Interstate Ave. Portland, OR 97229 Portland, OR 97217 COMPREHENSIVE PLAN DESIGNATION: I-L (Light Industrial). ZONING DESIGNATION: I-L (Light Industrial). LOCATION: WCTM 2S1 12BA, TAX LOT 5900 and 5901. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.70, 18.100, 18.102, 18.106. 18.108, 18.114, 18.116, 18.120, 18.150, and 18.164. SECTION II: DECISION: Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are note in Section IV. NOTICE OF DECISION SDR 96-0011 -WESTCON INDUSTRIAL BLDG. PAGE 1 CONDITIONS OF APPROVAL PRIOR TO THE ISSUANCE OF BUILDING PERMITS, THE FOLLOWING CONDITIONS SHALL BE SATISFIED: (Unless otherwise noted, the staff contact shall be Brian Rager, Engineering Department (503) 639-4171.) 1. Prior to issuance of a building permit, a Street Opening Permit will be required for this project to cover the installation of the new sidewalk and site driveway in Milton Court. The applicant will need to submit five (5) sets of the proposed public improvement plans for review and approval. NOTE: these plans are in addition to any drawings required by the Building Division and should only include information relevant to the public improvements. 2. The applicant shall provide an on-site water quality facility as required by Unified Sewerage Agency Resolution and Order No. 91-47. Final plans and calculations shall be submitted to the Engineering Department (Brian Rager) for review and approval prior to issuance of the building permit. In addition, a proposed maintenance plan shall be submitted along with the plans and calculations for review and approval. 3. Prior to issuance of the building permit, the applicant shall pay a partial fee in-lieu of constructing an on-site water quality facility. This partial fee is intended to make up for the fact that the proposed water quality facility will not meet 100% of the criteria required by USA Resolution and Order 91-47. The City will perform a fee calculation once the final swale calculations are submitted to the Engineering Department. 4. Revised site and landscaping plans shall be submitted for review by the Planning Division, Staff Contact: Will D'Andrea, Planning Department (639-4171). The revised plans shall include the following: a. Pedestrian walkways to adjoining property to allow for future connection with adjoining development. b. Written solid waste hauler approval of facility location and equipment compatibility. c. Tree mitigation plan for the mitigation of 54 caliper inches. This mitigation is in addition to the required minimum landscaping, street trees, and parking lot trees. THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO THE ISSUANCE OF OCCUPANCY PERMITS: 5. Prior to issuance of a Certificate of Occupancy, the applicant shall complete the required public improvements. NOTICE OF DECISION SDR 96-0011 -WESTCON INDUSTRIAL BLDG. PAGE 2 6. All site improvement shall be installed as approved per the revised site plan. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III: BACKGROUND INFORMATION Site History: Tax lots 5900 and 5901 were created through the platting of the Bonita Industrial Park subdivision in 1992. The preliminary plat for this subdivision was approved by the City's Land Use Hearings Officer on June 2, 1989 (S 88-07, SL 88-05). In February 1981, the City approved a zone change from R-7 and M-3 to M-3 (PD) with conditions relating to the development of the property (ZC PD 13-80/Ordinance No. 81-03). A revised proposal was reviewed in September 1981 and was denied for lack of adequate information (PD 25-811M 5-81). In 1983, in conjunction with the adoption of the City's Comprehensive Plan, the zone of the property was amended from M-3 (PD) to I-L (Light Industrial). In 1985, the applicant submitted two proposals to divide the subject property into 14 lots and for a Sensitive Lands approval to allow regrading and the development of a road within the 100-year floodplain (S 7-85/SL 5-85). Those approvals were not acted upon and the approvals expired. No other development applications were found to have been filed with the City of Tigard. Vicinity Information: The subject property is located north of SW Bonita Road and west of SW 72nd Avenue. Properties to the north, south and west are zoned I-L (Light Industrial). Properties to the east are zoned I-H (Heavy Industrial). Property to the north, west and south are vacant. Property to the east is developed with industrial uses. Site Information and Proposal Description: The site consists of approximately 30,638 square feet, is presently vacant, and contains a number of mature trees. The applicant is proposing to construct a 12,474 square foot manufacturing/warehouse/office building. The proposal includes two driveways to SW Milton Court. SECTION IV: APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing to build a manufacturing, warehouse and office building. This use is classified in Code Section 18.42 (Use Classifications) as NOTICE OF DECISION SDR 96-0011 -WESTCON INDUSTRIAL BLDG. PAGE 3 Manufacturing of Finished Products. Code Section 18.70.030 lists Manufacturing of Finished Products as a permitted use in the I-L zone. Dimensional Requirements: Section 18.70.050 states that there is no minimum lot area for parcels in the I-L zoning district. The site has an average lot width of approximately 185 feet, thereby exceeding the required 50 foot average minimum lot width. Developments within the I-L zone are required to provide a minimum of 15% landscaping. The applicant is proposing approximately 4,738 square feet, or 15% of the site for landscaping. Setbacks: Section 18.70.050 states that the front yard setback is 30 feet and that no side yard or rear yard setback is required except 50 feet shall be required where the I- L zone abuts a residential zoning district. The maximum building heights is 45 feet. As indicated on the site plan, the front yard setback is satisfied. Side and rear yards are not applicable as the site does not abut a residential zone. The applicant is proposing a building height of 18 feet, well under the maximum 45 feet allowed. Site Development Review - Approval Standards: Section 18.120.180(A)(1) requires that a development proposal be found to be consistent with the various standards of the Community Development Code. The applicable criteria in this case are Chapters 18.100, 18.102, 18.106, 18.108, 18.114, 18.120, and 18.164. These chapters are also listed as approval standards for a Planned Development Review application under Section 18.80.120.2. The proposal's consistency with these Code Chapters is reviewed in the following sections. The proposal contains no elements related to the provisions of Code Chapters 18.80 (Planned Developments), 18.84 (Sensitive Lands), 18.92 (Density Computations), 18.94 (Manufactured/Mobile Home Regulations) or 18.98 (Building Height Limitations: Exceptions), or 18.144 (Accessory Use and Structures) which are also listed under Section 18.120.180.A.1. These Chapters are, therefore, found to be inapplicable as approval standards. Section 18.120.180(A)(2) provides other Site Development Review approval standards not necessarily covered by the provisions of the previously listed sections. These other standards are addressed immediately below. The proposal contains no elements related to the provisions of 18.120.180.3 (Exterior