APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.64, 18.100, 18.102, 18.106. 18.108, 18.114, 18.116, 18.120, 18.150 and 18.164. SECTION II: DECISION: Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to conditions. The findings and conclusions on which the decision is based are noted in Section IV. NOTICE OF DECISION SDR 96-0009-POLLOCK/WAYMIRE OFFICE BUILDING Page 1 CONDITIONS OF APPROVAL PRIOR TO THE ISSUANCE OF BUILDING PERMITS, THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED: (Unless otherwise noted, the staff contact shall be Brian Rager, Engineering Department(503) 639-4171.) 1. Prior to issuance of the building permit, a joint use and maintenance agreement shall be executed and recorded on standard City forms for the proposed common driveway onto 69th Avenue. The agreement shall be referenced on and become part of all applicable parcel Deeds. The agreement shall be approved by the Engineering Department prior to recording. 2. Prior to issuance of a building permit, a public improvement permit and compliance agreement is required for this project. Five (5) sets of detailed public improvement plans and profile construction drawings shall be submitted for preliminary review to the Engineering Department. Once redline comments are addressed and the plans are revised, the design engineer shall then submit eight (8) sets of revised drawings and one (1) itemized construction cost estimate for final review and approval (NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements. Public improvement plans shall conform to City of Tigard Public Improvement Design Standards, which are available at City Hall. 3. Building permits will not be issued and construction of proposed public improvements shall not commence until after the Engineering Department has reviewed and approved the public improvement plans and a construction compliance agreement has been executed. A 100 percent performance assurance or letter of commitment, a developer-engineer agreement, the payment of a permit fee and a sign installation/streetlight fee are required. 4. As part of the public improvements, the applicant shall construct a 3/4 street improvement along the frontage of SW 69th Avenue. The improvements adjacent to this site shall include: A. Pavement section from curb to centerline/crown equal to 17-feet, plus an additional eight feet of pavement section on the west side of the centerline crown to give a total pavement section width of 25-feet. B. Curb and gutter, including an appropriate curb line transition between the existing street section to the south and the new section adjacent to this site. C. Storm drainage, including any off-site storm drainage necessary to convey subsurface run-off. D. A five-foot-wide concrete curb-side sidewalk, including appropriate connection to the existing sidewalk south of this site. NOTICE OF DECISION SDR 96-0009-POLLOCKNVAYMIRE OFFICE BUILDING Page 2 E. Street striping shall be provided. F. Streetlights as determined by the City Engineer. G. Underground overhead utilities (NOTE: the applicant may be eligible to pay a fee in-lieu of undergrounding existing overhead utilities). H. Street signs (if applicable). Driveway aprons. J. Adjustments in vertical and/or horizontal alignment to construct SW 69th Avenue in a safe manner, as approved by the Engineering Department. K. A profile of SW 69th Avenue shall be required, extending 300-feet either side of the subject site showing the existing grade and proposed future grade. 5. The public street improvements shall include extension of the existing eight-inch public sanitary sewer line and the 15-inch public storm sewer line in 69th Avenue to the north boundary of this site. 6. The applicant shall provide an on-site water quality facility as required by Unified Sewerage Agency Resolution and Order No. 91-47. Final plans and calculations shall be submitted to the Engineering Department (Brian Rager) for review and approval prior to issuance of the building permit. In addition, a proposed maintenance plan shall be submitted along with the plans and calculations for review and approval. 7. An erosion control plan shall be provided as part of the public improvement drawings. The plan shall conform to "Erosion Prevention and Sediment Control Plans - Technical Guidance Handbook, February 1994. 8. Approval of the design and location of the proposed trash and recycling facility shall be obtained from the franchised waste hauler for this area. STAFF CONTACT: Mark Roberts, Associate Planner. 9. A wheel guard or curb shall be provided to prevent damage to the proposed landscaped plantings within the parking lot. STAFF CONTACT: Mark Roberts, Associate Planner. 10. Tree mitigation shall be the equivalent to 121 caliper inches. The mitigation may be provided through the planting of on site replacement trees, off-site trees or payment into an account to plant trees city wide. The applicant shall provide a security lighting plan for the areas near the doorways at the east and west ends of the ground floor. STAFF CONTACT: Kelley Jennings, Crime Prevention Specialist. THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO THE ISSUANCE OF OCCUPANCY PERMITS: 13. Prior to issuance of a Certificate of Occupancy, the applicant shall complete the required public street, sanitary sewer and storm drainage improvements in SW 69th Avenue and have said improvements accepted by the City. 14. Prior to issuance of a Certificate of Occupancy, the applicant shall provide the City with as-built drawings of the public improvements as follows: 1) mylars, and 2) a diskette of the as-builts in "DWG" format, if available; otherwise "DXF" will be acceptable. Note: if the public improvement drawings were hand-drawn, then a diskette is not required. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III: BACKGROUND INFORMATION Site History: The site was previously developed with a detached single-family residence. The site has been designated for Commercial Professional (C-P) use since the Comprehensive Plan was adopted in 1983. Vicinity Information: The adjoining properties are largely either undeveloped, developed with older single-family residences, or are developing with low rise office buildings. Site Information and Proposal Description: The site was developed with a single-family residence that has been cleared. Much of the remainder of the property contains a mixture of coniferous and deciduous trees of varying sizes. The applicant has proposed to develop a two story, 8,200 square foot office building. NOTICE OF DECISION SDR 96-0009-POLLOCKNVAYMIRE OFFICE BUILDING Page 4 SECTION IV: APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing to build an 8,200 square foot office building. This use is classified in Section 18.42 (Use Classifications) as Professional and Administrative Services. Section 18.64.030 lists Professional and Administrative Services, as a permitted use in the Commercial Professional zone. Dimensional Requirements: Section 18.64.030 requires that a minimum of 6,000 square feet be provided for each site in the Commercial Professional Zoning District. There is an average lot width of 50 feet requirement in the Commercial Professional zone. Developments within the Commercial Professional Zoning District is required to provide a minimum of 15% landscaping. The net site area is approximately 18,000 square feet in compliance with the minimum lot size standard. The lot has 180 feet of average width in compliance with the lot width standard. A total of 22% of the site is proposed to be landscaped in compliance with this standard. Setbacks: Section 18.64.050 states that for. The maximum building height is 45 feet. The proposed building elevation indicates that the maximum height of the office would be at 26 feet 6 inches. The proposed height is, therefore, in compliance with this standard. Site Development Review - Approval Standards: Section 18.120.180(A)(1) requires that a development proposal be found to be consistent with the various standards of the Community Development Code. The applicable criteria in this case are chapters 18.80, 18.100, 18.102, 18.106, 18.108, 18.114, 18.120, and 18.164. These chapters are also listed as approval standards for a Planned Development Review application under Section 18.80.120.2. The proposal's consistency with these Code Chapters is reviewed in the following sections. The proposal contains no elements related to the