Zone: Professional Industrial (I-P) Location: (WCTM 2S1 12DA, tax lot 500). SECTION I - DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are referenced in Section II. conditions of approval THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO THE ISSUANCE OF BUILDING PERMITS. UNLESS OTHERWISE NOTED, THE STAFF CONTACT SHALL BE GREG BERRY OF THE ENGINEERING DEPARTMENT. 1. The applicant shall prepare a final traffic study to verify that the proposed development is consistent with the assumptions of the 1988 traffic report. Revised site and landscaping plans shall be submitted for review by the Planning Division, Staff Contact: William D'Andrea. The revised plans shall include the following: a. A pedestrian connection to the Centennial Bank building. A connection was previously provided as a condition of the Centennial Bank approval (See: SDR 94-0021). THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO THE ISSUANCE OF OCCUPANCY PERMITS: 3. All site improvements shall be installed as per the approved revised site plans. SECTION 18.164 STREET AND UTILITY IMPROVEMENT STANDARDS A. 18.164.180 Notice to City Required 1. Work shall not begin until the City has been notified in advance. 2. If work is discontinued for any reason, it shall not be resumed until the City is notified. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE DATE OF THE FINAL DECISION. SECTION II. FINDINGS OF FACT 1. Background Tax lot 500 was created through the platting of the Pacific Corporate Center subdivision in December, 1989. The preliminary plat for this subdivision was approved by the City's Land Use Hearings Officer on June 2, 1989. In 1994, an approval was granted (SDR 94-0009) to allow the construction of three buildings totaling approximately 126,000 square feet. No other land use or development applications regarding the subject parcel have been reviewed by the City of Tigard. 2. Vicinity Information The site is located between SW Sequoia Parkway and 1-5, south of SW Cardinal Lane. The site and the entire Pacific Corporate Center are zoned I-P (Industrial Park). Office and industrial buildings owned by Pacific Realty Associates are located on both sides of SW Sequoia Parkway. 3. Site Information and Proposal Description The site is a 1.81 acre portion of a larger 8.68 acre parcel. The majority of the site is currently developed with 126,000 square feet of commercial office space. The undeveloped portion of the site slopes west from Interstate-5, and is below the grade of the Interstate. The site has access to both SW Redwood Lane and SW Cardinal Lane. The applicant requests approval to construct a 25,644 square foot medical clinic. The proposed site would include 129 parking spaces with five (5) designated handicapped spaces. 4. Staff and Agency Comments The City of Tigard Public Works Department, City of Tigard Building Division, City of Tigard Water Department, City of Tigard Police Department, Portland General Electric, GTE, and Tualatin Valley Fire District have reviewed this application and have offered no comments or objections. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing to build a Providence Health Systems Medical Center. A medical office use is classified in Code Section 18.42 (Use Classifications) as Medical and Dental Services. Code Section 18.68.030(2)6) allows Medical and Dental Services as a permitted use in the Industrial Park(I-P)zoning district. Minirmim Lot Area: Section 18.68.050 states that there is no minimum lot area for parcels in the I-P zoning district. Developments within the Industrial Park(I-P) zone are required to provide a minimum of 25%landscaping, except that 20%can be provided when: 1.) Street trees are installed with a minimum caliper of three (3) inches rather than two (2) inches, at four(4)feet in height; 2.) The landscaping between a parking lot and street property line shall have a minimum width of ten(10)feet;and 3.) All applicable buffering, screening, and setback requirements shall be satisfied. The site has an average lot width of approximately 300 feet, thereby exceeding the required 50 foot average minimum lot width. The applicant is proposing approximately 21,225 square feet or 27% of the site for landscaping, thereby satisfying this requirement. Setbacks: Section 18.68.050 states that the front yard setback is 35 feet and that on corner lots the setback shall be a minimum of 20 feet on any lot facing a street. No side or rear yard setbacks are required except 50 feet shall be required where the I-P zone abuts a residential zoning district. The site does not abut a residential zoning district. As indicated on the site plan, the proposal meets the setback requirements. The maximum building height is 45 feet. The applicant is proposing a building height of 45 feet, meeting the maximum allowed height. While the I-P zone ordinarily limits building heights to 45 feet, the provisions of Section 18.98 apply to this proposal due to a proposed spire to be constructed on the building. This section states that projections, such as spires, not used for human occupancy, are not subject to the