Elevations), 18.120.180.5 (Privacy and Noise), 18.120.180.6 (Private Outdoor Areas: Residential Use), 18.120.180.7 (Shared Outdoor Recreation Areas: Residential Use), 18.120.180.8 (100-year floodplain), 18.120.180.9 (Demarcation of Spaces), and are, therefore, found to be inapplicable as approval standards. Relationship to the Natural and Physical Environment: Section 18.120.180.2 states that buildings shall be located to preserve existing trees, topography, and natural drainage and that trees having a six (6) inch caliper or greater, shall be preserved or replaced by new plantings of equal character. There are a number of mature trees on the property, with the majority of these clustered in the center of the property. Given the location of the building, parking area, and accessway, as well as the grading required to accommodate this proposal, the existing trees will be removed. An arborist's report has also been provided that states the existing stand of trees is infested and in poor health. NOTICE OF DECISION SDR 96-0011 -WESTCON INDUSTRIAL BLDG. PAGE 4 Therefore, requiring modifications to the plan to preserve a number of trees is not necessarily desirable. Buffering. Screening and Comp_atibilily between adjoining uses: Section 18.120.108.4(A) states that buffering shall be provided between different types of land uses. This criteria is not applicable as this proposal does not abut a use that requires buffering in accordance with the Buffer Matrix (18.100.130). Section 18.120.108.4(B) states that on-site screening from view of adjoining properties of such things as service and storage areas, parking lots, and mechanical devices on roof tops shall be provided. As indicated on the site plan, parking and storage areas shall be screened from adjoining properties. Crime Prevention and Safety: Section 18.120.108.10 requires that exterior lighting levels be selected and the angles shall be oriented towards areas vulnerable to crime and shall be placed in areas having heavy pedestrian or vehicular traffic. The City of Tigard Police Department has reviewed the applicant's lighting plan and has no comments or objections to the plan, thereby, satisfying this criteria. Landscaping Plan: Section 18.100.015 requires that the applicant submit a landscaping plan. This requirement has been satisfied as the applicant has submitted a plan indicating the number, type, and location of trees and shrubs. Street Trees: Section 18.100.033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with Section 18.100.035. Section 18.100.035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large). The preliminary landscape plan shows the provision of 5 Halka Zelkova trees to be spaced approximately 25 feet apart, satisfying this requirement. Screening: Special Provisions: Section 18.100.110(A) requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one (1) tree for each seven (7) parking spaces in order to provide a canopy effect. The minimum dimension on the landscape islands shall be three-feet-wide and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. As indicated on the site plan, screening has been provided in accordance with this section. Visual Clearance Areas: Section 18.102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three (3) feet in height. The code provides that obstructions that may be located in this area shall be visually clear between three (3) and eight (8) feet in height (trees may be placed within this area provided that all branches below NOTICE OF DEC:3ICN SCR 96-0011 -WESTCON INDUSTRIAL BLDG. PAGE eight (8) feet are removed). A visual clearance area is the triangular area formed by measuring a 30-foot distance along the street right-of-way and the driveway, and then connecting these two (2), 30-foot distance points with a straight line. As indicated on the site plan, vision clearance will be provided in accordance with this section. Minimum Off-Street Parking: Section 18.106.030.(D)(1) requires a minimum of one (1) parking space per employee of the largest shift for manufacturing uses. The applicant has submitted documentation stating that Westcon has 18 employees. The required parking spaces required by the 6,281 square feet occupied by Westcon is therefore 18 spaces. The plan shows the provision of 36 parking spaces. The 18 parking spaces remaining to serve the 6,193 square feet of leasable area should be adequate. Given the loading docks provided, the future tenant will most likely be a warehouse type user. The parking requirement for a warehouse is one space per 1000 square feet of gross floor area (plus one space per 200 square feet of office area). The I-L allows other types of uses which may require up to one space per 350 square feet (Research Services), which would require 18 parking spaces. The site would be able to accommodate such a user. Therefore, the site provides parking that is adequate to serve this proposal. The Americans with Disabilities Act (ADA): Section 18.106.020(M) became effective on January 26, 1992. All parking areas shall be provided with the required numbers and sizes of disabled person parking spaces as specified by applicable State of Oregon and federal standards. All disabled person parking spaces shall be signed and marked on the pavement as required by these standards. This section requires 2 disabled parking spaces if 26 to 50 parking spaces are provided. The plan shows the provision of two disabled parking spaces, thereby, satisfying this criteria. Bicycle Parking: Section 18.106.020(P) requires one (1) bicycle parking rack space for each 15 vehicular parking spaces in any development. Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian ways. Two (2) bicycle parking spaces will be required for this development. The plan shows the provision of three (3) bicycle parking spaces. thereby, satisfying this standard. Off-Street Loading spaces: Section 18.106.080 requires that every commercial or industrial use having floor area of 10,000 square feet or more, shall have at least one (1) off-street loading space on site. As indicated on the site plan, two off-street loading spaces are provided in accordance with this section. Access: Section 18.108.080 requires that commercial and industrial uses which requireless than 100 parking spaces provide one (1) accesses with a minimum width of 30 feet and a minimum pavement width of 24 feet. This criteria is satisfied as the plan shows the provision of two driveways, with pavement widths of 24 feet. Walkways: Section 18.108.050(A) requires that a walkway be extended from the ground floor entrance of the structure to the street that provides the required ingress and egress. Unless impractical, walkways should be constructed between a new development and neighboring developments. Wherever required walkways cross vehicle access-driveways or parking lots, such crossings shall be designed and located for pedestrian safety. Required walkways shall be physically separated from NOTICE OF DECISION SDR 96-0011 -WESTCON INDUSTRIAL BLDG. PAGE motor vehicle traffic and parking by either a minimum six (6) inch vertical separation (curbed), or a minimum three (3) foot horizontal separation; except that pedestrian crossings of traffic aisles are permitted for distances no greater than 36 feet if appropriate landscaping, pavement markings, or