APPLICATION SUMMARY FILE NAME: Clean Water Services Access Changes CASE NO.: Minor Modification (MMD) MMD2009-00009 PROPOSAL: The proposal is to improve the access to the complex by re-designing the north entry off 85th Ave. and making the south access an exit only gate. A security fence with gates is proposed at the property boundary on 85th Ave. with a card lock gate for pedestrian traffic. Street trees will be planted along the north side of the new drive way and landscaping will be installed where a parking island is to be removed and in the area where Shaffer Lane paving is to be removed. The I-P zoning district provides appropriate locations for combining light manufacturing, office and small-scale commercial uses, e.g.,restaurants,personal services and fitness centers,in a campus-like setting. Only those light industrial uses with no off-site impacts, e.g., noise, glare, odor,vibration, are permitted in the I-P zone. In addition to mandatory site development review, design and development standards in the I-P zone have been adopted to insure that developments will be well-integrated, attractively landscaped, and pedestrian-friendly. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.330, 18.390, 18.530,and 18.745. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. MMD2009-00009 Clean Water Services Access Changes 041509 Page 1 CONDITIONS OF APPROVAL PRIOR TO THE REQUEST FOR FINAL BUILDING INSPECTION, THE FOLLOWING CONDITIONS SHALL BE SATISFIED 1. Applicant shall provide updated revised drawings prior to beginning work on the project. 2. Applicant shall provide a concrete apron between the driveway and 85th Ave. per standard COT details. 3. Applicant shall revise the new curb at the south entrance to bring it out to the face of the existing curb (see redlined drawing C-5). 4. Applicant shall limit slopes in the sidewalk to 2 % at the cart crossing in the south area (see redlined drawing C-5). 5. Applicant shall install street trees per COT standards along the north side of the revised driveway. 6. Applicant shall install tree protection fencing for the trees along the south side of the revised driveway prior to construction. 7. Applicant shall obtain a Site Permit from the Building Division for fill and grade in excess of 50 cubic yards. 8. Applicant shall obtain a Site Utilities Permit from the Building Division for storm drains and catch basins not in the right-of-way. 9. Applicant shall obtain a separate Sign Permit from the Planning Division, as it was not part of this review. 10. Applicant shall call for final approval from the Planning Division prior to the final inspection of the Building Division site permits. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcel is located at 16580 SW 85th Avenue and consists of the Durham Advanced Wastewater Treatment Facility and its associated offices. The site currently has two non-controlled access points off 85th Avenue. The site has an existing conditional use approval for Basic Utilities. The unused Shaffer Lane will be removed and landscaped as will the parking island. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: MINOR MODIFICATION TO CONDITIONAL USE: Section 18.330.20.B contains the following criteria for approval of a request for Minor Modification of a Conditional Use: MMD2009-00009 Clean Water Services Access Changes 041509 Page 2 Section 18.020.B.2 state; at the Director shall determine 1. a major modification has resulted if one or more of the changes listed below have been proposed: a. A change in land use; The subject property has a conditional use classification of Basic Utilities. No change in land use will be proposed as part of this project. b. A ten% increase in dwelling unit density; The proposed project does not affect dwelling unit density. c. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; The minor change to the access and egress design will help alleviate traffic confusion on 85th Avenue by creating only one ingress location with new signage. d. An increase in the floor area proposed for non-residential use by more than 10 %where previously specified; There is no proposal for increase of non-residential floor area. e. A reduction of more than 10 % of the area reserved for common open space and/or usable open space; The project will actually increase the common open space by landscaping the area where the parking island and Shaffer Lane are to be removed and re-landscaped. f. A reduction of specified setback requirements by more than 20%; There is no reduction of setback requirements. g. An elimination of project amenities by more than 10 %where previously specified, such as: 1. Recreational facilities; No recreational facilities will be eliminated. 2. Screening; Screening will be enhanced by the planting of street trees along the north side of the driveway. 