provisions of Code Chapters 18.84 (Sensitive Lands), 18.92 (Density Computations), 18.94 (Manufactured/Mobile Home Regulations) or 18.98 (Building Height Limitations: Exceptions), or 18.144 (Accessory Use and Structures) which are also listed under Section 18.120.180.A.1. These Chapters are, therefore, found to be inapplicable as approval standards. Section 18.120.180(A)(2) provides other Site Development Review approval standards not necessarily covered by the provisions of the previously listed sections. These other standards are addressed immediately below. The proposal contains no elements related to the provisions of 18.120.180.3 (Exterior Elevations), 18.120.180.5 (Privacy and Noise), 18.120.180.6 (Private Outdoor Areas: Residential Use), 18.120.180.7 (Shared Outdoor Recreation Areas: Residential Use), 18.120.180.8 (100-year floodplain), 18.120.180.9 (Demarcation of Spaces), and are therefore found to be inapplicable as approval standards. NOTICE OF DECISION SDR 96-0009-POLLOCKM/AYMIRE OFFICE BUILDING Page 5 Relationship to the Natural and Physical Environment: Section 18.120.180.2 states that buildings shall be located to preserve existing trees, topography, and natural drainage and that trees having a six inch caliper or greater, shall be preserved or replaced by new plantings of equal character. Due to their widely spread locations and general overall condition the applicant has not preserved the existing trees in excess of six inches in caliper. Due to the existing site constraints, it is not possible to preserve these trees and develop the proposed structures and the related site improvements. Buffering. Screening and Compatibility between adjoining uses: Section 18.120.108.4(A) states that buffering shall be provided between different types of land uses. This standard is not applicable because the site does not directly adjoin a different land use type. Section 18.120.108.4(B) states that on-site screening from view of adjoining properties of such things as service and storage areas, parking lots, and mechanical devices on roof tops shall be provided. The applicant has screened service and storage areas from view due to their location between the proposed office and a developing office on an adjoining site. The mechanical devices on the roof top of the building have been screened through the use of building parapets and other architectural features. Crime Prevention and Safety: Section 18.120.108.10 requires that exterior lighting levels be selected and the angles shall be oriented towards areas vulnerable to crime and shall be placed in areas having heavy pedestrian or vehicular traffic. The Police Department has reviewed the proposed site plan and indicated that the landscaping addressed crime prevention and safety issues. The Police Department required a security lighting plan for the areas near the doorways of both the east and west ends of the ground floor. Landscaping Plan: Section 18.100.015 requires that the applicant submit a landscaping plan. A landscape plan has been submitted in conjunction with this application, in compliance with this requirement. Street Trees: Section 18.100.033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with Section 18.100.035. Section 18.100.035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large). The applicant has proposed a total of six, two inch caliper Norway Maple trees along the property frontage on SW 69th Avenue. The trees are proposed to be spaced at 30 feet on center. Due to their height of over 50 feet at maturity, this spacing complies with the applicable development standards. Screening: Special Provisions: Section 18.100.110(A) requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one (1) tree for each seven (7) parking spaces in order to provide a canopy effect. The minimum dimension on the NOTICE OF DECISION SDR 96-0009-POLLOCKlWAYMIRE OFFICE BUILDING Page 6 landscape islands shall be three-feet-wide and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. A minimum of one tree has been provided for each two and one-half parking spaces, in compliance with this standard. A wheel guard or curb shall be provided to prevent damage to the proposed plantings. Visual Clearance Areas: Section 18.102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height. The code provides that obstructions that may be located in this area shall be visually clear between three and eight feet in height (trees may be placed within this area provided that all branches below eight feet are removed). A visual clearance area is the triangular area formed by measuring a 30-foot distance along the street right-of-way and the driveway, and then connecting these two, 30-foot distance points with a straight line. No structures or landscaping has been proposed within the Clear Vision area for this reason the proposed site improvements comply with this standard. Minimum Off-Street Parking: Section 18.106.030.C.1. states that Professional and Adminstrative Services are to provide a minimum of one parking space for each 350 square feet of gross floor area for an office use. Based on this ratio, a total of 24 spaces are required. A total of 33 parking spaces have been provided, in compliance with this standard. The Americans with Disabilities Act (ADA1: Section 18.106.020(M) requires that all parking areas be provided with the required disabled person parking spaces as specified by applicable State of Oregon and federal standards. All disabled person parking spaces shall be signed and marked on the pavement as required by these standards. This section requires a minimum of two disabled parking spaces if 26 to 50 parking spaces are provided one of which shall be van accessible. The site plan as proposed, provides one van accessible handicapped parking space, therefore, an additional handicapped parking space shall be provided. Bicycle Parking: Section 18.106.020(P) requires one bicycle parking rack space for each 15 required vehicular parking spaces in any development. Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian ways. As proposed the office requires the provision of 24 parking spaces. For this reason, a minimum of two bicycle parking spaces must be provided. A bicycle rack has been proposed with several bicycle parking spaces for this purpose. Access: Section 18.108.080 requires that commercial and industrial uses which require up to 100 parking spaces provide a minimum of one access point to a Public Street. The access shall be designed with a minimum overall width of 30 feet and a minimum pavement width of 24 feet. The site has been designed with direct access to SW 69th Avenue. As part of this development the applicant has been required to improve a portion of SW 69th Avenue to current public street standards. The site also provides indirect NOTICE OF DECISION SDR 96-0009-POLLOCKMWAYMIRE OFFICE BUILDING Page 7 access to SW 68th Avenue. Both driveways are designed to meet the minimum width and design requirements. Walkways: Section 18.108.050(A) requires that a walkway be extended from the ground floor entrance of the structure to the street that provides the required ingress and egress. Wherever required walkways cross vehicle access-driveways or parking lots, such crossings shall be designed and located for pedestrian safety. Required walkways shall be physically separated from motor vehicle traffic and parking by either a minimum six inch vertical separation (curbed), or a minimum three foot horizontal separation; except that pedestrian crossings of traffic aisles are permitted for distances no greater than 36 feet if appropriate landscaping, pavement markings, or contrasting pavement materials are used. Walkways shall be a minimum of four (4) feet in width, exclusive of vehicle overhangs and obstructions such as mailboxes, benches, bicycle racks, and sign posts, and shall be in compliance with ADA standards. A direct walkway has been provided on the proposed site plan from the main building entrance to SW 69th Avenue. The walkway does not require pedestrians to cross portions of the parking lot or place obstructions in the pedestrian walkway. For these reasons, the proposed walkway is in compliance with the applicable development standards. Parking Lot Connections: Section 18.108.110(B) states that in order to eliminate the need to use public streets for movements between commercial or industrial properties, parking areas shall be designed to connect with