contrasting pavement materials are used. Walkways shall be a minimum of four (4) feet in width, exclusive of vehicle overhangs and obstructions such as mailboxes, benches, bicycle racks, and sign posts, and shall be in compliance with ADA standards. The proposed site plan shows the provision of one walkway connection to SW Milton Court but does not provide connections with adjoining property intended for industrial development. A revised site plan shall be submitted that provides for pedestrian connections to adjoining properties. Mixed Solid Waste and Recyclables Storage: Section 18.116 requires that new construction incorporates functional and adequate space for on-site storage and efficient collection of mixed solid waste and source separated Recyclables prior to pick-up and removal by haulers. The applicant must choose one (1) of the following four (4) methods to demonstrate compliance: Minimum Standard, Waste Assessment, Comprehensive Recycling Plan, or Franchised Hauler Review and Sign- Off. The applicant will have to submit evidence or a plan which indicates compliance with this section. Regardless of which method chosen, the applicant will have to submit a written sign-off from the franchise hauler regarding the facility location and compatibility. The plans show the provision of a trash enclosure. The applicant shall provide a written sign-off from the hauler regarding this location. Tree Removal: Section 18.150.025 requires that a tree plan for the planting, removal and protection of trees prepared by a certified arborist shall be provided with a site development review application. The tree plan shall include identification of all existing trees, identification of a program to save existing trees or mitigate tree removal over 12 inches in caliper, which trees are to be removed, protection program defining standards and methods that will be used by the applicant to protect trees during and after construction. This section requires a program to save existing trees or mitigate tree removal for trees over 12 inches in caliper. The applicant has provided a plan which identifies all existing trees greater than six (6) inches in caliper. The inventory identified 87 trees greater than 12 inch caliper. An arborist was hired to determine what trees were healthy and structurally stable. The arborist found that the trees have been growing in tight groves and are overcrowded. The trees heavy weighted tops and limbs are causing the trees to break. The trees were also found to be infested with Golden Oak Pit Scale (insect). Only three of the trees were found to be healthy and structurally stable. However, given the location of these trees, none of them will be retained. Since the applicant is retaining less than 25 percent of the three existing trees, Section 18.150.025(B)(2)(a) requires a mitigation program according to Section 18.150.070.D of no net loss of trees. The applicant shall, therefore, provide a mitigation plan that provides for no net loss of trees in accordance with this section. The plan shall demonstrate mitigation of 54 caliper inches. This mitigation is in addition to the required minimum landscaping, street trees, and parking lot trees. Signs: Section 18.114.130(F) lists the type of allowable signs and sign area permitted in the l-L Zone. All signs shall conform to the provisions listed in this code section. All NOTICE OF DECISION SCR 96-0011 -WESTCON INDUSTRIAL BLDG PAGE 7 signs shall be approved through the Sign Permit process as administered by the Development Services Technicians. PUBLIC FACILITY CONCERNS: Sections 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), and 18.164,100 (Storm Drains) shall be satisfied as specified below: STREETS: This site is adjacent to SW Milton Court, which is classified as a local commercial & industrial street and is fully improved with the exception of a concrete sidewalk along the site frontage. As a part of this development, the applicant is proposing to construct the concrete sidewalk along the frontage and install a driveway apron to City standards. There are no other right-of-way (ROW) dedications or street improvements required. SANITARY SEWER: There is an existing eight-inch public sanitary sewer line in Milton Court with a six-inch lateral stubbed to this site. The applicant's plans indicate that the new building will connect to the existing lateral. STORM DRAINAGE: There is an existing 12-inch public storm drainage line in Milton Court and a 10-inch lateral stubbed from a catch basin in the street to this site. The plans indicate that the on-site storm water will be directed to the west side of the site where it will be treated in a bioswale before being routed to the existing 10-inch lateral. This is an acceptable proposal. STORM WATER QUALITY: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91-47, as amended by R&O 91-75) that requires the construction of on-site water quality facilities. The facilities shall be designed to remove 65 percent of the phosphorus contained in 100 percent of the storm water runoff generated from newly created impervious surfaces. In addition, a maintenance plan is required to be submitted indicating the frequency and method to be used in keeping the facility maintained through the year. Prior to issuance of a building permit, the applicant shall submit plans and calculations for a water quality facility that will meet the intent of R&O 91-47. In addition, the applicant shall submit a maintenance plan for the facility that must be reviewed and approved by the City prior to issuance of the building permit. As stated above, the applicant will provide an on-site biofiltration swale. Preliminary sizing calculations were provided by the applicant that indicate the proposed swale will not be able to fully treat the storm water because of site size constraints. In cases like this, USA NOTICE OF DECISION SDR 96-0011 -WESTCON INDUSTRIAL BLDG. PAGE 8 and the City have allowed partial payment of the fee in-lieu to make up for any shortfall from the on-site facility. It is USA's and the City's opinion that even if the facility can not meet 100% of the criteria, it is better to have it installed and get partial treatment, than to allow the full fee in-lieu. Staff recommends that the applicant be required to install the proposed swale and be allowed to pay a partial fee. Staff can not estimate the fee at this time, as the preliminary calculations did not consider the roof area, which are required to be accounted for. The facility design will be reviewed and approved by the Engineering Department, and the partial fee will be calculated, prior to issuance of the building permit. GRADING AND EROSION CONTROL: USA R&O 91-47 also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity that accelerates erosion. Per R&O 91-47, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. SECTION V: OTHER STAFF COMMENTS The City of Tigard Water Department states that all portions of the building must be within 250 feet from a fire hydrant measured along accessible routes for fire equipment. Water meters to be located within landscaped areas. The City of Tigard Building Division and the City of Tigard Police Department have reviewed this application and have offered no comments or objections. SECTION VI AGENCY COMMENTS Tualatin Valley Fire and Rescue states that the applicant shall submit required fire flow calculations for review and approval. GTE states that the developer/owner to place conduits per GTE's specifications. Unified Sewerage Agency, Northwest Natural Gas, and PGE have reviewed this application and have offered no comments or objections. Sanitary Sewer: There is an existing eight-inch public sanitary sewer line in Milton Court with a six-inch lateral stubbed to this site. The applicant's plans indicate that the new building will connect to the existing lateral. 