A wide range of civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.360, 18.390, 18.510, 18.755 and 18.765. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. MMD2009-00012 Autumn Oaks Refuse Enclosure 042209 Page 1 CONDITIONS OF APPROVAL PRIOR TO THE REQUEST FOR FINAL BUILDING INSPECTION, THE FOLLOWING CONDITIONS SHALL BE SATISFIED 1. Applicant shall have all parking spaces smaller than standard marked as compact spaces. 2. Applicant shall install a City of Tigard approved standard concrete driveway apron between the public street and the driveway. Staff contact:Mike White 503-718-2464. 3. Applicant shall request final inspection by the Planning Division prior to requesting final inspection of the site work from the Building Division. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcel is located at 11200 SW Greenburg Ave.,WCTM 1S135CA, Tax Lot 00600. It is a 60 unit apartment complex a proved originally as A-2 Apartment Residential by the Washington County Planning Commission on my 26, 197 . MMD2008-00027 began the re-construction of the parking lot for improved drainage and re-distribution of parking spaces.the current modification is a refinement of that pplication. g P g p Proposal Description: Applicant proposes an additional waste/recyclables enclosure on the west end of the property. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.360.050.B contains the following criteria for approval of a request for Minor Modification: Section 18.360.050.B states that the Director shall determine that a major modification will result if one or more of the following changes are proposed. There will be: 1. An increase in dwelling unit density,or lot coverage for residential development; There is no proposed change in dwelling unit density.Therefore,this criterion does not apply. 2. A change in the ratio or number of different types of dwellings; There are no proposed changes to the dwelling units.Therefore,this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposal requires removing three parking spaces for the enclosure and modifying other parking areas to gain three spaces by reducing standard or oversized spaces to compact spaces. A change in the type of commercial or industrial structures as defined by the Uniform Building Code; There are no proposed changes in the type of structures. Therefore, this criterion does not apply. 5. An increase in the height of the building(s) by more than 20%; There is no proposed change in building height. Therefore,this criterion does not apply. 6. A change in the type and location of access ways and parking areas where off-site traffic would be affected; The proposal does not change the type or location of access ways or parking areas where off- site traffic would be affected. Therefore,this criterion does not apply. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day; The proposal does not increase vehicular traffic to and from the site by 100 vehicles per day. Therefore,this criterion does not apply. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet; There is no proposed increase in floor area. Therefore,this criterion does not apply. 9. A reduction in the area reserved for common space and/or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%; The proposal does not reduce the area reserved for common space or usable open space. The purpose of the revised design is primarily to provide a secondary location for recycling and trash disposal for the convenience of the tenants. An accessory structure near the pool is also included in the application. The proposed design maintains similar circulation and outdoor common spaces. While some parking stall areas were reduced,changes to the overall parking layout are minor, and changes to impervious surface areas are negligible. The proposed design maintains the features of the 1/09 MM, specifically: -Accessible walkways from the right-of-ways, connecting building entrances to parking areas, shared facilities and recreation areas -One-way vehicular circulation through most of the site -Shared open spaces: a central court, picnic/playground area, and two courtyards with convenient bike parking - Increased garden areas at residential units - Improved surface storm water drainage per Clean Water Services standards -Consolidated service area with emergency vehicle hammer-head - Maintains required parking count with the addition of four handicapped stalls The proposal meets the criteria for Minor Modifications per 18.360.050(B): (Code items are in italics) B. Evaluation criteria. The Director shall determine that a major modification(s)will result if one or more of the following changes are proposed. There will be: 1. The most recent site plan we were sent shows a second enclosure at the entrance off Greenburg Road. Pride drivers will be able to empty the containers and exit out of the complex. The site plan shows the enclosure to have two front load containers,one being a 4yd trash and a 4yd mixed recycle container. The site plan does not show the depth of the enclosure. To ensure that the enclosure is up to standard, it must be 10' feet deep by 20' wide. There should be no center post at access point. The gate opening must be no less that 20' wide. There must be full swing gates that open at least 120 degrees. The gate placement must be in front of, not inside the walls to allow for the full 20' required. The gate also needs cane bolts and holes put in place so the gates can be held in the open and closed position. There must not be any sort of overhang/roof over the area that our trucks will need to driver to get to the enclosure. The other enclosure straight back from the entrance off North Dakota Street is also fine for our drivers to access, utilizing the hammerhead turn around.