parking areas on adjacent properties unless not feasible. The Director shall require access easements between properties where necessary to provide parking area connections. The applicant has provided connectivity between a commercial site that is presently under construction and the proposed site. Future connectivity to the remaining vacant property to the north of the site has also been allowed for due to the design of the site. Mixed Solid Waste and Recyclables Storage: Section 18.116 requires that new construction incorporates functional and adequate space for on-site storage and efficient collection of mixed solid waste and source separated Recyclables prior to pick-up and removal by haulers. The applicant must choose one of the following four methods to demonstrate compliance: Minimum Standard, Waste Assessment, Comprehensive Recycling Plan, or Franchised Hauler Review and Sign-Off. The applicant will have to submit evidence or a plan which indicates compliance with this section. Regardless of which method chosen, the applicant will have to submit a written sign-off from the franchise hauler regarding the facility location and compatibility. The applicant has provided a waste collection area on the site plan. Approval of its design and location shall be obtained from the franchised waste hauler in this area. Tree Removal: Section 18.150.025 requires that a tree plan for the planting, removal and protection of trees prepared by a certified arborist shall be provided with a site development review application. The tree plan shall include identification of all existing trees, identification of a program to save existing trees or mitigate tree removal over 12 inches in caliper, which trees are to be removed, protection program defining standards and methods that will be used by the applicant to protect trees during and after construction. The applicant provided two arborist reports concerning the NOTICE OF DECISION SDR 96-0009-POLLOCFUWAYMIRE OFFICE BUILDING Page 8 trees on site. These reports were prepared February 25th and April 8th, 1996 and are the record for the mitigation requirements that apply for development of these sites. Many of the trees on this site were allowed to be removed to demolish the existing residence of the property and to construct improvements on the adjoining site. Tree mitigation is required for a period of one year after removal where new development is later proposed. Because the applicant did not preserve the existing trees, mitigation for the loss of 129 caliper inches is required. The proposed landscape plan provides a total of eight caliper inches of tree plantings in excess of the minimum standard. Therefore, the total mitigation shall be equivalent to 121 caliper inches. The mitigation may be provided through the planting of on site replacement trees, off-site trees or payment into an account to plant trees city wide. Signs: Section 18.114.130(B) lists the type of allowable signs and sign area permitted in the Commercial Professional Zone. No signs have been proposed as part of this review. The applicant will be required to obtain sign permit approval prior to the construction of any signs where desired by the future occupant. PUBLIC FACILITY CONCERNS: Sections 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: STREETS: This site lies adjacent to SW 69th Avenue, which is classified as a local commercial street to be built with two, 17-foot travel lanes and two, five-foot sidewalks. However, it is currently an unimproved gravel roadway adjacent to this site. Just south of the site the street is partially improved on the east side with curb, sidewalk and pavement section 20 feet wide from curb to centerline. When the existing improvement was installed, the City's standard for a local commercial street yielded a wider curb-to-curb pavement section than what is now required. There is 60 feet of total right-of-way (ROW) in this area which is adequate for a local commercial street. Therefore, no additional ROW dedications will be required. In order to mitigate the traffic impact that will be generated from this site, the applicant will be required to construct street improvements in 69th Avenue along the site frontage. Currently, the City's policy regarding partial street improvements for an unimproved gravel roadway require the developer to build half Of the street plus eight feet of pavement section on the opposite side of the centerline/crown to provide ample width for safe, two- way traffic. This is sometimes referred to as a 3/4 street improvement. As stated above, City standards for this roadway now require 17 feet of pavement section from curb to centerline/crown. When eight feet is added to the opposite side, the total pavement section adjacent to this site will be 25 feet. In addition, the applicant will need to construct an appropriate curb line transition between the existing roadway section to the south and the new section along his frontage. NOTICE OF DECISION SDR 96-0009-POLLOCKNVAYMIRE OFFICE BUILDING Page 9 SANITARY SEWER: There is an existing eight inch public sanitary sewer line in SW 69th Avenue that terminates at the south boundary of this site. The applicant's project can be served from this line and will be required to extend the public line to the north boundary of the site along with the required street improvements. STORM DRAINAGE: The site slopes to the southwest. There is an existing 15-inch public storm sewer line in 69th Avenue that presently terminates at the south boundary of this site. This line will also be extended to the north boundary of the site along with the applicant's street improvements. The applicant's plans indicate that the on-site drainage will be tied into the public line. STORM WATER QUALITY: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91-47, as amended by R&O 91-75) which require the construction of on-site water quality facilities. The facilities shall be designed to remove 65 percent of the phosphorus contained in 100 percent of the storm water runoff generated from newly created impervious surfaces. In addition, a maintenance plan is required to be submitted indicating the frequency and method to be used in keeping the facility maintained through the year. Prior to issuance of a building permit, the applicant shall submit plans and calculations for a water quality facility that will meet the intent of R&O 91-47. In addition, the applicant shall submit a maintenance plan for the facility that must be reviewed and approved by the City prior to issuance of the building permit. The applicant's plans do not show any provision for a storm water quality facility. Section 7.10 of R&O 91-47 only gives exemptions for cases where the following conditions exist: A. The site topography or soils makes it impractical, or ineffective to construct an on- site facility. B. The site is small compared to the development plan, and the loss of area for the on- site facility would preclude the effective development. C. There is a more efficient and effective regional site within the sub-basin and in the near vicinity. The applicant has not addressed the above criteria in order to be granted an exemption. Therefore, he should be required to install an on-site facility. NOTICE OF DECISION SDR 96-0009-POLLOCK/WAYMIRE OFFICE BUILDING Page 10 GRADING AND EROSION CONTROL: USA R&O 91-47 also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per R&O 91-47, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. ACCESS: The applicant owns the parcels of land to the north and east of this site. The plan indicates that a joint driveway is proposed to be built on the parcel to the north. In addition, there will be crossover traffic between this site and the site to the east. When the applicant recorded the partition plat for this parcel and the parcel to the east, a joint access easement was provided between the two parcels. A similar easement will be required between this parcel and the parcel to the north. Prior to issuance of the building permit, the applicant shall submit a joint access and maintenance agreement to the City for review and approval. The City will provide standard forms for this agreement. SECTION V: OTHER STAFF COMMENTS The Police Department has reviewed this proposal and have required a security lighting plan near the doorways on both the east and west ends of the ground floor. The landscape plan is acceptable as designed. No other comments or objections have been received. SECTION VI AGENCY COMMENTS The Unified Sewerage Agency has reviewed this proposal and provided the following comments: 1.) The extension of Public Storm and Sanitary Sewer shall be provided to the adjacent parcels should be evaluated. 