Massih LLC and Kamelia Mass& (collectively, "Owner") are the owners
of certain property and improvements known as Pacific Park Plaza located at 13000 SW
Pacific Highway, Tigard, Oregon 97223 (the `Project"). Welkin Engineering, P.C.
(" Welkin") provided certain work on the Project, including, without limitation, surveying
services, engineering plans and analysis, and landscape plans (collectively, the "Work").
Welkin claims that it is entitled to additional compensation for Work performed for the
Owner on the Project ( the "Welkin Claims"). Owner claims that Welkin has been fully
paid for any work performed for Owner or for the Project, and that Owner has claims
against Welkin for incomplete work and for delays caused on the Project (the "Owner
Claims"). The Welkin Claims and Owner Claims are hereinafter collectively referred to
as the "Claims" In consideration of the mutual covenants contained herein and other
valuable consideration, Owner and Welkin, fbr themselves and their respective
successors, hears and assigns, each flrlly release and discharge each other, and their
respective members, shareholders, directors, offices, employees, successors, heirs and
assigns, each fully from the Claims.
Contemporaneously with the execution of this Release, Welkin
acknowledges receipt from Owner of a check in the amount of $2,677.95 in consideration
of this Release.
In consideration of this Release, Welkin hereby (a) provides its release on
the Project as of the date of this Release so that Owner's replacement engineer may
proceed with engineering on the Project; and (b) authorizes Owner and its replacement
engineer to utilize Welkin's prior submittals, surveys, engineering plans and analysis, and
landscape plans.

The building permit above was issued in 2005. On December 27, 2005 Mr. Hyman submitted a request
to replace 2x6 dug fir #1, wood framing members with 6 inch cold - formed steel stud framing members to
be used on the walls of this project. The request was forwarded to Miller Consulting Engineers (MCE) for
review. MCE generated a plan review letter on January 10 (see attached). The following is correspondence
to date for above permit:
1. Miller Consulting reviewed the requested submittal on 1/06, based on the complexity of the building
framing. The review for this change has been based on the 2004 Oregon Structural Specialty Code
(OSSC).
2. 1/10/06, MCE requested the submittal of the following information to complete his review;
"1) calculation for loads to shear walls as required for the seismic & wind controlled directions as
required by sec 1609.1.5 & 1620.4 & table 1616.5.1.1 #2,
2) submit details for load transfer & connections including Omega as required by sec 2211,
3) Submit details for shear walls including fasteners, spacing & method of proper installation as
required by sec 2211,
4) Submit details & calculations as required as required by sec 2211"
3. During this review MCE noticed that the building was of irregular shape and that there was no
calculation for seismic design based off the shape of the building as required per OSSC 1998, section
1629.5.3. This was brought to City of Tigard Building Department's attention and it was determined
that this permit as noted above was issued in error as the plans are incomplete and need to be
completed OSSC 106.3.3. "Construction documents shall be of sufficient clarity to indicate the
location, nature and extent of the work proposed and show in detail that it will conform to the
provisions of this code and relevant laws, ordinances, rules and regulations",
4. A request was made by the City of Tigard on 1/11/06 by phone conversation with Mr. Hyman
requesting he submit this calculation showing the proposed building design would meet the code

requirements of Section 1629.5.3, OSSC. Mr. Hyman agreed to begin working on that immediately to
maintain the status of the issued permit without revoking it as this department has the authority to do
so as stated per OSSC 105.6 "Suspension or revocation. The building official is authorized to suspend or
revoke a permit issued under the provisions of this code wherever the permit is issued in error or on the basis of incorrect,
inaccurate or incomplete information, or in violation of any ordinance or regulation or any of the provisions of this code."
5. On 2/6/06 a phone conversation was held between Brian Blalock of the City of Tigard, Building
Division and Mr. Hyman of Welkin Engineering. The discussion was documented with a letter dated
2/8/06 from Mr. Hyman reiterating the conversation informing Brian B. that the proposed
construction change to steel studs will not be made at this time. He also explained that he was aware of
MCE's concerns regarding seismic effects of the building shape. Mr. Hyman requested that the
foundation construction be allowed to continue through the beginning of framing. Brian B agreed to
this provided MCE's concerns would be addressed. Brian B. told Mr. Hyman that if MCE did not
recommend approval based on a code complying design, Brian would request no work to be done
after the foundation and slab were complete. Mr. Hyman stated he would have this analysis to this
office by the following week to maintain the approved permit. No design has been received to date.
6. There was a request to change the exterior foundation design. On 2/15/06 this design was approved
based on submitted information with special inspection required for soil compaction on the interior
footing & foundation system. Brian B informed the contractor that no construction above the
foundation and slab was going to be allowed until Mr. Hyman addressed the issues identified in the
1/10/06 plan review letter generated by MCE had been satisfied.
7. Per a conversation with Eric Watson at MCE on 3/9/06, No response has been received.
PLEASE provide the requested design so that the project may proceed without interruption.