3. Landscaping provisions; Landscaping will be increased where the parking island and Shaffer Lane are to be removed and re-landscaped. h. A 10 % increase in the approved density; There is no approved density associated with the conditional use of Basic Utilities. FINDING: Based on the analysis above, Staff finds that the criteria for minor modification of a conditional use have been met. REVISION Purpose. Clean Water Services(CWS) desires to make changes to the two Durham Advanced Wastewater Treatment Facility plant entrances located at 16060 SW 85th Ave (Shaffer Lane)and 16580 SW 85th Avenue. The purpose for these changes is to centralize facility access to the 16060 location thus improving site security, complying with state emergency response requirements, and consolidating visitor screening to one location. These changes will reduce the extent and impact of facility-related traffic along the length of 85th Avenue by diverting this traffic to existing on-site roadways. All facility related incoming traffic will be directed to the 16060 location as opposed to the current situation where a significant amount of traffic enters the facility at the 16580 location. The current situation also results in increased traffic congestion on 85th Avenue resulting from visitor and delivery confusion regarding whether their desired destination is for the treatment facility purposes(the 16580 entrance)or engineering and visitor registration purposes(the 16060 entrance). The CWS Durham Facility Emergency Response Plan,required by 29 CFR 1910.120(1)(2)and adopted by reference in OAR 437-002-0101,requires that all personnel are accounted for in the event of an evacuation. The proposed changes will allow compliance by achieving a single point of entry where all personnel and visitors can be inventoried. Current Situation. CWS's Treatment Plant Services (treatment plant engineering)group and Durham Facility administration functions are located at the 16060 location, and the main treatment facilities operation and maintenance functions are at the 16580 location. The two are connected by a network of plant roadways and a manually operated gate off of Shaffer lane (the"north" gate). The 16580 location is currently routinely accessed off of 85th Avenue through an automated gate recessed a significant distance off of 85th' Ave. This"south"gate can be controlled locally by plant staff(having the proper control devices); or, for others(visitors,deliveries,etc.), via remote communication with the 16060 location. A significant number of visitors, deliveries,and contractors show up at the 16580 location only to have to turn around and report to the 16060 location to arrange entry. Proposed Changes. CWS is proposing a minor realignment of the"north"entrance (the 16060 or Shaffer Lane location)and addition of a secure automated"north" gate. All plant inbound traffic and most exiting traffic would be required to use this gate which can be more easily monitored from the Treatment plant Services building at 16060 SW 85th Avenue. All traffic would be then routed through the existing network of on-site roadways. The existing"south"plant entrance (the 16580 SW 85th Avenue location) would be modified by removing the existing"south"gate and replacing it with a new `exit only' gate at the 16580 SW 85th Avenue entrance. These proposed changes are shown on the preliminary drawings included with this application. Of particular interest are Drawings C-1 through C-5 which show an overall site plan,two demolition plans and two plans of the proposed changes respectively. Associated work includes the removal of the remainder of Shaffer Lane and replacement with landscaping,and completion of site security fencing at the south entrance. Additionally, the existing Durham Facility Entry Signs located at both entrances will be removed and replaced with a new Durham Facility entrance sign at the 16060 entrance per Drawing A. Compliance of Proposed Changes with 18.330.020(B)(2) Criteria. Below are itemized responses to the criteria indicated in 18.330.020(8)(2): a. A change in land use: This portion of the overall Durham Facility is zoned I-R (Industrial Park) and is a `basic utility' use according to the Community Development Code—the Clean Water Services Durham Wastewater Treatment Facility. The proposed change only alters the Durham Facility entrances through minor civil/site improvements. b. An 10%increase in dwelling unit density: There are no dwelling units on site as this site is not residential and the proposed change only alters the Durham Facility entrances through minor civil/site improvements c. A change in the type and location of access ways and parking areas where off-site traffic would be affected: This project includes only minor modifications to the site's access ways (entrances and exits) and such modifications will improve the site's impact on off-site traffic. Such improvement will be a result of less traffic along the length of 85th Avenue and unnecessary traffic currently experienced as a result of visitor traffic being shuttled along 85th Avenue between entrances. d. An increase in the floor area proposed for non-residential use by more than 10% where previously specified: This project does not alter any existing structure on the site. e. A reduction of more than 10% of the area reserved for common open space and/or usable open space: This project actually increases the amount of open space (and decreases the amount of impervious area)by converting a majority of the abandoned Shaffer Lane to landscaped area. f. A reduction of specified setback requirements by more than 20%: This project has no impact on setbacks from the public rights-of-way and property lines. g. An elimination of project amenities by more than 10%where previously specified provided such as: Recreational facilities, screening, or landscaping provisions: This project again increases the amount of such amenities by increasing the amount of open landscaped space as indicated in item g above. o Recreational Facilities: The Durham Facility provides a significant amount of grassed,treed and garden landscaped area and water features that the general public is allowed to use. This project will increase the amount of such area. o Screening: This project will increase the density of plantings at the north (Shaffer Lane) entrance thus increasing the screening of the treatment process structures of the Facility.
