Minor Modification. To review a modification as a Minor
Modification, the Director must first find that the expansion does not
invoke one or more of the 11 criteria discussed within Section
18.120.070(B) of the Tigard Development Code. If the modification CIT Area:

RE: Phoenix Inn E ansion—New Sidewalk Inspection
I have today inspected the new sidewalk installation on the west side of the project
toward Greenburg Road to determine what impact(beyond what was already present
from the old asphalt)the new sidewalk installation may have had on trees #1 and#2 on
the plot plan, and give a prognosis for root impact on the new sidewalk. Based on that
inspection I can make the following report.
1) The new sidewalk is farther from tree#2 than was the old asphalt paving, which
had been in place for many years prior to the present construction. The asphalt
paving had not been significantly impacted by buttress flare roots at the time of
my inspection just prior to construction.
2) The new sidewalk was installed on top of the original gravel bed laid for the old
asphalt. The gravel bed had not been disturbed or raised by the tree roots.
3) The distance to the edge of the sidewalk from tree#2, north of the sidewalk, is
approximately 44". The distance from the sidewalk to tree #2 on the east side is
approximately 28".
4) The distance from the sidewalk to tree #1 on the south is approximately 11 feet.
5) The old Greenburg Road sidewalk west of tree#1 has been in place for years and
still does not show any cracks from root pressure.
CONCL V SIGN 3:
The arboricultural impact in this instance with respect to the location of the new sidewalk
between the two Firs is moot as to a few feet in either direction. There is nothing
significant to be gained by moving the new sidewalk to anticipate potential root damage.
In any case, root expansion can cause cracks in sidewalks from as far as 10 to 12 feet
from major trees under certain circumstances. That has not happened to these trees
judging from the old sidewalk nearest them on Greenburg Road. Tree#1 is
approximately the same distance (28") from the old Greenburg Road sidewalk on the
west as is the new sidewalk on the east nearest tree #2. All of this speaks to history of
root impact in the immediate area of the trees and supports my conclusion that moving
the new sidewalk is relatively moot in terms of long range impact.

Moreover, further activity to move the new sidewalk would unavoidably require more
disturbance around the trees, which would be a negative. They have tolerated the
construction well to this point partly because the old asphalt was in place even nearer to
them than the new sidewalk is now. Stress on those trees has therefore now been
decreased rather than increased, especially considering the mulched flower/shrub beds
now in place where the old asphalt paving had been.
