Except where non-conforming, residential uses are limited to single-family residences which are located on the same site as a permitted use. A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations, are permitted conditionally. APPLI CABLE REVIEW CRITERIA: Community Development Code Chapters 18.360, 18.390, 18.520 and 18.765. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. MMD2009-00003 Hudson Plaza Parking Modification 022609 Page 1 CONDITIONS OF APPROVA PRIOR TO THE REQUEST FOR FINAL SITE PERMIT INSPECTION, THE FOLLOWING CONDITIONS SHALL BE SATISFIED 1. Applicant shall obtain a site permit from the Building Division for the relocation of the ADA accessible parking space, aisle and ramp. 2. Applicant shall call for final Planning inspection prior to final approval for the site permit from the Building Division. (Contact Cheryl Caines,Associate Planner, at 503-718-2437). THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcel is located at 12950 SW Pacific Highway. The property includes an office building of 17,516 sq. ft., and two other buildings having 1,324 sq. ft. combined that include a small office, public restrooms for the complex, and a coffee shop. The parking lot was reconfigured in 2006 when an older building was demolished and additional parking was provided. Proposal Description: The proposal is for relocation of an ADA accessible parking space with loading aisle, ramp and signage, elimination of four parking spaces, installation of a pedestrian ramp, and installation of a planter strip per plan labeled option #4 that addresses the affected area. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.360.050.B contains the following criteria for approval of a request for Minor Modification: Section 18.360.050.B states that the Director shall determine that a major modification will result if one or more of the following changes are proposed.: There will be: 1. An increase in dwelling unit density,or lot coverage for residential development; There are no dwelling units on the property. Therefore, this criterion does not apply. 2. A change in the ratio or number of different types of dwellings; There are no dwelling units on the property. Therefore, this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposal does not require additional on-site parking, but does reduce the number of parking spaces by four from 60 to 56 spaces. In addition to on-site spaces, the applicant has a shared parking agreement for 10 spaces on a neighboring property, Tigard United Methodist Church. Therefore, a total 66 spaces are available. The original approval (SDR27-84) was for development of the site with a mix of office and retail development. Forty-nine (49) spaces were required by code at that time. According to the applicant there is 6,760 square feet of Office use, 5,068 square feet of Personal Services use, and 7,012 square feet of the building is vacant. The table below calculates minimum parking requirements for the development utilizing current code requirements. Even if the vacant spaces were occupied with uses classified as Retail Sales, an intense use that requires more parking than Office or Personal Services, the parking provided would still meet the minimum required. Therefore, this criterion does not apply. 6. A change in the type and location of access ways and parking areas where off-site traffic would be affected; The proposal does not change the type or location of access ways or parking areas where off- site traffic would be affected. Therefore, this criterion does not apply. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day; The proposal does not increase vehicular traffic to and from the site. Therefore, this criterion does not apply. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet; No increase in floor area is proposed. Therefore, this criterion does not apply. 9. A reduction in the area reserved for common space and/or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%; The proposal does not reduce the area reserved for common space or usable open space. Therefore, this criterion does not apply. 10. A reduction of project amenities below the minimum established by this code or by more than 10%where specified in the site plan: a. Staff recommendations from the decision had to do with inadequacy of the proposed landscape/street trees along Walnut Place and parking lot screening. This proposal does not affect that landscaping, but proposes additional landscaping within the parking lot. FINDING: Based on the analysis above, Staff finds that the criteria for minor modification of a site development review have been met. SECTION V.