3. Storm Drainage: There is an existing 12-inch public storm drainage line in Milton Court and a 10- inch lateral stubbed from a catch basin in the street to this site. The plans indicate that the on-site storm water will be directed to the west side of the site where it will be treated in a bioswale before being routed to the existing 10-inch lateral. This is an acceptable proposal. ENGINEERING COMMENTS SDR 96-0011 Westcon Industrial Building PAGE 1 • 4. Storm Water Quality: The City has agreed to enforce Surface Water Management(SWM)regulations established by the Unified Sewerage Agency (USA)(Resolution and Order No. 91-47, as amended by R&O 91-75)which require the construction of on-site water quality facilities. The facilities shall be designed to remove 65 percent of the phosphorus contained in 100 percent of the storm water runoff generated from newly created impervious surfaces. In addition,a maintenance plan is required to be submitted indicating the frequency and method to be used in keeping the facility maintained through the year. Prior to issuance of a building permit,the applicant shall submit plans and calculations for a water quality facility that will meet the intent of R&O 91-47. In addition, the applicant shall submit a maintenance plan for the facility that must be reviewed and approved by the City prior to issuance of the building permit. As stated above,the applicant will provide an on-site biofiltration swale. Preliminary sizing calculations were provided by the applicant which indicate the proposed swale will not be able to fully treat the storm water because of site size constraints. In cases like this,USA and the City have allowed partial payment of the fee in-lieu to make up for any shortfall from the on-site facility. It is USA's and the City's opinion that even if the facility can not meet 100% of the criteria, it is better to have it installed and get partial treatment,than to allow the full fee in- lieu. Staff recommends that the applicant be required to install the proposed swale and be allowed to pay a partial fee. Staff can not estimate the fee at this time, as the preliminary calculations did not consider the roof area,which are required to be accounted for. The facility design will be reviewed and approved by the Engineering Department, and the partial fee will be calculated, prior to issuance of the building permit. 5. Grading and Erosion Control: USA R&O 91-47 also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing,and any other activity which accelerates erosion. Per R&O 91-47, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. Code section 1 8.120.020 Applicability of Provisions, states the requirement for a Site Plan Review Procedure. Chapter 1 8.120. Site Plan Review outlines the requirements for the review procedure. There are no variances, conditional use applications, or sensitive land issues which need to be addressed. Proposed Use: This is a 6281 SF manufacturing facility for Westcon, an equipment calibration company. The 6193 SF section of the building is a lease space for an industrial user. Construction will be concrete tilt up. Access is provided at two points along the frontage of Milton Court, one on the southem end of the front property line and the other at the northern end of the property line. The site plan includes parking for 36 cars, two of which meet ADA requirements. Loading is accomplished for the lease space through two drive-in doors at the front of the building. Truck maneuvering space is provided on the site within the drive area Westcon's loading needs are limited to small delivery trucks and vans which will be accomplished through the drive-in door on the south side of the building off the access drive aisle. All vehicular circulation occurs on the site. The front access aisle provides both movement and maneuvering space. There is a 15% landscaping requirement that has been met. Screening along the parking lot and along the access way has been provided. Trash enclosures are to be screened by redwood slats within a chain link fence. Landscaping is provided in front of trash areas where space provides. A walkway has been provided to the front doors of each user from the public sidewalk to meet the requirements of the Oregon State Transportation Planning Rule. Three lockable bicycle spaces have been provided in the front of the building. The Site Analysis Plan included in this application indicates the location and size of trees on the property. The attached arborist report indicates that several of the trees are diseased or unsound. Those trees that are healthy and structurally stable have been identified, Unfortunately the trees that are healthy are not located in a place that offers the opportunity to save them. We are proposing to remove the existing vegetation and replace it with new healthy plant materials in the appropriate location. PAGE 1 CONDITIONS OF APPROVAL PRIOR TO THE ISSUANCE OF BUILDING PERMITS, THE FOLLOWING • CONDITIONS SHALL BE SATISFIED: (Unless otherwise noted, the staff contact shall be Brian Rager, Engineering Department (503) 639-4171.) 1. Prior to issuance of a building permit, a Street Opening Permit will be required for this project to cover the installation of the new sidewalk and site driveway in Milton Court. The applicant will need to submit five (5) sets of the proposed public improvement plans for review and approval. NOTE: these plans are in addition to any drawings required by the Building Division and should only include information relevant to the public improvements. 2. The applicant shall provide an on-site water quality facility as required by Unified Sewerage Agency Resolution and Order No. 91-47. Final plans and calculations shall be submitted to the Engineering Department (Brian Rager) for review and approval prior to issuance of the building permit. In addition, a proposed maintenance plan shall be submitted along with the plans and calculations for review and approval. 3. Prior to issuance of the building permit, the applicant shall pay a partial fee in-lieu of constructing an on-site water quality facility. This partial fee is intended to make up for the fact that the proposed water quality facility will not meet 100% of the criteria required by USA Resolution and Order 91-47. The City will perform a fee calculation once the final swale calculations are submitted to the Engineering Department. 