building height limitations of this title. The proposed spire is therefore, not restricted to a maximum height of 45 feet. Landscaping Plan: Section 18.100.015 requires that the applicant submit a landscaping plan. This requirement has been satisfied as the applicant has submitted a plan indicating the number, type and location of trees and shrubs. Street Trees: Section 18.100.030 states that all development projects fronting on a public street shall be required to plant street trees in accordance with Section 18.100.035. Section 18.100.035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large). Street trees have been provided with previous development applications, thereby satisfying this requirement. Screening: Special Provisions: Section 18.100.110(A) requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between NOTICE OF DECISION SDR 95-0024 PACIFIC REALTY (Portland clinic south) PAGE 3 low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one (1 ) tree for each seven (7) parking spaces in order to provide a canopy effect. The minimum dimension on the landscape islands shall be three (3) feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. The proposed landscape plan partially complies with the parking lot tree requirements. In order to provide the required canopy effect, a revised plan shall be submitted which provides for a minimum of five (5) additional parking lot trees located within the parking strip along the retaining wall. Screening of the parking area shall also be provided along the retaining wall. Visual Clearance Areas: Section 18.102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three (3) feet in height. The code provides that obstructions which may be located in this area shall be visually clear between three (3) and eight (8) feet in height (trees may be placed within this area provided all branches below eight (8) feet are removed). A visual clearance area is the triangular area formed by measuring a 30 foot distance along the street right-of-way and the driveway and then connecting these two, 30 foot distance points with a straight line. As indicated on the site plan this requirement will be satisfied. Minimum Off-Street Parking: Section 18.106.030(CX22) requires a minimum of one (1) parking space for every 200 square feet of Medical and Dental services. The 25,644 square foot clinic therefore, requires 128 parking spaces. The site plan shows the provision of 129 parking spaces. The Americans with Disabilities Act (ADA), which became effective on January 26, 1992, requires five (5) disabled parking spaces if 101 to 150 parking spaces are provided. The proposed site plan shows the provision of five (5) disabled person parking spaces thereby, satisfying this requirement. Bicycle Parking: Section 18.106.020(P) requires one (1) bicycle parking rack space for each 15 vehicular parking spaces in any development. Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian ways. Nine (9) bicycle parking spaces will be required for this development. The site plan indicates the provision of ten (10) bicycle parking spaces thereby, satisfying this criteria. Access: Section 18.108.080 requires that commercial and industrial uses which require more than 100 parking spaces provide two (2) accesses with a minimum width of 30 feet, and a minimum pavement width of 24 feet. In addition, curbs are required, as well as a five (5) foot sidewalk. The preliminary site plan shows the provision of two (2) accessways which have 24 foot access widths. Walkways: Section 18.108.050(A) requires that a walkway be extended from the ground floor entrance of the structure to the street which provides the required ingress and egress. The plan shows a pedestrian connection to building #240 to the south, in accordance with this section. The plan does not provide a connection with the Centennial Bank building to the north. A connection was previously provided as a condition of the Centennial Bank approval (See: SDR 94-0021). Fire hydrants shall be located no further than 250 feet from all portions of a building. It was noted that this building is to be provided with automatic sprinkler protection. Hydrant distances may be extended to as much as 500 feet provided they give adequate protection. If the building is of light hazard occupancy, then the 500 feet will probably suffice. If it is of a higher hazard occupancy, then lesser distances will be required. With the building being provided with automatic sprinkler protection, fire hydrants shall be located within 70 feet of the fire department connection (FDC). FDC will not be allowed on the building. FDC connection and fire hydrants shall be located so that access roadways are not cut off by hoses laying between the devices. 2. Fire department access roadways shall be located within 150 feet of all portions of the building. Fire department access roadways shall have outside turning radius of not less than 45 feet with an inside turning radius of not less than 25 feet using the same center point. Roadway measures a bare 20 feet in width; turning radii for turnarounds do not meet the requirements as specified above. 