will not be visually adversely affected by the tree removal; and A recent Forest Resources study for this area concluded that this forested area would be a poor candidate for preservation as a natural open space area. These findings were based on the overall condition of the trees and the development constraints of this area. 6 . New vegetation planted by the applicant, if any, will replace the aesthetic value of trees to be cut. The applicant has proposed new vegetation in excess of the minimum standards required for a Commercial Professional development site. Based on these findings removal of the 30 to 40 trees shown within the existing conditions plan complies with the applicable criteria for tree removal. Prior to the issuance of Building Permits the applicant is required to obtain a tree removal permit from the City. NOTICE OF DECISION - SDR 95-0015 - ROTH OFFICE BUILDING PAGE 10 Transportation Planning Rule : The portion of the • Transportation Planning Rule, which became effective May 8, 1994 , that applies to this application is OAR 660-12-045 (4) and (5) . This section states that new retail, office and institutional buildings at or near existing or planned transit stops to provide preferential access to transit through the following measures: a. Orienting building entrances to the transit stop or station; b. clustering buildings around transit stops; and, c. locating buildings as close as possible to transit stops. The intent of this requirement is to provide preferential access to transit by locating building entrances at a direct, safe, and convenient distance from the transit street and by removing other barriers to pedestrian access . Building entrances should be located in a way that allows a direct, safe and convenient pedestrian link between the development and the transit stop. New retail and office buildings located on transit streets should have at least one public entrance facing the transit street . If it is not possible to orient an entrance facing the street the entrance shall be as close as possible to a transit route. A combination of building orientation, distance and pedestrian amenities are required to display the main entrance and direct pedestrians to that entrance. This submitted Site Development Review Application is specific to the development and construction of a single story office building being proposed on the Southwest corner of 68th Parkway and Franklin, City of Tigard, County of Washington. On the 4th day of April, 1995 a pre-application conference was held at the City of Tigard to review and address the issues and requirements of the development standards specific to the site location and the type and use of the proposed building. Present at the meeting were Mr. Michael Anderson, Mr. Mark Roberts (both with the City of Tigard) and Tim Roth (applicant). The preliminary site plan submitted at this meeting has been corrected to address the development standards established for the current property zoning and the "revised" plans are now be submitted for Site Development review. The following requirements have been addressed and designed for approval: -Zoning district dimensional requirements -Special setbacks -Special building height provisions -Parking and access -Clear Vision area -Landscaping -Buffering and screening General comments regarding the following: -SIGNS: Any sign to be erected on the building will be permitted with the City prior to installation. As of this date there is no application for tenant improvements. -"Other Agency Permits": Pride Disposal has been contacted and a site plan sent for their approval and "Hauler sign-off". -68th ACCESS: A 24' wide access is proposed on SW 68th Parkway as a common access to service both tax lots 8200 and 8500. A reciprocal ingress and egress easement is being created for both property owners approval and signature. -UTILITIES: The issue of storm drainage, sanitary, and storm water quality have all been addressed in the attached letter submitted by Sisul Engineering. -TOPOGRAPHY/TREE SURVEY: A topography and tree survey has been completed by Centerline Concepts, Inc. and attached to the blue-print drawings. The locations of existing trees do not suggest that any one may remain, however, a substantial amount of new trees are being noted to replace the existing and enhance the site. -SOLAR ACCESS: The height of the building (single story) and general location of the site (corner lot with street to the north) eliminate any solar shading to buildings located to the north of this structure. -OFF SITE IMPROVEMENTS: SW 68th Parkway has been improved to meet current standards and does not require additional improvements, with the exception of sidewalks (as noted on plans). Our investigation has determined the following. The proposed office building site can be served by the sanitary sewer in SW 68th Avenue. This was confirmed by Michael Anderson, as well as the onsite topography performed by Centerline Concepts, and the as-built construction plans. According to the as-built sanitary plans, this sanitary sewer line drains south on 68th Ave. to Hampton, westerly on Hampton to 70th where it ties into mains that existed prior to 1973, when this line was constructed. Storm drain facilities, and storm drain lines exist in SW 68th Avenue, as verified by the topography survey and the onsite visit. Franklin Street and SW 69th are, for large parts, unimproved streets, and drainage is by roadside ditches or swales. The site generally falls in a southwesterly direction. It appears, from the onsite topography survey, that the parcel will be able to be drained to the storm drain line that runs along the west curb line of SW 68th Avenue. To drain the most southwesterly corner of the site to the storm drain line in SW 68th Avenue, it may require some fill, perhaps less than a foot deep, to drain to SW 68th. SW Franklin Street has been partially paved by development of the photography store in the northwest quadrant of the intersection. SW Franklin Street falls to the west, and improvement of curb and paving along the frontage of this street will drain to the west. There is a modest ditch along the edge of gravel surfacing in SW Franklin that will handle runoff from the limited frontage improvement required along 4 SW Franklin. This modest ditch continues south along SW 69th and becomes more defined further south. In regards to storm water quality, Michael Anderson informed me that sites that are less than 1/2 acre are allowed to pay an in-lieu-of fee instead of constructing onsite water quality facilities. This site is less than 1/2 acre in size. It does not appear there will be problems in developing this site in terms of storm or sanitary improvements. We note, as stated above, a small fill may be required in the southwest corner of the site to be able to drain the site to the storm drainage in SW 68th. According to Michael Anderson, there are not any storm drainage problems downstream that should be a factor in consideration of development on this site. Due to the very limited amount of development required on SW Franklin Street, and the fact that the site does not drain towards SW Franklin, the existing drainage swales should be sufficient to handle runoff from the limited street improvement required.