4. The revised plans shall include the following: a. Pedestrian walkways to adjoining property to allow for future connection with adjoining development. b. SECTION III: BACKGROUND INFORMATION Site History: Tax lots 5900 and 5901 were created through the platting of the Bonita Industrial Park subdivision in 1992. The preliminary plat for this subdivision was approved by the City's Land Use Hearings Officer on June 2, 1989 (S 88-07, SL 88-05). In February 1981, the City approved a zone change from R-7 and M-3 to M-3 (PD) with conditions relating to the development of the property (ZC PD 13-80/Ordinance No. 81-03). A revised proposal was reviewed in September 1981 and was denied for lack of adequate information (PD 25-81/M 5-81). In 1983, in conjunction with the adoption of the City's Comprehensive Plan, the zone of the property was amended from M-3 (PD) to I-L (Light Industrial). In 1985, the applicant submitted two proposals to divide the subject property into 14 lots and for a Sensitive Lands approval to allow regrading and the development of a road within the 100-year floodplain (S 7-85/SL 5-85). Those approvals were not acted upon and the approvals expired. No other development applications were found to have been filed with the City of Tigard. Vicinity Information: The subject property is located north of SW Bonita Road and west of SW 72nd Avenue. Properties to the north, south and west are zoned I-L (Light Industrial). Properties to the east are zoned I-H (Heavy Industrial). Property to the north, west and south are vacant. Property to the east is developed with industrial uses. Site Information and Proposal Description: The site consists of approximately 30,638 square feet, is presently vacant, and contains a number of mature trees. The applicant is proposing to construct a 12,474 square foot manufacturing/warehouse/office building. The proposal includes two driveways to SW Milton Court. SECTION IV: APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing to build a manufacturing, warehouse and office building. This use is classified in Code Section 18.42 (Use Classifications) as NOTICE OF DECISION SDR 96-0011 -WESTCON INDUSTRIAL BLDG. PAGE 3 Manufacturing of Finished Products. Code Section 18.70.030 lists Manufacturing of Finished Products as a permitted use in the I-L zone. Dimensional Requirements: Section 18.70.050 states that there is no minimum lot area for parcels in the I-L zoning district. The site has an average lot width of approximately 185 feet, thereby exceeding the required 50 foot average minimum lot width. Developments within the I-L zone are required to provide a minimum of 15% landscaping. The applicant is proposing approximately 4,738 square feet, or 15% of the site for landscaping. Setbacks: Section 18.70.050 states that the front yard setback is 30 feet and that no side yard or rear yard setback is required except 50 feet shall be required where the I- L zone abuts a residential zoning district. The maximum building heights is 45 feet. As indicated on the site plan, the front yard setback is satisfied. Side and rear yards are not applicable as the site does not abut a residential zone. The applicant is proposing a building height of 18 feet, well under the maximum 45 feet allowed. Site Development Review - Approval Standards: Section 18.120.180(A)(1) requires that a development proposal be found to be consistent with the various standards of the Community Development Code. The applicable criteria in this case are Chapters 18.100, 18.102, 18.106, 18.108, 18.114, 18.120, and 18.164. These chapters are also listed as approval standards for a Planned Development Review application under Section 18.80.120.2. The proposal's consistency with these Code Chapters is reviewed in the following sections. The proposal contains no elements related to the provisions of Code Chapters 18.80 (Planned Developments), 18.84 (Sensitive Lands), 18.92 (Density Computations), 18.94 (Manufactured/Mobile Home Regulations) or 18.98 (Building Height Limitations: Exceptions), or 18.144 (Accessory Use and Structures) which are also listed under Section 18.120.180.A.1. These Chapters are, therefore, found to be inapplicable as approval standards. Section 18.120.180(A)(2) provides other Site Development Review approval standards not necessarily covered by the provisions of the previously listed sections. These other standards are addressed immediately below. The proposal contains no elements related to the provisions of 18.120.180.3 (Exterior Elevations), 18.120.180.5 (Privacy and Noise), 18.120.180.6 (Private Outdoor Areas: Residential Use), 18.120.180.7 (Shared Outdoor Recreation Areas: Residential Use), 18.120.180.8 (100-year floodplain), 18.120.180.9 (Demarcation of Spaces), and are, therefore, found to be inapplicable as approval standards. Relationship to the Natural and Physical Environment: Section 18.120.180.2 states that buildings shall be located to preserve existing trees, topography, and natural drainage and that trees having a six (6) inch caliper or greater, shall be preserved or replaced by new plantings of equal character. There are a number of mature trees on the property, with the majority of these clustered in the center of the property. Given the location of the building, parking area, and accessway, as well as the grading required to accommodate this proposal, the existing trees will be removed. An arborist's report has also been provided that states the existing stand of trees is infested and in poor health. NOTICE OF DECISION SDR 96-0011 -WESTCON INDUSTRIAL BLDG. PAGE 4 Therefore, requiring modifications to the plan to preserve a number of trees is not necessarily desirable. Buffering, Screening and Compatibility between adjoining uses: Section 18.120.108.4(A) states that buffering shall be provided between different types of land uses. This criteria is not applicable as this proposal does not abut a use that requires buffering in accordance with the Buffer Matrix (18.100.130). Section 18.120.108.4(B) states that on-site screening from view of adjoining properties of such things as service and storage areas, parking lots, and mechanical devices on roof tops shall be provided. As indicated on the site plan, parking and storage areas shall be screened from adjoining properties. Crime Prevention and Safety: Section 18.120.108.10 requires that exterior lighting levels be selected and the angles shall be oriented towards areas vulnerable to crime and shall be placed in areas having heavy pedestrian or vehicular traffic. The City of Tigard Police Department has reviewed the applicant's lighting plan and has no comments or objections to the plan, thereby, satisfying this criteria. Landscaping Plan: Section 18.100.015 requires that the applicant submit a landscaping plan. This requirement has been satisfied as the applicant has submitted a plan indicating the number, type, and location of trees and shrubs. Street Trees: Section 18.100.033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with Section 18.100.035. Section 18.100.035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large). The preliminary landscape plan shows the provision of 5 Halka Zelkova trees to be spaced approximately 25 feet apart, satisfying this requirement. Screening: Special Provisions: Section 18.100.110(A) requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one (1) tree for each seven (7) parking spaces in order to provide a canopy effect. The minimum dimension on the landscape islands shall be three-feet-wide and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. As indicated on the site plan, screening has been provided in accordance with this section. Visual Clearance Areas: Section 18.102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three (3) feet in height. The code provides that obstructions that may be located in this area shall be visually clear between three (3) and eight (8) feet in height (trees may be placed within this area provided that all branches below NOTICE OF DECISION SDR 96-0011 -WESTCON INDUSTRIAL BLDG. PAGE 5 • eight (8) feet are removed). A visual clearance area is the triangular area formed by measuring a 30-foot distance along the street right-of-way and the driveway, and then connecting these two (2), 30-foot distance points with a straight line. As indicated on the site plan, vision clearance will be provided in accordance with this section. Minimum Off-Street Parking: Section 18.106.030.