3. Fire flow for this building shall not exceed 3,000 gpm nor the available flow in the hydrant located in the city mains. SECTION I - DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are referenced in Section II. conditions of approval THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO THE ISSUANCE OF BUILDING PERMITS. The applicant shall prepare a final traffic study to verify that the proposed development is consistent with the assumptions of the 1988 traffic report. SECTION 18.164 STREET AND UTILITY IMPROVEMENT STANDARDS A. 18.164.180 Notice to City Required 1. Work shall not begin until the City has been notified in advance. 2. If work is discontinued for any reason, it shall not be resumed until the City is notified. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE DATE OF THE FINAL DECISION. SECTION II. FINDINGS OF FACT 1. Background Tax lot 500 was created through the platting of the Pacific Corporate Center subdivision in December, 1989. The preliminary plat for this subdivision was approved by the City's Land Use Hearings Officer on June 2, 1989. In 1994, an approval was granted (SDR 94-0009) to allow the construction of three buildings totaling approximately 126,000 square feet. No other land use or development applications regarding the subject parcel have been reviewed by the City of Tigard. 2. Vicinity Information The site is located between SW Sequoia Parkway and 1-5, south of SW Cardinal Lane. The site and the entire Pacific Corporate Center are zoned I-P (Industrial Park). Office and industrial buildings owned by Pacific Realty Associates are located on both sides of SW Sequoia Parkway. 3 Site Information and Proposal Description The site is a 1.81 acre portion of a larger 8.68 acre parcel. The majority of the site is currently developed with 126,000 square feet of commercial office space. The undeveloped portion of the site slopes west from Interstate-5, and is below the grade of the Interstate. The site has access to both SW Redwood Lane and SW Cardinal Lane. The applicant requests approval to construct a 25,644 square foot medical clinic. The proposed site would include 129 parking spaces with five (5) designated handicapped spaces. 4. Staff and Agency Comments The City of Tigard Public Works Department, City of Tigard Building Division, City of Tigard Water Department, City of Tigard Police Department, Portland General Electric, GTE, and Tualatin Valley Fire District have reviewed this application and have offered no comments or objections. No other comments have been received. NOTICE OF DECISION SDR 95-0024 PACIFIC REALTY (Portland clinic south) PAGE 2 SECTION III. ANALYSIS AND CONCLUSION A. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing to build a Providence Health Systems Medical Center. A medical office use is classified in Code Section 18.42 (Use Classifications) as Medical and Dental Services. Code Section 18.68.030(2)0) allows Medical and Dental Services as a permitted use in the Industrial Park(I-P)zoning district. Minimum Lot Area: Section 18.68.050 states that there is no minimum lot area for parcels in the I-P zoning district. Developments within the Industrial Park(I-P)zone are required to provide a minimum of 25%landscaping, except that 20%can be provided when: 1.) Street trees are installed with a minimum caliper of three (3) inches rather than two (2) inches, at four(4)feet in height; 2.) The landscaping between a parking lot and street property line shall have a minimum width of ten (10)feet;and 3.) All applicable buffering, screening, and setback requirements shall be satisfied. The site has an average lot width of approximately 300 feet, thereby exceeding the required 50 foot average minimum lot width. The applicant is proposing approximately 21,225 square feet or 27% of the site for landscaping, thereby satisfying this requirement. Setbacks: Section 18.68.050 states that the front yard setback is 35 feet and that on corner lots the setback shall be a minimum of 20 feet on any lot facing a street. No side or rear yard setbacks are required except 50 feet shall be required where the I-P zone abuts a residential zoning district. The site does not abut a residential zoning district. As indicated on the site plan, the proposal meets the setback requirements. The maximum building height is 45 feet. The applicant is proposing a building height of 45 feet, meeting the maximum allowed height. While the I-P zone ordinarily limits building heights to 45 feet, the provisions of Section 18.98 apply to this proposal due to a proposed spire to be constructed on the building. This section states that projections, such as spires, not used for human occupancy, are not subject to the building height limitations of this title. The proposed spire is therefore, not restricted to a maximum height of 45 feet. Landscaping Plan: Section 18.100.015 requires that the applicant submit a landscaping plan. This requirement has been satisfied as the applicant has submitted a plan indicating the number, type and location of trees and shrubs. Street Trees: Section 