2.) A water quality facility is needed. No other comments or objections have been received. Note that the applicant recently completed a land partition(MLP 95-0013)which would place this proposed project on Parcel 2 of the partition. The partition plat was approved by the City on April 15, 1996 and was sent to Washington County for recording. The approved lot size of Parcel 2 is approximately 17,991 sf. Findings: 1. Streets: This site lies adjacent to SW 69th Avenue,which is classified as a local commercial street to be built with two 17-foot travel lanes and two five-foot sidewalks. However, it is currently an unimproved gravel roadway adjacent to this site. Just south of the site the street is partially improved on the east side with • curb, sidewalk and pavement section 20 feet wide from curb to centerline. When the existing improvement was installed,the City's standard for a local commercial street yielded a wider curb-to-curb pavement section than what is now required. There is 60 feet of total right-of-way (ROW) in this area which is adequate for a local commercial street. Therefore, no additional ROW dedications will be required. In order to mitigate the traffic impact that will be generated from this site, the applicant will be required to construct street improvements in 69th Avenue along the site frontage. Currently,the City's policy regarding partial street improvements for an unimproved gravel roadway require the developer to build half of the street plus eight feet of pavement section on the opposite side of the centerline/crown to provide ample width for safe,two-way traffic. This is sometimes referred to as a 3/4 street improvement. As stated above, City standards for this roadway now require 17 feet of pavement section from curb to ENGINEERING COMMENTS SDR 96-0009 Pollock/Waymire Office PAGE 1 centerline/crown. When eight feet is added to the opposite side, the total pavement section adjacent to this site will be 25 feet. In addition, the applicant will need to construct an appropriate curb line transition between the existing roadway section to the south and the new section along his frontage. 2. Sanitary Sewer: There is an existing 8-inch public sanitary sewer line in SW 69th Avenue that terminates at the south boundary of this site. The applicant's project can be served from this line and will be required to extend the public line to the north boundary of the site along with the required street improvements. 3. Storm Drainage: The site slopes to the southwest. There is an existing 15-inch public storm sewer line in 69th Avenue that presently terminates at the south boundary of this site. This line will also be extended to the north boundary of the site along with the applicant's street improvements. The applicant's plans indicate that the on-site drainage will be tied into the public line. 4. Storm Water Quality: The City has agreed to enforce Surface Water Management(SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91-47, as amended by R&O 91-75) which require the construction of on-site water quality facilities. The facilities shall be designed to remove 65 percent of the phosphorus contained in 100 percent of the storm water runoff generated from newly created impervious surfaces. In addition,a maintenance plan is required to be submitted indicating the frequency and method to be used in keeping the facility maintained through the year. Prior to issuance of a building permit,the applicant shall submit plans and calculations for a water quality facility that will meet the intent of R&O 91-47. In addition,the applicant shall submit a maintenance plan for the facility that must be reviewed and approved by the City prior to issuance of the building permit. The applicant's plans do not show any provision for a storm water quality facility. Section 7.10 of R&O 91-47 only gives exemptions for cases where the following conditions exist: a. The site topography or soils makes it impractical, or ineffective to construct an on-site facility. b. The site is small compared to the development plan, and the loss of area for the on-site facility would preclude the effective development. c. There is a more efficient and effective regional site within the subbasin and in the near vicinity. ENGINEERING COMMENTS SDR 96-0009 Pollock/Waymire Office PAGE 2 The applicant has not addressed the above criteria in order to be granted an exemption. Therefore, he should be required to install an on-site facility. 5. Grading and Erosion Control: USA R&O 91-47 also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per R&O 91-47,the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. 6. Access The applicant owns the parcels of land to the north and east of this site. The plan indicates that a joint driveway is proposed to be built on the parcel to the north. In addition,there will be crossover traffic between this site and the site to the east. When the applicant recorded the partition plat for this parcel and the parcel to the east, a joint access easement was provided between the two parcels. A similar easement will be required between this parcel and the parcel to the north. Prior to issuance of the building permit,the applicant shall submit a joint access and maintenance agreement to the City for review and approval. The City will provide standard forms for this agreement. Recommendations: THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO ISSUANCE OF THE BUILDING PERMIT: Note: Unless otherwise noted, the staff contact for the following conditions will be Brian Rager, Engineering Department(639-4171). 1. Prior to issuance of the building permit, a joint use and maintenance agreement shall be executed and recorded on City standard forms for the proposed common driveway onto 69th Avenue. The agreement shall be referenced on and become part of all applicable parcel Deeds. The agreement shall be approved by the Engineering Department prior to recording. 2. Prior to issuance of a building permit, a public improvement permit and compliance agreement is required for this project. Five(5) sets of detailed public improvement plans and profile construction drawings shalt be submitted for preliminary review to the Engineering Department. Once redline comments are addressed and the plans are revised,the design engineer shall then submit eight(8) ENGINEERING COMMENTS SDR 96-0009 Pollock/Waymire Office PAGE 3 sets of revised drawings and one(1)itemized construction cost estimate for final review and approval (NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements. Public improvement plans shall conform to City of Tigard Public Improvement Design Standards,which are available at City Hall. 3. Building permits will not be issued and construction of proposed public improvements shall not commence until after the Engineering Department has reviewed and approved the public improvement plans and a construction compliance agreement has been executed. A 100 percent performance assurance or letter of commitment, a developer-engineer agreement, the payment of a permit fee and a sign installation/streetlight fee are required. 4. As part of the public improvements, the applicant shall construct a 3/4 street improvement along the frontage of SW 69th Avenue. The improvements adjacent to this site shall include: a. Pavement section from curb to centerline/crown equal to 17 feet, plus an additional eight feet of pavement section on the west side of centerline/crown to give a total pavement section width of 25 feet. b. curb and gutter, including an appropriate curb line transition between the existing street section to the south and the new section adjacent to this site c. storm drainage, including any off-site storm drainage necessary to convey subsurface runoff d. 5 foot concrete curb-side sidewalk, including appropriate connection to the existing sidewalk south of this site e. street striping f. streetlights as determined by the City Engineer g. underground utilities (NOTE: the applicant may be eligible to pay a fee in- lieu of undergrounding existing overhead utilities) h. street signs(if applicable) i. driveway apron j. adjustments in vertical and/or horizontal alignment to construct SW 69th Avenue in a safe manner, as approved by the Engineering Department. k. a profile of SW 69th Avenue shall be required,extending 300 feet either side of the subject site showing the existing grade and proposed future grade. 