APPLICATION SUMMARY FILE NAME: Summerfield Golf Cart Storage CASE NO.: Minor Modification (MMD) MMD2009-00011 PROPOSAL: The proposal is to construct a 720 sq. ft. golf cart storage building for the use of the residents of Tigard Retirement Residence. The building will be located west of the building at 11205 SW Summerfield Drive. No changes are proposed to landscaping, screening or automobile parking. ZONING DESIGNATION: R-7 (PD): Medium-Density Residential District. The R-7 zoning district is designed to accommodate attached single-family homes, detached single-family homes with or without accessory residential units, at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. Mobile home parks and subdivisions are also permitted outright. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.330, 18.350, 18.390 and 18.510. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. MMD2009-00011 Summerfield Golf Cart Storage 040809 Paj CONDITIONS OF APPROVAJ • PRIOR TO 1_ REQUEST FOR FINAL BUILDL , INSPECTION, THE FOLLOWING CONDITIONS SHALL BE SATISFIED 1. Applicant shall obtain a building permit from the Building Division. 2. Applicant shall request final inspection of this land use permit by the Planning Division prior to requesting final inspection by the Building Division for certificate of occupancy. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcel is located at 11205 SW Summerfield Drive, WCTM 2S110DC, Tax Lot 00600. The existing retirement residence building is near the NW corner of the intersection of Summerfield Drive and Durham Road. Proposal Description: The proposal is to construct a 720 sq. ft.golf cart storage building for the use of the residents of Tigard Retirement Residence.This property is part of the Summerfield Golf Course.The building will be located west of the building at 11205 SW Summerfield Drive. No changes are proposed to landscaping,screening or automobile parking. Setbacks conform to those required for the R-7 Residential Zone. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: MINOR MODIFICATION OF CONDITIONAL USE REVIEW: This site was designated Planned Development (PD) by City of Tigard Ordinance No. 73-5, dated February 12, 1973. The ordinance reflected the change in designation from Washington County P-R Planned Residential to City of Tigard PD Planned Development following annexation of the property known as "Summerfield", a golf course and residential development. Section 18.350.020.C.5 states: "In the case of an existing planned development overlay zone, once construction of the detailed plan has been completed, subsequent applications conforming to the detailed plan shall be reviewed under the provisions required in the chapter which apply to the particular land use application." The land use application is R-7 Medium Density Residential and Table 18.510.1 lists Community Recreation as allowed by conditional use approval. The current proposal, an accessory use to a golf course,will be reviewed as a modification of a conditional use. Section 18.330.020.C.1 states that any modification which is not within the description of a major modification as provided in Subsection B above shall be considered a minor modification. Section 18.330.020.B.2 states that the Director shall determine that a major modification has resulted if one or more of the changes listed below have been proposed. a. A 10% increase in ?Ming unit density; No dwelling unit density increase is proposed. Therefore,this criterion does not apply. c. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; There are no changes in the type or location of access ways that would affect off-site traffic. Therefore, this criterion does not apply. d. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; Non-residential use area was not specified when the property was annexed nor later when it was re-classified from a Washington County designation to City of Tigard Planned Development. The golf course clubhouse, however, is 20,400 sq. ft. The proposed 720 sq. ft. cart storage building is only 3.5 % of that area. Therefore, this criterion has been met. e. A reduction of more than 10% of the area reserved for common open space and/or usable open space; The common open space and/or usable open space on this parcel is approximately 43,830 sq. ft. and the proposed building of 720 sq. ft. is approximately 1.6% of that. Therefore, this criterion has been met. f. A reduction of specified setback requirements by more than 20%; All setbacks for this proposal exceed those required in the R-7 Residential Zone. Therefore, this criterion has been met. g. An elimination of project amenities by more than 10% where previously specified provided such as: 1. Recreational facilities; There is no proposed reduction in recreational facilities. Therefore, this criterion does not apply. 2. Screening; or There is no proposed reduction in screening.Therefore, this criterion does not apply. 3. Landscaping provisions; and The proposal would reduce the grass lawn area west of the retirement residence by 1.6%. Therefore, this criterion has been met. h. A 10% increase in the approved density. The project does not propose an increase in the approved density. Therefore, this criterion does not apply.