18.100.030 states that all development projects fronting on a public street shall be required to plant street trees in accordance with Section 18.100.035. Section 18.100.035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large). Street trees have been provided with previous development applications, thereby satisfying this requirement. Screening: Special Provisions: Section 18.100.110(A) requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between NOTICE OF DECISION SDR 95-0024 PACIFIC REALTY (Portland clinic south) PAGE 3 low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one (1 ) tree for each seven (7) parking spaces in order to provide a canopy effect. The minimum dimension on the landscape islands shall be three (3) feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. The proposed landscape plan partially complies with the parking lot tree requirements. In order to provide the required canopy effect, a revised plan shall be submitted which provides for a minimum of five (5) additional parking lot trees located within the parking strip along the retaining wall. Screening of the parking area shall also be provided along the retaining wall. Visual Clearance Areas: Section 18.102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three (3) feet in height. The code provides that obstructions which may be located in this area shall be visually clear between three (3) and eight (8) feet in height (trees may be placed within this area provided all branches below eight (8) feet are removed). A visual clearance area is the triangular area formed by measuring a 30 foot distance along the street right-of-way and the driveway and then connecting these two, 30 foot distance points with a straight line. As indicated on the site plan this requirement will be satisfied. Minimum Off-Street Parking: Section 18.106.030(C)(22) requires a minimum of one (1) parking space for every 200 square feet of Medical and Dental services. The 25,644 square foot clinic therefore, requires 128 parking spaces. The site plan shows the provision of 129 parking spaces. The Americans with Disabilities Act (ADA), which became effective on January 26, 1992, requires five (5) disabled parking spaces if 101 to 150 parking spaces are provided. The proposed site plan shows the provision of five (5) disabled person parking spaces thereby, satisfying this requirement. Bicycle Parking: Section 18.106.020(P) requires one (1) bicycle parking rack space for each 15 vehicular parking spaces in any development. Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian ways. Nine (9) bicycle parking spaces will be required for this development. The site plan indicates the provision of ten (10) bicycle parking spaces thereby, satisfying this criteria. Access: Section 18.108.080 requires that commercial and industrial uses which require more than 100 parking spaces provide two (2) accesses with a minimum width of 30 feet, and a minimum pavement width of 24 feet. In addition, curbs are required, as well as a five (5) foot sidewalk. The preliminary site plan shows the provision of two (2) accessways which have 24 foot access widths. Walkways: Section 18.108.050(A) requires that a walkway be extended from the ground floor entrance of the structure to the street which provides the required ingress and egress. The plan shows a pedestrian connection to building #240 to the south, in accordance with this section. The plan does not provide a connection with the Centennial Bank building to the north. A connection was previously provided as a condition of the Centennial Bank approval (See: SDR 94-0021). A revised plan shall be submitted which provides a pedestrian connection to the Centennial Bank building. NOTICE OF DECISION SDR 95-0024 PACIFIC REALTY (Portland clinic south) PAGE 4 Signs: Section 18.114.130 (F) lists the type of allowable signs and sign area permitted in the I-P zone. Section 18.114.130 (G)(d) contains other requirements which apply to industrial zones and industrial parks. This section limits industrial parks to a single signing format. Since this site is within an industrial park, the subject site is not allowed freestanding signage. The proposed buildings are entitled to wall signage but this shall not exceed 15 percent of any building face on which the sign is to be mounted. All signs shall be approved through the Sign Permit process as administered by the Planning Division. Mixed Solid Waste and Recyclables Storage: Section 18.116 requires that new construction incorporate functional and adequate space for on-site storage, and efficient collection of mixed solid waste and source separated recyclables prior to pick-up and removal by haulers. The applicant shall choose one of the following four methods to demonstrate compliance: 1.) Minimum Standard 2.) Waste Assessment 3.) Comprehensive Recycling Plan, or 4.) Franchised Hauler Review and Sign-Off. The applicant shall submit evidence or a plan which indicates compliance with this section. The applicant has submitted a drawing which has been signed-off by Pride Disposal, thereby satisfying this criteria. B. PUBLIC FACILITY CONCERNS: Sections 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: 1. TRAFFIC: A traffic study for the subdivision was originally prepared by MacKenzie Engineers in 1988. The applicant should verify that the proposed development is consistent with the assumptions of that report. 