5. The public street improvements shall include extension of the existing eight-inch public sanitary sewer line and the 15-inch public storm sewer line in 69th Avenue to the north boundary of this site. 6. The applicant shall provide an on-site water quality facility as required by Unified Sewerage Agency Resolution and Order No. 91-47. Final plans and calculations shall be submitted to the Engineering Department (Brian Rager) for review and approval prior to issuance of the building permit. An erosion control plan shall be provided as part of the public improvement drawings. The plan shall conform to "Erosion Prevention and Sediment Control Plans-Technical Guidance Handbook, February 1994. THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO ISSUANCE OF A CERTIFICATE OF OCCUPANCY: 8. Prior to issuance of a Certificate of Occupancy, the applicant shall complete the required public street, sanitary sewer and storm drainage improvements in SW 69th Avenue and have said improvements accepted by the City. 9. Prior to issuance of a Certificate of Occupancy,the applicant shall provide the City with as-built drawings of the public improvements as follows: 1)mylars, and 2)a diskette of the as-builts in"DWG" format, if available;otherwise"DXF"will be acceptable. Note: if the public improvement drawings were hand-drawn,then a diskette is not required. Prior to issuance of the building permit, a joint use and maintenance agreement shall be executed and recorded on standard City forms for the proposed common driveway onto 69th Avenue. The agreement shall be referenced on and become part of all applicable parcel Deeds. The agreement shall be approved by the Engineering Department prior to recording. 2. Prior to issuance of a building permit, a public improvement permit and compliance agreement is required for this project. Five (5) sets of detailed public improvement plans and profile construction drawings shall be submitted for preliminary review to the Engineering Department. Once redline comments are addressed and the plans are revised, the design engineer shall then submit eight (8) sets of revised drawings and one (1) itemized construction cost estimate for final review and approval (NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements. Public improvement plans shall conform to City of Tigard Public Improvement Design Standards, which are available at City Hall. 3. Building permits will not be issued and construction of proposed public improvements shall not commence until after the Engineering Department has reviewed and approved the public improvement plans and a construction compliance agreement has been executed. A 100 percent performance assurance or letter of commitment, a developer-engineer agreement, the payment of a permit fee and a sign installation/streetlight fee are required. 4. As part of the public improvements, the applicant shall construct a 3/4 street improvement along the frontage of SW 69th Avenue. The improvements adjacent to this site shall include: A. Pavement section from curb to centerline/crown equal to 17-feet, plus an additional eight feet of pavement section on the west side of the centerline crown to give a total pavement section width of 25-feet. B. Curb and gutter, including an appropriate curb line transition between the existing street section to the south and the new section adjacent to this site. C. Storm drainage, including any off-site storm drainage necessary to convey subsurface run-off. D. A five-foot-wide concrete curb-side sidewalk, including appropriate connection to the existing sidewalk south of this site. NOTICE OF DECISION SDR 96-0009-POLLOCKNVAYMIRE OFFICE BUILDING Page 2 E. Street striping shall be provided. F. Streetlights as determined by the City Engineer. G. Underground overhead utilities (NOTE: the applicant may be eligible to pay a fee in-lieu of undergrounding existing overhead utilities). H. Street signs (if applicable). Driveway aprons. J. Adjustments in vertical and/or horizontal alignment to construct SW 69th Avenue in a safe manner, as approved by the Engineering Department. K. A profile of SW 69th Avenue shall be required, extending 300-feet either side of the subject site showing the existing grade and proposed future grade. 5. The public street improvements shall include extension of the existing eight-inch public sanitary sewer line and the 15-inch public storm sewer line in 69th Avenue to the north boundary of this site. 6. The applicant shall provide an on-site water quality facility as required by Unified Sewerage Agency Resolution and Order No. 91-47. Final plans and calculations shall be submitted to the Engineering Department (Brian Rager) for review and approval prior to issuance of the building permit. In addition, a proposed maintenance plan shall be submitted along with the plans and calculations for review and approval. 7. An erosion control plan shall be provided as part of the public improvement drawings. The plan shall conform to "Erosion Prevention and Sediment Control Plans - Technical Guidance Handbook, February 1994. 8. Prior to issuance of a Certificate of Occupancy, the applicant shall complete the required public street, sanitary sewer and storm drainage improvements in SW 69th Avenue and have said improvements accepted by the City. 14. Prior to issuance of a Certificate of Occupancy, the applicant shall provide the City with as-built drawings of the public improvements as follows: 1) mylars, and 2) a diskette of the as-builts in "DWG" format, if available; otherwise "DXF" will be acceptable. Note: if the public improvement drawings were hand-drawn, then a diskette is not required. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III: BACKGROUND INFORMATION Site History: The site was previously developed with a detached single-family residence. The site has been designated for Commercial Professional (C-P) use since the Comprehensive Plan was adopted in 1983. V_icinity Information: The adjoining properties are largely either undeveloped, developed with older single-family residences, or are developing with low rise office buildings. Site Information and Proposal Description: The site was developed with a single-family residence that has been cleared. Much of the remainder of the property contains a mixture of coniferous and deciduous trees of varying sizes. The applicant has proposed to develop a two story, 8,200 square foot office building. NOTICE OF DECISION SDR 96-0009-POLLOCK/WAYMIRE OFFICE BUILDING Page 4 SECTION IV: APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing to build an 8,200 square foot office building. This use is classified in Section 18.42 (Use Classifications) as Professional and Administrative Services. Section 18.64.030 lists Professional and Administrative Services, as a permitted use in the Commercial Professional zone. Dimensional Requirements: Section 18.64.030 requires that a minimum of 6,000 square feet be provided for each site in the Commercial Professional Zoning District. There is an average lot width of 50 feet requirement in the Commercial Professional zone. Developments within the Commercial Professional Zoning District is required to provide a minimum of 15% landscaping. The net site area is approximately 18,000 square feet in compliance with the minimum lot size standard. The lot has 180 feet of average width in compliance with the lot width standard. A total of 22% of the site is proposed to be landscaped in compliance with this standard. Setbacks: Section 18.64.050 states that for. The maximum building height is 45 feet. The proposed building elevation indicates that the maximum height of the office would be at 26 feet 6 inches. The proposed height is, therefore, in compliance with this standard. Site Development Review - Approval Standards: Section 18.120.180(A)(1) requires that a development proposal be found to be consistent with the various standards of the Community Development Code. The applicable criteria in this case are chapters 18.80, 18.100, 18.102, 18.106, 18.108, 18.114, 18.120, and 18.164. These chapters are also listed as approval standards for a Planned Development Review application under Section 