(D)(1) requires a minimum of one (1) parking space per employee of the largest shift for manufacturing uses. The applicant has submitted documentation stating that Westcon has 18 employees. The required parking spaces required by the 6,281 square feet occupied by Westcon is therefore 18 spaces. The plan shows the provision of 36 parking spaces. The 18 parking spaces remaining to serve the 6,193 square feet of leasable area should be adequate. Given the loading docks provided, the future tenant will most likely be a warehouse type user. The parking requirement for a warehouse is one space per 1000 square feet of gross floor area (plus one space per 200 square feet of office area). The I-L allows other types of uses which may require up to one space per 350 square feet (Research Services), which would require 18 parking spaces. The site would be able to accommodate such a user. Therefore, the site provides parking that is adequate to serve this proposal. The Americans with Disabilities Act (ADA): Section 18.106.020(M) became effective on January 26, 1992. All parking areas shall be provided with the required numbers and sizes of disabled person parking spaces as specified by applicable State of Oregon and federal standards. All disabled person parking spaces shall be signed and marked on the pavement as required by these standards. This section requires 2 disabled parking spaces if 26 to 50 parking spaces are provided. The plan shows the provision of two disabled parking spaces, thereby, satisfying this criteria. Bicycle Parkina: Section 18.106.020(P) requires one (1) bicycle parking rack space for each 15 vehicular parking spaces in any development. Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian ways. Two (2) bicycle parking spaces will be required for this development. The plan shows the provision of three (3) bicycle parking spaces, thereby, satisfying this standard. Off-Street Loading spaces: Section 18.106.080 requires that every commercial or industrial use having floor area of 10,000 square feet or more, shall have at least one (1) off-street loading space on site. As indicated on the site plan, two off-street loading spaces are provided in accordance with this section. Access: Section 18.108.080 requires that commercial and industrial uses which requireless than 100 parking spaces provide one (1) accesses with a minimum width of 30 feet and a minimum pavement width of 24 feet. This criteria is satisfied as the plan shows the provision of two driveways, with pavement widths of 24 feet. Walkways: Section 18.108.050(A) requires that a walkway be extended from the ground floor entrance of the structure to the street that provides the required ingress and egress. Unless impractical, walkways should be constructed between a new development and neighboring developments. Wherever required walkways cross vehicle access-driveways or parking lots, such crossings shall be designed and located for pedestrian safety. Required walkways shall be physically separated from NOTICE OF DECISION SDR 96-0011 -WESTCON INDUSTRIAL BLDG. PAGE 6 motor vehicle traffic and parking by either a minimum six (6) inch vertical separation (curbed), or a minimum three (3) foot horizontal separation; except that pedestrian crossings of traffic aisles are permitted for distances no greater than 36 feet if appropriate landscaping, pavement markings, or contrasting pavement materials are used. Walkways shall be a minimum of four (4) feet in width, exclusive of vehicle overhangs and obstructions such as mailboxes, benches, bicycle racks, and sign posts, and shall be in compliance with ADA standards. The proposed site plan shows the provision of one walkway connection to SW Milton Court but does not provide connections with adjoining property intended for industrial development. A revised site plan shall be submitted that provides for pedestrian connections to adjoining properties. Mixed So_lid Waste and Recyclables Storage: Section 18.116 requires that new construction incorporates functional and adequate space for on-site storage and efficient collection of mixed solid waste and source separated Recyclables prior to pick-up and removal by haulers. The applicant must choose one (1) of the following four (4) methods to demonstrate compliance: Minimum Standard, Waste Assessment, Comprehensive Recycling Plan, or Franchised Hauler Review and Sign- Off. The applicant will have to submit evidence or a plan which indicates compliance with this section. Regardless of which method chosen, the applicant will have to submit a written sign-off from the franchise hauler regarding the facility location and compatibility. The plans show the provision of a trash enclosure. The applicant shall provide a written sign-off from the hauler regarding this location. Tree Removal: Section 18.150.025 requires that a tree plan for the planting, removal and protection of trees prepared by a certified arborist shall be provided with a site development review application. The tree plan shall include identification of all existing trees, identification of a program to save existing trees or mitigate tree removal over 12 inches in caliper, which trees are to be removed, protection program defining standards and methods that will be used by the applicant to protect trees during and after construction. This section requires a program to save existing trees or mitigate tree removal for trees over 12 inches in caliper. The applicant has provided a plan which identifies all existing trees greater than six (6) inches in caliper. The inventory identified 87 trees greater than 12 inch caliper. An arborist was hired to determine what trees were healthy and structurally stable. The arborist found that the trees have been growing in tight groves and are overcrowded. The trees heavy weighted tops and limbs are causing the trees to break. The trees were also found to be infested with Golden Oak Pit Scale (insect). Only three of the trees were found to be healthy and structurally stable. However, given the location of these trees, none of them will be retained. Since the applicant is retaining less than 25 percent of the three existing trees, Section 18.150.025(B)(2)(a) requires a mitigation program according to Section 18.150.070.D of no net loss of trees. The applicant shall, therefore, provide a mitigation plan that provides for no net loss of trees in accordance with this section. The plan shall demonstrate mitigation of 54 caliper inches. This mitigation is in addition to the required minimum landscaping, street trees, and