PERMANENT EASEMENT DEED
Clackamas County Bank, Grantor(s), hereby dedicates to the
CITY OF Tigard (City), an Oregon municipal corporation, Grantee, on behalf of the public, for use of the
public forever, the following easements in that certain real property situated in Washington County and the
State of Oregon that is more particularly described on the attached Exhibit"A", and shown on the attached
Exhibit"B";
The true consideration paid for this conveyance is$ 18,500.00. However, the actual consideration
consists of or includes other property or value given or promised which is the whole consideration.
PARCEL 1 —PERMANENT SLOPE EASEMENT
Including the right to construct and maintain slopes necessitated by the construction, operation, and
maintenance of the public road, all public facilities, and improvements in the adjacent right-of-way.
Grantee shall never be required to remove the slope materials placed by it on said property, nor shall
Grantee be subject to any damages to Grantor(s) by reasons of any change of grade of the roadway
abutting on said property.
PARCEL 2 -TEMPORARY CONSTRUCTION EASEMENT
Including the right for Grantee, its employees, agents, and employees of independent contractors
performing work under contract for City of Tigard, to enter and use the easement area for a construction
work area in connection with the construction of the SW 72nd Ave& SW Dartmouth St. Intersection
Improvement project as designed. The contractor shall not be permitted to store materials or equipment
with this easement.
The term and duration of this temporary construction easement shall be for a period of 11 months, from
February 1, 2014, to December 31, 2014, or upon completion of the above-mentioned construction
project, whichever is sooner.
This document is intended to grant easements on the property described, not to convey fee title or any
interest in the underlying property except as expressly stated herein. The easements granted shall not
prevent Grantor(s) from the use of said property provided, however, that such use shall not be permitted
to interfere with the rights herein granted. Grantor shall not be permitted to endanger the lateral support of
any facilities constructed within the easements granted herein.
Grantor(s) hereby covenants to and with the Grantee that the Grantor(s) is/are the owner(s)of said
property, which is free from all encumbrances, except easements, conditions and restrictions of record,
and will warrant and defend the easement rights herein granted from all lawful claims whatsoever, except
as stated herein.

of tangency at Centerline Station 128+38.35;thence North 01° 00' 26"West, a distance of