2. STREETS: Access to SW Redwood Lane and SW Sequoia Parkway is provided by existing driveways within the parcel. No additional street improvements are required. 3. SANITARY SEWER: Service is provided by connecting to an existing private line on the site. No additional public sewer improvements are required. 4. STORM DRAINAGE: Drainage is provided by an existing on-site system. Surface water treatment is provided by a previously approved water quality facility at the southwest corner of the parcel. In 1995, an approval was granted (SDR 95-0024) to construct a 25,644 square foot medical clinic. No other land use or development applications regarding the subject parcel have been reviewed by the City of Tigard. NOTICE OF DECISION MINOR MODIFICATION(SDR 95-0024) PAGE Vicinity Information: The site is located between SW Sequoia Parkway and 1-5, south of SW Cardinal Lane. The site and the entire Pacific Corporate Center are zoned I-P (Industrial Park). Office and industrial buildings owned by Pacific Realty Associates are located on both sides of SW Sequoia Parkway. Site Information and Proposal Description: The site is a 1.81 acre portion of a larger 8.68 acre parcel. The majority of the site is currently developed with 126,000 square feet of commercial office space. The undeveloped portion of the site slopes west from Interstate 5 and is below the grade of the Interstate. The site has access to both SW Redwood Lane and SW Cardinal Lane. The applicant requests Minor Modification approval to the approved Site Development Review (SDR 95-0024). The modified site plan would provide for a 24,963 square foot office building. IV. APPLICABLE REVIEW CRITERIA AND FINDINGS The Tigard Community Development Code, Site Development Review Section, states; "if the requested modification meets any of the major modification criteria, that this request shall be reviewed as a new Site Development Review application." This request does not meet any of the eleven (11) approval criteria for qualification as a major modification. Section 18.120.070(B) states that the Director shall determine that a major modification(s) will result if one or more of the following changes are proposed. There will be: 1. An increase in dwelling unit density, or lot coverage for residential development. This criteria is not applicable as this request involves commercial uses. 2. A change in the ratio or number of different types of dwelling units. This criteria is not applicable as this request involves commercial uses. 3. A change that requires additional on-site parking in accordance with Chapter 18.106. The square footage of the building has been reduced slightly, therefore, the required parking is less than the approved plan. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change will result as the uses are the same. 5. An increase in the height of the building(s) by more than 20 percent. The proposed modification will not result in an increase in height by more than 20 percent. The building is within the 45-foot height requirement. A portion of the buildings parapet is above the 45-foot limit, however, this is exempted from the building height provision. A change in the type and location of accessways and parking areas where off-site traffic would be affected. There are no changes to parking areas or accessways that would affect off-site traffic. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 20 vehicles per day. The modification will result in 14 fewer trips based upon the reduction in the square footage of the building. 8. An increase in the floor area proposed for a non-residential use by more than 10 percent excluding expansions under 5,000 square feet. The plan shows a decrease from 25,644 square feet to 24,963 square feet. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by this code or reduces the open space area by more than 10 percent. There is no required open space element required for this project. The area devoted to landscaping has increased from 21,225 square feet (27%) to 22,512 square feet (29%). The I-P zone requires the provision of a minimum of 20% of the site for landscaping. 10. A reduction of project amenities (Recreational facilities, Screening; and/or, Landscaping provisions) below the minimum established by this code or by more than 10 percent where specified in the site plan. Recreational facilities are not required as part of a commercial development. Screening shall be provided in accordance with code standards. The area devoted to landscaping has increased from 21,225 square feet (27%) to 22,512 square feet (29%). The I-P zone requires the provision of a minimum of 20% of the site for landscaping. 