parking lot trees. Signs: Section 18.114.130(F) lists the type of allowable signs and sign area permitted in the I-L Zone. All signs shall conform to the provisions listed in this code section. All NOTICE OF DECISION SDR 96-0011 -WESTCON INDUSTRIAL BLDG. PAGE 7 signs shall be approved through the Sign Permit process as administered by the Development Services Technicians. PUBLIC FACILITY CONCERNS: Sections 18.164.030(E)(1)(a) (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: STREETS: This site is adjacent to SW Milton Court, which is classified as a local commercial & industrial street and is fully improved with the exception of a concrete sidewalk along the site frontage. As a part of this development, the applicant is proposing to construct the concrete sidewalk along the frontage and install a driveway apron to City standards. There are no other right-of-way (ROW) dedications or street improvements required. SANITARY SEWER: There is an existing eight-inch public sanitary sewer line in Milton Court with a six-inch lateral stubbed to this site. The applicant's plans indicate that the new building will connect to the existing lateral. STORM DRAINAGE: There is an existing 12-inch public storm drainage line in Milton Court and a 10-inch lateral stubbed from a catch basin in the street to this site. The plans indicate that the on-site storm water will be directed to the west side of the site where it will be treated in a bioswale before being routed to the existing 10-inch lateral. This is an acceptable proposal. STORM WATER QUALITY: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 91-47, as amended by R&O 91-75) that requires the construction of on-site water quality facilities. The facilities shall be designed to remove 65 percent of the phosphorus contained in 100 percent of the storm water runoff generated from newly created impervious surfaces. In addition, a maintenance plan is required to be submitted indicating the frequency and method to be used in keeping the facility maintained through the year. Prior to issuance of a building permit, the applicant shall submit plans and calculations for a water quality facility that will meet the intent of R&O 91-47. In addition, the applicant shall submit a maintenance plan for the facility that must be reviewed and approved by the City prior to issuance of the building permit. As stated above, the applicant will provide an on-site biofiltration swale. Preliminary sizing calculations were provided by the applicant that indicate the proposed swale will not be able to fully treat the storm water because of site size constraints. In cases like this, USA NOTICE OF DECISION SDR 96-0011 -WESTCON INDUSTRIAL BLDG. PAGE 8 and the City have allowed partial payment of the fee in-lieu to make up for any shortfall from the on-site facility. It is USA's and the City's opinion that even if the facility can not meet 100% of the criteria, it is better to have it installed and get partial treatment, than to allow the full fee in-lieu. Staff recommends that the applicant be required to install the proposed swale and be allowed to pay a partial fee. Staff can not estimate the fee at this time, as the preliminary calculations did not consider the roof area, which are required to be accounted for. The facility design will be reviewed and approved by the Engineering Department, and the partial fee will be calculated, prior to issuance of the building permit. GRADING AND EROSION CONTROL: USA R&O 91-47 also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity that accelerates erosion. Per R&O 91-47, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. SECTION V: OTHER STAFF COMMENTS The City of Tigard Water Department states that all portions of the building must be within 250 feet from a fire hydrant measured along accessible routes for fire equipment. Water meters to be located within landscaped areas. The City of Tigard Building Division and the City of Tigard Police Department have reviewed this application and have offered no comments or objections. SECTION VI AGENCY COMMENTS Tualatin Valley Fire and Rescue states that the applicant shall submit required fire flow calculations for review and approval. GTE states that the developer/owner to place conduits per GTE's specifications. Unified Sewerage Agency, Northwest Natural Gas, and PGE have reviewed this application and have offered no comments or objections. There is a 15% landscaping requirement that has been met. Screening along the parking lot and along the access way has been provided. Trash enclosures are to be screened by redwood slats within a chain link fence. Landscaping is provided in front of trash areas where space provides. A walkway has been provided to the front doors of each user from the public sidewalk to meet the requirements of the Oregon State Transportation Planning Rule. Three lockable bicycle spaces have been provided in the front of the building. The Site Analysis Plan included in this application indicates the location and size of trees on the property. The attached arborist report indicates that several of the trees are diseased or unsound. Those trees that are healthy and structurally stable have been identified. Unfortunately the trees that are healthy are not located in a place that offers the opportunity to save them. Walkways shall provide convenient connections between buildings in multi-building commercial, institutional, and industrial complexes. Unless impractical, walkways should be constructed between a new development and neighboring developments. (Refer to Code Section 18.108.050) LOADING AREA REQUIREMENTS Every commercial or industrial building in excess of 10,000 square feet shall be provided with a loading space. The space size and location shall be as approved by the City Engineer. (Refer to Code Section 18.106.070-090) .EAR VISION AREA The City requires that clear vision areas be maintained between three and eight feet in height at road/driveway, road/railroad, and road/road intersections. The size of the required clear vision area depends upon the abutting street's functional classification. 13 (Refer to Code Section 18.102) p' BUFFERING AND SCREENING In order to increase privacy and to either reduce or eliminate adverse noise or visual impacts between adjacent developments, especially between different and uses, the City requires landscaped buffer areas along certain site perimeters. Required buffer areas are described by the Code in terms of width. Buffer areas must be occupied by a mixture of deciduous and evergreen trees and shrubs and must also achieve a balance between vertical and horizontal plantings. Site obscuring screens or fences may also be required; these are often advisable even if not required by the Code. The required buffer areas may only be occupied by vegetation, fences, utilities, and walkways. Additional information on required buffer area materials and sizes may be found in the Community Development Code. Street trees must be placed either within the public right-of-way or on private property within six (6) feet of the right-of-way boundary. Street trees must have a minimum caliper of at least two (2) inches when measured four (4) feet above grade. Street trees should be spaced 20 to 40 feet apart depending on the branching width of the proposed tree species at maturity. Further information on regulations affecting street trees may be obtained from the Planning Division. A minimum of one (1) tree for every seven (7) parking spaces must be planted in and around all parking areas in order to provide a vegetative canopy effect. