The site is located at 13545 SW Pacific Highway,WCTM 2S 102CC,Tax Lot 600. The original approval in 2003 was for construction of the Fast Lane Quicklube building and on-site improvements. You have requested a Minor Modification to reconfigure the existing parking lot in preparation for a minor land partition which is also requested through the Minor Land Partition process (MLP2007-00004) and is therefore not addressed in this review. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter, states; "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore, this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The changes proposed do not require additional on-site parking. There are currently eight spaces provided, as required by the Tigard Development Code (TDC). After the parking re-configuration there will be a total of nine parking spaces. All standard parking spaces meet the minimum dimensions (8.5" x 18.5"). Wheel stops are required by TDC 18.765.040, but none are proposed. A condition of approval will ensure this standard is met. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural occupancy type of the buildings is proposed. Therefore, this criterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. This criterion is not applicable because no changes to the buildings are proposed with this application. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The site is accessed by a shared driveway onto SW Pacific Highway. No changes are proposed to the accessways with this application only to the parking configuration which is in the back portion of the site. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. This modification to parking and landscaping will not generate additional vehicle trips to and from the site. Therefore,this criterion is satisfied. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The applicant is not proposing an expansion to the building floor area with this application. Therefore, this criterion is not applicable. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. There are no common open spaces on the site, so this criterion is not applicable. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. Based on the original approval the 15% landscape requirement was exceeded because the plan proposed 46% landscaping. Landscape area information was only provided for proposed lot 1. Because the minor land partition has not been approved, the landscape area should also include the pervious area of lot 2. A condition of approval 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. The original site plan was approved through a Site Development Review in 2003 (SDR2003-00005). Staff has reviewed this decision and finds that this modification has no effect on conditions imposed at the time of Site Development Review nor is the applicant requesting a modification to those conditions. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties, provided that development which occurs after this decision complies with all applicable local, state, and federal laws and the condition below: CONDITION OF APPROVAL PRIOR TO THE ISSUANCE OF SITE AND/OR BUILDING PERMITS, THE FOLLOWING CONDITION SHALL BE SATISFIED: (The staff contact shall be Cheryl Caines in the Planning Division (503) 639-4171.) 1. Submit a revised site plan showing the landscape area for the total site and wheel stops in the parking spaces. 2.