11. A modification to the conditions imposed at the time of site development review approval that are not the subject of B. 1 through 10 above of this subsection. As the table indicates, the total number of trips is just below the 1988 projection. The critical exiting traffic is 17% less than anticipated, while the entering traffic is 30% higher. Traffic projections presented in MEL's July 19, 1994, letter were used as a basis for this analysis. No new traffic counts were conducted for this analysis. This update adds traffic generated by Building 239. This building is the last vacant lot for the Center, and is proposed to be a 24,963 s.f medical clinic. TRIP GENERATION Trip generation rates for the medical clinic building are estimated using the Institute of Transportation Engineers Trip Generation, Fifth Edition, for Land Use Code 630. The number of trips anticipated from the 24,963 s.f medical clinic are as follows: ADT 594 vpd PM Peak Hour Enter 58 vph Exit 17 vph PM Peak Flour Enter 30 vph Exit 69 vph TRAFFIC COMPARISON The Transportation Analysis prepared for the Pacific Corporate Center in December 1988 estimated a total of 532 vehicles entering and 1228 vehicles exiting the site at full development during the PM peak hour. Hall Blvd. Tigard, OR 97223 ("the City") RECITALS WHEREAS, PacTrust has not received final land use approval from the City of Tigard for construction of a medical office building commonly known as Portland Clinic in the City of Tigard; and WHEREAS, there will be an appeal period for the Site Development Review following the Director's Notice; and WHEREAS, the City retains permit authority for this project during the pendency of any such appeal ; and WHEREAS, in the interest of promoting economic development, it is in the best interest of the City to allow PacTrust to receive a site permit authorizing the construction of a retaining wall , grading, and limited utility work for this project, with due regard for protection of the City's processes and interest, NOW, THEREFORE, in consideration of the mutual promises, covenants, and conditions herein contained, the parties agree as follows: SECTION 1 . Upon receipt of a valid and complete application for the above mentioned site permit for the Portland Clinic project, and provided such application meets all of the City's requirements for such site permit, the City shall issue the site permit, subject to the conditions contained herein. SECTION 2. Nothing in this agreement is intended to limit or remove the City's authority to impose any lawful conditions on the applied for site development permit, including conditions imposed as a part of the land use approval requested herein and any other applicable provisions of City code of law. -1- SECTION 3. In consideration of the granting by the City of the above-described permit, PacTrust hereby agrees to indemnify and defend and to hold the City and its employees harmless from and against losses and damages of any nature whatsoever, that the City may or shall at any time sustain or be put to by reason of the issuance of the permit described in this Agreement prior to the issuance of a final decision or applicable appeal period affirming the City's approval of the Site Development Review application. (a) "Final decision affirming" means a final decision by the City, LUBA, the Oregon Court of Appeals or the Oregon Supreme Court affirming the City's initial decision, on remand or as a result of a new application. Nothing in this Agreement is intended to limit PacTrust's right in the event of remand or a reversal of this land use decision to seek renewed Site Development Review approval from the City for the real property described herein by reference, except as otherwise limited by the City Code. SECTION 4. The indemnity obligation contained in this Agreement shall continue from the date hereof until the final decision or appeal period on all levels of appeal resulting from the issuance of the permit described in this Agreement. SECTION 5. In the event the City's approval of the Site Development Review application described herein is overturned on appeal , PacTrust agrees to restore any public property to the state in which it existed prior to the execution of this Agreement, and to remove any and all improvements therefrom at its sole expense. The City shall not exercise its rights under this paragraph until such time as the City finally denies the Site Development Review application. SECTION 6. This Agreement shall be binding upon and insure to the benefit of the parties and their respective successors and assigns. SECTION 7. No modification or cancellation of this Agreement shall be made without the written consent of both parties. SECTION 8. Notices and demands under this Agrement shall be in writing and shall be deemed effective when deposited in the United States mail , first class postage prepaid, directed to the other party at the address set forth above or such other address as a party may indicate by written notice to the other. SECTION 9. