Tigard,OR 97223 RE: Minor Modification Approval (MMD208-00012) —Westgate Baptist Church Dear Mr. Dutton: This letter is in response to your request for Minor Modification approval (MNID2008-00012) of previously approved plans for a religious institution located at 10730 SW 130th Avenue, WCTM 1S133AD, Tax Lot 2200. The site is zoned Medium Density Residential (R-7,) Planned Development (PD), as axe the other parcels to the east and south. Properties across 130th Avenue are zoned Medium-High Density residential zoning (R-25). The City of Beaverton is north of the site, across Scholls Ferry Road. The request is to approve a reduction in the posted occupant load in the main assembly area from 660 to 600. This would allow a reduction in the minimum parking requirement. The Tigard Development Code does not regulate occupancy loads. These are regulated by building codes and are based on square footages. The applicant is not reducing the square footage of the building. Parking requirements are based on the number of seats in the main assembly areas for religious institutions;therefore this decision will limit the number of seats in the assembly area. Discussions with the applicant revealed that the seats are set-up in the multi-purpose assembly area for each service. When services are not being held the seats may be cleared for other uses. Between 400 and 450 chairs are set up for a typical Sunday service. In the most recent Conditional Use Permit (CUP2001-00004), seating capacity was approved at 660 seats. Minimum parking requirements are 1 space for every 3 seats. The minimum of 220 was lowered to 184 because 26 parking spaces were provided on SW 130th Avenue and a parking reduction of 4.5% was also approved. Applying this same reasoning,then 167 spaces is sufficient for 600 seats. Only 165 spaces are needed for 600 seats. A search of City records revealed five previous land use cases on the parcel. Conditional Use CU13-78 approved a Christian school use within the existing church. An addition for classrooms and overflow parking (CUP94-00005)was granted in 1994. In 2001 a two-story multipurpose building was approved (CUP2001-00004) along with an adjustment to the minimum off-street parking requirment (VAR202- 00002). A minor modification was approved in 2003 to relocate the playground (MMD2003-00010). No other land use cases were found. Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. A change in land use; The prior uses approved for this site include a public high school. The uses are not proposed to be changed. 2. A 10% increase in dwelling unit density; The site is not developed with a residential use; therefore this criterion is not applicable. 3. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; The applicant is proposing re-striping of the current parking lot. This reduction of parking will not affect off-site traffic. 4. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; No additional floor area is proposed. This standard is satisfied. 5. A reduction of more than 10% of the area reserved for common open space and/or usable open space; No reduction of common/usable open space is proposed. 6. A reduction of specified setback requirements by more than 20%; The applicant has not requested a change to the setback requirements. Setbacks will not be affected by the proposed parking lot modification. 7. An elimination of project amenities by more than 10% where previously specified provided such as: (a) Recreational facilities; (b) Screening; or (c) Landscaping provisions; A change to project amenities is not proposed. All work is proposed within the existing parking lot. 8. A 10% increase in the approved density;The proposed modification request does not involve residential development; therefore, no increase to density is involved in the request. See CUP 2001-00004, Section C (discussion), paragraph 4A. This reduction would allow us to restripe our parking area with some spaces slightly larger than they currently are. In response to the criteria listed in Section 18.330.020.B.2: • A change in land use? No change in land use will occur; the site will continue to be used as a church/school. • A 10% increase in dwelling-unit density? No dwelling units will be added as a result of lowering the main auditorium occupancy load or decreasing the number of parking spaces on the site. • A change in the type and/or location of access ways and parking areas where off-site traffic would be affected? The access to the site remains unchanged(two entry ramps on 130th); in addition, the change in occupancy load theoretically would reduce the amount of traffic. • An increase in the floor area proposed for non-residential use by more than 10% where previously specified? Our proposal keeps the same amount of common and open space. • A reduction of specified setback requirements by more than 20%?