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. These design features may include the use of landscaped berms, decorative walls, and raised planters. For detailed information on design requirements for parking areas and accesses. (Refer to Code Chapters 18.100, 18.106 and 18.108) SIGNS Sign permits must be obtained prior to installation of any sign in the City of Tigard. A "Guidelines for Sign Permits" handout is available upon request. Additional sign area or height beyond Code standards may be permitted if the sign proposal is reviewed as part of a development review application. Alternatively, a Sign Code Exception application may be filed for review before the Hearings Officer. (Refer to Code Section 18.114) SENSITIVE LANDS The Code provides regulations for Ian s which are potentially unsuitable for development due to areas within the 100-year floodplain, nat al drainageways, wetland areas, on slopes in excess of 25 percent, or on unstable ground. Staff will tempt to preliminary identify sensitive lands areas at the pre-application conference based on available 'nformation. HOWEVER, the responsibility to precisely identify sensitive lands areas, and their boun ries. is the responsibility of the applicant. Areas meeting the definitions of sensitive lands must ' e clearly indicated on plans submitted with the development application. Residential development is prohibited within floodplains. In most cases, dedication of 100- year floodplain areas to the City for park and open space areas is required as a condition of the approval of a development application. (Refer to Code Section 18.84) TREE REMOVAL PLAN REQUIREMENTS A tree pan for the p anting, removal and protection of trees prepared by a certified arborist shall be provided for any lot, parcel or combination of lots or parcels for which a development application for a subdivision, major partition, site development review, planned development or conditional use is filed. Protection is preferred over removal where possible. The tree plan shall include the following: b Identification of the location, size and species of all existing trees including trees designated as significant by the city; Identification of a program to save existing trees or mitigate tree removal over 12 inches in caliper. Mitigation must follow the replacement guidelines of Section 18.150.070.D. according to the following standards: ➢ Retainage of less than 25 percent of existing trees over 12 inches in caliper requires a mitigation program according to Section 18.150.070.D. of no net loss of trees; ➢ Retainage of from 25 to 50 percent of existing trees over 12 inches in caliper requires 18.150.070.D; ➢ Retainage of from 50 to 75 percent of existing trees over 12 inches in caliper requires that 50 percent of the trees to be removed be mitigated according to Section 18.150.070.D; ➢ Retainage of 75 percent or greater of existing trees over 12 inches in caliper requires no mitigation; Identification of all trees which are proposed to be removed; and A protection program defining standards and methods that will be used by the applicant to protect trees during and after construction. Trees removed within the period of one (1) year prior to a development application listed above will be inventoried as part of the tree plan above and will be replaced according to Section 18.150.070.D. If a replacement tree of the species of the tree removed or damages is not reasonably available, the Director may allow replacement with a different species of equivalent natural resource value. ➢ If a replacement tree of the size cut is not reasonably available on the local market or would not be viable, the Director shall require replacement with more than one tree in accordance with the following formula: ➢ The number of replacement trees required shall be determined by dividing the estimated caliper size of the tree removed or damaged, by the caliper size of the largest reasonably available replacement trees. The tax map number is 2Sl 12BA, tax lots 5900 and 5901. The building is designated as B-2 occupancy and III-N construction. The building area of 12,535 square feet is allowed by the Oregon State Structural Specialty because of two yards of 42 feet,which allow for a building increase of 27% of the basic allowable building area of 12,000 square feet. City of Tigard Planning Code section 18.106.030D requires one parking space per employee of the largest shift, based specifically upon the industrial use of the building for manufacturing, production, processing, and assembly. The site plan provides 36 spaces, including one van-accessible handicapped space. The required landscaping is 15% of the site area (Tigard Planning Code section 18.70.050.5). The plan provides 5058 square feet of landscaping,which is equal to 16.5% of the 0.70 acres of site area. Building and parking setbacks conform to Tigard Planning Code section 18.70.050 3a.c.d and section 18.100.110. Screening must be 3'-0" high. No parking setback is required along front property line. 5. Street trees are required along frontage of property. 6. Eight parking spaces may be provided between landscape islands. This may be increased to nine spaces if shading coverage of parking area can be shown. 7. Standard parking space is 8'-8"x 16'-0". Compact space is 8'-0" x 14'-0". 40% of parking spaces may be compact 8. Tigard's new tree ordinance requires a survey showing all trees 6" or greater in caliper. Mitigation is required for trees 12" or greater that are removed. Hazardous or damaged trees may be removed without mitigation. An arborist's report is required for the removal and protection of trees. Mitigation may occur ofd site by approval of the City Parks Department or a fee may be paid to cover the cost of tree replacement 9. Water quality is required for the site. On-site detention is not required. A composter may be used for water quality provided the property owner agrees to a plan of maintenance. City of Tigard Engineering will do the final review and approval of the water quality design--Unified Sewerage Agency will be furnished with plans for review and comment 10. 5'-0" sidewalk must be constructed as part of the project I I. Maximum width of driveway is 40'-0", minimum width is 24'-0". Driveway must be located 5'-0" minimum away from the property line. 12. Building and parking setbacks are measured perpendicular from the property line at the cul-de- sac radius. SCHEDULE 1. A neighborhood meeting must be held before a Site Development Review submittal may be made. The neighborhood meeting may be held two weeks after letters are mailed notifying all property owners within 250'-0"from the site. The site must also be posted during this time. 2. After the Site Development Review submittal is made, City of Tigard takes approximately I 0 days to deem the application complete. The decision takes approximately 8 weeks followed by a 10-20 day appeal period. Eighteen sets of plans must be provided with the submittal--these will be distributed to the various agencies.
