The development is comprised of ten tax lots, but only two are affected by the proposed modification. You have requested to install an emergency generator within existing landscaping on tax lot 1004. Conduit will be routed underground from the generator through the parking garage to existing rooftop equipment on tax lot 3400. Fencing is proposed for security and screening purposes. One tree will be removed, but will be replaced with a tree of the same species (Pines Nigra - Black Pine) to the east of the proposed generator. The submitted site plans reflect the current conditions as well as the proposed modifications. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter,states; "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore,this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. Parking requirements are based on building square footage. No building additions are proposed. The amount of existing parking will not be affected because the generator will be located within a landscape area. This criterion is met. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural occupancy type of the buildings is proposed. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed any changes to building heights. Therefore, this standard is met. 6. A change in the type and location of accessways and parking areas where off site traffic would be affected. The proposal is to place a generator within an existing landscape area. Changes are not proposed to either the accessways or parking areas. Off-site traffic will not be affected. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. There is no change to the type or intensity of use proposed. The modification request is for placement of a generator. This modification will not generate additional vehicle trips. Therefore,this criterion does not apply. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposal will not increase the square footage of the buildings. Therefore,this standard is met. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. According to a previous land use (MMD2002-00020) there is a total of 274,214 square feet (26.8%) of open space within the Lincoln Center development. The proposed generator will be on a 4 ft. x lift. concrete slab. This will be a reduction of 44 square feet is minimal and less than a 10% reduction. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. As discussed above, landscaping will be reduced by 44 square feet, and this is less than a 10°h reduction. The minimum landscape requirement is 15% in the MUE-1 zone. With approximately 26% of the site being landscaped, this reduction will still exceed minimum requirements. The applicant will replace the one tree removed for placement of the generator. A brick enclosure will screen the generator from view. Recreational facilities, screening, and landscaping will not be detrimentally affected. Therefore this criterion is met. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above. The City has reviewed numerous land use applications for the area known as the Lincoln Center. The site was annexed to the City of Tigard in 1987 at which time it received the City's Commercial Professional (GP) zoning designation. The 12-story Lincoln Tower was approved later in 1987 (SDR 87-08/V 87-07) along with a variance to the maximum building height standard of the GP zone. In 1988, a Conditional Use Permit was approved allowing a heliport on top of the Lincoln Tower. In 1989, the City gave Site Development Review approval for the Lincoln V building (SDR 89-12/V 89-17) with a variance to the maximum building height requirements and parking dimensional standards. In 1990, SDR approval was granted for a 7- story office building and 3-level parking structure (SDR 90-0022/VAR 90-0033). A variance to the maximum building height standard was also approved. In 1999, a proposal for two new buildings was approved; however, this approval was never acted on, and has since expired. On March 28, 2002,the Washington Square Regional Center Plan was adopted, and the zoning designation of the property changed to MUE-1. In 2002 a minor modification (MMD2002-00020) was approved for site modifications including realigning the entry drive from SW Greenburg Road, changing the on-site circulation for vehicles and pedestrians, improving accessibility of certain building entrances, and modifying the landscaping. A review of these previous decisions reveals that compliance with specific conditions of approval will not be affected. The applicant is not requesting to amend the previously imposed conditions. This standard is met. Page 2 of 4 Section 18.798.050 states that wireless communication facilities subject to Site Development review shall be evaluated using the following standards: 1. Aesthetic: a. New towers shall maintain a non-reflective grey finish or, if required by the FAA, be painted pursuant to the FAA's requirements; The application is for a new back-up generator. A new tower is not proposed with this application. This standard does not apply. b. If collocation on an existing tower is requested,the design of any antenna(s), accessory structures or equipment shall, to the extent possible, use materials, colors and textures that will match the existing tower or non-tower structure to which the equipment of the collocating provider is being attached; Collocation is not requested with this application. The request is to install a back-up generator within an existing landscape area. This standard does not apply. c. If collocation on an existing non-tower structure is requested, the antenna(s) and supporting electrical and mechanical equipment shall be a neutral color that is the same as the color as the supporting structure so as to make the antenna(s) and related equipment as visually unobtrusive as possible. As stated above collocation is not requested with this application. 2. Setbacks: a. Towers designed to collapse within themselves shall be set back in accordance with the setbacks contained in the base zone; b. Towers not designed to collapse within themselves shall be set back from the property line by a distance equal to the height of the tower. 3. Tower spacing: No new tower shall be allowed within 500 feet of an existing tower. If, having completed the collocation protocol outlined in Section 18.798.080 without success, the provider will be required to build a tower less than 500 feet from an existing tower, it will be required to obtain a Type I adjustment governed by 18.370.020 C8b; 4. Tower height: No tower shall exceed 100 feet for a single user or 125 for multiple users; 5. Lighting: No lighting shall be permitted on a tower except as required by the FAA; Standards 2-5 do not apply because a new tower or changes to the existing tower are not requested with this application. 6. Fencing and security: For security purposes, towers and ancillary facilities shall be enclosed by a minimum six-foot fence; An 8-foot, brick enclosure is proposed for security and screening. This standard is met. 7. Landscaping and screening: a. Landscaping shall be placed outside the fence and shall consist of evergreen shrubs which reach six feet in height and 95% opacity within three years of planting; b. When adjacent to or within residentially-zoned property, free-standing towers and accessory equipment facilities shall be screened by the planting of a minimum of four evergreen trees at least 15 feet in height at the time of planting. The planting of said trees shall be prescribed in number by a plan prepared by a registered arborist in locations that (1) most effectively screen the wireless facilities from residential uses and (2) promote the future survival of the trees while limiting adverse effects of the trees on abutting properties. Existing evergreen trees at least 15 feet in height may be used to meet the screening Page 3 of 4 requirement of this section if the arborist demonstrates that they provide screening for abutting residential uses; The applicant has proposed an 8-foot, brick enclosure to screen the generator from surrounding uses and properties. New landscaping is not proposed at this time for screening. One existing tree is being removed and replaced. The applicant has proposed a tree of the same species, Black Pine. The site is within a commercial zone MUE-1. Residential uses are not adjacent to the site. The nearest residential use is approximately 250 feet from the site. 8. Noise: Noise-generating equipment shall be sound-buffered by means of baffling, barriers or other suitable means to reduce the sound level measured at the property line to 50 dBA (day)/40 dBA(night) when adjacent to a noise-sensitive land use and 75 dBA (day)/60 dBA (night) when adjacent to other uses. The applicant did not address this standard. A condition of approval will ensure the noise requirements are met. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local,state,and federal laws and the condition below THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DEPARTMENT SUBJECT TO THE FOLLOWING CONDITION AND LIMITATIONS.