18.80.120.2. The proposal's consistency with these Code Chapters is reviewed in the following sections. The proposal contains no elements related to the provisions of Code Chapters 18.84 (Sensitive Lands), 18.92 (Density Computations), 18.94 (Manufactured/Mobile Home Regulations) or 18.98 (Building Height Limitations: Exceptions), or 18.144 (Accessory Use and Structures) which are also listed under Section 18.120.180.A.1. These Chapters are, therefore, found to be inapplicable as approval standards. Section 18.120.180(A)(2) provides other Site Development Review approval standards not necessarily covered by the provisions of the previously listed sections. These other standards are addressed immediately below. The proposal contains no elements related to the provisions of 18.120.180.3 (Exterior Elevations), 18.120.180.5 (Privacy and Noise), 18.120.180.6 (Private Outdoor Areas: Residential Use), 18.120.180.7 (Shared Outdoor Recreation Areas: Residential Use), 18.120.180.8 (100-year floodplain), 18.120.180.9 (Demarcation of Spaces), and are therefore found to be inapplicable as approval standards. NOTICE OF DECISION SDR 96-0009-POLLOCKNVAYMIRE OFFICE BUILDING Page 5 Relationship to the Natural and Physical Environment: Section 18.120.180.2 states • that buildings shall be located to preserve existing trees, topography, and natural drainage and that trees having a six inch caliper or greater, shall be preserved or replaced by new plantings of equal character. Due to their widely spread locations and general overall condition the applicant has not preserved the existing trees in excess of six inches in caliper. Due to the existing site constraints, it is not possible to preserve these trees and develop the proposed structures and the related site improvements. Buffering, Screening and Compatibility between adjoining uses: Section 18.120.108.4(A) states that buffering shall be provided between different types of land uses. This standard is not applicable because the site does not directly adjoin a different land use type. Section 18.120.108.4(B) states that on-site screening from view of adjoining properties of such things as service and storage areas, parking lots, and mechanical devices on roof tops shall be provided. The applicant has screened service and storage areas from view due to their location between the proposed office and a developing office on an adjoining site. The mechanical devices on the roof top of the building have been screened through the use of building parapets and other architectural features. Crime Prevention and Safety: Section 18.120.108.10 requires that exterior lighting levels be selected and the angles shall be oriented towards areas vulnerable to crime and shall be placed in areas having heavy pedestrian or vehicular traffic. The Police Department has reviewed the proposed site plan and indicated that the landscaping addressed crime prevention and safety issues. The Police Department required a security lighting plan for the areas near the doorways of both the east and west ends of the ground floor. Landscaping Plan: Section 18.100.015 requires that the applicant submit a landscaping plan. A landscape plan has been submitted in conjunction with this application, in compliance with this requirement. Street Trees: Section 18.100.033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with Section 18.100.035. Section 18.100.035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large). The applicant has proposed a total of six, two inch caliper Norway Maple trees along the property frontage on SW 69th Avenue. The trees are proposed to be spaced at 30 feet on center. Due to their height of over 50 feet at maturity, this spacing complies with the applicable development standards. Screening: Special Provisions: Section 18.100.110(A) requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one (1) tree for each seven (7) parking spaces in order to provide a canopy effect. The minimum dimension on the NOTICE OF DECISION SDR 96-0009-POLLOCK/wAYMIRE OFFICE BUILDING Page 6 landscape islands shall be three-feet-wide and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. A minimum of one tree has been provided for each two and one-half parking spaces, in compliance with this standard. A wheel guard or curb shall be provided to prevent damage to the proposed plantings. Visual Clearance Areas: Section 18.102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height. The code provides that obstructions that may be located in this area shall be visually clear between three and eight feet in height (trees may be placed within this area provided that all branches below eight feet are removed). A visual clearance area is the triangular area formed by measuring a 30-foot distance along the street right-of-way and the driveway, and then connecting these two, 30-foot distance points with a straight line. No structures or landscaping has been proposed within the Clear Vision area for this reason the proposed site improvements comply with this standard. Minimum Off-Street Parking: Section 18.106.030.C.1. states that Professional and Adminstrative Services are to provide a minimum of one parking space for each 350 square feet of gross floor area for an office use. Based on this ratio, a total of 24 spaces are required. A total of 33 parking spaces have been provided, in compliance with this standard. The Americans with Disabilities Act (ADA): Section 18.106.020(M) requires that all parking areas be provided with the required disabled person parking spaces as specified by applicable State of Oregon and federal standards. All disabled person parking spaces shall be signed and marked on the pavement as required by these standards. This section requires a minimum of two disabled parking spaces if 26 to 50 parking spaces are provided one of which shall be van accessible. The site plan as proposed, provides one van accessible handicapped parking space, therefore, an additional handicapped parking space shall be provided. Bicycle Parking: Section 18.106.020(P) requires one bicycle parking rack space for each 15 required vehicular parking spaces in any development. Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian ways. As proposed the office requires the provision of 24 parking spaces. For this reason, a minimum of two bicycle parking spaces must be provided. A bicycle rack has been proposed with several bicycle parking spaces for this purpose. Access: Section 18.108.080 requires that commercial and industrial uses which require up to 100 parking spaces provide a minimum of one access point to a Public Street. The access shall be designed with a minimum overall width of 30 feet and a minimum pavement width of 24 feet. The site has been designed with direct access to SW 69th Avenue. As part of this development the applicant has been required to improve a portion of SW 69th Avenue to current public street standards. The site also provides indirect NOTICE OF DECISION SDR 96-0009-POLLOCK/WAYMIRE OFFICE BUILDING Page 7 access to SW 68th Avenue. Both driveways are designed to meet the minimum width and design requirements. • Walkways: Section 18.108.050(A) requires that a walkway be extended from the ground floor entrance of the structure to the street that provides the required ingress and egress. Wherever required walkways cross vehicle access-driveways or parking lots, such crossings shall be designed and located for pedestrian safety. Required walkways shall be physically separated from motor vehicle traffic and parking by either a minimum six inch vertical separation (curbed), or a minimum three foot horizontal separation; except that pedestrian crossings of traffic aisles are permitted for distances no greater than 36 feet if appropriate landscaping, pavement markings, or contrasting pavement materials are used. Walkways shall be a minimum of four (4) feet in width, exclusive of vehicle overhangs and obstructions such as mailboxes, benches, bicycle racks, and sign posts, and shall be in compliance with ADA standards. A direct walkway has been provided on the proposed site plan from the main building entrance to SW 69th Avenue. The walkway does not require pedestrians to cross portions of the parking lot or place obstructions in the pedestrian walkway. For these reasons, the proposed walkway is in compliance with the applicable development standards. Parking Lot Connections: Section 18.108.110(B) states that in