APPLICATION SUMMARY FILE NAME: Pauly & Rogers Office Building Addition CASE NO.: Minor Modification (MMD) MMD2009-00004 PROPOSAL: The proposal is to construct a 1,396 sq. ft. addition to the south end of the existing office building, two floors at 698 sq. ft. each. ZONING DESIGNATION: MUE: Mixed-Use Employment. The MUE zoning district is designed to apply to a majority of the land within the Tigard Triangle, a regional mixed use employment district bounded by Pacific Highway (Hwy. 99), Highway 217 and I-5. This zoning district permits a wide range of uses including major retail goods and services, business/professional offices, civic uses and housing; the latter includes multi-family housing at a maximum density of 25 units/acre, equivalent to the R-25 zoning district. A wide range of uses, including but not limited to community recreation facilities, religious institutions, medical centers, schools, utilities and transit-related par -and-ride lots, are permitted conditionally. Although it is recognized that the automobile will accommodate the vast majority of trips to and within the Triangle, it is still important to 1) support alternative modes of transportation to the greatest extent possible; and 2) encourage a mix of uses to facilitate infra-district pedestrian and transit trips even en for those who drive. The zone may be applied elsewhere in the Ci through the legislative process. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.360, 18.390, 18.520 and 18.765. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. MMD2009-00004 Pauly&Rogers Office Addition 031109 Page 1 CONDITIONS OF APPROVAL PRIOR TO The. REQUEST FOR FINAL BUILDINi INSPECTION, THE FOLLOWING CONDITIONS SHALL BE SATISFIED 1. Applicant shall provide a copy of the final plat and recording document for the lot line adjustment prior to requesting final inspection by the Planning Division. 2. Applicant shall request final inspection of this land use permit by the Planning Division prior to requesting final inspection by the Building Division for certificate of occupancy. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcel is located at 12700 SW 72nd Ave, WCTM 2S101AC, Tax Lot 00700. The existing office building is on the SE corner of the intersection of 72nd Ave and Gonzaga St. The parking along the east property line is actually on another lot under the same ownership as this site. A lot line adjustment will be necessary to bring the project under compliance. Proposal Description: The proposal is to construct a 1,396 sq. ft. addition to the south end of the existing office building, two floors at 698 sq. ft. each. The addition will be built to match the existing building's height, design style and exterior finish. The addition will extend over 4 existing parking spaces without loss of open space or landscaping. No changes are proposed to the existing parking, as these spaces are sufficient for the expanded building. The plan reflects reusing the stairs and wall sign on the south end of the building. A trash enclosure will be placed at the south end of the addition. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.360.050.B contains the following criteria for approval of a request for Minor Modification: Section 18.360.050.B states that the Director shall determine that a major modification will result if one or more of the following changes are proposed. There will be: 1. An increase in dwelling unit density, or lot coverage for residential development; There are no dwelling units on the property.Therefore, this criterion does not apply. 2. A change in the ratio or number of different types of dwellings; There are no dwelling units on the property. Therefore, this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposal does not require additional on-site parking, but does reduce the number of parking spaces by four from 30 to 26. The original approval (SDR90-00005) was for development of the site for office use. Nineteen spaces are required and 26 will remain as existing non-conforming in excess of the maximum number (24) allowed. Therefore, this criterion is satisfied. A change in the type of commercial or industrial structures as defined by the Uniform Building Code; There are no proposed changes in the type of structures. Therefore, this criterion does not apply. 5. An increase in the height of the building(s) by more than 20%; There is no proposed change in building height. Therefore, this criterion does not apply. 6. A change in the type and location of access ways and parking areas where off-site traffic would be affected; The proposal does not change the type or location of access ways or parking areas where off- site traffic would be affected. Therefore, this criterion does not apply. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day; The proposal does not increase vehicular traffic to and from the site by 100 vehicles per day. Therefore, this criterion is satisfied. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet; The increase in floor area is less than 5,000 square feet.Therefore, this criterion is satisfied. 9. A reduction in the area reserved for common space and/or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%; The proposal does not reduce the area reserved for common space or usable open space. Therefore, this criterion does not apply. 10. A reduction of project amenities below the minimum established by this code or by more than 10%where specified in the site plan: a. Recreational facilities; b. Screening; and/or c. Landscaping provisions. The proposal does not reduce the project amenities.Therefore, this criterion does not apply. 11. A modification to the conditions imposed at the time of site development review approval which are not the subject of B 1 through 10 above of this subsection. The original site plan was approved under SDR90-00005. Staff recommendations from the decision had to do with the proposed landscape/street trees along 72nd Avenue and parking lot screening. This proposal does not affect the existing landscaping, screening or street trees. Therefore, this criterion does not apply. There is one small matter yet to be addressed on the plans for me to consider the application complete. Aerial photographs show a small structure covering one of the parking spaces that I believe to be a carport. It is allowed,but I have no record of it being installed under permit. If you intend to keep it, it should be permitted and approved by the Building Division. The photographs also show what appears to be a small dumpster in the parking space just east of the carport. Per TMC 18.745.010.E.4 the refuse receptacle must be screened from view. Normally this is a cosmetic fence enclosure.These enclosures need to be approved by the hauler,in this case Pride Disposal. They will issue you a letter agreeing to your plan,which you can submit along with a copy of the amended plan to complete the application. The Engineering Division would like to recommend that you place the footing base at one foot below the gutter elevation of the existing street.This is to protect your addition at the time 72nd Ave is improved, as it will be considerably below the current existing grade at the building. The site plan faxed dated 8/20/2008 (perhaps incorrect date on machine?) shows an enclosure at the entrance off 72nd Avenue. Pride drivers will be able to empty the containers and exit out of the complex onto Hampton Street. The site plan shows the enclosure to have enough space for two front load containers,as large as but not exceeding a 4yd trash and a 4yd mixed recycle container. The site plan shows the depth of the enclosure to be 8' feet deep and 20' wide.There should be no center post at access point. The gate opening must be no less that 20' wide. There must be full swing gates that open at least 120 degrees. The gate placement must be in front of, not inside the walls to allow for the full 20' required. The gate also needs cane bolts and holes put in place so the gates can be held in the open and closed position. There must not be any sort of overhang/roof over the area that our trucks will need to drive to get to the enclosure. If you have any questions, please feel free to contact me.