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. JII. BACKGROUND INFORMATION Property History: Tax lot 500 was created through the platting of the Pacific Corporate Center subdivision in December, 1989. The preliminary plat for this subdivision was approved by the City's Land Use Hearings Officer on June 2, 1989. In 1994, an approval was granted (SDR 94-0009) to allow the construction of three buildings totaling approximately 126,000 square feet. In 1995, an approval was granted (SDR 95-0024) to construct a 25,644 square foot medical clinic. No other land use or development applications regarding the subject parcel have been reviewed by the City of Tigard. NOTICE OF DECISION MINOR MODIFICATION(SDR 95-0024) PAGE 1 Vicinity Information: The site is located between SW Sequoia Parkway and 1-5, south of SW Cardinal Lane. The site and the entire Pacific Corporate Center are zoned I-P (Industrial Park). Office and industrial buildings owned by Pacific Realty Associates are located on both sides of SW Sequoia Parkway. Site Information and Proposal Description; The site is a 1.81 acre portion of a larger 8.68 acre parcel. The majority of the site is currently developed with 126,000 square feet of commercial office space. The undeveloped portion of the site slopes west from Interstate 5 and is below the grade of the Interstate. The site has access to both SW Redwood Lane and SW Cardinal Lane. The applicant requests Minor Modification approval to the approved Site Development Review (SDR 95-0024). The modified site plan would provide for a 24,963 square foot office building. IV. APPLICABLE REVIEW CRITERIA AND FINDINGS The Tigard Community Development Code, Site Development Review Section, states; "if the requested modification meets any of the major modification criteria, that this request shall be reviewed as a new Site Development Review application." This request does not meet any of the eleven (11) approval criteria for qualification as a major modification. Section 18.120.070(B) states that the Director shall determine that a major modification(s) will result if one or more of the following changes are proposed. There will be: 1. An increase in dwelling unit density, or lot coverage for residential development. This criteria is not applicable as this request involves commercial uses. 2. A change in the ratio or number of different types of dwelling units. This criteria is not applicable as this request involves commercial uses. 3. A change that requires additional on-site parking in accordance with Chapter 18.106. The square footage of the building has been reduced slightly, therefore, the required parking is less than the approved plan. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change will result as the uses are the same. 5. An increase in the height of the building(s) by more than 20 percent. The proposed modification will not result in an increase in height by more than 20 percent. The building is within the 45-foot height requirement. A portion of the buildings parapet is above the 45-foot limit, however, this is exempted from the building height provision. A change in the type and location of accessways and parking areas where off-site traffic would be affected. There are no changes to parking areas or accessways that would affect off-site traffic. • 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 20 vehicles per day. The modification will result in 14 fewer trips based upon the reduction in the square footage of the building. 8. An increase in the floor area proposed for a non-residential use by more than 10 percent excluding expansions under 5,000 square feet. The plan shows a decrease from 25,644 square feet to 24,963 square feet. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by this code or reduces the open space area by more than 10 percent. There is no required open space element required for this project. The area devoted to landscaping has increased from 21,225 square feet (27%) to 22,512 square feet (29%). The I-P zone requires the provision of a minimum of 20% of the site for landscaping. 10. A reduction of project amenities (Recreational facilities, Screening; and/or, Landscaping provisions) below the minimum established by this code or by more than 10 percent where specified in the site plan. Recreational facilities are not required as part of a commercial development. Screening shall be provided in accordance with code standards. The area devoted to landscaping has increased from 21,225 square feet (27%) to 22,512 square feet (29%). The I-P zone requires the provision of a minimum of 20% of the site for landscaping. 11. A modification to the conditions imposed at the time of site development review approval that are not the subject of B. 1 through 10 above of this subsection. There were two conditions of approval contained in the original decision. The first condition remains unchanged. The revised plan shows how the second condition will be satisfied. Therefore, this request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification to this existing site will promote the general welfare of the City and will not be significantly detrimental, nor injurious, to surrounding properties provided that development that occurs after this decision complies with applicable local, state and federal laws.