order to eliminate the need to use public streets for movements between commercial or industrial properties, parking areas shall be designed to connect with parking areas on adjacent properties unless not feasible. The Director shall require access easements between properties where necessary to provide parking area connections. The applicant has provided connectivity between a commercial site that is presently under construction and the proposed site. Future connectivity to the remaining vacant property to the north of the site has also been allowed for due to the design of the site. Mixed Solid Waste and Recyclables Storage: Section 18.116 requires that new construction incorporates functional and adequate space for on-site storage and efficient collection of mixed solid waste and source separated Recyclables prior to pick-up and removal by haulers. The applicant must choose one of the following four methods to demonstrate compliance: Minimum Standard, Waste Assessment, Comprehensive Recycling Plan, or Franchised Hauler Review and Sign-Off. The applicant will have to submit evidence or a plan which indicates compliance with this section. Regardless of which method chosen, the applicant will have to submit a written sign-off from the franchise hauler regarding the facility location and compatibility. The applicant has provided a waste collection area on the site plan. Approval of its design and location shall be obtained from the franchised waste hauler in this area. Tree Removal: Section 18.150.025 requires that a tree plan for the planting, removal and protection of trees prepared by a certified arborist shall be provided with a site development review application. The tree plan shall include identification of all existing trees, identification of a program to save existing trees or mitigate tree removal over 12 inches in caliper, which trees are to be removed, protection program defining standards and methods that will be used by the applicant to protect trees during and after construction. The applicant provided two arborist reports concerning the NOTICE OF DECISION SDR 96-0009-POLLOCKNVAYMIRE OFFICE BUILDING Page 8 trees on site. These reports were prepared February 25th and April 8th, 1996 and are the record for the mitigation requirements that apply for development of these sites. Many of the trees on this site were allowed to be removed to demolish the existing residence of the property and to construct improvements on the adjoining site. Tree mitigation is required for a period of one year after removal where new development is later proposed. Because the applicant did not preserve the existing trees, mitigation for the loss of 129 caliper inches is required. The proposed landscape plan provides a total of eight caliper inches of tree plantings in excess of the minimum standard. Therefore, the total mitigation shall be equivalent to 121 caliper inches. The mitigation may be provided through the planting of on site replacement trees, off-site trees or payment into an account to plant trees city wide. Signs: Section 18.114.130(B) lists the type of allowable signs and sign area permitted in the Commercial Professional Zone. No signs have been proposed as part of this review. The applicant will be required to obtain sign permit approval prior to the construction of any signs where desired by the future occupant. PUBLIC FACILITY CONCERNS: Sections 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: STREETS: This site lies adjacent to SW 69th Avenue, which is classified as a local commercial street to be built with two, 17-foot travel lanes and two, five-foot sidewalks. However, it is currently an unimproved gravel roadway adjacent to this site. Just south of the site the street is partially improved on the east side with curb, sidewalk and pavement section 20 feet wide from curb to centerline. When the existing improvement was installed, the City's standard for a local commercial street yielded a wider curb-to-curb pavement section than what is now required. There is 60 feet of total right-of-way (ROW) in this area which is adequate for a local commercial street. Therefore, no additional ROW dedications will be required. In order to mitigate the traffic impact that will be generated from this site, the applicant will be required to construct street improvements in 69th Avenue along the site frontage. Currently, the City's policy regarding partial street improvements for an unimproved gravel roadway require the developer to build half of the street plus eight feet of pavement section on the opposite side of the centerline/crown to provide ample width for safe, two- way traffic. This is sometimes referred to as a 3/4 street improvement. As stated above, City standards for this roadway now require 17 feet of pavement section from curb to centerline/crown. When eight feet is added to the opposite side, the total pavement section adjacent to this site will be 25 feet. In addition, the applicant will need to construct an appropriate curb line transition between the existing roadway section to the south and the new section along his frontage. NOTICE OF DECISION SDR 96-0009-POLLOCK/WAYMIRE OFFICE BUILDING Page 9 SANITARY SEWER: There is an existing eight inch public sanitary sewer line in SW 69th Avenue that terminates at the south boundary of this site. The applicant's project can be served from this line and will be required to extend the public line to the north boundary of the site along with the required street improvements. STORM DRAINAGE: The site slopes to the southwest. There is an existing 15-inch public storm sewer line in 69th Avenue that presently terminates at the south boundary of this site. This line will also be extended to the north boundary of the site along with the applicant's street improvements. The applicant's plans indicate that the on-site drainage will be tied into the public line. STORM WATER QUALITY: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91-47, as amended by R&O 91-75) which require the construction of on-site water quality facilities. The facilities shall be designed to remove 65 percent of the phosphorus contained in 100 percent of the storm water runoff generated from newly created impervious surfaces. In addition, a maintenance plan is required to be submitted indicating the frequency and method to be used in keeping the facility maintained through the year. Prior to issuance of a building permit, the applicant shall submit plans and calculations for a water quality facility that will meet the intent of R&O 91-47. In addition, the applicant shall submit a maintenance plan for the facility that must be reviewed and approved by the City prior to issuance of the building permit. The applicant's plans do not show any provision for a storm water quality facility. Section 7.10 of R&O 91-47 only gives exemptions for cases where the following conditions exist: A. The site topography or soils makes it impractical, or ineffective to construct an on- site facility. B. The site is small compared to the development plan, and the loss of area for the on- site facility would preclude the effective development. C. There is a more efficient and effective regional site within the sub-basin and in the near vicinity. The applicant has not addressed the above criteria in order to be granted an exemption. Therefore, he should be required to install an on-site facility. NOTICE OF DECISION SDR 96-0009-POLLOCKNVAYMIRE OFFICE BUILDING Page 10 GRADING AND EROSION CONTROL: USA R&O 91-47 also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per R&O 91-47, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. ACCESS: The applicant owns the parcels of land to the north and east of this site. The plan indicates that a joint driveway is proposed to be built on the parcel to the north. In addition, there will be crossover traffic between this site and the site to the east. When the applicant recorded the partition plat for this parcel and the parcel to the east, a joint access easement was provided between the two parcels. A similar easement will be required between this parcel and the parcel to the north. Prior to issuance of the building permit, the applicant shall submit a joint access and maintenance agreement to the City for review and approval. The City will provide standard forms for this agreement. SECTION V: OTHER STAFF COMMENTS The Police Department has reviewed this proposal and have required a security lighting plan near the doorways on both the east and west ends of the ground floor. The landscape plan is acceptable as designed. No other comments or objections have been received. This easement is for a proposed driveway that will be common to both Parcel 1 and Parcel 2. A map and Tree Schedule for Parcel 2 is attached. Tree Protection Measures The trees have been identified and are shown on the Tree Plan Map prepared by Arboreal Enterprises, dated February 25, 1996. Tree protection measures should be taken to protect trees 5, 18, 24 and 37 and 38. Specifically: Before construction: 1. Remove trees marked for removal. See the Schedule of Trees in the appendix; • Tree falling, skidding and loading will be done to avoid damage to the remaining trees by falling trees in proposed roadways, driveways, utility corridors, building pads and areas with no trees. Methods that may be used to avoid damage to the remaining trees will include wedges, ropes and removing trees in pieces. 2. Remove English ivy and construction debris from around trees 37 and 38. These trees could not be inspected for their potential risk of failure. After the removal of the ivy and debris the consulting urban forester/certified arborist will inspect these trees for obvious defects. 3. Mark boundaries of construction envelopes. The construction envelope includes everything within five feet of the demolition site, building sites, roadways, paths, utilities and material storage areas as shown on the site plan. • Install tree protection fencing, (3' min. height orange PVC or equivalent) at the perimeter of the construction envelope. All fencing will be installed prior to demolition or construction. It will remain in place for the duration of the project. The placement of the fencing will be inspected by the consulting urban forester/certified arborist or a designated representative. Fencing will be placed to protect as much of the critical root zone' as possible. • Through written and verbal communication, inform all construction personnel about the need to protect trees and root zones. Roth Construction On Saturday, April 6, 1996, I conducted a site visit to inspect trees within 50 feet of the Southerly property boundary of Parcel 3. A map and Tree Schedule for Parcel Three is attached. The purpose of the inspection was to 1) identify trees that need to be removed for a driveway being constructed for Parcels One and Two and 2) to develop protection measures for trees not affected by the driveway construction. The trees have been identified and are shown on the Tree Plan Map prepared by Arboreal Enterprises, dated April 7, 1996. Trees to be removed due to hazard. Trees 6, 7, 13, 15, 16, 17, 18, 21, and 22 should be removed due to their hazardous condition. Trees to remove for construction. Trees 1, 2, 3, , 8, 9, 10 and 11 will require removal for the construction of the driveway. Trees to protect Tree protection measures should be taken to protect trees 12, 14, 19, and 20. Specifically, Before construction: 1. Remove trees marked for removal. See the Schedule of Trees in the appendix; • Tree falling, skidding and loading will be done to avoid damage to the remaining trees by falling trees in proposed roadways, driveways, utility corridors, building pads and areas with no trees. Methods that may be used to avoid damage to the remaining trees will include wedges, ropes and removing trees in pieces. 2. Mark boundaries of construction envelopes. The construction envelope includes everything within five feet of the building sites, roadways, paths, utilities and material storage areas as shown on the site plan. • Install tree protection fencing, (3' min. height orange PVC or equivalent) at the perimeter of the construction envelope. All fencing will be installed prior to construction. Trees within this area may be subject to root injury. During construction the consulting urban forester/certified arborist will inspect all protected trees within 10 feet of the construction envelope. • The consulting urban forester shall monitor construction progress to assure compliance with the tree protection and preservation requirements. • Pruning and cabling may be recommended for those trees that are to be protected. Tree care operations shall be directed, and inspected b4he consulting urban forester/certified arborist. Pruning will be performed by companies employing International Society of Arboriculture, Pacific Northwest Chapter Certified Arboricultural Technicians or ISA Certified Arborists. LANDSCAPING Street trees are required for all developments fronting on a public or private street as well as driveways which are more than 100 feet in length. Street trees must be placed either within the public right-of-way or on private property within six (6) feet of the right-of-way boundary. Street trees must have a minimum caliper of at least two (2) inches when measured four (4) feet above grade. Street trees should be spaced 20 to 40 feet apart depending on the branching width of the proposed tree species at maturity. Further information on regulations affecting street trees may be obtained from the Planning Division. A minimum of one (1) tree for every seven (7) parking spaces must be planted in and around all parking areas in order to provide a vegetative canopy effect. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. (Refer to Code Section 18.114) SENSITIVE LANDS The Code provides regulations for lands which are potentially unsuitable for development due to areas within the 100-year floodplain, natural drainageways, wetland areas, on slopes in excess of 25 percent, or on unstable ground. Staff will attempt to preliminary identify sensitive lands areas at the pre-application conference based on available information. HOWEVER, the responsibility to precisely identify sensitive lands areas, and their boundaries, is the responsibility of the applicant. Areas meeting the definitions of sensitive lands must be clearly indicated on plans submitted with the development application. (Refer to Code Section 18.84) TREE REMOVAL PLAN REQUIREMENTS A tree pan for the planting, removal and protection of trees prepared by a certified arborishall be provided for any lot, parcel or combination of lots or parcels for which a development application for a subdivision, major partition, site development review, planned development or conditional use ist, filed. Protection is preferred over removal where possible. The tree plan shall include the following: Identification of the location, size and species of all existing trees including trees designated as significant by the city; Identification of a program to save existing trees or mitigate tree removal over 12 inches in caliper. Mitigation must follow the replacement guidelines of Section 18.150.070.D. according to the following standards: ➢ Retainage of less than 25 percent of existing trees over 12 inches in caliper requires a mitigation program according to Section 18.150.070.D. of no net loss of trees; ➢ Retainage of from 25 to 50 percent of existing trees over 12 inches in caliper requires 18.150.070.D; ➢ Retainage of from 50 to 75 percent of existing trees over 12 inches in caliper requires that 50 percent of the trees to be removed be mitigated according to Section 18.150.070.D; ➢ Retainage of 75 percent or greater of existing trees over 12 inches in caliper requires no mitigation; Identification of all trees which are proposed to be removed; and A protection program defining standards and methods that will be used by the applicant to protect trees during and after construction. APPLICATION SUBMITTAL PROCESS All applications must be accepted by a Planning Division staff member of the Community Development Department at Tigard City Hall offices. PLEASE NOTE: Applications submitted by mail or dropped off at the counter without Planning Division acceptance may be returned. Applications submitted after 4:30 P.M. on Thursday will be batched for processing with the following week's applications. Staff will notify the applicant if additional information or additional copies of the submitted materials are required. The administrative decision or public hearing will typically occur approximately 45 to 60 days after an application is accepted as being complete by the Planning Division. Applications involving difficult or protracted issues or requiring review by other jurisdictions may take additional time to review.
